This event is in preparation for National Fire Prevention Week, October 6-12, 2002, and to thank all department staff for their contributions over the past year. CITY OF STILLWATER CITY COUNCIL MEETING NO 02-20 September 17, 2002 SPECIAL MEETING 4:30 P.M. The meeting was called to order by Mayor Kimble. Present: Councilmember Bealka, Milbrandt, Rheinberger, Zoller and Mayor Kimble Absent: None Also present: City Administrator Hansen City Attorney Magnuson Public Works Director Eckles Police Chief Dauffenbach Community Development Director Russell Director of Administration Knauss City Clerk Ward Press: Julie Kink, Courier Laura Brinkoetter, Gazette OTHER BUSINESS Territorial Prison Project Community Development Director Russell explained that staff thought it would be appropriate for the developers of the Territorial Prison Site to meet with Council and possibly reaffirm mutual commitment to developing the site following the destruction of the prison by the recent fire. Brian Sweeney, representing Territorial Place, LLC, introduced the development team: Robert Engstrom, Jack Buxell, and R. Michael Buelow. He stated that the team is still committed to the project and that approximately 75% of the work and studies that have been done can be applied to the new project. Robert Engstrom stated that the team agrees the fabric of the project is still there, although most of the construction will now be new. He believes a portion of the warehouse building can be saved. Because of the loss of historic tax credits it will be necessary to have most units for sale rather than rental. Jack Buxell stated that the site plan would remain very similar to the original. He introduced Ann Ketz of the 106 Group who did the archaeological studies. She informed Council of some of the findings at the site, and stated that the fire did not destroy the archaeological site. Michael Buelow also reaffirmed the team's enthusiasm for the project and their commitment to going forward with project. Page 1 of 11 City Council Meeting No. 02-20 September 17, 2002 Mr. Sweeney stated that the site plan would have to be redrawn and brought back to Council for approval. They hope to be able to begin construction next spring. . Council expressed their general willingness to continue with the current development team for development of the site. Mayor Kimble praised and thanked the Fire Department, Police Department, Public Works, and Water Department for their efforts during and after the fire. PETITIONS, INDIVIDUALS, DELEGATIONS & COMMENDATIONS Proclamation - Constitution Week - September 17-23, 2002 Mayor Kimble read a proclamation proclaiming September 17-23, 2002 as Constitution Week. Motion by Councilmember Rheinberger, seconded by Councilmember Zoller to affirm the proclamation proclaiming September 17-23, 2002 as Constitution Week. All in favor. . Page 2 of 11 City Council Meeting No. 02-20 September 17, 2002 . OPEN FORUM David "Choc" Junker, 101 North 4th St., asked if the public works building will be completed before winter. City Engineer Eckles responded that the contractor has targeted November 1 as completion date and November 15 as move in date. Mr. Junker asked about cost overruns and Mr. Eckles stated that the project is approximately 2% over budget. Mr. Junker asked if the Police Department will take over the pay parking lots downtown. Mayor Kimble stated that it is under consideration in the budget process. Ron Anderson, 216 W. Orleans, asked for copies of all the bills paid to contractors for the public works building. Mayor Kimble stated that he can obtain those from City Hall during regular business hours. He asked what the dollar figure is for the cost overruns. Mr. Eckles stated that it is about $100,000. STAFF REPORTS There were no staff reports at this time. CONSENT AGENDA . Motion by Councilmember Bealka, seconded by Councilmember Rheinberger to approve the Consent Agenda. All in favor. Resolution 2002-209 directing payment of bills. Approve purchase of thermal imaging camera for the Fire Dept. from "Friends of Fire" account. Approval of 2002 Capital Budget Reallocation - Library. Resolution 2002-210, authorizing acceptance of grant agreement with Minnesota Department of Public Safety for underage compliance check/alternate enforcement grant for 2002-2003. Approval of Gambling Permit for Church of St. Michael - November 9, 2002. PUBLIC HEARINGS . Proposal recommended by the Charter Commission to chanqe the City Charter by Ordinance. Mayor Kimble opened the public hearing. Page 3 of 11 City Council Meeting No. 02-20 September 17, 2002 Jim O'Brien, 509 S. Greeley, current president of the Stillwater Water Board, stated that the Water Board represents a cost-effective organization which has provided the City with the best water since 1870. He provided a history of the Water Department, and urged the Council to vote against the merger. . Jim McKnight, 2231 Pinehurst Lane, current manager of the Water Department, stated that he disagrees with some of the cost savings that the auditors reported, specifically the future hires that have not been approved yet. He does not feel there will be a cost savings to the City, but in the long run it will be a cost increase. He does not see a public benefit in the merger. Vern Jacobson, consulting engineer with TKDA, currently working for the Board of Water Commissioners in Stillwater, questioned why, with a 91-year record of outstanding service in Stillwater, would the City want to make a change. He stated the Board has adequate monetary reserves, water supply facilities that are adequate to supply the customers, water quality that meets or exceeds the standards, and employees that are interested and responsive to their customers. Richard Kilty, 118 W. Oak Street, stated that the Larson Allen report used figures from Mr. Eckles' testimony to the Charter Commission rather than doing an independent study. He asked that the City Council vote against the second reading of the ordinance. Wayne Anderson, 713 N. 5th St., current Chair of the Charter Commission. He . stated that the Charter Commission did formally vote unanimously to recommend combining the Water Boardwith the City, after a year of studying the issue. He emphasized that by law water rates cannot be used to subsidize anything else; therefore, it would not generate revenue for the City. The Charter Commission is convinced that there are actual cost savings and recommended that the Council approve the ordinance. David C. Junker, 101 N. 4th St., asked that the Council use common sense and vote against the merger. Vicki Bergstedt Cross, 1029 McKusick Road Lane N., stated that she has had years of experience dealing with the Water Department and the employees are very efficient. She feels the Water Department should be left alone. Bob Thompson, 917 N. Owens St., stated this issue has come before the City before. He feels the costs will outweigh the savings and the Water Department should be left alone. John Jewell, not a current resident of the City, stated that the Water Department employees make approximately $1 per hour more than comparable workers in the Street Department. He stated that the Public Works Department employees will want to be paid the same as the Water Department, which will cause an increase in costs to the City. . Orleans, a former employee of the Water Department asked Councilmember Milbrandt about misstatements in the newspaper. Mr. Milbrandt stated he had been misinformed. Mr. Anderson stated that this issue is about raising water rates and increasing revenue for the City. He gave examples of cost savings that would be lost ifthe City took over the Water Department. He said the Water Department is the most efficient operation he has seen and they take pride in their work. Ron and Eloise Zaniewski, 1112 W. Linden, spoke against the merger. Mrs. Zaniewski stated that she worked for a short time'for the Wat~r Department and is afraid of losing the personal touch that there is currently. Edward Simonet Jr., 904 S. 2ndSt., said he does not believe. the figures regarding overtime cost savings. Dan Fabian, 326 S. 6th St., agrees with the opposition to the merger. He believes it will be a roundabout way of raising more funds. Duane Nelson, 822 S. 2nd St., agrees with the opposition to the merger and urged the Council to vote no. Lawrence Maslowski, Sr., 924 W. Willard St.,asked aboutthe costs ofcross~ . training water department and public works department employees. . Pat Johnson, 611 Lake Drive, recommended that the Cityvote downthe ordinance. Richard McDonough, not a resident of the City, asked if the Charter Commission had considered analyzing the Public Works Department to see if it could be run in the same manner as the Water Department. Gary Kriesel, 1451 Lydia Circle, member of the Charter Commission, explained that this issue has been before the Charter Commission previously, and this time the Commission decided to do a thorough study of the issue. He noted that the Water Department has already voted to increase the water rates January. 1 and also recommended hiring another person. He asked that the Council's decision be based on fact and not on emotion. Mr. Kries!31 asked Mr. McKnight if the r?te increase and hiring decision was true. Mr. McKnight stated that the board is considering it in the budget. Richard Kilty, 118 W. Oak St., stated there is no written re'cord that the.Charter Commission ever voted to send this matter to the City Council or that there is no written record that the Water Board is going to hire another person. . Barbara Arney, 2240 Orwell Ct. N., stated,that ground ~ater is the nU[T)b~r one issue in Washington. County. With the Water Board there is a built in checks and balances system. ' Page 5 of 11 " City Council Meeting No. 02-20 September 17, 2002 Jim McKinney, 410 W. Rice, is concerned about taking clean water for granted. The Water Department's only concern is supplying clean water, and this is the . wrong time to take away control. Jim Tibbetts, 502 Hemlock St., current employee of the Water Department. He stated he spends about 80% of his time in the summer maintaining the Water Department properties, and wondered who would take care of the properties if the department was merged into the City. Ernest Peasley, 1017 W. Abbott, asked that the Council not interfere with the Water Department. Tom Lindell, 673 Sunrise, has not heard that there is anything wrong with the Water Department, and all the cost savings figures are speculative. He would recommend that the Council vote no. There being no additional comments, Mayor Kimble closed the Public Hearing, and turned the matter over to the City Council. Councilmember Rheinberger stated he feels the matter should go to referendum. City Attorney Magnuson clarified that if the Council does not pass the issue tonight the matter will automatically go to referendum. Since the issue has missed the deadline for the general election ballot in November, there has to be a separate special election called. . Motion by Council member Rheinberger to approve Ordinance No. 928 proposing to change the City Charter by Ordinance to merge the Water Board and the City Public Works Department, seconded by Council member Milbrandt. (Motion failed 1-4) Ayes - Councilmember Milbrandt Nays - Councilmembers Bealka, Rheinberger, Zoller, and Mayor Kimble City Attorney Magnuson explained an issue of two conflicting State Statutes, Mr. Magnuson will do further research regarding the date for the referendum. Mayor Kimble recessed the meeting at 8:35 p.m. Council member Bealka left meeting at 8:35 p.m. Mayor Kimble reconvened the meeting at 8:45 p.m. . Discussion of alternative land use and circulation patterns for the Boutwell South Planninq Area. Community Development Director Russell explained the background of the plan. Sherri Buss from Bonestroo Rosene Anderlik & Associates, the consultant on the project, reviewed the plan. The study looked at current and future traffic patterns, storm water runoff, drainage and trails. Page 6 of 11 . . . . City Council Meeting No. 02-20 September 17, 2002 Mayor Kimble opened the public hearing. Tom Crotty, 7879 Minar, asked about traffic from the new Public Works Facility. He is also concerned about an increase in water in the tributary. Mike Adams, 12950 75th St. N., asked about the median on Co. Rd. 12, and if there would be a median in the extension of Neal Avenue. Sherri Buss responded that design details have not been worked out yet because decisions would happen at the design stage of the project. Michael Erickson, 212 Deerpath, is concerned about increased traffic on Deerpath and that Deerpath concerns should be considered for any development plan for this area. David Hanson, 7960 Newberry Court N., urged the Council to improve Boutwell Road as soon as possible for safety reasons. He asked that Council not approve a quick annexation of property that is not scheduled to be annexed until 2015. Patty Ogborn, 7940 Neal Ave. N., suggested that future developments put in grid systems with north-south, east-west streets. Joe Lux, Transportation Planner for Washington County, provided a history of Boutwell, which was the County Road and spacing standards for Washington County. He also stated that a median is very expensive Tom Johnson, 12993 Boutwell Road, is concerned about the option for the straight cut through of Neal Avenue. He stated that this option would have a big cost in the acquisition of homes. He also stated that the easement for Neal already exists and it should be considered to use that street alignment and felt that this alignment would allow for better sight distance. He stated that the bridge could be eliminated making people go out to County Road 15 and help the traffic issue on Deerpath. He requested that Council use the actual easement for the extension of Neal Avenue and save his home. Paul Halarious, 208 Deerpath, disagrees with the numbers projected for Deerpath and felt it was too conservative. He stated that the median would direct traffic right to Deerpath. He requested that this go back to the Planning Commission. Tom Garley, 13295 Boutwell Road, stated that the extension between Northland and Maryknoll would cause more problems. Bob Lohmer, 12960 75th St., asked for the purpose of the meeting tonight. Community Development Director Russell stated the road location is part of the recommendation reviewed by the Planning Commission and the Joint Board. He Page 7 of 11 '. City Council Meeting No. 02-20 September 17, 2002 stated that if that alignment would be changed it would have to go back to the Joint Board for review. . Mayor Kimble closed the Public Hearing. Councilmember Zoller stated that there is not a good answer to this problem. Councilmember Milbrandt agreed with Council member Zoller, felt that the traffic issue should have more study on the issues raised especially the Deerpath traffic problems, and that Deerpath should be included in this plan. Council member Rheinberger stated that this issue needs to be studied again. Motion by Councilmember Rheinberger, seconded by Councilmember Milbrandt to table the Boutwell South Area Plan. All in favor. Motion by Council member Zoller, seconded by Councilmember Rheinberger to direct staff and the Planning Commission to further study the traffic issues, particularly Deerpath, the Public Works Facility, the whole traffic picture for this area, and return the study for Council review in approximately 60 days. All in favor. Mayor Kimble recessed the meeting at 10:00 p.m. Mayor Kimble reconvened the meeting at 10:15 p.m. . UNFINISHED BUSINESS Lake Elmo Airport Letter. Mayor Kimble reviewed the request for support of the name change of Lake Elmo Airport. Motion by Council member Rheinberger, seconded by Councilmember Zoller to adopt Resolution No. 2002-213 supporting the name change for the Lake Elmo Airport to St. Croix Valley Airport. Ayes - Council members Milbrandt, Rheinberger, Zoller, and Mayor Kimble. THIS AGREEMENT is made this _ day of ,2002, between THE CITY OF STILLWATER, a Municipal corporation ("City"), and ARCOLA DEVELOPMENT COMPANY, LLC, a Minnesota Limited Liability Company ("Arcola"), RECITALS A. City is the owner of land, (the "Property") located in the City of Stillwater, County of Washington, State of Minnesota, legally described as set forth on Exhibit "A" attached hereto. B. Arcola desires to lease a portion surface parking lot on the part of the Property described in Exhibit "B" attached hereto (the "Parking Area"), and to create the necessary leasehold rights for joint use of portions of the Parking Area by Arcola and the City. NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is hereby agreed that: 1. Exclusive Possession of Parking Area. City reserves exclusive use of the twenty (20) parking spaces between the hours of 6:00 p.m. and 5:00 a.m., Monday through Friday, and at all times on Saturday and Sunday and any National holiday. At all other times, exclusive use of the Parking Area is reserved in Arcola. 2. Rent. Arcola is not obligated to pay rent to City during the term of this Agreement. However, Arcola, its agents and tenants must purchase Downtown Parking Permits for each of the twenty parking spaces reserved for their exclusive use. Construction. Arcola will, at its sole expense and subject to the approval of the City, design and construct a surface parking lot ("Parking Lot") on the Parking Area in the following manner: a. The Parking Lot must have bituminous surface; b. The Parking Lot must consist of approximately 20 parking spaces; c. There must be vehicular access to and from the Parking Lot to Mulberry Street; and . d. Arcola will maintain Parking Lot in acceptable condition and be responsible for all necessary repans. e.Arcolawill be responsible for snow removal and sweeping of the Parking Lot. 5.. Signage. Arcola must, at its sole expense and subjectto the approval of the City, design and install signage that clearly identifies the Public Use Periods provided for by this Lease Agreement. 6.. Lighting. Arcola must install lighting on the parking area, subject to approval of the City, however, the City will be responsible for utility charges for electrical use of the lighting. 7. Insurance. Term. We have received pricing and furniture options from two companies, S&T office Products and Dayton's Commercial Interiors. The quotes were as follows: S&T Office Products Dayton's Com. Int. Budgeted amount $24,457 $19,733 $30,000 It is difficult to compare product and pricing, because nothing is exactly the same. The Dayton's products are in a somewhat lower price category. This is because we were looking for bare bones with our first effort, so the Dayton's bid includes some used/refurbished product. The S&T bid includes some additional items not in the Dayton's Bid such as task lights, keyboard trays, tack boards, and 3 additional file cabinets. Also there are some obvious quality differences in the chairs. In order to make the Dayton's bid complete these items would need to be added. In the past the city has received good service from S&T. To date, we have not worked with Dayton's, but the firm certainly has a good corporate name. Recommendation Staff recommends Council accept the bid from S&T for office furniture, with the caveat that we reexamine the specific choices for some of the products specified. Action Required If Council concurs with staff s recommendation, Council should pass a motion adopting a resolution, accepting the proposal from S&T Office Products for the delivery of office furnishings at a price not to exceed $24,457. The company is not affiliated with any bus company. The fronts and backs of the "bus" benches are rented to individuals for the purpose of advertising their product or business. The City is paid $15.00 a year from U.S. Bench for 14 benches; in turn they contract the advertisements on the benches monthly. A study conducted by John Burbank, a planner at Cottage Grove concluded that the average cities in Minnesota collect between $25 to $50 dollars per bench. We have not increased are rates since 1996. Staff is suggesting we increase the rate to $50 per bench with the 2003 contract. The proposal has a price of $20,000 for the ten plus acres of seeding. This compares very favorably with the quotes received as part of our bid package on the building that included $45,000 for the same work. RECOMMENDATION . Staff recommends that Council acceptthe proposal from Applied Ecology for the seeding of prairie and grass around the Public Works Facility. Outlined below are procedures and specifications for seeding mesic prairie and 'LoGro' fescue mixes at the Stillwater Public Works facility located on Boutwell Road. Soil grading and initial soil preparation will be completed by the general contractor. Maintenance procedures are not included in this proposal because the Stillwater public works department will flail-mow seeded areas during the first two growing seasons. Additional maintenance requirements (weed spraying, etc.) may be contracted for with Applied Ecology on a time and materials basis ($50 per worker hour). Mesic Prairie Seedin2 Approximately 8 acres will be seeded with a mixed height / mesic prairie seed mix composed of at least 30 native species. A pre-mixed blend of grasses and forbs will be broadcast and harrowed into the soil over the entire restoration site (Applied Ecology 'Native Harvest' mix). Prairie mix will be broadcast at the bulk rate of20 pounds per acre with a cover crop of winter wheat broadcast at the rate of 10 pounds per acre. Additional wildflower seed will be broadcast in front ofthe building (4 pounds bulk) and along Boutwell Road. Additional wet prairie mix (10 pounds) will be broadcast around detention ponds and in runoff swales. ($2,000 per acre / $16,000 total) 1. Harrow site to create a smooth and firm seedbed. 2. Broadcast and harrow mesic prairie mix over entire restoration area (20 pounds per acre). 3. Broadcast and harrow winter wheat cover crop over entire restoration site (20 pounds per acre). 4. Broadcast additional forb seed in highly visible areas (4 pounds bulk). 5. Broadcast additional wet prairie mix in appropriate areas (10 pounds bulk). . '. Erosion Control . Seeded areas will be stabilized by the winter wheat cover crop. Drainage swales will be stabilized by installing straw erosion control blankets in the channel basins. ($2 per cubic yard / $1,400 total) 1. Install approximately 800 lineal feet (700 cubic yards) of erosion control blanket in drainage swales (North American Green S2 or equivalent). Low Maintenance Fescue Seedint! Approximately one acre will be seeded with a blended 'LoGro' fescue mix and a cover crop of annual rye. Fescue areas are located around the building and under the rows of planted trees. ($2,600 total) 1. Harrow soil to create a smooth and fIrm seedbed. 2. MEMORANDUM September 26, 2002 TO: Mayor and City Council FROM: Shawn Sanders S r<S, Civil Engineer SUBJECT: Sidewalk Rehabilitation Project Assessment Hearing and Adoption of Assessment Roll Project 2002-11, L.I. 356 DISCUSSION: It is typical for most improvement projects to be completed or substantially completed prior to the assessment, but this is not the case for the 2002 Sidewalk Improvement Project. The contractor has recently stated that the project will begin the week of September 30th. . Assessments for this project were based on the contract amount and estimating the administration and engineering costs. The estimate total cost ofthe project amounts to $85,026.04. The feasibility report estimate was $98,240. For this project there were 58 properties affected with approximately 13,000 square feet of sidewalk to be replaced. It has been the policy to assess one-half of the cost of sidewalk improvements to the property owners. This results in an assessed cost of $3.25 per square feet of sidewalk replaced. The assessment period would be for 10 years at an interest rate of five percent. To date, we have not received any appeals to the assessment. RECOMMENDATION: Staff recommends that Council hold the assessment hearing and adopt the attached assessment roll for the 2002 Sidewalk Rehabilitation Project. SUBJECT: Street Improvement Project Assessment Hearing and Adoption of Assessment Roll Project 2002-02, L.I. 355 DISCUSSION: The 2002 Street Improvement project is substantially completed. The only work that remains is the spot repair of the sanitary sewer. The feasibility report estimated the cost of the project to be $940,403.75. The actual total project amounted to $690,136.50 (including engineering, administration and construction.) The assessable cost is $414,081.90 and the City's share is $276,054.60. Assessment rates were adjusted to reflect lower project costs from $2,487.74 to $2,190.91 for a full lot and from $1,243.92 to $1,095.46 for a halflot. The assessment period would be for 10 years at an interest rate of five percent. To date, we have not received any appeals to any assessments. RECOMMENDATION: Staff recommends that Council hold the assessment hearing and adopt the attached assessment roll for the 2002 Street Improvement Project as submitted. ACTION REQUIRED: If Council concurs with the staff recommendation, they should conduct the public hearing and pass a motion adopting Resolution No. 2002-_, RESOLUTION ADOPTING ASSESSMENT FOR STREET IMPROVEMENT PROJECT (pROJECT 2002-02, L.I. 355) " RESOLUTION ADOPTING ASSESSMENT FOR 2002 STREET IMPROVEMENT PROJECT (pROJECT 2002-02, L.I. 355) . WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment 2002 Street Improvement Project for the following properties. Properties abutting Crestwood Terrace, Darrell Court, Dundee Place, Fairmeadows Road, Greenmeadow Court, Hansen Place, Icerose Lane, Laurie Lane, Laurie Court, Marine Circle, NortWand Court, Oak Ridge Court, Oak Ridge Road, Skyview Court, W oodridge Lane, and Nightingale Boulevard from Icerose to 1124 Nightingale; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA: 1. Such proposed assessments, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. . 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 2003, and shall bear interest at the rate of five percent per annum from the date of the adoption of this assessment resolutions. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2002. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. Property owners may at anytime prior to certification of the assessment to the county auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City of Stillwater Treasurer. NO INTEREST WILL BE CHARGED IF THE ENTIRE ASSESSMENT IS PAID BY NOVEMBER 15, 2002. If the assessment is not paid by November 15, 2002, accrued interest from the date of the adoption of the assessment roll through December 31, 2003 will be added with the first installment due in 2003. If payment is not received by November 15, 2002, the amount listed above will be collected over a 10-year period with interest added at 5% per year on the unpaid balance. The yearly installments will be collected with the property taxes that are paid to Washington County. AMENDING. The Stillwater City Code, Section 31-1, subd. 33(2) General provisions and definitions is amended by changing the definition of Shorelands to hereafter read as follows: "Shorelands means that lot which meets all of the following criteria: ( a) A portion of the lot must be located within one thousand (1,000)' feet of the ordinary high water level of any public body of water or within three . hundred (300) feet of the landward extent of a floodplain designated by the Floodplain Ordinance. The city council after receiving and briefly reviewing the request referred it to the planing commission and staff for comment. Planning: Commission Review. On' September 9, 2002, the planning commission reviewed the request (staff report attached). After discussing the request, the planning commission consensus was that the city should plan for future needs before selling land in proximity to cityhall. They recommended that a study be undertaken to provide a long term view of city building spaces and site needs. Some commission members felt the site was a good housing site with possible views and a secluded location. Lack of play facilities was a concern for children in the proposed use, In ,conclusion, the planning commission recommended the city prepare a city facilities master plan anticipating f~lture (20 year) needs so use of existing city property can be better planned rather than reacting to individual requests. The planning commission felt the city should work with HSI and other community organizations to meet special housing needs ofthe community. . Staff Comments. City staff members considered the proposal and offer the following comm~nts. An enclosed space is needed to store cars confiscated by the police departinent. The old public works site could provide that location permanently or until another site is found. Expansion otcity'hallor city hall parking will be necessary at some time in the future. Ifthe site is used for housing, other sites adjacent to city hall may need to be purchased to accommodate that expansion. in general, staff felt sale of the site is premature and there are more important factors than a quick sale of the property. 'A concern for highest and best use of the property was also expressed based on the sites RB Duplex Residential density; "" NOTE: The specifics of the enclosed proposal submitted by HSI for the, site was not considered in this review. September 5, 2002 Future Use of City Owned Old Public Works Site, 215 North 5th Street The city was approached by a relator to sell the old public works site for 8 units of assisted housing. In response to the request, the council referred the request to the Planning Commission for comment. This review is regarding the use of the site and not the design specifics of any proposal. The site contains approximately two acres of land. The site is separated topographically from the city hall building and parking area. The city owned land is in two zoning districts. The city hall portion is zoned professional administrative office (P A) the public works site is zoned duplex residential (RB). The idea for future use of the public works site was to return it to a conforming residential use when the public works facility was relocated ifnot needed for public use. , City staff members have indicated the continual need for the site for city hall related activities. The police department has indicated a need for a secured parking area. Additional space for general parking has been mentioned for city hall/library staff and it is possible that some of the exiting parking area to rear of the existing city hall building will be converted to building area in time requiring replacement parking. It may make sense to prepare a city facilities master plan that anticipates public facility growth needs based on city population growth. What I would envision is some sort of mailed flyer (perhaps even our regular newsletter) noting the history of the issue, the basic facts and response to commonly asked questions or statements. As stated in the City Attorney's memo, all information would have to be unbiased in nature, Currently staff feels that all aspects of the proposed merger have not been aired to the: general public. Magnuson DATE: September 25, 2002 RE: Public Expenditures to Encourage Voters to Support or Oppose a Ballot Question You have asked whether the City of Stillwater or the Water Board can spend public funds for advertisements encouraging voters to either support or oppose a ballot question. There is no state statute that specifically addresses this type of expenditure and further,' the Minnesota Supreme Court has never dealt with this question. However, the Attorney General has issued several opinions that have found this type of expenditure improper. In one opinion issued in 1927, the Attorney General said, "The legal way is by anyone who wants to, chipping in with his own money. It is not, however, permissible for a public entity to lawfully spend or vote to spend public monies for such purposes." It is possible, however, under Minn. Stat. S4l2.831 to spend public funds on mailings that are informational and unbiased, such as when a city wants to encourage people to vote by advertising the fact that there will be an election, or a factual explanation of a proposed charter amendment. In order to be legally permissible, however, this type of informative mailing should be unbiased and the city should not promote a particular point of view. It goes without saying that the same rules that bind the city are applicable to the water board. Please let me know if you need more on this. Minnesota Statute 2048.46 allows a municipality submitting questions to the voters at a special election to apply to the county auditor for approval of an election by mail with no polling place other than the office of the clerk. Listed below are pros & cons on a mail ballot election process and regular election process. Magnuson DATE: September 25, 2002 RE: Timing of Special Election on Referendum The purpose of this opinion is to reconcile conflicting provisions in Minnesota Statutes dealing with the timing of a needed special election on a Referendum question. The conflict is between the Minnesota Statutes dealing with city charters and the general election law of Minnesota. . The charter law in question is Minn. Stat. ~410.I0, subd. 1, which provides that upon the delivery of a draft of a proposed charter amendment by the charter commission to the city council, "if there is no general election occurring in the city within 6 months after delivery of such draft, then the council of the city shall cause the proposed charter to be submitted at a special election to be held within 90 days after delivery of such draft." The conflicting statute specifically dealing with municipal special elections. is Miim. Stat. ~205.1O,subd. 2, which provides that no special election on which the voters are authorized by charter to pass judgment may be held within 40 days after the state general election. The conflict arises since the charter commission submitted a draft to the city council on September 3rd. If a special election were held within the 90 day time limits under. the charter statute, it would need to be held on the 3rd of December. This in turn, would violate the 40 day black out period contained in Minn. Stat. ~205.1O, subd, 3, during which special elections are' ' prohibited. . The question is resolved be a careful examination of Minn, Stat. ~410,1O. That statute allows the city council to wait 6 months after the delivery of a draft to hold a special election if a general election will occur within the city within 6 months after delivery of the draft. In our present instance, a general election is scheduled within 6 months after the delivery of the draft. This reading, however, assumes by implication that the question could be placed on the ballot at the next general election. In our case, however, state law prohibits question additions to the ballot no later than 5 :00 p.m. on September 17, 2002 and that date has passed. ~ \. However, when statutes appear to be irreconcilable, Minn. Stat. S645.26 provides guidance. Subd. 4 of that statute provides that when 2 or more laws passed at different sessions . of the legislature are irreconcilable, the law latest in date of final enactment shall prevail. The charter statute S410.1O, subd, I, was last amended by Laws I 998c.444. The state special election black out law at S205.11, subd. 3, was last amended by Laws 1999c.132 SS31, 32. Following this rule of construction, S205.l 0, subd. 3, would control. Also, since Minn. Stat. S205.1O, subd. 3, specifically requires a 40 day black out period dealing with regard to any charter ballot questions, it would control over the more general law dealing with charter amendments in Chapter 410. In conclusion, because of the more general nature of Minn. Stat. S41O.1O, subd. I, and because it was enacted earlier, the 90 day time frame requirement for a special election can be extended by the number of days necessary to observe the mandatory requirements of the 40 day black out period created by Minn. Stat. S205.l 0, subd. 3, and by the time needed to prepare for and conduct a special election. Since the 40 black out period expires on Saturday, December 14th, it would be necessary to schedule the election as closely as possible to that date. In order to update the list of voters by adding new voters who register for the first time on the November 5, 2002 election, the earliest feasible date for the special election would be Tuesday January 28,2003, This date would satisfy the time frame requires for special elections contained in Minn. Stat. S41 0.1 0, subd. I. The idea of the project was simply to assist qualified low and moderate income homeowners by lowering assessments. The application was a three year request totaling approximately $300,000. . A recent review of the US Department of Housing and Urban Development (HUD), regulations indicate the program concept does not qualify. If assessments are paid the full assessment must be paid for low/moderate income homeowners. It is estimated that 30 to 50 households may qualify for the program based ontheincome standards. The estimated assessment is $15,000 resulting in a total project cost of as much as $750,000. Option 2 as described in the attached memo requires certification that at least 38.3% of the households in the North Hill Improvement Area qualify as low and moderate. It is unlikely that 38.3% of households meet the requirement. A third option that looks most promising is to use the CDBG funds for private costs associated with the project. Hooking up water and sewer lines from the residence to the street and removing septic systems is estimated at $5,000 - $6,000 per residence. With 30 to 50 qualifying residences this would equate to $150,000 to $300,000 depending on the number of households. Other "rehab" health and safety costs could be paid by the project if the full $300,000 wasn't used for private hood ups. To learn more about the neighborhood and determine how many qualifying low/moderate income households live in the North Hill Public Improvement area, a questionnaire will be sent out for the homeowner to fill out and return for tabulation and further project development. Recommendation: No recommendation, this report responds to Washington County memo and updates the council on the form of the North Hill Public Improvement Low and Moderate Income Household Assistance Project. . There are three options to demonstrate that your project principally benefits low and moderate income families. Option 1: Assistance with Assessments Recent information received from the U.S. Department of Housing and Urban Development (mID) has made it clear that the option originally proposed by the City may be the most difficult to implement under the Community Development Block Grant (CDBG) program. mID regulations require that when CDBG funds are used for payment of city assessments, the full assessment must be paid for all eligible low and moderate income households that request assistance. If 30 to 50 eligible households apply for this assistance to pay their assessments, the City will be obligated to provide between $1,200,000 and $1,500,000 in assistance. . Option 2: Area-Benefit Activity A second option is to fund the project as an "area benefit" activity. Using CDBG funds in this manner would involve applying the City's grant funds to the project costs as a whole rather than to individual households. The City will have to show that the area served by this project meets the Washington County low-mod threshold (at least 38.3 percent of residents are low to moderate income) using survey data or 2000 census data. The most recent census income data currently available was collected in 1989. John Swanson questioned whether this data can any longer be reliably used to quantify the low-mod population in the project area. The City could complete a neighborhood survey to determine the percentage of families that are low or moderate income in the service area. Alternatively, the City will have to wait until census income data for 2000 is available to determine if the North Hill neighborhood meets the area . benefit threshold. Option 3: Rehabilitation Activity The third option for using CDBG funds.in the North Hill neighborhood is to treat the project asa rehabilitation activity. Under this option, CDBG funds could be loaned or granted to residents to assist in paying for private hook up to the City water and sewer system. H rehab assistance is provided to residents, the City could use an outside organization to administer the program. The Club would agree to finance this cost in exchange for a very limited usage of 15 unique amphibian cars. . The direct benefit of this modest infrastructure improvement would be to the fire department. After speaking with Kim Kallestad, an emergency launching point for the Fire Department's rescue Zodiac at a downtown location would improve response time for river mishaps. Currently, the Fire Department would have to access via Sunnyside or Wolf's Marina for potential downtown river emergencies. We would propose the city could stripe off an area 20 feet wide leading up to the rock work from the access point of the existing railroad tracks. The city could also provide signage "Fire Lane", "No Parking", or language to that effect. We understand the potential of other individuals or groups to request use of this nearly invisible amenity. We also understand there are no facilities available for boats, parked cars, trailers or jet skis. This fact alone would preclude general public use. The amphibious car is as unique as Stillwater. The required time for a launch or approach is under 5 seconds. There is no stopping or pausing in this process. Our thought is that club members would receive a decal permitting this use. We understand this privilege is at the pleasure of city government and can be suspended or revoked at any time. The amphicar is becoming a Stillwatericon, very much like the hot air . balloons, trolley, Gondola, dinner train and other unique Stillwater oddities. . .... .\ .
