ORDINANCE NO.: 985 AN ORDINANCE CREATING THE EAGLE RIDGE SIDEWALK DISTRICT The City Council of the City of Stillwater does ordain: 1. AUTHORITY. The authority for the creation of this Sidewalk District is found in Section 435.44 of the Statutes of Minnesota. 2. FINDING. It is found, by the City Council, that Eagle Ridge Trail is a street that manages vehicular and pedestrian traffic, not only from the homes abutting on the street, but also from homes that are constructed on cul-de-sacs, all of which contribute to pedestrian traffic on Eagle Ridge Trail. The Council further finds that all of the property abutting on the following streets and cul-de-sacs will hereafter be included in the Eagle Ridge Sidewalk District: Eagle Ridge Court; Eagle Ridge Crescent; Eagle Ridge Lane; Eagle Ridge Place; Eagle Ridge Trail; Green Twig Way; Kallie Court; Lecuyer Circle; Lecuyer Court; Lecuyer Drive; Mallard Court; Thorene Place; Wildwood Court; and Wildwood Lane, all depicted in the map attached as Exhibit "A." 3. UNIFORMITY; WIDE SIDEWALKS; INDIRECT BENEFIT. The total costs of Sidewalk District improvements, including construction and repair, may be apportioned and assessed as to all parcels or tracts of land located in the District on a uniform basis as to each classification of real estate. Where sidewalk widths are wider than the standard width of the District, the additional costs may be assessed as a direct benefit to the abutting property. An indirect District benefit assessment may involve all parcels or tracts of land located in the Sidewalk District without regard to the location of sidewalks as it is hereby deemed that all parcels or tracts of land within the Sidewalk District benefit equally. UP TO FIVE YEARS. The City Council may assess the costs on all District Sidewalk improvements up to a maximum of five years in equal annual installments, plus interest on the unpaid balance. 5. SAVING. In all other ways, the City Code will remain in full force and effect. 6. EFFECTIVE DATE. This ordinance will be in effect from and after its passage and publication according to law.
