Ms. Amrein called the meeting to order at 7 p.m.
Approval of minutes: Mr. Milbrandt, seconded by Ms. Snellman, moved approval of the
minutes of Aug. 22, 2005, as presented. Motion passed unanimously.
Friends of Parks update: Judy Gulden, Friends of Stillwater Parks, appeared to thank the
Board for support of the organization's activities, including the Art in the Park event
which was attended by many families, and the upcoming Race You to the Park event at
Bergmann Park. She told the Board a buckthorn removal project is scheduled for Oct. 22.
Brown's Creek Management Plan and Boutwell Cemetery Plan: Consultant Sherri Buss
updated the Board on the Boutwell Cemetery Plan and Brown's Creek Management Plan.
Regarding the final plan for the Boutwell Cemetery park area, Ms. Buss said the major
changes were moving the cemetery marker off the street and into the park area; plantings
around the bench in the prairie viewing area; and relocation of the boardwalk. Mr.
Milbrandt said people from Boutwells Landing are interested in assisting with the
development of the park. Ms. Amrein asked about wheelchair accessibility. Ms. Buss
responded that portions are accessible, but other areas are relatively steep for wheelchair
access.
Ms. Buss briefly reviewed the draft Brown's Creek management plan, maintenance
calendar and staffing memo included in the agenda packet. Ms. Amrein asked if City
Forester Kathy Widin had the opportunity to review the plan; Ms. Buss said that was a
good suggestion. Mr. Milbrandt said he liked the format of the materials. Mr. Brandt
questioned the staffing estimates. Ms. Buss said the estimates for new staff are based on
full development of the parks/trails. Mr. Brandt noted that Washington County only has
five full-time parks staff; Mr. Milbrandt pointed out that the County utilizes a lot of part-
time parks personnel, and he said staffing is an issue that the Council will deal with. Mr.
Brandt said it would be helpful to see the number of miles of new trails versus existing
trails.
Ms. Buss said the last piece of the project is developing signage and/or a brochure. Ms.
Amrein noted that the Zephyr depot was shown in the wrong location on the attached
map; Ms. Amrein also noted there were several typos in the draft materials.

Mr. Russell asked that the Board take official action on the final Boutwell Cemetery Plan.
Ms. Snellman, seconded by Ms. Amrein, moved to adopt the final plan as presented.
Motion passed unanimously.
Skateboard park regulations: Mr. Russell said there is a concern about requiring the use
of headgear and pads and not enforcing the requirement. Copies of several cities' skate
park regulations were included in the packet. Mr. Brandt said he favored Eden Prairie's
policy, which states the use of headgear and pads is "strongly recommended." Mr.
Milbrandt said the major concern is removing the language that use of such gear is
required: and then not enforcing the policy. It was the Board's consensus that the City
should adopt a policy similar to Eden Prairie's.
There was a brief discussion about allowing bikes to use the facility. Mr. Russell said
some cities prohibit bikes because the components are not as sturdy as Stillwater's.
Stillwater's facility is of a type of surface where bikes can be allowed. He said users are
encouraged to share the space. Mr. Milbrandt said police will be patrolling the area once
per shift; he said there had been no complaint calls to date. Mr. Russell said he had
received a request to use the park for a demonstration by a professional skateboarder on
Oct. 8; it was the Board's consensus the demonstration should be allowed.
Settler's Glen park planting: Mr. Russell said he had talked with K1ayton Eckles about
planting alternatives. He said Mr. Eckles indicated there is a native grass that could be
used that is not as tall as the prairie grass type initially proposed. Ms. Snellman said she
had walked the area in question and said the houses are so close that there is a need to
differentiate the area from the yards. It was the Board's consensus to use a natural prairie
grass mix of the shorter variety.
Millbrook park update: Mr. Russell said staff had met with developers to discuss park
issues on several occasions. He said the City is being persistent in adhering to the
required 10 percent park dedication requirement.
Public Works basketball court update: Mr. Russell reported the court should be
completed by the end of October. Ms. Amrein asked how to publicize the court
availability. The City newsletter was mentioned as a possible vehicle for publicity.
Other items:
Ms. Amrein asked about the status of Schulenberg Park. Mr. Russell said the play
equipment had been selected. Ms. Amrein suggested looking into utilizing volunteers to
help with the maintenance of neighborhood parks.
Mr. Brandt brought up the issue of the trail from the Highlands area to Lily Lake School.
The trail is overgrown, and he questioned whether the City or School District is
responsible for maintenance. Mr. Russell said maintenance is the City or developer's
responsibility and said he would check into the matter.
Mr. Milbrandt reported the City had received a request to create an ice rink in the
downtown area in conjunction with the Victorian Christmas celebration. He said the City
has agreed to create an oval rink in the City's gravel parking lot area, but will not
maintain the rink after the first of the year.
Ms. Snellman, seconded by Mr. Brandt, moved to adjourn at 8:12 p.m. Motion passed
unanimously.

PARKS AND RECREATION
The community development director must cause
to be prepared an agenda for each commission
meeting and must submit the agenda to the
commission in a timely manner. The community
development director shall attend meetings as
may be required by the commission,
The community development director may as-
sign a qualified member of the community devel-
opment department to assist in carrying out the
duties and responsibilities required by this sec-
tion.
(2) The public works director is responsible
for the maintenance of park and recre-
ation facilities. The public works director
must cooperate with the community de-
velopment director in the development of
plans for park and recreation facilities
and coordinate and administer all phases
of park and recreation implementation.
The public works director must attend
meetings as may be required by the com-
mission and keep the commission in-
formed on park and recreation facility
maintenance programs and budgetary
needs.
The public works director may assign a quali-
fied member of the public works department to
assist in carrying out the duties and responsibil-
ities required by this section.

Sec. 48.2. Use of parks.
Subd. 1. Definitions. The following words, terms
and phrases, when used in this section, shall have
the meanings ascribed to them in this subdivi-
sion, except where the context clearly indicates a
different meaning:
Public parks or park means real property owned
by the city devoted to recreational use.
Subd. 2, Defacing or destroying property. No
person may deface, destroy, diminish or impair
the value of public or private property located

within any public park in the city including
buildings or structures, or trees, shrubs or vege-
tation.
Subd. 3, Parking and driving of vehicles. No
person may drive a motorized vehicle in a public
park other than on public roads within the park.
No person may park a motorized vehicle in a
public park in an area not specifically posted with
signs permitting parking of motorized vehicles
nor in an area posted with signs prohibiting
parking,
Subd, 4. Speed of vehicles, No person may
drive or operate a motorized vehicle at a speed in
excess of 15 mph in any park unless legally signed
for a higher speed.
Subd. 5, Open fires. No person may build a fire
in any place in any park except in fireplaces or
receptacles pr9vided for the building of fires or in
an area specifically posted with signs permitting
the building of an open fire.
Subd. 6. Swimming or wading in certain ar-
eas. No person may wade or swim in an area in
which signs have been posted prohibiting swim-
ming or wading. In all areas wherein swimming
and wading is permitted, the city council has the
authority by resolution to prohibit the use of
equipment dangerous to persons swimming or
wading and to prohibit activities or conduct as
dangerous or hazardous.

Sec. 48.3. Regulating Use of Lily Lake,
McKusick Lake and Lily Lake
Park.
Subd, 1. Definitions. The following words, terms
and phrases, when used in this section, shall have
the meanings ascribed to them in this subdivi-
sion, except where the context clearly indicates a
different meaning:
Alcoholic beverage means intoxicating liquor,
as defined in the state statutes.
Beach premises means that part of Lily Lake
Park described as follows: That area bounded on
the south by the arena-beach house building;
bounded on the west and the east by chainlink

the south by the arena-beach house building;
bounded on the west and the east by chainlink
fences running north and south to the water's
edge and continuing into the water of Lily Lake
by strings of white floating logs; bounded on the
north by a string of white painted floating logs
running east and west.
Flotation devices means any air inflated,
styrofoam or other buoyant devices including, but
not limited to, inner tubes and air mattresses,
other than a U.S. Coast Guard approved life, buoy
or life jacket, when properly worn.
Lily Lake Park means that property owned by
the city used as a public park and abutting on Lily
Lake described as follows: Lots 14 and 15, block
20, Holcombe's Second Addition to the city, accord-
ing to the plat thereof on file and of record in the
office of the Register of Deeds in and for Wash-
ington County, Minnesota. Also all that part of the
SWl/4 of the NWl/4 of Section 33, 'Ibwnship 30,
Range 20 described as follows: Beginning at a
point where the south line of lot 14, block 20,
Holcombe's Second Addition to where the city
intersects with the westerly line of South Greeley
Street; thence south along the westerly line of
South Greeley Street 195.2 feet to an iron pipe;
thence continuing southerly along the westerly
line of South Greeley Street 155.4 feet to an iron
pipe; thence continuing southerly along the west-
erly line of South Greeley Street 284.0 feet to an
iron pipe; thence deflecting to the right 122 de-
grees 1 minute 692.1 feet to an iron pipe on the
west line of such SWl/4 of the NWl/4; thence north
along such west line to the NWl/4 of such SWl/4 of
the NWl/ 4; thence east along the north line of such
SWl/4 of the NWl/4, being also the south line oflot
15, block 20, Holcombe's Second Addition, to the
point of beginning. And also all that part of the

Power-operated watercraft means any water-
craft, including seaplanes when not airborne,
which is propelled by any means other than sail,
oars, paddles; poles, foot-operated paddle wheels
or electric trolling motors.

Subd. 2. Power-operated watercraft. No person
may operate a power-operated watercraft on Lily
Lake or McKusick Lake at any time.

Subd. 3. Flotation devices. No person may en-
ter the waters of Lily Lake Park with a flotation
device or use the device within the beach prem-
ises for other than emergency purposes.
Subd. 4. Entry to Lily Lake. No person may
enter the waters on Lily Lake from the shoreline
of Lily Lake Park as previously described in this
section except at places designated by signs con-
structed and erected as follows: A metal sign plat,
stating either "boat launching" or "swimming
area" and erected on standard channel steel sign-
posts.
Subd. 5. Alcoholic beverages. No person may
conveyor consume any alcoholic beverages upon
the beach premises.
Subd. 6. Hours of use of beach premises. No
person may be present upon the beach premises
or use beach equipment during hours when the
beach premises are not supervised by lifeguards
or instructors employed for that purpose by the
city or other authorized agency.
Subd.7. Penalty. Any person who violates any
provision of this section is guilty of a misde-
meanor.

Sec. 48-4. Consumption and possession of

Subd. 1. Prohibited generally. No person may
consume upon, introduce upon, or have in his
possession upon the public park known as Pio-
neer Park and located upon Block 8 of the Origi-
nal Town (now City) of Stillwater, any intoxicat-
ing liquor or 3.2 percent malt liquor, as defined in
Minn. Stat. ch. 340A.
Subd. 2, Exemption by city council. The city
council may upon its own motion or upon appli-
cation waive prohibitions of subdivision 1 of this
section for specific occasions, groups or individu-
als.

Sec. 48-5. Consumption and possession of

and Washington Park; establish-
ing curfew in parks within city.
Subd. 1. Prohibited generally, No person may
consume upon, introduce upon or have in his
possession upon the public park, known as Lowell
Park or the public park, known as Washington
Park, any intoxicating liquor or 3.2 percent malt
liquor, as defined in Minn. Stat. ch. 340A.
Subd.2. Prohibited hours for certain acts. It is
unlawful for any person to be present in or upon
the public parks within the city between the
hours of 10:00 p.m. and 6:00 a.m. when that
person does loiter or make undue noise by shout-
ing or yelling, or when that person otherwise
disturbs the peace and quiet of the city.
Subd. 3. Exemptions by city council. The city
council may, upon its own motion or upon appli-
cation, waive prohibition of subdivisions 1 and 2
of this section for specific occasions, group or
individuals, upon reasonable assurances that the
safety and welfare of the public and the peace and
quiet of the city will be protected.

Subd. 13. Other governmental agency permits.
AB a condition precedent to the filing of an appli-
cation for a dock permit under this section, the
applicant must have obtained all other permits
that are required by any other governmental
agency having appropriate jurisdiction, including
the state department of natural resources and the
U.S. Army Corps of Engineers.
Subd. 14. Adoption of state law provisions re-
garding watercraft operation. Minn. Stat. ~~
86B.311-86B.461 regarding the operationofwa-
tercraft are hereQY adopted by reference. Every
provision contained therein is hereby adopted and
made a part of this section.
Subd. 15. Penalties. Violation of any provision
of this section is a misdemeanor. However this
section does not preclude civil actions if directed
by the city council.

Sec. 4~7,~ Use and operation of watercrai't )
. on Long Lake. . ~
Subd. 1. Application. This section applies to the
waters of Long Lake, located in sections 30 and
31, township 30 north, range 20 west, in the city.
Subd. 2. Definitions. Terms used in this section
related to boating are defined in Minn. Stat. ~
86B.005.
Subd. 3. Horsepower limit. With the exception
of pontoon boats, watercraft used on Long Lake
may not be powered by motors exceeding ten
horsepower. Pontoon boats may not be powered by
motors exceeding 25 horsepower.
Subd. 4. Enforcement. Primary enforcement of
this section shall rest with the county sheriffs
department and the city police department. This,
however, shall not preclude enforcement by other
licensed peace officers.
Subd. 5. Exemptions. All authorized resource
management, emergency and enforcement person-
nel, when acting in the performance of their
assigned duties, are exempt from the provisions of
this section.

Subd. 6. Public notification. It shall be the
responsibility of the city to provide for adequate
notification of the public, including the placement
of any necessary buoys or signs.
Subd. 7. Penalties. Any person who violates
any of the provisions of this section is guilty of a
misdemeanor and may be fined by a fine of not
more than $700.00 or by imprisonment of not
more than 90 days, or both.

Re: Resolution Requesting Limitations on
Motorized Watercraft on South Twin Lake

Dear Mr. Russell:
On May 12, 2005, the Stillwater Town Board adopted a resolution requesting that the City of
Stillwater and the Minnesota Department of Natural Resources limit the usage of South Twin
Lake to non-motorized watercraft. The Board understands the resource limitations of the lake
including its small size, shallow depth, and muddy bottom and would not lend itself to motorized
use. In addition, with the impending U.S. Homes development to the west of South Twin Lake,
there could be increased pressure to use the lake for recreation. For these reasons, the Town
Board would strongly urge the City to limit the usage of the lake to non-motorized watercraft
such as canoes, kayaks, small sailboats, and paddleboats propelled by human power.

RESOLUTION NO.
RESOLUTION REGARDING NON~MOTORIZED BOA T8 AND ACCESS TO
SOUTH TWIN LAKE
STILLWATER TOWNSHIP, MINNESOTA
WHEREAS, South Twin Lake is currently entirely within Stillwater Township; and
WHEREAS, South Twin Lake is a Natural Environment Lake, as detennined by the
criteria found in Minnesota Regulations, Part 6120.3300 and the Protected Waters
Inventory Map for Washington County, Minnesota; and
WHEREAS, natural environment lakes are generally small, often shallow lakes with
limited capacities for assimilating the impacts of development and recreational use; and
WHEREAS, South Twin Lake is a small, shallow lake with limited area for use of
motorized watercraft; and
WHEREAS, intensive private, residential development is planned for the west and south
sides of the lake; .
NOW, THEREFORE, BE IT RESOLVED, that Stillwater Township, in consideration of
the abovementioned facts, hereby requests the City of Stillwater and the Minnesota
Department of NaturaJ Resources (DNR) to take appropriate actions to limit the usage of
South Twin Lake to non-motorized watercraft to include canoes, kayaks, small sailboats
(under 20 feet) and paddleboats propelled by human power; and

Stillwater Skate Park
FACILITY IS OPEN FROM 8:00 AM to Sunset
NO TRESPASSING: Sunset to 8:00 am
. Experienced and inexperienced skateboarders, in-line skaters and BMX bikers use this facility.
. This area has been designed to provide users with a moderate challenge for recreation
purposes and to help develop their skills. It is not possible to design and build a facility of this
nature without hard surfaces; the same hard surfaces that challenge the user pose significant
risk of injury if the user falls.
WARNING!
. This facility is unsupervised; users assume all risks inherent in the use of this facility. Use may
result in serious injury and/or death.
. Skate with safety in mind and remember weather conditions may create unsafe surfaces for
users.
SAFETY EQUIPMENT
. It is strongly recommended that all skateboarders, skaters, and bikers wear: Protective
helmets, Elbow pads, Knee Pads and Wrist Pads.
. All parents should require their children to wear this protective equipment while using this
facility. Failure to wear protective equipment will expose users to serious injury and/or death
upon falling or collision with other users.
RULES
. Skateboards, in-line skates, bicycles and scooters are permitted.
. No glass containers, food or beverage allowed on the skating surfaces. Spills jeopardize the
skaters.
. No other items such as benches, tables, wood materials, or other objects used as ramps or
jumps are allowed in the skate park facility.
. No drugs, alcohol or tobacco products will be permitted in this facility.
. No loud music or disorderly behavior will be permitted at this facility.
. No pets are allowed in the skate park area.
. Do not proceed down a ramp until clear of other skaters.
. No littering. Please use trash cans.
. Spectators are welcome but must stay clear of ramps and apparatus.
SERIOUS INJURY
. In case of serious injury or other emergencies call 911.
MAINTAINING THE FACILITY
. Please report maintenance concems to the Parks & Recreation Department at 651-275-4102.
Messages may be left 24 hours per day.
STILLWATER PARKS DEPARTMENT RESERVES THE RIGHT TO:
. Close the facility for any circumstances deemed necessary.
. Restrict entry to the facility and to ask persons to leave the facility if any rules are not followed,
or if unsafe or inappropriate behavior is observed.
