The City of Stillwater Parks and Recreation Board will meet on Monday, January 22,
2007, at 7 p.m. in the Council Chambers of Stillwater City Hall, 216 North Fourth Street.

Ms, Amrein called the meeting to order at 7:04 p.m.
Approval of minutes: Mr. Milbrandt, seconded by Ms. Snellman, moved approval of the
minutes of Nov. 27, 2006, as submitted. Motion passed unanimously.
Action Items
Discussion of Peace Pole in Lowell or Pioneer Park (continued from the November
meeting) - Mr. Pogge noted that a similar request had been made to the Park Board and
City Council in 2002. In 2002, the Council and Park Board denied the request due to a
concern about the possible setting of precedence in granting the request. Mr. Pogge
noted that in 2002, it was suggested that the Board/City look at setting a policy regarding
the placement of monuments on Park/City property; no such policy was ever formulated,
he noted. Mr. Pogge said he was not able to find any communities in Minnesota that
have such policies; however, the city of Holland, MI, does have a policy regulating the
placement of monuments and symbolic structures, which was included in the agenda
packet.
Ms. Amrein noted that the Veterans Memorial is placed on City property and there was
no objection to that. Mr. Milbrandt pointed out that the requested peace pole could be
construed as a political statement - an anti-war statement -- and said he would not want
to go down "that slippery slope" and approve the placement of what might be construed
as a political statement in a park. Mr. Brandt agreed that it is not the City's function to
promote a particular stance or message. Regarding the Veterans Memorial, Mr.
Milbrandt noted there is precedent for honoring veterans on government property.
However, he said he would not favor a request from a special interest group, no matter
how good or bad the message the group is seeking to promote. Mr. Brandt asked how a
request from a special interest group to dedicate a park bench might be handled; Ms.
Amrein said she thought there was a policy in place for bench dedications.
Mr. Milbrandt, seconded by Mr. Brandt, moved to deny the request from a special
interest group for the placement of a monument on public property. Motion passed
unanimously.
Informational Items
Pioneer Park Master Plan - Ms, Amrein said she had raised this issue as a point of
information. She said she knew a master plan had been prepared and the first phase
completed and wondered about the status of the remainder of the work. Mr. Pogge
noted that no more funds have been budgeted for the plan implementation. Mr. Milbrandt

suggested that if the Board thinks completion of the Pioneer Park plan is more important
than other park projects, the Board should bring that up next spring when the City looks
at the CIP. Mr. Pogge suggested that it would be good for the Board to inventory parks
again in order to assist the Board in setting its priorities.
Possible multi-agency purchase of the Minnesota Zephyr - Mr. pogge briefly updated
the Board on the possible purchase of the Zephyr to connect the Gateway Trail to
downtown Stillwater. Mr. Pogge called the possible acquisition an exciting possibility for
the City. Mr. Brandt said he had heard lots of positive comments about the proposal. Mr.
Milbrandt noted that the Council's reaction has been one of support, but with no funding.
Mr, Milbrandt said the City might be willing to provide some trail amenities, but would
look to the State or County to take the lead in the acquisition.
The meeting was adjourned at 7:33 p.m.

Review and recommend playground equipment for Munklewicz Park

DISCUSSION
Attached are two proposals for playground equipment at Munklewicz Park. Currently there is
$75,000 budgeted for the equipment. In the park there is two areas for the playground
equipment. The first area is designed for children ages 2-5 and the second area is designed for
children ages 5-12.
The first proposal uses equipment from Kompan and is based the same equipment shown in the
plans developed by Bonestroo. The estimated cost for this equipment is $102,855.94 installed.
The second proposal uses equipment from Playcraft. The City has been exclusively installing
Playcraft equipment in our parks for the past several years. The estimated cost for this
equipment is $47,999.56 installed.
Staff has been happy with the performance of the Playcraft line. Maintenance has been very
minimal and replacement parts are readily available through the manufacture. Staff believes
that the City should continue to use the Playcraft line of equipment.
At the meeting staff will also review the various color choices with the board.
Once the style of equipment is selected staff will go out for competitive bid to select a vendor.
STAFF RECOMMENDATION
Review the proposals and make a recommendation to the City Council.

Green
Gym 2 consists of two sections connected by a
net. The first larger section with the curved slide
includes a transfer station that moves up gently,
taking the child to the slide and net via a transfer
point and easy elevation changes, The space in
the tower allows for activities of several
playgroups. The net of the Gym 2 challenges the
child to cross from tower to tower by climbing in
the changing patterns of the net strands, or to
approach the net from ground level. The large
size of this net also encourages social play, since
there is enough room for children to sit in the
strands and "perch ", to see and be seen. The
second smaller section of the structure contains a
double slide and a challenging rock climb.

Dorado. GXY 924
The Dorado offers challenge at every angle. With twirlers at the end,
the Dorado creates quite a buzz in a small package. Ropes in the center
stabile extend upward in every direction with various supports along the
way. The Spinner with the curved bar makes two kids work together to
reach an optimal spin or one child can go solo for the ride of their life.
The other Spinner can send up to 2 kids on a fast orbit or a peaceful rotation
depending on how well they can handle the spin. The standing bar at the
bottom ensures a safe standing position on both the inside and outside.

BACKGROUND
Bob Clark of Lynskey & Clark (and MBM Development) has submitted a preliminary plan for a
twinhome development referred to as Fairway Villas of Stillwater. The property is currently
owned by Mary Ann Sandeen and is located at the far west end of Hazel Street next to the
Stillwater Country Club.
The proposal is to develop a 24 twinhome enclave within a well landscaped setting. The enclave
would include two outlots that combine stormwater treatment with private pedestrian trails and
other amenities.
In order to develop the property as proposed, the applicant has requested the following:
1. Rezoning of the property from RA, Single Family Residential to RB, Two Family
Residential
2. Approval of a Comprehensive Plan future land use map amendment changing the
guided use of the property from SFLL, Single Family Large Lot to SFSL, Single Family
Small Lot.
3. Approval of a Preliminary Plat for 24 twinhomes (12 buildings; 2 units each)
4. Approval of a Variance to allow the cul-de-sac to have a length of 690 feet, whereas 600
feet is the standard maximum length.

SPECIFIC REQUEST
The specific request of the Park & Recreation Board is to review the preliminary plat
proposal against the public park and trail standards of the City's Subdivision Ordinance.
ANALYSIS
The Comprehensive Plan's park element shows no planned park on the site, nor does it
show trails through the site.
PARKLAND - The Schulenberg School Park is located about 1,800 feet (the length of about
3 City blocks) from the subject property. Given the close proximity of the park, the
master park plan does not show the need for another park in the immediate area.
Consequently, a cash dedication in lieu of a land dedication may be appropriate for this
subdivision.
TRAILS - The master trail and park plan show trail segments in the immediate vicinity of
the property. One potential future trail segment follows the Minnesota Zephyr railroad
immediately north of the property. The other is a potential trail that generally follows
Poplar Street from 2nd Street along the Stillwater Country Club golf course to the Brown's
Creek bluffline. This trail segment never traverses the steep slopes of Brown's Creek,
rather it follows the upland side of the bluff to the Stonebridge Trail bridge, where it
would join the existing trail along the county road.
Typically the City would consider requiring an easement for one or both of the future
trail segments. However, in this instance, there are sound reasons not to require the
easements. They include:
. Railroad segment - If a trail is developed along the railroad tracks, the tracks
would have to be removed and the current railroad bed would have to serve as
the trail alignment. The other option would be for a trail to be built parallel to the
Minnesota Zephyr railroad tracks. This option would require additional
easement. However, the DNR has estimated that a parallel trail would cost in
excess of $15 million to construct. This is so expensive as not to be a reasonable
option. As a practical matter, either the whole railroad line would have to be
purchased for trail purposes or the trail would have to be located elsewhere, for
example along Highway 96. In either case, no additional easement would be
needed from the subject property.
. Golf course segment - As seen in the attached graphics, the future golf course
trail is shown to lie on the Stillwater Country Club property along the proposed
development site. But due to concerns with the alignment of this potential future
trail, staff is not certain it will ever be built. Those flaws include:
o Given the way the 13th hole is played, it does not seem likely that a trail can
be built without sending users of the trail between the men's or women's

tees and the green. Trail users would be right in the flight path of drives.
(See attached trail alignment detail.)
o A trail could not be squeezed between the men's 13th tee and the proposed
development site because there would be no outlet for the trail without
traversing the very steep slopes down to the railroad.
o Even if there were some way to avoid the trail problems at the 13th hole, the
remainder of the trail would be located on the bluffline directly parallel to a
fairway (the 14th?). A few members of the Stillwater Country Club have
said that there are any number of errant shots that send golf balls over this
bluffline. Probably not where we would choose to locate a public trail.
Therefore, the City's option to require a $500 trail fee per lot in lieu of trail
dedication or construction may be appropriate.
IMPROVEMENTS ON CITY PROPERTY - A portion of the entrance road into the development
site is shown on City property. This can be seen in the attached grading plan. The area
of encroachment can be seen higWighted in yellow. The proposed developer
improvements on the City property include: about 720 square feet of road surface, a
sidewalk, an 80 foot long segment of retaining wall (an average of about 3 feet high) and
grading.
The City acquired this property through tax forfeiture and therefore has
limitations on how it can use the land. Forfeiture law allows the City to use it only for
park, open space or road improvements. The City currently uses the land as open space
but has in the past used it for nursery stock used in City parks and City improvement
projects.
Neither the Comprehensive Plan's park element nor the master trail plan show a
proposed use for the tax forfeit parcel.
Since one of the permitted uses of the property is park land, the Park Board
should at least consider whether the placement of the proposed developer improvements
would preclude potential park use of the property in the future.
ALTERNATIVES
The Parks & Recreation Board has several options:
1. Recommend that the City Council require cash in lieu of park dedication and
trail dedication. Also, recommend that the City Council approve use of the
City's abutting open space property for street improvements.
2. Recommend that the City Council require cash in lieu of park dedication and
trail dedication. But, recommend that the City Council not approve use of the
City's abutting open space property for street improvements.
3. Table the request for the developer to provide public park or trail dedication
within the project.

RECOMMENDATION
Since the comprehensive plan and the master park and trail plan show neither park nor
trail improvements on the property, and the trail segments that abut the site will in all
likelihood not require easements from this property, staff recommends cash in lieu of
dedication to satisfy park dedication requirements.

DISCUSSION
As the board is aware the City has had a number of discussions related to the trail alignment
along Brown's Creek in the proposed Brown's Creek Reserve development. Since the Browns
Creek Watershed District rules prohibit impervious trails in the creek's buffer area the trail plan
with the preliminary plat called for the trail to run in an easement in the rear yard of lots 9-15.
In order to get the trail further from the homes and closer to the creek the developer has been
reviewing alternatives. Recently the developer discussed the possibility of using pervious
asphalt for the trail with the watershed district. After reviewing the proposal the watershed
district has agreed to allow the use of pervious asphalt for the trail within the creek's buffer
area. The attached plan shows the new proposed location of the trail and depicts which section
will be pervious and impervious.
Since this is a new product there is not enough information related to the service life of a
pervious trail. Attached is a memo from Shown Sander concerning the proposed use of
pervious asphalt for the trail.
Cash in Lieu - In addition to the open space shown on the plat the developer is planning to
provide the full amount of cash in lieu of parkland dedication for this plat which amounts to a
total of $30,000.00.

Subject: Pervious Trail System for Browns Creek Reserve Development
The proposed plan shows approximately 800 feet of pervious trail to be installed as part
ofthe project. This is different from the proposed plan submitted as part ofthe
preliminary plat where no pervious trail was shown. The trail has been relocated west
into the wetland buffer area, where impervious trails are not allowed according to the
Browns Creek Watershed District Rules. The city will be installing 300 feet of pervious
trail in the wetland buffer area of Munklewicz Park. Installation of this type of trail is
new to the city and should be considered a "trial or experiment". Consideration of future
trails should be installed with caution until more information is available including the
following:
1. If a pervious trail is to be installed, the City will be responsible for the overall
maintenance of the trail, including replacement. Since it is an pervious trail,
maintenance such as crack sealing, and pot holes will be treated differently. Cost
is unknown
2. Pervious pavement is a newer product for the northern climate and there is not
enough information on service life.
3. Seal coating pervious trails would not be allowed since it would fill the voids in
the pervious pavement, making the purpose of the pavement ineffective.
4. If the trail requires to be swept, a vacuum sweeper is recommended, the City does
not have this type of equipment at this time.

Selection of Comprehensive Plan consultant

Message: The City Council will be considering several consulting firms to assist the
City with its 2008 Comprehensive Plan and Downtown Plan update. On February 6, 2007 at its
4:30 pm work session two firms will make proposal presentations to the Council. One proposal
will be presented by Hoisington Koegler Group and the other by Bonestroo, Rosene & Anderlik.
The City Council would like one member from each of its commissions to help them assess the
proposals. Therefore, the Park Board should select one of its members for the task.
