CHANGE OF MEETING DATE
NOTICE IS HEREBY GIVEN that due to the Labor Day Holiday the Heritage
Preservation Commission will hold Its regular meeting on Wednesday, September 5,
2007 instead of Monday, September 3, 2007 in the Council Chambers at Stillwater City,
Hall, 216 North 41h Street.

Present: Howard Lieberman, Chairperson, Phil Eastwood, Robert Gag, Gayle Hudak, Jeff
Johnson, Larry Nelson, Roger Tomten and Scott Zahren
Staff present: Community Development Director Bill Turnblad
Mr. Lieberman called the meeting to order at 7 p.m.
Approval of minutes: Mr. Tomten, seconded by Mr. Nelson, moved approval of the minutes of
Aug. 6, 2007. Motion passed unanimously.
PUBLIC HEARINGS
Case No. DEM /07 -44 A demolition request for a 20' x 14' barn at 1818 Broadway St. N. in the
RA, Single Family Residential District. Kirk Johnson, applicant.
Mr. Lieberman reviewed the nine steps required for the issuance of a demolition permit. The
applicant was present and spoke to the poor shape of the structure, including roof, foundation
and siding. He stated he plans to construct a new one -car garage plus storage in a similar
location on the property. Kirk Johnson stated he had spoken with historian Don Empson who
told him that it was unfortunate that the structure appeared to be in a condition that it is not
economically viable to repair the structure.
Mr. Lieberman opened the public hearing. No comments were received, and the hearing was
closed. Mr. Lieberman stated he would hate to lose a structure that is 107 years old, but it is in
disrepair, with an estimate of $20,000 to repair. Mr. Nelson said the photos of the structure
speak for themselves from an economic point of view. Ms. Hudak and Mr. Zahren agreed with
Mr. Nelson's comments, with Ms. Hudak adding that it appears the condition of the structure is
to the point of danger. Jeff Johnson noted the original structure has been altered with the
addition of a garage entry, and suggested that if not for the alterations, there would be more
interest in preserving the structure.
Jeff Johnson, seconded by Mr. Zahren, moved approval of the demolition permit based on the
completeness of the application. Mr. Eastwood said he would like to see Mr. Empson's
comments. Mr. Eastwood said he had a problem losing a structure such as this, which
contributes to the character of the neighborhood. Mr. Eastwood spoke of the issue of demolition
by neglect. The applicant stated their original intent was to preserve the structure, but they
discovered it is beyond their means to do so. Motion to approve the demolition permit passed by
unanimous vote.
Case No. DEM /07 -46 A demolition request for a garage at 1208 Ramsey St. W. in the RA,
Single Family Residential District. Lakeland Contractors LLC, applicant.
Mr. Lieberman opened the public hearing. No comments were received, and the hearing was
closed.
Charles Drake, Lakeland Contractors, apologized for forgetting to include an estimate for the
cost of repair in the application packet. Mr. Zahren asked if a new garage would match the
primary structure. Mr. Drake said yes, when funds are available to construct a new garage. Mr.

Johnson noted that applicants must follow the requirements of the ordinance, and no cost
estimate is included, and he pointed out there is no timetable and no urgency to putting up a
new garage. Mr. Drake said they are in the process of redoing the porch for the homeowner, are
hoping to finish the construction project next week and had hoped to do the demolition while
they were on site.
In the absence of the completion of the nine steps required for the issuance of a demolition
permit, Mr. Lieberman moved to table this request until the next meeting. Mr. Johnson seconded
the motion. Mr. Tomten suggested the possibility of approving the permit subject to the applicant
submitted a cost estimate to staff, noting that this structure does not contribute to the character
of the neighborhood. Mr. Johnson spoke of a concern about setting precedent and also pointed
out that this is a public hearing and approving with the condition that an estimate be provided to
staff would amount to leaving staff to make a decision without public input. Mr. Lieberman stated
that if a request falls within the parameters of the demolition ordinance, all nine steps must be
followed. Motion to table passed unanimously.
DESIGN REVIEWS
Case No. DR/07 -45 Design review of Liberty 5th Addition office /retail building at the southeast
corner of County Roads 12 and 15, Outlot D, Liberty Village. Mike Waldo, Liberty Office Group,
LLC, applicant.
Mr. Waldo stated the design plans have been approved by the Kroenings. The Liberty
architectural review committee also reviewed and approved the plan with some recommended
changes, mostly to minor details such as flushing the rake ends and beefing up the columns, he
said. Mr. Tomten asked about the awnings. Mr. Waldo provided color samples and stated the
awnings would be cloth /material, not structural. Mr. Johnson asked about lighting. Mr. Waldo
said he wasn't sure about lighting or signage plans because he is not sure of the tenant mix at
this point. Mr. Waldo stated with the nearby streetlights, he isn't sure if lighting will be needed in
the parking lot; he said there likely would be can lighting underneath the entries and something
by the entrance on the park side. Regarding landscaping plans, Mr. Johnson suggested the
applicant consider lower plant materials sde to the sight distance to the corner; a representative
of the applicant explained plant materials will be contained in a low retaining wall away from the
street.
Mr. Waldo stated there will be some mechanicals outside and the trash receptacle will be
enclosed with the same material as the primary structure. Mr. Waldo stated the siding will be 4"
lap siding, rather than the 6" siding as stated in the agenda packet. He also noted that the
building will have a basement, unlike what was noted in the agenda packet.
Mr. Tomten said he thought these were good plans and represent the character everyone has
been striving for in the Village Commercial District. Mr. Lieberman moved to approve the plans
as presented and conditioned, changing the reference to 6" siding to 4" lap siding and noting the
building will have a basement. Mr. Johnson seconded the motion asking Mr. Lieberman to add
conditions that the windows be 6 over 6, that the awnings be of cloth material, and that signage
and lighting plans be submitted for review at a later date. Mr. Lieberman agreed to the additional
conditions. Amended motion passed unanimously. Mr. Johnson also requested that the drawing

detailing the architectural review comments submitted the evening of the meeting be made part
of the record.
Case No. DR/07 -47 Design review of signage at 1875 S. Greeley St., Stillwater Area Public
Schools, in the BP -I, Business Park Industrial District. ASI Modulex, applicant.
A representative of Independent School District 834 was present. He explained the reason for
the decision to replace the existing monument sign. The new signage will not be lighted. An
existing flagpole will be washed in light as required.
Mr. Tomten moved approval of Case No. DR/07 -47 as conditioned. Ms. Hudak seconded the
motion; motion passed unanimously.
Case No. DR/07 -48 Design review of signage at 1500 Frontage Road in the BP -C, Business
Park Commercial District. Arrow Designs, representing Washington County.
No one was present representing the applicant. Mr. Johnson asked about lighting. Mr. Turnblad
stated that as submitted, the sign will not be lighted. Mr. Johnson moved approval of the plans
as submitted and conditioned, clarifying that the signage will not be lighted. Mr. Zahren
seconded the motion; motion passed unanimously.
OTHER BUSINESS
• Mr. Zahren pointed out the house at Willow and Second Street, the subject of considerable
discussion by the HPC, is for sale.
• Mr. Tomten brought up the provision in the demolition permit process that is supposed to
allow the HPC a chance to review plans for a replacement structure. Mr. Tomten noted that
as the ordinance currently stands, if an applicant doesn't build a replacement structure
immediately after demolition, the applicant could ultimately build something very different
than what the HPC thought would be done with the property. Mr. Gag suggested tweaking
the infill guidelines to ensure HPC review in such instances. Mr. Johnson noted the primary
intent of the demolition ordinance is to get the applicant to think about the decision and
possible alternatives to demolition.
• Mr. Eastwood spoke of the issue of demolition by neglect and the possibility of enacting a
maintenance ordinance. Mr. Turnblad spoke of the difficulty of enforcing such ordinances.
• There was a question about the status of the parking ramp design process. Mr. Turnblad
noted the RFPs have been evaluated and narrowed to three finalists.
• Mr. Turnblad noted the National Trust Conference is scheduled for Oct. 3 -6 and suggested
that members who want to attend should contact Mr. Pogge.
Mr. Lieberman, seconded by Mr. Eastwood, moved to adjourn at 8:20 p.m. Motion passed
unanimously.
