Koehler Dated: August 8, 1979 - e -- ., . . . Minutes of the Joint Powers Committee August 15, 1979 CALL TO ORDER The meeting was called to order at 5:05 P.M. by Chairperson Cathy Buck. MEMBERS PRESENT Ann Bodlovick, Harry Peterson, William Lundquist, Bill McDonald, Cathy Buck OTHERS PRESENT Dan Koehler, Sue Mosiman, Doug Swenson, John M. Caldwell, Mrs. Feely, Stephen McCarten, Bruce Folz, Mrs. Bergmann, Paul Bergmann, Gerald B. Ouderkirk, Bi II Pauley APPROVAL OF MINUTES Ann Bodlovick made a motion to approve the minutes of the July 25, 1979 meeting. Motion seconded. Motion carried. ORVILLE MADSEN & SONS, INC. Mr. Caldwell, a representative of Orvi lie Madsen & Sons, Inc., discussed the concept of rezoning 6.26 acres of the Feely property in order to con- struct a townhouse development. Orvi lie Madsen & Son, Inc. are considering the construction of 60 town- house units if a rezoning is approved. This project could be used as a buffer between the Multiple Fami Iy and Commercial/Industrial zone. Dan is in favor of thi s area for such a development. There will be parking in the front of the buildings with garages located in the back of the buildings. The townhouses wi II be at a 6,000 square foot density. They prefer 30 garages rather than the 1 to 1 ratio required in the ordinance because of the extra cost involved to the fami lies for rental of the garages. There wi II be no discrimination against a person because of his/her race, sex, age, etc. People in the area wi II have first priority to rent the town- houses. The owners of the townhouses persona Ily i ntervi ew possi ble renters. Although they have taken no polls, Madsen feels they wi II have no problem renting the units. Area residents feel there is no need for anymore sub- sidized hOUSing or Section 8 housing, because these people pay only 500;0 taxes. Ann Bodlovick asked if these were for rent or sale. Mr. Caldwell stated they were for rent. The amount of rent is based on 2 SOlo of the renters ad- justed gross income. Mr. Caldwell stated there is a possibility the units would be converted to condominiums in fifteen (15) years. . . ~ , e e -- Joint Powers Minutes August 15, 1979 Page Two Cathy Buck asked the Committee members for their opinions on the develop- ment. Mr. McDonald feels this a good location for such a development. Mr. Peterson and Mrs. Bodlovick are in favor of the concept. Several mem- bers did not approve of the garage ratio proposed by Mr. Caldwell and felt the ordinance requirement should be met. The next step to take would be to apply for rezoning and schedule a public hearing. Dan asked if he could present the plans in October if Madsen's have submitted the required information. Mr. McDonald made a motion to hold the public hearing in September with the understanding no action will be taken until the October meeting. Motion seconded. Motion carried. AUGUSTINE BROTHERS Bruce Folz discussed Augustine's proposal to rezone a parcel of property west of Zantigo from LB to G B and to subdivide the property into commer- cia I and housing lots. Land use would be a retai I shopping center on the frontage road, office building north of the center, with multiple housing in the rear as a buffer between the existing Single family homes in Forest Hills. Dan suggested a 100 foot greenbelt (buffer zone) as indicated on the conceptual develop- ment plan for the Highways 212/36 corridor. Mr. McDonald feels Oak Park Heights should be asked to attend the next Joint Powers meeting to discuss the alignment of the proposed 61st Street and the installation of utilities. Mr. McDonald made a motion to hold a special meeting for public hearing for rezoning and subdivision of the property into five (5) parcels, with a representative(s) from the City of Oak Park Heights present, October 3, 1979 at 7:00 P.M. Motion seconded. Motion carried. BERGMANN .GARDEN CENTER Paul Bergmann discussed his application for an amended Special Use Per- mit in order to expand the existing facilities. Cathy Buck expressed concern over the fact that Bergmannl s, in the past, have applied for piecemeal additions and the Township preferred a Planned Uni t Development be issued for an overa II plan of the Garden Center. Dan feels a Special Use Permit would be adequate and amended each year as each stage, shown on the site plan, is developed. Cathy Buck feels this plan fulfi Its the idea of the P. U.D. e Joint Powers Minutes August 15, 1979 Page Three Mr. Bergmann explained he is remodeling and replacing existing structures and there will be no new structures other than an awning on the existing garden center. Mr. McDonald made a motion to approve the amended Special Use Permit for the three (3) items (moving the hoop house, adding an eave overhang to the existing garden center, and replacing the existing green house with a gutter connected house) proposed for 1979 construction. ORDINANCE AMENDMENTS Doug has spoken to other lawyers regarding changes to the amendments addressing financial guarantees for C.U.P.'s and S.U.P.ls and he has come to the conclusion that the language could be more general. There are many different ways a developer could supply a bond, for example; certifi cate of deposit, a letter of credit, or a loan against a savings ac- count. Doug will have more specific information at a later date. e The amendments have been rat.ified at the Town Board level. The City, by taking no action, has also ratified the amendments. Doug wi II make the appropriate changes to the amendments and a formal publication will follow .
