Mr. Folz explained the staging of the development may be acheived by transi- tional zoning, from multiple fami Iy, to limited business, to commercial. The commercial use would be possible by rezoning the southern portion of the prop- erty which abutts Highway 212. There will be a 100 foot buffer zone between the existing single family resi- dents of Forest Hi lis and the proposed multiple fami Iy use in the northern por- tion of the property. Mr. Folz explained there will be extensive grading done on this property. He also stated the development will intensify the existing run-off problem. This matter will have to be resolved by the City Engineers. A storm water ponding area now exists behind Burger King. Ann Bod lovick stated the Sti IIwater City Council informed Mr. Peterson and herself that they did not have enough information regarding the proposals, therefore they were not to vote on the proposals this evening. . e Mr. McDonald explained the property is located in the Township of Stillwater and is governed by the Joint Powers Committee. Cathy Buck explained the MMC decided the property will be amended to the City of Stillwater but has not written an order; unti I an order is written the property is sti II in the T own- ship. e Joint Powers Minutes October 3, 1979 Page Two Mr. McDonald read Carl Dale1s letter of recommendation to the Committee and the audience. Mr. McDonald asked if there was a representative from the City of Oak Park Heights or the City of Sti Ilwater present to address the road situation, no one responded. Mr. Folz stated he sent a letter to the City of Oak Park Height's Planner to review the situation. In response he received a letter from Midwest Planning, which he read to the Committee and the audience. Mrs. Bodlovick asked Mr. Folz if he had contacted Mr. Elliot regarding the road alignment. Mr. Folz replied he had spoken to Mr. Elliot who felt Augustinels should follow the Comprehensive Plan for the Joint Power's area. Mr. Folz stated the City of Oak Park Heights provides the utilities. Mr. Elliot was not sure if the Stillwater sewer main could serve the Augustine property due to the fact that the existing main is quite shallow. e .The property to the east is owned by Stephen McCarten who stated he is in favor of the extension of 61st Street but feels the City of Oak Park Heights, City of Stillwater, Stillwater Township, Washington County should all get to- gether and determine the exact location of the 61st Street extension. Dan stated ade quate area exists for the road, greenbelt, and multiple fami Iy dwellings. Kip Kippenhan explained the residents of Forest Hills had met last year with the MMC at which time Mr. Dalels plan was reviewed. At that time the pro- posal for annexation was discussed and Mr. Dale's plan at that time was for a green strip without the multiple family dwellings. The residents of Forest Hills at that time felt the plan was more consistent with the existing develop- ment. Mrs. Buck asked who sponsored the meeting between the residents of Forest Hills and the MMC. Maury Jenson described the meetings as informal, infor- mational meetings for the residents of Forest Hills regarding the annexation of this property with input from Carl Dale and Oak Park Heightl s Planners'. e Mr. Peterson read an exert of a letter from the City Attorney to the City Co- ordinator which explained the residents of Forest Hi lis were informed of the Joint Powers and the City of Oak Park Heights development of a Comprehen- sive Plan for the area adjacent to Forest Hills. Both plans were reviewed (, e e e . Joint Powers Minutes October 3, 1979 Page Three by the residents of Forest Hills in regard to the annexation proceedings. The residents were in favor of the Stillwater plan and submitted their support to the Municipal Board which may have helped in annexing the property to the City of Stillwater. The plan that was supported by the Forest Hills residents involved a greenbelt adjacent to the Forest Hills homes and also included a gradual phas- ing of mu ltiple fami Iy housing adjacent to the green area so the property deve l- oped closest to Forest Hills would only have townhouses or duplexs. Mr. Tom Farrell, Chairman of the Stillwater Planning Commission, explained that part of Stillwater1s Comprehensive Plan was to continue the greenways to the south of the City. Cathy explained the Joint Powers Committee endorses the greenbelts or buffer zones as indicated in their Comprehensive Plan. In response to park dedication, Mr. Folz explained the property is approximately 13 acres in size. This requires a 70;0 (.9 acres) land dedication. The reqUired 100 foot greenbelt is approximately 1.25 acres in size so the 70;0 requirement would be exceeded. Mr. Folz felt dedication of the greenbelt would also exceed a 1010 monetary dedication. Mr. Farrell expressed concern over the use of the greenway. The City does not intend to use it for walkways, bike paths, etc. but rather as a buffer zone. He feels that if trees have to be removed they should be replaced with dense ever- greens. Mr. Kip Kippenhan has a written proposal addressing the development of this area relative to the annexation he would like to submit to the Committee. The public expressed concern over the vague proposal being presented. It was explained the hearing this evening is to rezone the southern lot and subdivide the property. An exact detailed development plan will be submitted, at the ap- prop.riate time, for which there will be another public hearing to discuss the pro- posal. Corrine Urban stated she was told that once property is rezoned the public has no say as to what happens to the property. It was explained that most develop- ments on this property would require a Special Use Permit and a public hearing. Cathy Buck asked how much cutting and filling would have to be done. Mr. Folz stated Mr. Elliot can not determine the grade until the alignment of 61st Street is determined. The City Engineer will have to determine the road size, etc. . '"' .. e e e Joint Powers Minutes October 3, 1979 Page Four The public expressed concern over the grading, cutting, and removal of vegeta- tion which now acts as a natura I buffer to the res idents of Forest H ills from the noise on Highway 212. Mr. Anez, the owner of the property west of Augustine's, stated he was con- cerned about the street grading causing run-off problems onto his property. Corrine Urban asked about the possi bi Iity of aligning the road to a location which wi" not affect the terrain of the property so drastically. Mr. Folz states he is follow ing the conceptua I p Ian for the extens ion of 61st Street. Cathy Buck expressed concern about the amount of grading necessary to construct a road. Mr. McDonald explained this is a concept for 61st Street to run east and west in this general area. Ann Bodlovick asked Mr. McCarten if his prope.rty is accessible without the east/ west 61st Street. Mr. McCarten stated his property can be served without the extension of 61st Street but he is in favor of the concept of 61st Street dividing hi s property into two parcels. ADJOURNMENT Mr. Peterson made a motion to close the public hearing and continue discussion at the November 21, 1979 meeting at 7:00 P.M. with any written comments, to be submitted by November 1, 1979, for review prior to the November 21st meeting. Motion seconded. Motion carried. Mr. Peterson made a motion to move the date of the November meeting from the 21st (the day before Thanksgiving) to the 14th of November at 7:00 P.M. Mo- tion seconded. Motion carried. The meeting adjourned at 9:05 P. M.
