HomeMy WebLinkAbout0885 Ord (Automotive) ORDINANCE NO. 885 AN ORDINANCE AMENDING THE STILL WATER CITY CODE BY ADDING CHAPTER 31-1, SUBD. 16(3)C The City Council of the City of Stillwater does ordain: 1. The City Code is amended by addition 931-1, subd. 16(3)c, that will hereafter read as follows: "c. Automotive. 1, Automotive uses. All automotive uses described in Subdivision 16.(1 )k. adjacent to a residential zone must maintain the required front yard setback area in a clear condition without permanently parked or stored automobiles, trailers, vehicles or other stored items or materials used for or accessory to the automotive use, Short term daily customer parking is allowed in the setback area but the area must be clear when the business is closed. 2. Fences. All stored autos, auto parts, trailers or business related items must be enclosed in a building, or stored behind a secure solid masonry wall or sightly fence not less than six (6) feet in height. 3, Compliance. All automobile repair uses as specified above must obtain a special use permit and comply with this Section c, within six (6) months from the effective date of this ordinance." In all other ways, the Stillwater City code shall remain in full force and effect. BYP~ ATTEST: Published Stillwater Gazette 12/28/99 I ORDINANCE NO, 886 AN ORDINANCE AMENDING CHAPTER 30 OF THE STILL WATER CITY CODE "GARBAGE AND RUBBISH" THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Chapter 30-1 of the Stillwater City Code, entitled "Garbage and Rubbish" is hereby amended to hereafter read as follows: Section 1. Subd. 8 shall be amended to read as follows: Fees. Effective January 1,2000, the fee for collection per month shall be as follows: For each 30 gallon container For each 60 gallon container For each 90 gallon container Adjusted accounts For each extra 30 gallon bag F or recycling services $ 9,80 $11.59 $13.45 $ 7,35 $ 1.50 $ 1.65 The minimum charge for each and every dwelling unit shall be based on the fee for a 30 gallon container. Multifamily residences of three or more units shall pay the mandatory rate for 30 gallon containers per dwelling unit unless a different rate is negotiated between the contractor and the residence, A residence shall be allowed to change container size at intervals of not less than two billing quarters and must give at least 30 day notice to the contractor. When a proper notice is received, changes in fees will be made to the following quarter billing, Changes in containers and related fees shall only be made on a quarterly basis. In the event a residence desires collection of normal household waste in excess of the waste held by the resident's container per week, they shall place the waste in bags not exceeding 30 gallons, Residents shall pay the contractor $1.50 for each additional 30 gallon bag. Residents who will be continuously absent from the city for more than 90 days shall be entitled to a reduced rate of $5.00 per month during the period of their absence. Section 2. Subd. 10. Financing, is hereby deleted, Section 3. Subd. 11. shall be renumbered Subd 10, and shall read as follows: Collection of charges, Monthly fees shall be collected by the city's duly authorized contractor and shall be due and payable quarterly in advance. All accounts shall be delinquent if not paid within 90 days after the statement is rendered, The charges shall be a charge against the owner, lessee or occupier of any residential unit and any such charge properly billed and unpaid may be collected in a civil action in a court of competent jurisdiction, or at the discretion of the city council, may be certified to the county auditor for collection with the real estate taxes, A penalty charge of $5.00 or ten percent of delinquent charges due, whichever is greater, shall be added to the amount to be certified to the county auditor for administrative expenses resulting from the delinquency. Section 4, In all other ways Chapter 30 ofthe Stillwater City Code shall remain in full force and effect. Section 5, Effective Date. This ordinance shall be in full force and effect after its publication according to law.
