Vice Chair Johnson called the meeting to order at 7 p.m.
Approval of minutes: Mr. Tomten, seconded by Mr. Eastwood, moved approval of the minutes of
April 7, 2008. Motion passed unanimously.
DESIGN REVIEWS
Case No. DR/08-18 Design review for replacement of signage at 1750 Frontage Road in the
BP-C, Business Park Commercial District. Duane Downey, applicant.
The applicant was present. Mr. Johnson noted the pylon sign is higher than allowed by
ordinance, but because this request does not represent a change in usage, the height is grand-
fathered under the previously granted variance. The size of the signage does meet the
ordinance requirements, he stated. Mr. Tomten moved to approve the replacement signage as
submitted and conditioned. Ms. Hudak seconded the motion; motion passed unanimously.
Case No. DR/08-19 Design review for fac;ade of the proposed storefront renovation and
reopening of the second floor window openings at 124 S. Main St. in the CBD, Central Business
District. Mark Balay, representing Lynskey Properties, applicant.
Mr. Balay was present and explained one change to the submitted plans -- the addition of a
location for another second floor stairway to facilitate development of the second floor with a
second egress. Mr. Nelson wondered if a handicap-accessible elevator might be needed at
some point. Mr. Balay said that would be possible should usage require that at some point in the
future.
Mr. Balay said the plans are to keep the existing colors so the fac;ade looks like three separate
buildings. He expressed a concern about the wording of one of the conditions of approval, that
the windows shall be "historically accurate double-hung wood windows," with plans submitted to
staff for review and approval. Mr. Balay noted this is not a tax-credit project and said they did
not want to commit to Department of Interior standards for restorations. He said the intent is to
fill the original window openings with double-hung, custom-sized windows, but would like the
option of using vinyl or aluminum clad windows. Mr. Pogge said staff is supportive of the request
and would not be opposed to striking the word "wood," if that is a sticking point with the
applicant.
Mr. Tomten asked about the new lower panels on the front fac;ade. Mr. Balay said the existing
brick veneer will be removed and new wood panels attached to the concrete block behind the
veneer. Mr. Tomten asked if any thought had been given to utilizing a wider frame for the entry
doors, expressing a concern that the thin line Qf the frame brings to mind 1950s-60s architecture
and a wider style might be more appropriate. Mr., Tomten used the new door of the Gazette as

an example of the style he would prefer to see used. Mr. Balay said the applicant would
consider that if the cost is similar.
Mr. Johnson suggested the possibility of bringing the display windows out to the front of the
building in the center section. Mr. Balay said that is a cost issue. Mr. Johnson asked if there
would be any work on the parapet, noting there is a piece missing. Mr. Balay stated that is not
being considered at this time.
Mr. Tomten moved approval as conditioned striking the words "wood" and "historically" from
condition of approval No. 3 and adding a condition that the applicant consider using a door
profile with a wider style head and rail than the standard aluminum frame. Mr. Johnson
suggested adding wording regarding review by staff and that the windows fit the original
openings. Mr. Tomten restated his motion to include approval is given to reopen the second-
floor windows with the condition that the new windows are a full window infill of the original
masonry openings, with final details to be reviewed and approved by staff. Mr. Johnson
seconded the motion; motion passed unanimously.
Case No. DR/08-20 Design review for installation of a neon channel letter and non-illuminated
plastic lettering on a sign at 2510 Curve Crest Blvd. in the BP-O, Business Park Office District.
Mary Ferraro, Spectrum Signs, applicant.
The applicant was not present. Mr. Eastwood noted the request meets the ordinance
requirements and moved approval as submitted and conditioned. Mr. Tomten seconded the
motion; motion passed unanimously.
Case No. DR/08-21 Design review for installation of two signs, change of windows to doors, and
ventilation on the roof of the building at 423 S. Main St. in the CBD, Central Business District.
Tim McKee, applicant.
The applicant was present and stated that he will reduce the size of the proposed projecting
blade sign to meet the ordinance. Mr. Johnson asked about the location of the signage on the
south elevation. Mr. McKee stated it would be placed below the Brick Alley sign. Regarding the
proposed new roof vent, it was noted there are a number of existing vents on the east side of
the building and the vent will not be visible from Main Street. Mr. McKee said they would also
like to replace two windows with doors; the existing headers will be utilized, he said.
Mr. Eastwood moved approval as conditioned, with the additional condition that the sign on the
south elevation be placed under the Brick Alley sign and that the blade sign be no larger than 6
square feet, as allowed by ordinance. Ms. Hudak seconded the motion; motion passed
unanimously. Mr. McKee asked about temporary banners; it was noted that such banners can
be up for 30 days.
Case No. DR/08-22 Design review of signage, new awnings and lighting at 108 N. Main St. in
the CBD, Central Business District. AdCraft, The Signmakers, applicant.
A representative of AdCraft and Jeff and Kristin Klemetsrud, owners of Savories, were present.

Mr. Johnson opened the discussion by saying he liked the proposed sign but had concerns
regarding the proposal to add columns and paint the brick on the infill building. The
representative of AdCraft said the introduction of columns was an attempt to unify the fac;ade,
carrying over the column elements from the larger building. Kristen Klemetsrud said they had
looked at other options of tying the two buildings together, stating they need a cohesive
storefront to maintain the integrity of their business. Ms. Klemetsrud also noted that these are
not contributing buildings to the Historic District. Mr. Nelson spoke in favor of the plans, saying it
makes sense to try to tie the two buildings together and create a cohesive storefront. Mr.
Johnson said the proposed awnings would work better if they are at the same elevation and
pitch as the Pulp Fashion awnings. Even though the awnings are different colors, keeping the
same elevation and pitch will keep the larger building more homogeneous, Mr. Johnson
suggested.
There was discussion of the request to paint the brick on the infill building. Mr. Eastwood spoke
against painting brick. Mr. Johnson noted that painting brick causes moisture to gather behind
the brick and eventually causes deterioration and permanent damage to the brick. The AdCraft
representative asked if there are options other than painting. Mr. Tomten suggested that
perhaps tinting the mortar might achieve the desired look. Ms. Klemetsrud spoke of other
nearby buildings where the brick has been painted, and Mr. Klemetsrud noted the brick on the
infill building is not historic, quality brick. Mr. Johnson again spoke of the potential deterioration
of the fac;ade due to painting, as well as a concern for setting a precedent in approving the
request; he stated he would be comfortable allowing the staining of the mortar.
Mr. Johnson read Mr. Zahren's written comments into the record. Mr. Zahren stated he would
approve the signage and awnings, but would not approve the painting of the brick due to the
likelihood of moisture damage or the addition of the columns, which he said create a disconnect
with the remainder of the building. Mr. Nelson said he had no problem with the columns. Mr.
Eastwood suggested muting the color of the columns around the entrance as a way of framing
in the entrance. Mr. Tomten said he likes the awnings and even the columns, but agreed that
the awning pitch/height should match the Pulp Fashion awnings. Mr. Tomten also suggested
moving the signage up a bit higher on the building, as well as moving in the three new goose-
neck light fixtures so all of the fixtures are on the infill building. Mr. Tomten asked about plans
for the infill windows at the southern-most portion of the business front. Ms. Klemetsrud stated
the plan is to install a wood panel, with perhaps a wrought iron metal grate and window box.
Mr. Johnson moved approval as conditioned, with the additional conditions that the awnings be
of the same height and pitch as the Pulp Fashion awnings and that the valence be a free
hanging valence of the same material; that the three goose-neck light fixtures be moved closer
together so all are placed on the infill building and the sign raised slightly to reach the bottom of
the light fixtures; that the three southern and two northern columns be of a darker shade than
the two columns on either side of the entrance; that the applicant be allowed to stain the mortar
but not paint the brick on the infill building; and that the access windows on the southern portion
of the building can be filled in with a solid material with a wrought iron or steel grill overlay. Mr.
Johnson amended his motion to include the condition that colors and awning material swatch be
submitted to staff for review and approval. Mr. Eastwood seconded the motion; motion passed
unanimously.

OTHER BUSINESS
· Tom Huninghake was present to get the Commission's input regarding possible
demolition of a house at 1224 N. Second St. Mr. Pogge stated the house is in very poor
condition and the City has issued an abatement order, with the next step a possible
request for demolition. Mr. Pogge also stated that Mr. Empson has gone through the
structure and suggested it should be demolished. Mr. Huninghake said he might make a
bid on the house but would not want to get stuck with it, if it can't be demolished. Mr.
Johnson noted that the Commission couldn't give an indication of possible action without
going through the nine steps required by the ordinance.
· Mr. Pogge told the Commission that the annual Preservation Awards will be presented at
the second Council meeting in May.
· Members were asked to get their photo assignments completed and to Mr. Pogge at
their convenience.
Ms. Hudak, seconded by Mr. Eastwood, moved to adjourn at 8:50 p.m.

BACKGROUND
Francis Brown, property owner of 81715t St S, made application for a demolition permit for
an existing house that was damaged by fire in February.
After review of the application and in light of two separate structure engineering reports,
staff elected to issue an emergency demolition order pursuant to Section 34-6 of the
Stillwater City Code.
Since the notices on the request were mailed prior to staff's decision to issue the emergency
demolition order the Commission needs to open and close the public hearing. No action is
needed to be taken by the Commission on this matter.
RECOMMENDATION
Open and close the public hearing.

BACKGROUND
Andrew and Amber Barnick, property owners of 219 Martha St N, are requesting a
demolition permit for an existing shed on their property. The exact age of the shed could
not be determined and a building permit for the structure was not on file at the City office;
however, the property owner believes that the shed was built in the late 1800' s. The style
and condition of the structure leads staff to conclude that the shed is more than 50 years
old. Since the shed appears to be over 50 years old, it is by definition considered to have
potential historic significance. Consequently, the Heritage Preservation Commission is
required to review the demolition request.
This site is in the Conservation Design District; however, since the main structure is not
being removed any new structure would not be subject to the infill design criteria.
SPECIFIC REQUEST
The applicant requests approval of a permit to demolish the existing shed.
EVALUATION OF REQUEST
Chapter 34, Section 34-4 of the City Code states that" if buildings or structures are
determined by the community development director to be historic or potentially historic,
the application must be sent to the [heritage preservation] commission for review...
Buildings or structures determined nonhistoric must be referred to the building official for
issuance of a demolition permit."
A "nonhistoric structure or building" is defined by Chapter 34, Section 34-2 as a structure or
building less than 50 years old... Since the age of the structure could not be determined it is
assumed that the shed is over 50 years old; therefore, it is of potential historic significance
and requires review by the Heritage Preservation Commission.

Section 34-5 of the City Code lists nine items which must be considered prior to approval of
a demolition permit by the Commission.
(1) A map showing the location of the building or structure to be demolished on its
property and with reference to neighborhood properties;
This information is included in the attached application.
(2) A legal description of property and owner of record;
The legal description of the property was included in the application.
(3) Photographs of all building elevations;
Photos from various angles are included in the packet.
(4) A description of the building or structure or portion of building or structure to be
demolished;
The existing shed is an approximately 30' by 10' shed. The applicant has indicated in the
cover letter that the entire shed structure is proposed to be demolished.
(5) The reason for the proposed demolition and data supporting the reason, including,
where applicable, data sufficient to establish any economic justification for demolition;
The applicant has included a quote from J-Mar builders and remodelers. A new building is
estimated to cost $21,174.00 while repairing the existing shed would cost $17,964.00.
(6) Proposed plans and schedule for reuse of the property on which the building or
structure to be demolished is located;
The applicant stated in his application that they desire to remove the shed for additional open
space on the property.
(7) Relation of demolition and future site use to the comprehensive plan and zoning
requirements;
The current comprehensive plan land use designation for the property is Single Family Small
Lot and is zoned RB, two-family residential. Once the current shed is demolished any new
shed in the future would be required to meet all of the requirements of the zoning code.
This site is in the Conservation Design District; however, since the main structure is not
being removed a new shed would not be subject to the infill design criteria.

(8) A description of alternatives to the demolition;
The applicant feels the structure is a hazard. The applicant feels that the cost of renovations
far exceeds any added value thus the applicant has no intent on renovating the shed.
(9) Evidence that the building or structure has been advertised for sale for restoration or
reuse and that sale for restoration or reuse is not economically feasible.
The applicant has indicated that they have advertised the shed in the Stillwater Courier on
May 8, 2008.
ALTERNATIVES
The Heritage Preservation Commission has the following options:
1. Approve the demolition permit as presented.
2. Deny the demolition permit if the applicant has not proved the necessity for
demolishing the shed or if the Commission believes there are altema tes to
demolishing the shed.
3. Continue the public hearing until the July 7, 2008 Commission meeting. The 60 day
decision deadline for the request is July 15, 2008.
RECOMMENDATION
Review and take action on the request.

Dear members of the Heritage Preservation Commission:
This application is asking for a demolition permit for a shed/outbuilding at the rear of
my property located 219 Martha Street North, Stillwater MN 55082: Thompson Parker
and Mower's 2nd, Lot 10, Block 2. The main dwelling/residence at 219 Martha Street
North was built in 1870. The shed/outbuilding was constructed at the same time or
shortly after the main dwelling in the late 1800's. The shed has had some updates
throughout the years which include concrete flooring, (which is now cracking) a tin roof
(which is rusting over in the back with holes), and also the shed was recently painted last
year. The shed currently imposes hazards such as exposed nails and rod spikes, loose and
rotting lumber, and loose ceiling supports.
The structure was constructed originally of two by fours with a flat roof and a
limestone base. The shed now has concrete flooring and a tin roof. It also has an updated
door. The shed's windows are loose to the walls. The shed is located on my rear
property line next to my double garage and bordering the neighbor's garage. The shed
measures 30 feet by 10 feet. I have no evidence of any historical significance of the
structure. I was told by the sellers of the property that the shed was built around the time
of the main dwelling.

D. Description of structure:
The structure I wish to remove/demolish from my property is a shed/outbuilding
that lies at the rear of my property line. It is 30 feet by 10 feet. I was told from
the seller of the home that the shed was built at the time of the main dwelling or
shortly after, in the late 1800's. The shed is built from lumber two by fours. Its
original wood has grown soft over the years and is loose and rotting in places.
The shed originally appears to have had a limestone base. It now has a concrete
floor that is cracking. The shed appears to have originally had lumber roofing
that was flat. The shed now has a rusted over tin roofing angled. Some of the old
roofing lumber is loose and poses safety risks. . The windows and the treatments
are loose and very aged. They also appear to pose safety hazards. The shed was
recently painted within the last year. It does have an updated entry door in front
that has a loose lock joint. The door is not secure for locking.
E. Reason for demolition and supporting Data:
Bid from Licensed Restoration Contractor. Attached bid shows that it is not
economically feasible to restore shed.

F. Reuse of property/outdoor living space:
If the Heritage Preservation Commission grants the demolition permit for the
shed/outhouse at the rear of my property at 219 Martha Street North, Stillwater
MN 55082 I plan on fencing off the area with a six foot privacy fence(attached to
this application is a fence permit application) and creating a patio garden. This
will substantially improve the value of property and provide a lush safe backyard
where my wife and I can feel our son is safe from the hazards created by the shed.
The shed currently takes up the majority of our properties backyard living space
and by creating more space and a garden/patio we will significantly improve the
properties value and safety. The shed/outbuilding on my property is posing a
significant financial determent to my property and a hazard to my family and the
public. The shed/outbuildings does not contribute to the historic character of the
community.
Pending the approval of the shed's demolition, the approval of a building
permit, and the approval of a fence permit we plan to fence off the outdoor space
formerly occupied by the shed up to my backyard property lines creating space
for a small garden and use the concrete slab lying under the shed as a patio
surface. Weare not building any new structures other than the fence, per the
permit. These plans will not impact the surrounding neighbor's privacy, access to
sunlight, or street access.

G. Relation of demolition and future site use to the comprehensive plan
and zoning requirements:
The property on 219 Martha Street North will continue to be used as a single
family home. The demolition of the shed/outhouse will not impact the main
dwellings use, and there will be no structure built to replace the existing
shed/outbuilding-only privacy fencing per pending city fencing permit.
H. Alternatives for demolition:
I have no intent on renovating the shed/outbuilding on my property. I feel the
cost of renovations far exceed any value the renovated shed could bring to the
property. I currently do not feel comfortable using the shed for storage of
anything but garbage containers and spare lumber. The locks on the shed are not
secure enough to store anything of value such as tools or household goods.
I have advertised the shed for sale in the Stillwater Courier and have received no
responses. The shed is cemented to the ground and would not be applicable for
transfer to another site. I would be open to let anyone attempt to transfer the shed
off my property as long as my main dwelling would be unharmed.
The shed imposes hazards to my family. I feel renovations could limit those
hazards but I cannot financially afford those renovations at this time.

BACKGROUND
Erin and Andy Braun, property owners of 116 6th St S, are requesting a demolition permit
for an existing garage on their property. The exact age of the garage could not be
determined and a building permit for the structure was not on file at the City office;
however, the property owner believes that the garage is approximately 60 years old. The
style and condition of the structure leads staff to conclude that the garage is more than 50
years old. Since the garage appears to be over 50 years old, it is by definition considered to
have potential historic significance. Consequently, the Heritage Preservation Commission
is required to review the demolition request.
This site is in the Conservation Design District; however, since the main structure is not
being removed the new addition would not be subject to the infill design criteria.
SPECIFIC REQUEST
The applicant requests approval of a permit to demolish the existing garage.
EVALUATION OF REQUEST
Chapter 34, Section 34-4 of the City Code states that "if buildings or structures are
determined by the community development director to be historic or potentially historic,
the application must be sent to the [heritage preservation] commission for review...
Buildings or structures determined nonhistoric must be referred to the building official for
issuance of a demolition permit."
A "nonhistoric structure or building" is defined by Chapter 34, Section 34-2 as a structure or
building less than 50 years old... Since the age of the structure could not be determined it is
assumed that the garage is over 50 years old; therefore, it is of potential historic significance
and requires review by the Heritage Preservation Commission.

Section 34-5 of the City Code lists nine items which must be considered prior to approval of
a demolition permit by the Commission.
(1) A map showing the location of the building or structure to be demolished on its
property and with reference to neighborhood properties;
This information is included in the attached application.
(2) A legal description of property and owner of record;
The legal description of the property was included in the application.
(3) Photographs of all building elevations;
Photos from various angles are included in the packet.
(4) A description of the building or structure or portion of building or structure to be
demolished;
The existing garage is an approximately 14' by 22' garage. The applicant has indicated in
the cover letter that the entire garage structure is proposed to be demolished.
(5) The reason for the proposed demolition and data supporting the reason, including,
where applicable, data sufficient to establish any economic justification for demolition;
The applicant has included a quote from Rydel Homes Inc. for a new addition to the east and
a new garage to the west. No quote was provided related to cost to renovate the garage.
(6) Proposed plans and schedule for reuse of the property on which the building or
structure to be demolished is located;
The applicant stated in his application that they desire to construct a new attached 28' by 24'
garage with living space above the garage.
(7) Relation of demolition and future site use to the comprehensive plan and zoning
requirements;
The current comprehensive plan land use designation for the property is Single Family Small
Lot and is zoned RB, two-family residential. Once the current garage is demolished the
proposed garage would be required to meet all of the requirements of the zoning code as
proposed.

(8) A d~scription of alternatives to the demolition;
The applicant states that if they are not allowed to demo the garage that they would leave the
site as is an move.
(9) Evidence that the building or structure has been advertised for sale for restoration or
reuse and that sale for restoration or reuse is not economically feasible.
The applicant has indicated that they have advertised the garage in the Stillwater Gazette on
May 20, 22, and 23, 2008.
ALTERNATIVES
The Heritage Preservation Commission has the following options:
1. Approve thei demolition permit as presented.
2. Deny the demolition permit if the applicant has not proved the necessity for
demolishing! the garage or if the Commission believes there are alternates to
demolishing the garage.
3. Continue the public hearing until the July 7, 2008 Commission meeting. The 60 day
decision deadline for the request is July 15, 2008.
RECOMMENDATION

BACKGROUND
James and Diane Kleinke, property owners of 116 6th St S, are requesting a demolition
permit for an existing block garage on their property. The exact age of the garage could not
be determined and a building permit for the structure was not on file at the City office;
however, the property owner believes that the garage was built around 1952. The style and
condition of the structure leads staff to conclude that the garage is more than 50 years old.
Since the garage appears to be over 50 years old, it is by definition considered to have
potential historic significance. Consequently, the Heritage Preservation Commission is
required to review the demolition request.
This site is in the Conservation Design District; however, since the main structure is not
being removed a new garage would not be subject to the infill design criteria.
SPECIFIC REQUEST
The applicant requests approval of a permit to demolish the existing garage.
EVALUATION OF REQUEST
Chapter 34, Section 34-4 of the City Code states that"if buildings or structures are
determined by the community development director to be historic or potentially historic,
the application must be sent to the [heritage preservation] commission for review...
Buildings or structures determined nonhistoric must be referred to the building official for
issuance of a demolition permit."
A "nonhistoric structure or building" is defined by Chapter 34, Section 34-2 as a structure or
building less than 50 years old. .. Since the age of the structure could not be determined it is
assumed that the garage is over 50 years old; therefore, it is of potential historic significance
and requires review by the Heritage Preservation Commission.

Section 34-5 of the City Code lists nine items which must be considered prior to approval of
a demolition permit by the Commission.
(1) A map showing the location of the building or structure to be demolished on its
property and with reference to neighborhood properties;
This information is included in the attached application.
(2) A legal description of property and owner of record;
The legal description of the property was included in the application.
(3) Photographs of all building elevations;
Photos from various angles are included in the packet.
(4) A description of the building or structure or portion of building or structure to be
demolished;
The existing garage is an approximately 15' by 22' garage. The applicant has indicated in
the cover letter that the entire garage structure is proposed to be demolished.
(5) The reason for the proposed demolition and data supporting the reason, including,
where applicable, data sufficient to establish any economic justification for demolition;
The applicant has included a quote from D&A Construction of Stillwater related to the cost
to renovate the garage. It was estimated it will cost $19,000 to restore this structure. Since
it is a block building the entire structure would be deconstructed and then rebuilt in order to
restore the building.
The applicant states in their application that the structure is in disrepair, is a hazard and
liability, does not complement the character of their home, and is not functional.
(6) Proposed plans and schedule for reuse of the property on which the building or
structure to be demolished is located;
The applicant stated in his application that they desire to construct a new 24' by 30' garage
with storage above the garage. The new garage will be shifted approximately 10 feet east of
the existing garage location.
(7) Relation of demolition and future site use to the comprehensive plan and zoning
requirements;
The current comprehensive plan land use designation for the property is Single Family Small
Lot and is zoned RB, two-family residential. Once the current garage is demolished the
proposed garage would be required to meet all of the requirements of the zoning code as
proposed.
This site is in the Conservation Design District; however, since the main structure is not

(8) A description of alternatives to the demolition;
The applicant states that there are no alternatives to demolition. Staff would offer that
restoration of a structure is always an alternative to demolition.
(9) Evidence that the building or structure has been advertised for sale for restoration or
reuse and that sale for restoration or reuse is not economically feasible.
The applicant has indicated that they have advertised the garage in the Stillwater Gazette on
May 16, 2008. A copy of the ad has been included in your packet.
ALTERNATIVES
The Heritage Preservation Commission has the following options:
1. Approve the demolition permit as presented.
2. Deny the demolition permit if the applicant has not proved the necessity for
demolishing the garage or if the Commission believes there are alternates to
demolishing the garage.
3. Continue the public hearing until the July 7, 2008 Commission meeting. The 60 day
decision deadline for the request is July 15, 2008.
RECOMMENDATION
Review and take action on the request.

Dear Members of the Heritage Preservation Commission:
We have a one and a half car garage located just behind our house on the north west side of our
property. This garage is in very poor condition and is a hazard and liability. We have lived in our
house at 116 Sixth Street South since 1996 and are now seeking to construct a much needed new
two car garage that is functional, safe, matches the character of the house, and meets our needs.
In determining the age of the garage, we approached the Charlsen family. This family owned and
lived in this home from1911 to 1993.At our request, Pat Downs (Charlsen) contacted her siblings in
order to help us give an approximate date to our cement block garage. The family was able to locate
photographic evidence that placed the garages age at approximately 1952. This would make our
garage 56 years old and require us to pursue demolition authorization through the Heritage
Preservation Commission.
Prior to 1952 there were several detached structures on the property which included a horse shed
and out house. These were all removed many years ago and no evidence remains of them.
We have a historic photograph of the property that dates around 1900. This photo shows the north
side of the property with out any type of garage or stable / barn structure on the site of the present
garage.
We do not know of any special history associated with our house. We have been told that Mr. Charlsen
was once a Stillwater mayor.

Description of the building to be demolished.
The building is a garage on the northwest side of our property. It was built approximately 1952 by
the Charlsen family. It is a cement block structure with a cement floor.The roof is constructed with
recycled lumber. It is a one and one half car garage with a small wood storage area off the back.

. Attached photos show the garage, cracks in the cement brick walls, damaged roof, walls, siding
and rotting wood. The whole structure is tipping / leaning to the north and west.

Zoning requirements.
The proposed new garage falls within the RB district /Thompson Parker and Mowers second
addition to Stillwater and will comply with set backs and other applicable zoning requirements.
Our lot is more than 10,000 feet. The garage will follow or exceed the minimum set back of 3'from
the side. Our new garage will be 24'x 30' and approx. 720 sq feet

Alternatives to demolition.
We see no feasible or reasonable alternative to demolition.The structure is a hazard and liability. It
is unsafe and dangerous for our family to use. Beyond that it does not fit our needs and we can not
safely park a car within it. The garage does not fit with the character or architectural style of the
house and is an eye sore.

Proposed plans and schedule for reuse
We have attached some drawings and a footprint of what the foundation will look like.
Our plan is to construct a two car garage in approximately the same location as the
existing garage. We plan on repeating the dormered look of the houses roof in the
new garage. We hope to place windows in the dormers if we can afford the cost.
There will be one or two service doors on the south side of the garage. There will be
stairs to the storage area and the back of the garage will have room for lawn and
garden equipment, bikes,etc.
The garage will have two 8'x 9' garage doors that will face East. The foundation will
have frost footings and because of the grade will not be a floating slab.
We will include as many architectural details as we can reasonably afford in an attempt
to build a garage that matches the character of the house.
We hope to start the project in June and hope to see it completed by the end
of September 2008.
Sketches are attached.
These are concept drawings. The builder will obtain detail drawings for construction.

DISCUSSION
The applicant is requesting design review and approval to install a wall sign for The
Shirt Factory at 126 Main St S. The applicant has indicated on his application that the
sign will be 204-inches (17 feet) by 19-inches (1 foot 7 inches) for a total of 26.9 square
feet. The sign is proposed to contain the words "The Shirt Factory" and "We customize
T-shirts instantly! You Name it, we print it!". The lettering is proposed to be gold black
background and gold border.
For retail storefront signs the Commercial Historic District Design Manual provides the
size of signs shall be consistent with the Sign Ordinance. The sign ordinance states
building signs in the CBD '.. . may have an aggregate area not exceeding one square foot
for each foot of building face.. .'. The applicant's retail space facing Main Street is 27
feet long. The total sign area of the proposed sign is 26.9 square feet, which is smaller
than the square footage allowed by the ordinance.
Staff would note that the image supplied by the applicant shows a larger
(approximately 25.3' by 2.2') sign than what is described in the application. As a
condition of approval staff would recommend the sign be limited to the size of 17 feet
by 1 foot-7 inches as described in the sign permit application.

DISCUSSION
The applicant is requesting design review and approval to replace the existing "DQ"
wall signs at 1840 Market Drive with new signs for "Leeann Chin". The new signs will
be comprised of red channel letters. The first sign is on the north elevation and is
proposed to be 23'1-5/8" wide by 20" tall for a total area of 38.3 square feet. The second
sign is on the east elevation and is proposed to be 13'10-1/2" wide by 12" tall for a total
area of 13.8 square feet.
For retail wall signage the West Business Park design standards provide that the
signage shall be consistent with the Sign Ordinance. The sign ordinance states that for a
wall sign, 'the gross surface area of a wall sign may not exceed one square foot for each
foot of building, parallel to the front lot line'. The applicant's retail space has 46'3" feet
facing Market Drive. The total sign area on the north elevation is less than the
maximum allowed by the ordinance. A variance was granted for a second wall sign
for up to 16 square feet of signage on the east elevation of the building. A variance runs
with the property, not the business. So it can be applied to Leeann Chin's signage. The
proposed sign on the east elevation meets the stipulations of the existing variance.

DISCUSSION
The applicant is requesting design review and approval of a new wall sign and store
front changes for the building at 223 Main St S.
Building signage
The sign is proposed to contain the business name "Maison Galleria". The lettering is
proposed to be tan with a tan boarder all on a black background. The proposed sign is
3' tall by 8' wide for a total area of 24 square feet.
For retail storefront signs the Commercial Historic District Design Manual provides the
size of signs shall be consistent with the Sign Ordinance. The zoning ordinance states
building signs in the CBD '.. .may have an aggregate area not exceeding one square foot
for each foot of building face...'. The applicant's retail space is 28 feet long facing Main
St. The total sign area of the proposed sign is 24 square feet, which is smaller than the
square footage allowed by the ordinance.

Store Front Facade Changes
The applicant is also seeking approval to remove the existing store front framing and
install new bronze aluminum display windows and door. The building is located in the
core Stillwater Commercial Historic District as listed on the National Registry of
Historic Districts. The building itself is a contributing building to the Historic District.
The Downtown Design Manual Guidelines provides direction for storefront fa<;ades.
Generally, it is encouraged that store fronts be returned to their original characteristics.
Bronze aluminum storefronts are not original to downtown Stillwater. However, the
Commission has permitted these store fronts on other buildings in the district.
AL TERNATIVES
The Heritage Preservation Commission has the following options:
1. Approve the requests in whole or in part.
2. Deny the requests.
3. Continue the request for more information. The 60 day decision deadline for
the request is July 15, 2008 and the next Heritage Preservation Commission
meeting is scheduled for July 7, 2008.
STAFF RECOMMENDATION
Approve the requested building sign and store front fa<;ade changes as conditioned.
CONDITIONS FOR APPROVAL
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.

new store front including kick panels, transom windows, display windows, and door.
The building is located in the core Stillwater Commercial Historic District as listed on
the National Registry of Historic Districts. The building itself is a contributing building
to the Historic District.
The Downtown Design Manual Guidelines provides direction for storefront fa<;ades
including requirements for transom windows, display windows, entry doors, and kick
plates. The applicant indicated in their letter that the storefront will use wood and glass
materials.
The applicant's drawings show lights on either side of the entryway. Specific details on
the lights were not submitted. The light fixtures would appear to be open unshielded
fixtures. Detailed lighting specifications should be submitted and shielded light
fixtures should be used with the appropriate wattage of light bulbs.
With the exception of the proposed lights, the proposal as submitted meets the intent of
the Downtown Design Manual Guidelines for storefront fa<;;ades.
ALTERNATIVES
The Heritage Preservation Commission has the following options:

RE: Building Improvements @ 208 So Main St
Overview
We were careful in researching and planning our design efforts of the building, and hope
that you will agree that not only is this a major improvement, but done so in a historically
sensitive way. The building was more than likely updated over the years moving away
from its original character and charm for cost and maintenance reasons. We think this is
moving back in a direction towards the original character and charm for the era of this
building.
The building currently contains a steel support beam (horizontally) across the front and
above the windows and door. The current materials used are wood, metal, and standard
(non-tempered) glass.
We propose to reconstruct the front of the building from the beam down. The materials
used will all be wood (painted black) and safety or tempered glass. The front will be built
to look as though it would have looked in the era it was originally built. We will also
bring out the front of the store to both maximize floor space and create a more welcoming
facade. We will also be cleaning the brick and removing existing graffiti, adding a sign
and lighting.

Demolition ordinance
Message:
In 1995 the City passed the current building demolition ordinance that is in place today. The
demolition ordinance was for the purpose of:
"protecting the historic and aesthetic qualities of the city by preserving, rehabilitating or
restoring, when reasonable, buildings or structures which constitute or reflect distinctive
features of the architectural or historical resources of the city, thereby promoting the
public welfare and preserving the cultural heritage of the city."
This ordinance requires the HPC to review and approve all demolition permits for buildings
proposed to be demolished that are greater than 50 years of age. The only exception is if a
building poses an immediate life and safety hazard the Building Official and Community
Development Director can issue and emergency demolition permit.
Staff has two areas of the ordinance that we would like Commission to review.
1) Related to the 50 year timeline, staff believes that a set date should be used in the ordiance.
The period of influence for Stillwater as identified in Vogel's "Stillwater Historic Context" is
between the 1840's and the 1910's. For some neighborhoods the period of influence extends
to pre World War II. As it currently stands, as time passes more and more buildings within
the Community are becoming subject to this review process even though they were not built
within the City's period of influence. Starting injust as little as 10 year portions of
Croixwood will become subject to this ordinance. Staff would suggest that the current
ordinance be modified to require the review of buildings built only prior to 1940.

Sec. 34-1. Purpose of chapter.
This chapter is adopted for the purpose of protecting the historic and aesthetic qualities of the city
by preserving, rehabilitating or restoring, when reasonable, buildings or structures which constitute
or reflect distinctive features of the architectural or historical resources of the city, thereby
promoting the public welfare and preserving the cultural heritage of the city. (Ord. No. 814, 12-5-95)
Sec. 34-2. Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meanings
ascribed to them in this subdivision, except where the context clearly indicates a different meaning:
Buildings or structures of potential historic significance means a princilJcd building or portion 0/ a

Historically significant building or structure means any building or structure or portion of a
building or structure on the National Historic Register, a designated local landmark or a contributing
structure or building in a designated national register historic district.
Nonhistoric structure or building means a structure or building

Sec. 34-3. Permit required.
No building or structure may be demolished without obtaining a demolition permit. An application
for a demolition permit must be filed with the city building official. (Ord. No. 814, 12-5-95)
Sec. 34-4. Procedure.
The building official must forward a copy of each demolition permit application to the community
development director for determination of historic significance or potential significance. The
community development director must make the following determination:
Subd. 1. The building or structure is historically significant or potentially historically significant;
or
Subd. 2. The building or structure is not historically or potentially historic.
If buildings or structures are determined by the community development director to be historic or
potentially historic, the application must be sent to the commission for review according to section
34-5. Buildings or structures determined nonhistoric must be referred to the building official for
issuance of a demolition permit. (Ord. No. 814, 12-5-95)

Update on City of Stillwater v. Bush and
City of Stillwater v. Lehmke

The City has entered in to a plea deal with Bush and Lehmke related to the barn that
was demolished without a permit from the City of Stillwater.
The City has agreed to continue the case for dismissal which means that if he has no
same or similar violations, remains law abiding and keeps the peace that these charges
will go away. As part of the agreement, Bush will donate $1,000 and Lehmke will
donate $500 to a historical preservation fund that can be used by the HPC as they see fit
for preservation activities in the City of Stillwater. If either party violates the terms of
the agreement then they will forfeit the money and will have to answer to these
charges.
