The f;~i~s:e"'" recommendati on is a potenti al cost ~ayff'\g:r~i tem of
considerable significance. Wayne Wohlers took an "ac"'tlon at
the January meeting to investigate potential energy cost savings
b;y!';;:9ci1~~"g.t:n.e ice temperature. A refrigeratiOn '.eHper.t was
contacted':a.t Ho'lmsten Ice Rinks Inc. on Como Ave. iri':'St.::Paul.
The''''e~~~'l:o.i 'n:.formed Wayne that the opti mum ice temperature for a
typi cal unheated arena is 20 to 22 degrees fahremhef.:t:.. Wayne
indicated that to the best of his knowledge the Lily Lake ice
temperature is kept a.t a consta,nt 18C>F. The Hol msten e>~pert
pointed out that some arenas will drop their ice temperature to
18 degrees a, few hours before major events but he.,~id'n{.:t,,_kr:l9w of
any other unheated ice arena in the midwest keeping their ice at
a c6l'i€l:.in-t:. 18C>F. How much money could be saved? The expert.
indieS~~[~hat based on his experience, raising ~he ice tempera-
tureiO ~E~iEjt?o 20 degrees coul d save as much a,s $7500.'00 for a
typical season. Another $1500 could be realized per degreti1 per
season thereafter. It is recognized that the outside temperature
has some affect on the ice temperature and adjustments are re-
quired to accomodate the minus 30C>F to abov-e:-freezfng temperature
swings we enjoy here in this part of the country. The Holmsten
e}~pert i nsi sts that thi:: is f a,ctored into hiS' ,coste':-' .sa~i ngs
estimates. The IADC recommends that the City of Stillwater coun-
cil direct the ice arena manager to raise the ice temperature to
20 or 21C>F, let the ice stabilize and then consult with Wayne to
determine if further increases can be made. Wayne has already
discussed this proposal with Coach Bealieu who is not opposed to
the idea. Andre will be asked to provide input again once the ice
temperature reaches 20 or 21C>F.
The other item is mostly service related but some additional
revenue could be realized. One of the biQQest complaints we
"rink rats" have is that the concession stand is usually closed
when the lobby is full of people (potential buyers). Bob

for 7:00 P.M. Thursday, May 2, 1985 in the City Council

$120,000 per year. Based on information made available to our
committee thus far, it, would appear that these numbers are greatly

General Fund tcr'itfi'lir,'ena in 1983 appears to have been approximately
$35,000. of this toftrl, approximately $10,000 was necessary to cover
shortfalls in operations at the ball field complex and the swimming
beach. Consequently, it would appear that the ice arena operations
for 1983 was f;2'5:;0~fn'''ithe red.

losses in operating)1~\ept at the absolute minimum. The arena

Recom menda tions:
1. It appears that! significant savings could be realized by
restructuring the'Rotif~ and responsibilities of the site manager. By
so doing, the jobiof A~S:is-tant Manager and its related expenses (j.e.
insurance, wages a;.rw'~mer fringe benefits, etc.) could likely be
eliminated and 'f~pl~I:\i<f'tJy job opportunities for part time help at
much reduced' c,O~fs::.."i<'the:refore, this committee recommends that the
City not fill the~Assts't'ant Manager vacancy at this time.
2. We believe that opportunities exist for increasing revenues
that would result In little, if any, increased costs. Examples of
increased revetfu:e~ m}~ht' be (1) advertising on and/or off site, (2)
expanded concession ~ahd operation, both in terms of timing and
product line (U~. fape~;laces, sticks, and skate sharpening), (3)
non-traditional faeHiky re'htals, (4) revised ice rental structure.

Dear Dennis:
You have asked for my opinion with regard to Wayne Orn's
request that we negotiate with him for the sale of ice time
on the basis of the length of time he has been involved in
hockey in the St. Croix Valley and also on the basis that he
plans to form a non-profit corporation.

Since both the questions involved the possibility of
eliminating competitive bidding, they concern the same issue.
Since the 1982 Supreme Court decision in Community
Communications Company, Inc. vs. City of Boulder, cities
throughout the nation have been faced with the threat of
federal anti-trust lawsuits. In the Boulder decision, the
Supreme Court ruled that cities and other local units of
government that take actions which have not been authorized
by a "clearly articulated and affirmatively expressed" state
policy of substituting regulation for competition are subject
to challenge under the federal anti-trust laws.
A flood of lawsuits have followed this decision. In
Unity Ventures vs. Village of Grayslake, the jury awarded
9.5 million dollars in damages against two local governments
and several elected officials for failing to extend sewer
lines to a developers property that was located in a township
adjacent to the incorporated area. The judge, acting pursuant
to the anti-trust laws, automatically tripled the damages to
28.5 million dollars.
.
Following the adoption of the local government anti-trust
act of 1984, cities have enjoyed some protection from awards of
money damages, however this congressional action did not grant
immunity to cities such as are enjoyed by the states. Anti-
trust problems which remain include:
e
1. The law continues to allow plaintiffs to seek injunctive
relief based on anti-trust laws.
2. Successful plaintiffs in these injunctive cases may recover
costs and attorney's fees.
3. Local government officials and employees may still be sued
for treble damages for conduct which is allegedly to be beyond their
official capacity.
4. And private parties may still be sued for treble damages
for activities which were not "directed by" the local government.
To award the ice time to Mr. Orn based upon his length of
residency in the Stillwater area or on the basis that he plans to
form a non-profit corporation, both have the end result of displacing
competition. Matters such as this are ripe with anti-trust implications.
We must view the situation with a cold eye. When two competitors are
fighting over the same asset, the only conceivable way to protect the
members of the recreation board, the Stillwater City Council, the
Stillwater City Attorney, and all the citizens of the City of Stillwater
against potential liability, is to advertise the contested asset for
competitive bids.

The seventh meeting of the Ice Arena Operations Committee met as
scheduled on 14MAR85 in the City of Stillwater council chambers. 4It

The meeting was called to order at 7:35 by committee chairman
Bolin.
M/S/C Carlson/Edstrom - To approve minutes from the February
12, 1984 meeting.
Committee members were asked for reports on any feedback as a
result of the interim report containing the suggested actions to
raise the ice temperature and keep the concession stand open.
All reports were positive. It was further suggested that if a
reliable procedure could be found, the ice temperature could be
adjusted daily to reflect actual ice usage. At least one arena is
known to have implemented such a procedure. The ice temperature
is raised to 250F or so at the end of the day and lowered again
two to three hours before the first ice hour the next day. It was
agreed to include this suggestion in the final report.
It was suggested that it was time to wrap things up and submit
the final report. After much discussion, an outline for the ~
report was agreed upon: ~
I. Short term recommendations ($15,000+>
A. Raise ice temperature
B. Keep concession stand open
C. Find an advertiser for the Zamboni
D. Reduce permanent staff to manager only
II. Long term recommendations
A. Suggest Plan of Action
B. Suggest Ice Arena Board

duties except ice scheduling and arena promotion. Hours are
somewhat flexible but it was reported that Monday through
Wednesday were expected to be longer than the others. All
preventive maintenance, repairs, stocking the concession
stand and bookwork are done on these days starting at 8:00am
until sometimes late into the evening. Thursday and Friday
hours are generally from 10:QOam to 6:00pm. Weekends on
call. The concession stand is staffed by high school people
starting at $2.10/hr with 51. increase yearly if rehired.
Each employee signs a behavior pact which is strictly
enforced. The Zamboni operator is paid $3.75/hr.

Compressors are shut down when outside temperature is below

On a moti.on by Jay Kimble, seconded by John Rahm to accept the bids, it was
unanimously passed by the Board.
A motion by Brad MacDonald, seconded by Wayne Wohlers, to reduce the Lily
Lake tournament fees for softball from $200.00 to $100.00 was rejected on a
3 to 3 vote.
A motion by Wayne. Wohlers, seconded by Jay Kimble, to set 1985 tournament fees
at Lily Lake at $150.00. Approved by the Board 5 to 1 with J. Rahms objecting.
Jim Fackler was given permission to hire Buberl, Bloomstrong, Skulvac, Pearson
and O'Brien as Beach Lifeguards at Lily Lake for the 1985 season. All guards
are to meet the required qualifications needed.

example of "misplaced priorities."
"Obviously, $800,000 would buy
a lot of computers and new books,"
Jabas said. "I'd like us to place
more emphasis on the academics.
I'm not opposed to sports. Athletics
play an important role in any

Members Present: Duane Nelson, John Benson, Dennis Sullivan, Linda Kluy,
Wayne Wohlers and Brad Macdonald.
Members Absent: John Rahm, Jim Swanson.

APPROVAL OF MINUTES:
The minutes of September 25, 1985 were approved.
BIDS - SUMMER ICE TIME:
One bid was received for Summer Ice Time - 1986 from Andre Beaulieu. A bid of
$11,000 was received from Andre Beaulieu Hockey School. The days were from
June 5, 1986 to July 3, 1986. A check for $1,100.00 was included.
A motion was made by Duane Nelson, seconded by Wayne Wohlers for acceptance
. and was unanimously approved by the Board.
The Board set December 11, 1985 as the next meeting date at City Hall, 7:00
P.M. The agenda is to cover Arena and Ballfield fees for 1986.

LILY LAKE ICE ARENA
The City of Sti llwater (the "City") is the owner of the Li ly Lake
Ice Arena (the "Arena").

(the "User") wish to enter into an agreement for the use of certain of the
facilities described in Paragraph 2 below (the "Facilities").
NOW THEREFORE. the parties agree as follm.s:

(2) Janitorial Services. City agrees to furnish all necessary
janitorial services. City in its sole discretion. shall
determine what is "necessary".
(3) Parking. City agrees to furnish an adequate parking area
for User's use. City in its sole discretion, will determine
what is an "adequate" area.

parking lot, during the Term of this Agreement, shall be damaged
by the act or failure to act of User, its members, agents or
invitees, City may deduct from the damage deposit the sum that
is necessary to restore the premises to its present condition.
In the event the damage deposit is not adequate for this purpose,
User will pay to City the additional amount required to complete
repairs.
D. Release of Claims Against City. City is expressly released and
discharged from any and all liabilities for loss, injury or
damages to person or property that-may be sustained by User, its
members, agents or invitees while on the Arena property or in the
Arena parking lot during the Term of this Agreement. In the event
such loss, injury or damage occurs, User agrees to indemnify City
against all claims resulting therefrom.
E. Removal of User's Personal Property. City reserves the right to
remove from the Arena all personal property of User, its members,
agents and invitees therein after the expiration of the Term, to
store the effects at User's expense, ana to sell such personal
property after the passage of 30 days from the expiration of the
Term.

F. Default by User. City reserves the right to cancel this Agreement
~or any default by User in the terms of this Agreement.
G. Right to Reschedule. City reserves the right, in its discretion,
to reschedule the Term of this Agreement if User is given notice
of the rescheduling at least 10 days prior to commencement of the
original Term. Notice shall be deemed to be given upon mailing
thereof. User shall have the right, within 5 days of the giving
of such notice of rescheduling, to either accept the rescheduled
Term, all other terms and conditions of this Agreement remaining
the same, or cancel the Agreement with the City entirely. The
User, after notice of rescheduling, shall not have the right to
bind the City to the original Term of the Agreement.
H. Cityts Right to Cancel. In the event of mechanical failure or
other unforeseen occurrence that renders the fulfillment of this
Agreement by City impossible or impracticable, this Agreement shall
terminate and User waives any claim for damages or compensation
should this Agreement be so terminated.

SCHEDULE A
The terms, conditions and limitations set forth hereunder are
a part of the Agreement for use of Lily Lake Ice Arena to which
this Schedule A is attached.
1) Liabili ty Insurance. In the case of use of the fadIi ty for
20 hours of use or more as determined from Paragraph 1, User
will provide City within 20 days after execution of this Agreement,
but no later than 5 days immediately preceding the date of commence-
ment of the term of this Agreement, a policy of public liability
and property damage insurance for the term of this Agreement. The
policy shall have limits of $500,000 per person and $1,000,000
per accident for bodily injury and $500,,000 per accident for
property damage and shall have as named insured City and User
and shall contain such further nrovisions and be in such form
. .
and issued by such issuer as shall be acceptable to City. The
policy shall also contain an endorsement to the effect that no
change or cancellation in the terms of the policy shall be effective
unless written notice is received hy the Lessor at least 10 days
prior to the change or cancellation.
2) The City reserves the right to approve or disapprove of any
subtenant or subuser.

The Stillwater City Council will meet tomorrow, Oct. 1. At the depart-
mental meeting set for 4:30 p.m., the council will meet with Dennis
Balyeat of HRA to discuss the single family mortgage revenue bond pro-
grl 11so, Tom Farrell, speaking for the River Valley Lions will make a
request far placement of docks at Lily Lake and Brewers Pond in Croix -
wood. Ten public hearings have been set for the 7:30 p.m. meeting, The
council will Also discuss a modification of the tax increment. financing
district..
Among the agenda items to be discussed at Lake Elmo's city council
meeting Tuesday evening will be the 1986 budget resolution, two public
hearings on a variance and a drainage easement, and a rezoning request.
The meeting starts at 7:00.
The council also is expected to correct the spelling of "Jamaca"
Avenue to Jamaica Avenue.
The Washington County Cable Co. will make a request to amend the
franchise ordinance when the Central St. Croix Valley Joint Cable Com-
munications Commission holds its regular monthly meeting meets Thurs-
day at 7:30 p.m. at Stillwater City Hall.
Other agenda items include a report from the Community Access Corp.
and discussion on the commission's 1985-86 tasks.

The fees for open skating and open hockey this season at Lily Lake
Arena in Stillwater have been set at $1.50 for weekends sessions and $1 for
weekday sessions.
The fees were set at last Wednesday's Recreation Commission
meeting.
The commission also decided to request the city to send out a residents'
questionnaire with its next bulletin, which is mailed monthly to
homeowners along with their utility bills. The questionnaire has five
questions dealing with recreational facilities:
1) Are Lily Lake swimming facilities adequate? 2) Are outdoor skating
rinks adequate? 3) Would you prefer an outside skating rink on Lily
Lake? Or, a flood rink on Lily Lake's ballfield? 4) Is Lily Lake Arena ade-
quate? 5) List any park, recreational equipment, facilities ar any other
needs that should be considered by the recreational board.
Only replies which are accompanied by payment of utility bills will be
accepted, the commission decided, to ensure only residential input into
the survey.
The commission meets again Oct. 16 at City Hall.

At it s Tuesday evening meeting, the
Stillwater City Council decided to at least
delay --if not turn down --the recreation com-
mission's request to send out a short, five -
question survey concerning the adequacy of
this town's recreational facilities. The
recreation commission had asked the coun-
cil to approve sending out the survey with
homeowners' quarterly utility bills, due to
be trailed within the next two weeks, but the
council decided instead to send out its own
survey, one basically
assessments and the Public library. dealing with
There is no question the councils own
survey is a valid and important one: public
input into these issues is vital. But these
facts are also true of the recreation com-
mission's survey, and if some coun-
cilmembers believe otherwise, they are
sadly mistaken and incredibly blind.
This city is as fanatical about sports as
one can get...perhaps too fanatical. But, as
the recreation commission has painfully learned over the years, residents don't
usually say very much until they have
something to complain about. The survey is
the commission's opportunity to learn of
residents' opinions in an orderly and com-
prehensive fashion.
The commission is seeking the city•s
•`want list" of facilities and improvements
on existing facilities. Concern has been ex-
pressed for more soccer fields and more
open skating rinks. For a city this size, the
present number Of tennis courts-- I 4--seems
very inadequate, especially considering six
of those are owned and maintained by
School ❑istrict 834.
The commission had hoped to air out
the responses at its November or December
meeting, but it will have to wait until at
least mid -January, when the next utility
bills are sent out, unless it wants to spend
several hundred dollars in postage to mail
out the surveys itself. Hopefully, the council
Will agree to include the surveys in its
January utility mailings. Then, the com-
mission will still have time to formulate its
1986.87 budget with the help of survey
responses of residents.
Public input into public facilities only
makes sense, councilmembers shouldn't
allow their personal biases to stand in the

STILLWATER RECREATION COMMISSION
December 11, 1985
The meeting was called to order by Chairperson, Linda Kluy.
Members Present: Duane Nelson, Dennis Sullivan, Linda Kluy, John Rahm, Wayne
Wohlers, Jim Swanson.
Members Absent: John Benson, Brad MacDonald.
Also Present: Robert Bielenberg, A. Beaulieu, Dick Blekum.
APPROVAL OF MINUTES
The minutes of October 16, 1985 were approved.
BALLFIELD & ICE ARENA FEES
Because no cost figures were furnished the Commission for Ballfield and Ite
' Arena Operation for 1985, and after a short discussion by the Commission, a
,motion was made by W. Wohlers, seconded by J. Swanson and unanimously approved
"to keep the same fees for 1986 as were in effect for 1985.
As no cost figures were available for the current period on the Ice Arena
operation, a motion was made by W. Wohlers and seconded by J. Rahm to postpone
.6e Arena fees until the January 22, 1986 meeting.
After a general discussion on the high insurance premiums for liability
.,overage on,recreational activities, the Commission requested the secretary to
.mention the concerns to the Mayor and City Council to take a positive stance
for reversing the recent State Statute making municipalities liable for
excessive claims in recreational activities.
The date for the January meeting was set for January 22, 1986.
The meeting adjourned at 8:20 P.M.
