ORDINANCE NO. 762 AN ORDINANCE AMENDING THE CITY CODE RELATING TO THE CONSUMPTION AND POSSESSION OF LIQUOR IN PUBLIC PLACES The city Council of the city of stillwater does ordain: Subdivision 1. Amending. (1) The stillwater City Code is hereby amended to add a new sUbdivision, S43.03, subd. 2a, which shall hereafter read as follows: 43.03 Subd. 2a "It shall be unlawful for any person, firm or corporation licensed to sell alcoholic beverages or their employees or agents to permit any person to remove any alcoholic beverage from the licensed premises in an open container." (2) A new S43.03, Subd. 3 is hereby added which shall hereafter read as follows: Subd. 3 "Penal tv. Any person violating any provlslon of this Ordinance shall be guilty of a petty misdemeanor and shall be sentenced to a fine that shall not exceed $20.00." Subd. 2. This ordinance shall be in full force and affect from and after its passage and publication according to law. Subd. 3. In all other ways, the stillwater city Code shall remain in full force and affect. Enacted by the City Council of the City of stillwater this 16th day of June , 1992. Magnuson stillwater City Attorney 324 South Main Street Re: Uniform Fine for violation of City Code Section 43.03 Dear Mr. Magnuson: The Washington County judges at their August ~4 Bench meeting approved an administrative order setting a fine not to exceed $20 for violation of City Code Section 43.03 which provides that a person consuming alcoholic beverages in an open container in a public place or a licensed operator that permits a person to remove alcoholic beverages from a licensed premises in an open container are guilty of a petty misdemeanor. A copy of the order signed by the Washington County judges is enclosed. This order will be filed and indexed in the Washington County Court Administrative Order Manual.
