Joint Powers Committee
July 25, 1979

Ann Bodlovick made a motion to name Cathy Buck as Chairperson. Motion
seconded. Moti on carried.
CALL TO ORDER
The meeting was calted to order at 6: 10 P. M. by Chairperson Cathy Buck.

APPROVAL OF MINUTES
Ann Bodlovick made a motion to approve the minutes of the June 20, 1979
meeting. Motion seconded. Motion carried.
Mr. Kern expressed concern over the editing of the minutes. He feels every
opinion and comment should be written down in the minutes. Cathy Buck ex-
plained motions and discussion pertinent to the meeting would be written in
e the minutes but not all opinions are included.
SIDNEY WH ITE: DISCUSS NON-CONFORMING USE
Mr. Koehler noted corrections to be made in the letter to the Joint Powers
Committee regarding Sidney White's non-conforming use dated July 20, 1979.
Mr. White does not have employees and open sales lots are allowed in Com-
mercial GB and notiri Industrial zoning districts.
Mr. White explained he had 7 1/2 acres zoned R-4 which he purchased
August 1977. He is licensed with the State of Minnesota to sell vehiCles.
He purchases' wrecked vehicles and then fixes them for sale.
Bodlovick asked if he was aware of his violation of the ordi nance. He stated
he was aware of that fact but would like to obtain permission to continue his
operation.
Mr. McDonald feels his only option is to rezone the property or change the
operation so it does not appear to be a commercial operation. Mr. McDonald
thinks the neighbors would strongly oppose rezoning conSidering the number of
complaints already received.

Mr. White asked if a S.U.P. could be issued to him unti I future rezoning of
the area allows him to continue his operation. Cathy Buck stated a S.U.P.
is not in order.
Mr. Lundquist thought if the property was zoned commercial Mr. White would
not be able to live there. Mr. White was under the impression he would be
able to live there unti I he sold the property or unti I the house was destroyed
after which time it would be strictly commercial. Cathy Buck stated the grand-
father clause involved his house, not his business, and that even if the prop-
erty is rezoned the business would still require a S.U.P. Open sales lots
are not permitted in an industrial zone and a home occupation is not permitted
in an accessory building. .'
Mr. Peterson made a motion Mr. White be given until September 1, 1979
to terminate his operation or to apply for rezoning. Motion seconded. Motion
carried.
Mr. Kern thought after Dr. Wallace's subdivision there would be approximately
84 feet left between Dr. Wallace's property and the corner. Dan showed
there would be approximately 300 feet remaining.
B. Burger King C.U.P. Site Plan
Dan stated a representative from Burger King questioned why Dan would not
release the bond. Dan asked a site plan be brought in and reviewed by the
Joint Powers Committee. The bond will be released when Burger King com-
pletes their landscaping as shown on an approved site plan.
CALL PUBLIC HEARING ON ORDINANCE AMENDMENTS TO ORDER
The public hearing was called to order at 7:10 P.M.

Cathy Buck stated if there were no objections she would like Dan to go
through each amendment. Dr. Lundquist noted these changes should be
limited to Industrial, Commercial and Multiple Family.

Section 708.05 (4) amendment was deleted and will now read:
All of the area intended to be utilized for parking space and driveways shall be
surfaced with a material to control dust and drainage as provided in 708.0 l.
Plans for surfacing and drainage shall be subject to approval of the Community
Engineer.
Section 708.05(6) was changed to read:
Six (6) inch poured in place concrete curbing or other concrete curbing as ap'"
proved by the Zoning Administrator shall be installed around the entire edge of
the pa ved area. 'f

Section 708.05 (11) was changed to read:
Planting Islands. For each additional three thousand (3,000> sqoare feet, or
portion thereof, of parking area beyond the first three thousand (3,000> square
feet, one (1) planting island equal in size to a single parking space shall be
installed within the interior of the parking area. All planting islands shall have
six (6) inch poured in place concrete curbing or other concrete curbing approved
by the Zoning Administrator and a landscaped interior. Planting islands shall
be located to facilitate and direct traffic circulation within the parking area.
Employee parking areas located in Industria I zoning districts may be exempt from
these requirements provided the developer submits alternatives in controlling traf...
fic circulation subject to approval by the Joint Powers Committee.
Mr. Kern feels a tree in the middle of blacktop is not very attractive. Usually
they are poorly taken care of and do not grow we II surrounded by blacktop.
There w~s discussion on the validity of planting islands.
Mr. Peterson suggested suspending talk on 708.05 (11),
Mr. McDonald made a motion to delete the wording "provided the developer sub-
mits alternatives in controlling traffic circulation subject to approval by the
Joint Powers Committee". in 708.05 (11), Motion seconded. Motion carried.
Cathy Buck opposed.
Doug was asked to review and make any necessary changes in the following a-
mendments: 505.09,505.10,505.11, 506.23, 506.24, and 506.25.
Motion was made to continue the public hearing at the next meeting August 15,
1979. Motion seconded. Motion carried.
The public hearing adjourned at 7:50 P.M.

DISCUSS ORDINANCE AMENDMENTS
McDonald made a motion to approve amendments 708.05 (4), (6), and (11),
Motion seconded. Motion carried. Cathy Buck opposed.
Doug checked the zoning ordinance, and to approve the amendments require$
a 2/3 majority. He suggested voting on 708.05 (11) separately due to the
fact that Cathy is against only this particular amendment.
The motion is reconsidered.

Motion was made to adopt amendment 708.05 (4). Motion seconded. Motion
carried.
Motion was made to adopt amendment 708.05 (6), Motion seconded. Motion
carried.
Motion was made to adopt amendment 708.05 (11) as amended. Motion sec-
onded. Motion carried. Cathy Buck opposed the motion.
