HomeMy WebLinkAbout0989 Ord (Residential Driveways) ORDINANCE NO. 989 AN ORDINANCE ESTABLISHING MINIMUM STANDARDS FOR CONSTRUCTION AND RECONSTRUCTION OF DRIVEWAYS WITHIN THE CITY OF STILLWATER The City Council of the City of Stillwater does ordain: 1. INTRODUCTION. It has come to the attention of the City Council that residents of the City are experiencing the early failure of driveways that have been constructed with concrete and asphalt, earlier than what should be expected to be the useful life of asphalt and concrete. 2. PURPOSE. It is the purpose of this Ordinance to establish minimum standards for the construction and reconstruction of driveways within the City and that the standards so adopted be admissible as minimum standards for the purposes of any civil action in the Washington County Conciliation Court or the Washington County District Court of the State of Minnesota. 3. STANDARDS. The minimum standards are as follows: A. For the construction of Residential Driveways: Concrete Driveways: 4 inches of compacted sand and 5 inches of concrete; Bituminous Driveways: 4 inches of Class 5 gravel and 2 inches of bituminous; B. For Commercial Drives: For Concrete, 4 inches of compacted sand and 6 inches of concrete; For Blacktop, 4 inches of Class 5 and 4 inches of bituminous. C. The sand or aggregate base should be compacted to 100% of the Standard Proctor Density. D. An additional sub-cut, depending on the condition of the underlying soils, should be considered to prevent heaving or settlement ofthe driveway. 4. ADMISSIBILITY. That at the request of any citizen, the City Clerk shall prepare a certified copy of this Ordinance which shall be admissible in any court in Washington County, to be evidence of a standard of care, the breach of which constitutes prima facia evidence of negligence. 5. NOTICE TO CONTRACTORS. The Public Works Department is obligated to provide a copy of this Ordinance to any person or entity that requests a building permit in this City after the effective date of this Ordinance. 6. SAVING. In all other ways the Code will remain in full force and effect. 7. EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and publication according to law. Adopted by the City Council of the City of Stillwater this 4th day of September 007.
