Joint Powers Committee
June 20, 1979
CALL TO ORDER
The meeting was called to order at 7:55 P.M. by Chairperson Cathy Buck.

APPROVAL OF MINUTES
Motion was made to approve the minutes of the June 6th meeting as submitted.
Motion seconded. Motion carried.

KERN-PAULEY RACQUETBALL CLUB: REVIEW AND DETERMINE CONDI-
TIONS OF SPECIAL USE PERMIT AND MINOR SUBDIVISION
Mr. Kern asked if Mr. Torseth could made a few points to the Committee.
The Committee agreed. Mr. Torseth displayed pictures of landscaping incon-
sistancies within the Joint Powers Area. He pointed out that Press-On, Inc.
had landscaped beyond the requirements necessary. Mr. Torseth disapproved
of the requirement of poured in place concrete curbs and parking islands in an
employee parking lot in an Industrial Zoning District. There is a vistor park...
ing lot for the public at Press-On. He pointed out a number of parking lots
without poured in place concrete curbing, and in some cases timbers were used
as curbing. Mr. Koehler pointed out that because concrete curbs are not in
place at the Burger King, Zantigo, and the Warehouse Services parking lots
the performance bonds were not being released. Mr. T orseth noted the current
Zoning Ordinance does not require poured in place concrete curbing. Dan con-
firmed that fact but the Joint Powers Committee had established a precedent
of requiring them as a condition of the Special Use Permits.
Mr. Pauley asked what the amount of the performance bond wi II be. Dan
stated the bond amount must be 1000;0 of the estimated cost of blacktopping,
landscaping, and curbing.
Mr. Kern feels the requirement of a performance bond causes the developer to
do the least amount of landscaping possible. Chairperson Buck explained that
several bonds could be submitted and when each phase of construction is com-
pleted that portion of the bond could be released.

Chairperson Buck asked that an addition to Condition #8 be made that crushed
rock should be used as a base until the area can be blacktopped. The black-
topping should be cOlnpleted one (1) year from the date of the Special Use Per-
mit.

Bill McDonald asked that Condition #15 be changed to read IIAny major alter-
ations to the attached plot and landscape plans shall be reviewed and approved
by the Joint Powers Committee and the County Planning Department and shall
require an amended Special Use Permittl.
Motion was made to approve the final draft of the permit as written conditioned
upon receipt of grading/drainage plan, lighting plan, bond and approval by the
staff. Motion seconded. Motion carried.
The Kern-Pauley minor subdivision was approved at the June 6, 1979 meet-
ing conditiond upon receipt of a certificate of survey and deed being submitted
for approval.
LEONARD FEELY MINOR SUBDIVISION PROPOSAL
Doug Swenson, County Attorney suggested the minor subdivision be tabled until
Dr. Wallace submits more information and both proposals would be considered
at the same time. Motion was made to postpone consideration of the minor sub-
division. Motion seconded. Motion carried.

PRESS-ON, INC. CUP: DISCUSS EXPANSION OF EXISTING BUSINESS
(CONSTRUCTION OF PHASE lID
Mr. Torseth explained Phase I was constructed in 1975, and Phase II in
1977. Phase III is an addition of 37,594 square feet and a new parking
lot to accommodate 105 automobiles. This addition will be the same roof
height as Phases I and II and will be built in two (2) levels.
Mr. Torseth disagrees with the use of parking islands in an employee parking
lot because they are a nui sance to snow removal and he feels the shrubbery
would be ki lied by the salt from the cars. He sees no sense in parking is-
lands especially in an employee parking lot. There is a designated vistor
parking lot between the two (2) existing buildings. Mr. Torseth thought head
in curbing would be sufficient.
Dan feels the parking islands are essential for traffic circulation. He suggests
at least four (4) islands to direct traffic especially in winter when the painted
Jines of the parking stalls are not visible.

A motion was made to have the County Planning Staff draft an amendment to
the Ordinance, Section 708.05 (11) (Parking Islands. For each additional
3,000 square feet of off-street parking space after the first 3,000 square
feet, one (1) parking island equal in size to a single parking space shall be
installed. All parking islands shall have concrete curbs, and a landscaped
interior.> in regard to industrial employee parking lot standards at the next
public hearing July 25, 1979. Motion seconded. Motion carried.

Mr. Swenson stated the Planning Department could issue the Conditional Use
Permit requiring parking islands and amend the Conditional Use Permit if the
Ordinance 708.05 (11) is amended.
GENERAL DISCUSSION
Mr. Koehler was unable to get to Sid White1s for a visual inspection of the
property, consequently Doug was unable to write Mr. White a letter. Dan
stated he would get a letter of review to Doug before the next meeting.
Virgil Canfield is interested in subdividing his property in the Joint Powers
District. Mr. Koehler had given him a list of the requirements needed to
subdivide.

The purpose of th is publ ic hearing is to gather publ ic input and hear
testimony concerning an application by James Wallace, D.C. for a
Planned Unit Development in an Industrial Zoning District to allow a
three (3) acre parcel of property to be used for the development of a
multiple use structure to be used for a clinic, offices and residence.
The property fronts on Northwestern Avenue in the City of Stillwater
and is the W 4001 of the S 3261 of the S! of the NEt of the SEt
Section 32, T30N, R20W.
The publ ic is encouraged to attend and testify. Both written and
oral statements will be accepted at the hearing.

testimony concerning an appl ication by Oscar L. Kern and B. J. Pauley
for a Special Use Permit in an Industrial Zoning District to allow a par-
cel of property to be used for the development of an eight (8) court rac-
quetball club. The property fronts on Novak Avenue North (a. k.a.
Northwestern Avenue) and is the easterly 300 feet of Outlot D of the
Stillwater Industrial Park.
The public is encouraged to attend and testify. Both written and oral
statements will be accepted at the hearing.

Chairperson Buck opened the hearing at 7:30 P.M.

Dr. Wallace submitted a landscaping plan which Dan Koehler found to
be inadequate. Dr. Wallace reviewed the plans for his building which
is a combination professional building and residence. The building will
have three (3) stories, the first two (2) stories would be used for pro-
fessional office and the third would be used for a residence. The build-
ing would be located on three (3) acres of property.
Mr. Kern expressed concern over the use of the property as a residence.
Mr. Torseth was concerned over the screening of the industrial area from
the residence. Mr. Torseth went on to say that even under the best of
conditions there may still be activities that go on in an industrial area,
such as excessive noise, lighting, etc., that may be offensive to a resi-
dent. Dr. Wallace realizes the adverse conditions that may occur but
does not feel that the conditions wi II be intolerable.
Ann Bodlovick asked if Dr. Wallace were to sell the property in the fu-
ture would the use have to remain the same. Doug explained that a
P . U.D. and conditions of such are binding on the land not the owner.
Mr. Torseth again questioned the screening of the industrial property from
the residential property. Ann Bodlovick suggested screening be the re-
sponsibility of the developer of the proposed P.U.D. applicant, rather
than the adjacent industrial uses. Dr. Wallace was asked if this were one
of the conditions of his P.U.D. would he have any objections. Dr.
Wallace stated he would have no objection.
Dan stated a detailed site plan and landscape plan should be submitted
which shows the bui Iding on the lot including future expansion.

Mr. Kern asked about the property being assessed for the construction of
the road. It was noted that the property is now under Green Acres, but

as soon as the property is sold the buyer or seller wi II be assessed for
the road.
Mr. McDonald asked Mrs. Feely if they had any plans for their remain-
ing 40 acre parceL Mrs. Feely is not sure what will be done with the
remaining 37 acres (20 of which are platted),
