I will also have to resign as the Council representative to the Parks and Recreation Board as this is a Council liaison position. Please consider my resignations to the above named positions effective as of January 3, 2005. I am grateful for the honor and privilege of serving with each of you in representing the citizens of Stillwater. Also, I would like to thank Larry Hanson, staff and citizen volunteer board members for their support during my tenure. All in favor. PETITIONS, INDIVIDUALS, DELEGATIONS & COMMENDATIONS OPEN FORUM No public comments STAFF REPORTS Police Chief Dauffenbach reminded the public of the winter parking regulations and stated that even if there is not snow they are enforcing the ordinance. Public Works Director Eckles reported that while jetting a sewer line on 5th Street between Orleans and Marsh approximately 300 feet of sewer pipe collapsed. He stated that a contractor was hired at a cost of approximately $16,000. Mayor Kimble thanked Public Works for their quick response of placing a temporary power pole at 3rdand Myrtle. City Administrator Hansen requested that Council provide direction on the appointment of the City Council member. "- Animals Mayor Kimble reviewed the amended ordinance which would allow the City Council to set fees by resolution from time to time. Motion by Councilmember Milbrandt, seconded by Councilmember Rheinberger to adopt Ordinance No. 951, amending City Code relating to Dogs and Animals Ayes: Council members Kriesel, Milbrandt, Rheinberger, Junker and Mayor Kimble . City Council Meeting - 04-30 Possible adoption of resolutions for 2005 Budaet & Tax Levv December 21,2004 City Administrator Hansen presented various options of the tax levy and asked for a decision on the personnel requests. Council member Rheinberger stated that he felt the requests should be acted upon after the budget and tax levy were decided. Motion by Council member Milbrandt, seconded by Councilmember Kriesel to approve the personnel additions to finance, police, parks and the library request for increased hours. Ayes: Councilmembers Kriesel, Milbrandt, Junker and Mayor Kimble Nays: Council member Rheinberger City Administrator Hansen reviewed the various tax levy proposals presented to Council. Councilmember Milbrandt stated that because of the discussions of the possible loss of Local Government Aid, freeze of levy limits, and allowing the City to do future capital projects that the tax rate should be at 51.854%, which would result in a 0% change from 2004. Mayor Kimble stated that a reserve would protect the services and that if the LGA were not loss it would help residents if the City used that reserve on the capital projects. Councilmember Junker stated that he would like to see the tax rate be reduced 1.7%, because it would still allow some cushion if there are LGA cuts but reduce the tax rate. Councilmember Kriesel concurred with Councilmember Junker. Council member Rheinberger reviewed various reasons why he is suggesting that the budget be reduced to between 7.81 M -7.85M approximately a $650,000 cut and that the tax rate be cut from 51.878 to somewhere between 45.250 and 45.500 or approximately 13.25% cut. He stated that people's income is not keeping up and felt that in essence slowly pushing residents out of the city. Councilmember Milbrandt asked if Council would consider a 51.500% tax rate. Councilmembers Kriesel and Junker liked the 1.7% reduction but felt they could accept the 0.7% reduction. Motion by Councilmember Milbrandt, seconded by Councilmember Kriesel to adopt Resolution 2004-259, adopting the final tax levy for the year 2005 and Resolution 2004-260, adopting the final budget for the year 2005. Possible aDDointments to Boards/Commissions Mayor Kimble reviewed the various appointments for the Downtown Parking Commission, Planning Commission, Heritage Preservation Commission, and Parks Board. It was decided that motions would be done on individuals for Downtown Parking Commission and Planning. Motion by Council member Junker, seconded by Councilmember Milbrandt to appoint Kevin LaCasse to the Downtown Parking Commission. All in favor. Motion by Councilmember Junker, seconded by Councilmember Kriesel to appoint Robert Gag to the Planning Commission. All in favor. Motion by Councilmember Junker, seconded by Councilmember Milbrandt to appoint Mike Dahlquist to the Planning Commission. All in favor. Councilmember Milbrandt suggested that to have a Ward balance on the Planning Commission that Gregg Carlsen be appointed. He also suggested investigating the possibility of term limits on the Commissions. He commended Mr. Ranum on his service to the commission, but felt that there was an imbalance of ward representation. Councilmember Kriesel concurred with Council member Milbrandt and stated that Mr. . Ranum has done a good job on the commission. Motion by Councilmember Milbrandt, seconded by Councilmember Kriesel to appoint Gregg Carlson to the Planning Commission. Ayes: Councilmembers Kriesel, Milbrandt, Rheinberger and Mayor Kimble Nays: Councilmember Junker Motion by Council member Kriesel, seconded by Council member Junker to appoint Jeff Johnson, Phil Eastwood and Howard Lieberman to the Heritage Preservation Commission. Motion by Council member Milbrandt, seconded by Council member Rheinberger to adopt Resolution 2004-261, appointments to various city of Stillwater boards/commissions and directed staff to continue the advertisement for Joint Cable Commission, Downtown Parking Commission and Parks Board. Request for aooroval of consultant services for oreoaration of Brown's Creek Park and Natural Area Resource Manaqement Pial!. Community Development Director Russell stated that since the purchase of the Boutwell Cemetery, the Munkelwitz property and the addition of a basic trail system and habitat restoration project has been completed in the Brown's Creek Natural Area/Park it would be time to review the use and restoration efforts and prepare a park master plan to establish use and management of Brown's Creek Park, nature area and trail system. He also stated that the plan would provide guidelines for use, maintenance, improvement and management of the site and guidelines for the trail connection to the Phase /I Palmer expansion area and the Brown's Creek area to the north of McKusick Road to Trunk Highway 36. He stated that funding for the services would be from the Park Fund. Council member Milbrandt stated that he would like to see more neighborhood meetings. Community Development Director Russell assured Council member Milbrandt that there would be neighborhood meetings and input from residents of the area on the management plan. Motion by Council member Rheinberger, seconded by Councilmember Milbrandt to adopt Resolution 2004-262, approval of proposal for preparation of Brown's Creek-Boutwell Area Open Space, Parks and Trail plan . Ayes: Council members Kriesel, Milbrandt, Rheinberger, Junker and Mayor Kimble Nays: None Aooroval of 2005 Communitv Develooment Block Grant Community Development Director Russell requested approval of the 2005 CDBG application for grants in the amount of $167,881 for the use of park improvements at Benson, Lily Lake, Peace, Schulenberg and Stonebridge Elementary Parks. Motion by Councilmember Kriesel, seconded by Councilmember Rheinberger to adopt Resolution 2004-263, approval of 2005 Community Development block Grant (CDBG) application. Lucy Winton Bell Athletic Fields Capital Request Presentation Stillwater City Council January 4, 2005 Overview of Lucy Winton Bell Athletic Fields Lucy Winton Bell Athletic Fields (LWBAF) is a unique, nonprofit athletic complex that operates with a cooperative partnership between the Valley Athletic Association (V AA), S1. Croix Soccer Club (SCSC), S1. Croix Valley Athletic Partnership (SCVAP) and Belwin. Belwin provided the 50 acres of land for the complex and in 2004 has taken over the role of managing the fields. Belwins management of the fields has provided efficiencies that have improved resources in administration, maintenance and land management. The LWBAF mission is to ensure opportunities for healthy young development by providing a safe, quality sports facility in the S1. PARTNERSHIP OVERVIEW Lucy Winton Bell Athletic Fields (LWBAF) was created to meet a chronic shortage of good playing fields in the St. Croix Valley area. A unique partnership was developed between Belwin, a nonprofit organization managing over 1200 acres of land in Afton and Lakeland Township, St. Croix Valley Athletic Association (VAA) and St. Croix Soccer Club (SCSC). Belwin purchased the 50 acres needed to develop the athletic complex and the V AA and SCSC participated in the building of the fields. They come from 14 communities served by the fields and their hearts beat in unison FOR OUR YOUTH. They commit hundreds of hours to help keep management costs low and quality high. As we wind down the 2004 season, it was determined that we needed to name one outstanding person who would represent all hands and hearts working together to maintain the integrity and purpose of Lucy Winton Bell Athletic Fields. Fred devoted countless hours helping to prepare the site for the season which included selection of the best field crew, spring clean up, hours of minor repair and maintenance, installation of interior and exterior lighting in the storage shed, donation of dollars to pay for handy man fix-up projects, and the donation of new facilities equipment: tables, pop-tents, generator and lighting supplies. RESOLUTION 2005-06 RESOLUTION RELATING TO FINANCING OF CERTAIN PROPOSED PROJECTS TO BE UNDERTAKEN BY THE CITY OF STILLWATER; ESTABLISHING COMPLIANCE WITH REIMBURSEMENT BOND REGULATIONS UNDER THE INTERNAL REVENUE CODE BE IT RESOLVED by the City Council (the Council) of the City of Stillwater, Minnesota (the City) as follows: 1. Recitals. a. The Internal Revenue Service has issued Section 1. 103 -18 of the Income Tax Regulations (the Regulations) dealing with the issuance of bonds, all or a portion of the proceeds of which are to be used to reimburse the City for project expenditures made by the City prior to the time for the issuance of the bonds. b. The Regulations generally require that the City make a prior declaration of its official intent to reimburse itself for such prior expenditures out of the proceeds of subsequently issued borrowing, that the borrowing occur and the reimbursement allocation be made from the proceeds of such borrowing within one year of the payment of the expenditure or, if longer, within one year of the date the project is placed in service, and that the expenditure be a capital expenditure. c. The City desires to comply with requirements of the Regulations with respect to certain projects hereinafter identified. 2. Official Intent Declaration. a. The City proposes to undertake the following projects described on Exhibit A attached hereto. b. Other than (i) expenditures to be paid or reimbursed from sources other than a borrowing or (ii) expenditures permitted to be reimbursed pursuant to the transition provision of Section 1.103-18(1)(2) of the Regulations or (iii) expenditures constituting of preliminary expenditures as defined in Section 1.103-18 (i)(2) of the Regulations, no expenditures for the foregoing projects as identified on Exhibit A have heretofore been made by the City and no expenditures will be made by the City until after the date of this Resolution. c. The City reasonably expects to reimburse the expenditures made for the costs of the designated projects out of the proceeds of the debt (the Bonds) to be incurred by the City after the date of payment of all or a portion of the costs. All reimbursed expenditures shall be capital expenditures as defined in section 1.150-1 (h) of the Regulations , d. This declaration is a declaration of official intent adopted pursuant to Section 1. 103-18 of the Regulations. . 3. Budaet Matters. As of the date hereof, there are no City funds reserved, allocated on a long term basis or otherwise set aside (or reasonably expected to be reserved, allocated on a long term basis or otherwise set aside) to provide permanent financing for the expenditures related to the projects other than pursuant to the issuance of the Bond. This resolution, therefore, is determined to be consistent with the City's budgetary and financial circumstances as they exist or are reasonably foreseeable on the date hereof, all within the meaning and content of the Regulations. 4. Filinq. This resolution shall be filed within 30 days of its adoption in the publicly available official books and records of the City. This resolution shall be available for inspection at the office of the city clerk at the City Hall (which is the main administrative office of the City) during the normal business hours of the City on every business day until the date of issuance of the bonds. 5. Reimbursement Allocations. The City's financial officer shall be responsible for making the reimbursement allocations" described in the Regulations, being generally the transfer of the appropriate amount for proceeds of the Bonds to reimburse the source of temporary financing used by the City to make payment of the prior costs of the projects. Each allocation shall be evidenced by an entry on the official books and records of the City maintained for the bonds, shall specifically identify the actual prior expenditure being reimbursed or, in the case of reimbursement of a fund or account in accordance with Section 1. 103-18, the fund or account from which the expenditure was paid, and shall be . effective to relieve the proceeds of the bonds from any restriction under the bond resolution or other relevant legal documents for the Bonds, and under any applicable state statue, which would apply to the unspent proceeds of the Bonds. Employee Assistance personnel policy development and consultation. . 3. Supervisory training of management personnel in the use of the program. 4. Promotional materials including brochures, posters and newsletter articles to keep your Employee Assistance Program visible to your employees, and their families. 6. Ongoing consultations with managers and supervisors to assist them in utilizing the EAP within your organization. 7. Confidential assessment, referral and brief counseling to be provided to all employees, and their family members. Up to four sessions of counseling based on the clinical recommendation of EAP counselor. Each session being comprised of one clinical hour. All of the employees of The City of Stillwater and their family members may contact The Sand Creek Group for assessment, brief counsel and, when necessary, referral free-ol-charge to them. No limit is placed on the number of assessments and referrals made annually. All contact is strictly confidential. 8. 24 hour telephone crisis intervention. . 9. Elicdbilitv: All employees of The City of Stillwater and members of their household who are experiencing personal, emotional, family or social problems which have direct, indirect or potential effects on work performance or personal well being, are eligible for the services of the Employee Assistance Program. V. Emolovee Particioation: A working policy of the EAP is that Employee participation in the EAP will affect neither future employment or advancement nor protect employee from disciplinary action for continued substandard performance. If this is not acceptable we would request using the parking spaces on the west side of Water St. from Chestnut St. to just south of the old Outfitters building which we have done in past years (see plan B). We will contact affected business to see if there are any conflicts. A port-a-pot will be on sight and all clean up will be done on Sun. Feb. 20th. Case No. Vj04-94. Background. The Planning Commission held a public hearing on the variance request December 13, 2004. The variance is required because of the steeply sloped condition of the lot (see site survey). The site slopes steeply to the east resulting in the need for variances to the front and rear yard (steep slope) setbacks. The Planning Commission reviewed the request and expressed concern mainly for steep slope setback. The residence is sited over the 24%+ sloped. Neighbors spoke in opposition to the variance (CPC minutes enclosed). Some Commission members felt that the applicant has addressed the site issues with the size, design and location of the proposed residence. Other Commission members felt the slope setback was to significant to approve. The Planning Commission voted 3-3 to approve the variance. The applicant has appealed the Planning Commission's variance decision to the City Council (January 4, 2005). Recommendation: Reconsideration of Planning Commission's decision. This past year, sewer and water services were extended to the site and provide city water and sewer service. Much of the lot is in slopes greater that 24 percent (steep slopes). The City RA zoning regulations and . conservation regulations require 30 foot setbacks from steep slopes and the front property lines. The proposed structure is setback 25 feet from the front property line and located over the steep slopes to the rear of the site. The size and location of the structure minimizes development impacts on the site. The structure is in character with the neighborhood. As proposed, trees other than those in the construction area will be preserved. Recommendation: Approval Conditions of Approval: 1. The City Forester shall review site development plans for tree impacts and protection of existing trees. 2. A drainage, erosion control plan shall be prepared as a part of the site development plans and reviewed and approved by the City Engineer when the building permit is issued. 3. A front yard landscape plan shall be provided for review and approval with the building permit plans and installed before residence occupancy. 5. He said he is asking that he be allowed to keep the roof on the deck and move the carport inside the property line. A number of photos and drawings were included with Mr. Buettner's application. Mr. Junker asked if he had obtained building permits for the deck or carport. Mr. Buettner replied he had not. Paddy Danaher, 1723 N. Second St., said she hopes there is a registered survey, as it appears some of the structure might be on her property. She also spoke of a concern regarding erosion when building occurs in the ravines. She also spoke of a concern that the deck will become more of the house - a three-story structure. Mr. Teske asked if there was a survey. Mr. Buettner said he had looked for survey benchmarks and could find none. Mr. Junker moved approval with the carport set back off city right-of-way to a point to be determined by the building inspector. Mr. Turnquist seconded the motion. Mr. Russell expressed a concern about property lines. Mr. Turnquist moved to continue the case until a survey is completed; Mr. Dahlquist seconded the motion. Mr. Junker withdrew his motion of approval; Mr. Turnquist withdrew his second. Motion to continue passed unanimously. The applicant agreed to grant a waiver to the 60-day action timeframe. . Case No. V104-94 A variance to the front and steep slope setback (front - 30 feet required, 25 feet proposed; steep slope - 25 feet required, 0 feet proposed) and variance to the developable lot size requirement (10,000 square feet required, about 5,000 feet existing) to construct a two-story residence on Lot 39, Block 7, Carli and Schulenberg Addition (between 1221 and 1306 N. Broadway St.) in the RA, Single Family Residential District. Jeanne Haapala and Nancy Walsh, applicants. The applicants were present, along with their architect Steve West of Lansted Homes. Ms. Haapala explained their request is to build a two-story bungalow designed to fit the character of the neighborhood. Because of the slope of the property, the variance is needed for the developable lot size. Two small retaining walls would be constmcted to the rear of the house, and impact to trees on the site would be minimal, she said. Ron Christopherson, neighbor to the west, noted the property drops off "to nothing," so the house will be right on the road. He also noted the property had been filled in the past. And he stated a developer owns property to the south and will likely be asking for the same thing if this proposal is approved. . 3 . . . City of Stillwater Planning Commission December 13, 2004 Mr. Junker, Mr. Peroceschi and Mr. Dahlquist all spoke of a concern about the slope of the property. Mr. Dahlquist noted that the City has an ordinance protecting steep slopes for a purpose. Mr. Russell pointed out that the lot in question is a lot of record. Mr. Gag suggested this is a classic example ofthe definition of "hardship," and he said he thought the plans were well thought out. Mr. Teske said there is more to a lot than the buildable area - open space, for example. Mr. Teske also pointed out this is a lot of record; a drainage plan will be required addressing a major concern in that area. Mr. Turnquist agreed that the applicants/architect did a good job with plans to fit the site. Mr. Turnquist moved approval as conditioned. Mr. Teske seconded the motion. Motion failed on a 3-3 vote, with Mr. Turnquist, Mr. Teske and Mr. Gag voting in favor and Mr. Junker, Mr. Peroceschi and Mr. Dahlquist voting against. Case No. V/04-95 A variance to the accessory use square footage requirements (1,000 square feet allowed, 1,900 square feet requested) for constmction of a new residence with a two level garage at 3180 lIo Way in the Lakeshore Residential District. Mark Lindeberg, applicant. Present were Mr. Lindeberg and his builder, Randy Cernohous of McDonald Construction. Mr. Lindeberg explained he is combining two lakeshore lots into one lot of record. As perceived from the street, the garage will appear to be less than 1,000 square feet, he said. Most of the discussion centered on the request to have a garage door at the rear of the stmcture. Mr. Lindeberg said the space would be used for storage, but at some point he might want to partition the space into a therapy room or theater room. The garage door, he said, will look like two carriage doors. Mr. Gag asked if there were plans for any other accessory stmctures. Mr. Lindeberg stated there were none. Joe Fogarty, 3160 Ilo Way, said he had no objections to the plans. However, he said he would like conditions added that there be no other accessory structures and no future subdivision of the property. Mr. Lindeberg said he had talked with other neighbors and no one objected to the plans. Most of the discussion centered on the reason for installing the garage door at the rear. The concept of de novo review is based on the assumption that the members of the reviewing body did not take part in the original d~cision. In regard to the HaapalalWalsh appeal, the integrity of the de novo review process, as defined in the Stillwater Code, would be better served if the council member who participated in the Planning Commission's review did not participate in the City Council's review. The City's variance standards (Stillwater Code 31-1, Subd. 30 (2) (d) parallel those contained in the State's enabling legislation (M.S. 462.357, Subd. 6(2)). Essentially, the applicant for a variance must show the following: 1. The hardship is peculiar to the property and not created by the applicant. This standard relates to the pre-existing condition of the property. The size of the lot, the shape of the lot, the grade of the property, and the soil conditions of the property could be factors that suggest unique circumstances. In order to satisfy this standard, the applicant must show that he/she is requesting to use the property in a reasonable manner that is otherwise prohibited by a strict application of the City Code. The property owner does not have to show that there is no other reasonable use for the property. (Rowell supra). In my opinion, prohibiting ~ny development of this property, which would result from a strict application of the City's regulations, would be unreasonable. Development of the property for a modest single-family dwelling which is designed to fit the lot is a reasonable use. 3. Granting the variance would not be a substantial detriment to the adjacent neighborhood (see neighbor letters in support of application); and would not materially impair the purpose and intent of the City's Zoning Code (the property would be developed for a permitted use within the RA-One Family District). The City's conservation regulations which are the subject of the variance request indicate that some parcels which had received preliminary approval prior to the effective date of the conservation regulations would be exempt. In particular, Section 31-5, subd. 3 (9) states that the regulations would not apply "to any new development that has been given preliminary plat or PUD approval prior to the effective date" of the regulations. If some more recently created lots were excluded from the regulations, why not a lot created more than 80 years ago which otherwise complies with the City's regulations? Recently, the City extended sewer and water connections to the property. Someone must have thought that the property would be developed and that the utilities would be connected. On December 21, 2004, the City advised the property owners that a Notice of City Water and Sewer Availability had been recorded with Washington County. The Notice was filed to make future purchasers aware of the pending obligation and to Ilassure collection at a later date". This is another indication that the City has treated this property as if it could be developed. It is unlikely that this parcel can now be sold without requiring the Sellers to escrow the connection charges which are accruing interest and which c,ppear to be more than twice the special assessments which were levied on the same projectfor single family lots of the same size that had already been developed. . ~ased upon the facts and circumstances in this particular case, the applicant respectfully requests that the City Council approve the variance application. Also provided with this letter are 12 copies of the original variance application packet. We renew our request through filing this appeal, and respectfully request that the City Council consider the following: . 1. The staff report findings state, and we agree that: · "A hardship peculiar to the property, not created by any act of the owner exists". · "A variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same district and in the same vicinity; and that a variance, if granted, would not constitute a special privilege of the recipient not enjoyed by his neighbors". · "Authorizing of the variance will not be of substantial detriment to adjacent property and not materially impair the purpose and intent of this title or the public interest nor adversely affect the Comprehensive Plan". 2. The above criteria are present in the ordinance to give guidance on the review of variances and their application must be considered given these regulations/provisions. 3. Our proposal met each of the conditions necessary for the variance, as evidenced by the staff recommendation and materials submitted in the application packet. None of the Planning Commission objections indicated that we have not met the required conditions. 4. Our proposal is a responsible/respectful solution to the hardship present on the site. 5. Extraordinary measures are not necessary to construct the proposed home. Two small retaining walls near the Southeast corner of the home will be constructed to retain the slope at that corner of the home. Both retaining walls will be less than 4 feet tall, and are consistent with standard walkout homes. . 6. The proposed use is consistent with the RA zoning of the property (single-family). 1 . . 7. The lot has been a legal lot of record dating to before 1916. · The lot is not a remnant parcel. · Presumably the lot was subdivided under regulations in place at the time, with the assumption that the lot would be developed. Understandably, the regulations have evolved over time, and as such a variance process is provided in the ordinance to evaluate existing parcels with regard to more recent regulations and to determine whether strict enforcement would prohibit development under the current zoning. · Most of the homes in the neighborhood were constructed under different re gulations/ guide I ines. · The proposal is consistent with use enjoyed by parcels in the general vicinity, and in some instances will be in greater compliance with the regulations than some homes built in the past 1] years. 8. The value of the property, as recorded at Washington County, does not reflect the value of a remnant parcel. The 2004 market value is $] 27,000. . 9. Unless some relief is granted from the requirements, then substantial property rights cannot be enjoyed. Excerpts of the City of Stillwater's variance application packet state: · There are occasions when the strict application of such standards may be inappropriate because of special characteristics of the property. · It provides for adjustment where special or extraordinary circumstances applying to a parcel of land or building that prevent the property from being used to the extent intended by the zoning. · Special circumstances include size, shape, topography, vegetation etc. · Said circumstances or conditions are such that the strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such land or buildings. 10. Staff recommended approval of the application with 5 conditions. We agree to each of the conditions recommended by the staff. Those conditions are: · City Forester shall review site development plans for tree impacts and protection of existing trees. · A drainage/erosion control plan shall be prepared as part of the site development plans and reviewed and approved by the City Engineer when the building permit is issued. · The house shall be painted or stained an earth tone color. · A front-yard landscape plan shall be provided for review and approval with the building permit plans and installed before residence occupancy. · No trees other than those in the residence structure building site shall be removed without Community Development Director approval. . 1 ]. The Planning Commission chair and two other members of the commission agreed that characteristics of the lot cause it to meet the very definition of hardship. 2 . . ] 2. Several neighbors along N Broadway have written and signed letters of support for the proposed home and the variance request. Copies will be provided to the staff and City Council at the Council meeting. We would also submit for Council consideration, responses to objections that arose during the Planning Commission discussion or by one member of the audience. 1. One Planning Commission member questioned the accuracy of the survey, specifically the topographic data. · The statement is not based in fact. · Stack Land Surveying, a registered land surveyor that has done considerable work in Stillwater, prepared the survey submitted with the application. · The surveyor certifies the survey and his seal is affixed on the document. · The surveyor used actual elevations to draw the topographic characteristics of the property. · The data represented on the survey line up with Washington County data, with one exception. The existing rock shelf represented in our survey (and present on the site) is not shown in the County data. . 2. The same Planning Commission member stated that the home would be "cantilevered out over the slope". · The statement is not based in fact. · The site plan presented on page F -I of the application packet clearly shows where the home is located. The first 8 feet of the uppermost portion of the slope at the NE corner of the home provides for a limited walkout. · At the time of the Planning Commission submission, and in response to a recommendation from staff, we had staked the proposed front of the home only. As of Tuesday morning, December 14, we have staked the rear wall of the house as well to further illustrate the minimal use of the slope. · The proposed home would be constructed closer to the street than the existing home at 1307 (the adjacent home to the N), and that home is not "cantilevered" out over the slope even though it does encroach onto the slope more than the proposed home for lot 39. · Two homes constructed in the last] 1 years on Riverview Drive (in the same neighborhood) were constructed entirely on a slope greater than 25%. These homes have considerably more encroachment onto sloped areas than our proposal (located at ]413 and 1425 Riverview Drive). 3. One Planning Commission member remarked upon the building moratorium that had been in place due to environmental hazards of septic systems on a slope. · An extension of the City's sewer and water system has been installed and stubs have been provided for this lot. . 3 . . 4. A member of the audience claimed that the proposed home would be "right on a narrow roadway", and that the garage constructed at 1307 (the adjacent property to the North) was also "right on the road". · The two statements are not based in fact. Actual measurements demonstrate their maccuracy. · The proposed home would be 25 feet from the front lot line and approximately 33 feet from the paved surface of the roadway. · The garage at ] 307 is more than 30 feet from the front lot line and approximately 38 feet from the paved surface of the newly constructed roadway. · In addition, the proposed front setback was based on a staff recommendation that from the City's perspective it would be seen as more desirable to locate the home closer to the street to further remove the home from the slope. We amended our proposal and moved the home 5 feet closer to the street based on that advice. · A number of homes in the surrounding neighborhood are constructed closer to the street than the 30-foot front setback, particularly on N First and N Second streets, and directly across the street from lot 39. . 5. According to aerial mapping with lot line overlay obtained from Washington County, the home directly across the street (on the NW corner of N Broadway and St. Croix) is built immediately adjacent to the road right-of-way of both adjacent streets. In addition, the home is closer to the paved surface of the roadway for both N Broadway and St. Croix than the proposed home on lot 39. (Note: The roadway is constructed in the eastern edge of the right-of-way.) We have evolved considerably in our desires for our future home. Once we purchased the lot, we started over with the desire to plan a home specifically for that site, using the best alternatives possible to design a home that would be respectful of the site and the neighborhood. The proposed home has little resemblance to our original ideas before purchasing the property because those original desires would not have been appropriate for this site. · The desire for a rambler was replaced with a two-story that would minimize the footprint. · The desire for a larger garage was replaced with a smaller one because it is the right thing to do. · The desire for a simpler roof design (and the resulting lower construction cost) was sacrificed for a bungalow design with a front porch and dormers. · Square footage was sacrificed because it makes sense for the site, and because it helps pay for the design elements that make the proposed home fit into the neighborhood. · Each of these changes is the right thing to do on this site. . 4 t . Please note that this item was neither approved nor denied by the Planning Commission, because there were 3 votes in favor and 3 votes against the motion for approval. This matter now comes to the City Council without a recommendation from the Planning Commission. In addition, the only findings presented at the Planning Commission meeting are contained in the staff report, which recommends approval. By their very nature, they need to be high density. The aggressive and long overdue infrastructure project that was undertaken in the North Hill Neighborhood, stated that one ofit's goals was to promote development of some residential pockets in the North Hill neighborhood. I was at the Planning Commision meeting where these applicants were denied their variance on a tied vote by the commission, despite the recommendation of approval by the Planning Director, Steve Russel. I have attended many planning commission meetings, and have looked at many of the application submittals that are open for review at the meetings. I have never seen a more comprehensive, well thought out, sensitive application from an individual homeowner. Their obvious sincerity as displayed in their proposal would make them good "developers", and more importantly, good neighbors. During the "open mic" segment of this case hearing, a resident that owns property across the street from the applicants stood up to express his concerns. His concern was that if this variance was approved, it would open the door to allow the property owner to the south of the subject property to further develop Broadway, and, I quote, "we will have houses crammed in all over". . This perception from the neighbor is extremely shallow, near sighted, and uninformed. There are thousands of design and construction professionals who have devoted their careers to sensitively, creatively, and aesthetically designing and building homes that resolve the many issues associated with small lots. These professionals develop projects that functionally and artfully address the static and dynamic issues of the site, and in the end, add value to our neighborhoods and community. I'm sure that they do not feel that they are "cramming" houses in all over. They feel that they are serving a public good, and samples of their work indicate that indeed they are. At that same planning Commission meeting I stood up and expressed my concerns over a separate case in which a property owner is requesting a lot size variance in order to subdivide an existing lot. Had this applicant supplied the type of well thought out, sensitive, neighborhood integration proposal that these applicants submitted, I would have stood up and said, "Hey, I want that in my neighborhood". I used to live across the street from this lot, and if I still lived there, I would stand up and say Hey, I want that in my neighborhood. . At the planning commission meeting, Steve Russel was asked by one of the Commissioners what was the purpose of the slope setback. Mr. Russel responded that it was to mitigate erosion problems, and to preserve green space. In this particular instance, preserving green space seems to be well served. The erosion concern is real, however with the recent addition of curbs, gutters, and well engineered storm sewer on the North Hill, run off from impervious areas such as driveways and roofs can be adequately addressed. The City, through it's Planning and Building Departments can ensure that . drainage issues are addressed in the plans, and implemented in the const!l..!ction. The completion of the North RiB infrastructure project will, indeed, put development pressure on these residential infill pockets. Due to the second owner's claim to lot 39 through the contract for deed, he had the ability to prevent the sale oflot 39. The result was that he would not agree to the sale oflot 39 without first selling the home he owned on lot 40 (also for sale at the time). This meant that we couldn't buy lot 39 without buying the house next door. 1 I I. I I I I I I I I. I I I I I I I. I I Before we entered into a purchase agreement for either property, we contacted the Stillwater Engineering and Planning Departments to obtain more information about the property (April of2003). From Engineering staffwe learned of the City's intent to install sewer/water in the area, the uncertainty of the timing for the sewer/water project, and the City's efforts to obtain State funding for a portion of the project cost. From Planning staff we learned of a development moratorium (due to the lack of sewer and water to the site). Because the City was actively pursuing the sewer/water project, and we were eager to move to Stillwater, we decided to purchase the existing home and make obvious necessary improvements while we waited for sewer/water. Existing Horne Improvements - By the fall of 2003 we were well into the process of needed repairs/replacements on our current home. We had already replaced the original windows, an old deck had been removed, and the new deck was under construction. About that time it became clear that the City would be proceeding with the water/sewer project, but the timing for the N Broadway segment of the project was still unclear. We decided to move forward with plans to resolve some of the more serious problems with the existing home and hired a remodeling contractor (North Hill Horne Styling) to design an addition that would fix ongoing drainage problems in front of the tuck-under garage, and eliminate a flat roof that had caused water leakage problems inside the home. Once the remodeling project was underway we began working with Landsted Homes to design our retirement home for lot 39, so that we would be ready to build when water/sewer became available. We chose Landsted because ofthe quality of their work and because we believed they would help us design a home that would complement the existing neighborhood. In addition, we were confident that Landsted would help us find a solution to the site limitations by using as much of the natural features of the lot as possible, and help make our new home a welcome addition to the neighborhood. Lot of Record-Buildabilitv -As additional background information, it is important to note the following: 1. Lot 39 has been a separate lot of record since at least the early 1900s. A brief search at Washington County indicated that it was a separate lot of record in 1916. We did not search further back to ascertain the original date of the plat. 2. The lot has changed ownership numerous times over the last 100 years. 3. The lot has changed ownership twice in the last 4 years. 4. The purchase of lot 39 was its own real estate transaction, with a separate closing date, and a different closing company from the sale of the home at 1307 N Broadway. 5. The City's 2000 feasibility study (obtained from the City's Engineering department in April of 2003) for the sewer/water project states that the project will "provide services for future development". We reasonably interpreted the meaning of "future development" to mean building on existing parcels as well as potential future parcels. 6. Water and sewer services have been constructed to the area. 7. Water and sewer stubs have been installed for lot 39. 2 I I. I I I I I I I I. I I I I I I I. I I III. Description of Home Recognizing the limitations of the site given the topography, and as evidenced by the improvements we have made to our existing home, we have designed a home that is modest in size and sensitively designed to reflect the property and the neighborhood. The following is a description of the proposed home: 1. Single-family home with two-car attached garage 2. Two-story bungalow design 3. Exterior elevations, floor plans, and site plan are attached 4. Exterior is Hardi siding, painted in natural tones to allow the home to blend into the landscape/surroundings 5. A craftsman style privacy fence near the southwest corner of the home will screen the south side yard from the street (drawing offence is provided with house plans) 6. Horne dimensions/characteristics: a. Two bedrooms, with future expansion area above garage for 3rd bedroom b. Three baths (two full and one half) c. Footprint of home is 30 feet wide and 38 feet deep d. Front porch is 8 feet deep, and extends across the front of the home e. 16x 14 foot deck (at the rear of the home), constructed on posts f. 14x14 foot screen porch (at the rear ofthe home), constructed on posts g. Attached 24x24 foot garage h. Height of the home, using the average front ground elevation and the midway point of the roof slope, is 22 feet 6 inches. 7. We propose to construct our new home at a 25-foot front setback. This setback was selected through a careful balance of the limitations of the site, consideration of the natural topography, impact on trees and the resulting driveway slope. The result is: a. 11.9% driveway slope from the street, and 4% driveway slope in front of the garage (Note: The slope of the street is 14%) b. Removal of 2 Locust trees from the slope behind the home. c. The northeast corner of the home would utilize the first 8 to 9 feet of elevation change to accommodate a limited walkout at that corner of the home. d. The south side yard substantially matches the elevation of the adjacent property. 8. The impervious surface area for the home footprint and additional structures is shown in the table below. Site and Building Issues The information provided in this section is intended to present relevant information for variances necessary to develop the site according to the existing zoning classification. Develooable area of lot 1. Because of extraordinary characteristics of the property, strict enforcement of the restrictions would prohibit development of the property to the extent intended by the zoning. Extraordinary characteristics include size, shape and topography. a. The lot 39 measures 75 feet at the street, and 150 feet deep, for a total square footage of 11,250. b. 56% of lot 39 is covered by a slope greater than 25%, thereby the remaining area is 4,950 square feet. c. These characteristics present a substantial hardship for full use of the lot. 2. Similar and/or significantly more restrictive characteristics were present for existing homes constructed in the past 10 years on nearby parcels on the North Hill. Some of these newer homes were constructed entirely on the slope. Slooe/front setbacks. and the resultin!! imoact on drivewav slooe 1. Due to the shape of the lot, and the slope on the east side of the lot, strict adherence to the slope and front setbacks would nearly eliminate the buildable area. 2. At the elevation of the new roadway surface, the slope of the driveway becomes steeper as the home moves toward the street. As a result, it is necessary to simultaneously consider the front setback, impacts on the eastern slope, and the driveway slope. To partially minimize the effect the front setback has on the driveway slope, the garage elevation is more than 3 feet lower than the main floor elevation of the home. a. The proposed 25-foot front setback provides the best balance between the impacts on the slope at the rear of the home and the driveway slope to the front. b. The driveway slope is 11.9% from the street, and 4% for a 20 foot parking pad in front of the garage. c. The setback and driveway slope will provide adequate area for parking up to two vehicles in front of the garage without impacting the street. 4 I I. I I I I I I I I. I I I I I I I. I I 3. The 25- foot front setback enables our home to be built utilizing the natural contours of the site to the greatest extent possible a. Our home will utilize the first 9 feet of elevation change from the main portion of the home to the northeast comer to provide a limited walkout at that comer. This approach uses the natural elevation change and does not alter the slope beyond that point. b. Two small boulder retaining walls at the southeast comer of the home will protect the slope from erosion at the transition from the south side of the home around the south east comer to the east side of the home. The height of the boulder retaining walls are typical to that of a standard walk out, and will not exceed 4 feet high. c. To accommodate the construction of the screen porch and deck at the rear of the home, footings to support posts will be located within the slope. This approach provides minimal disruption to the ground area for individual footings, and is similar to the deck constructed in 2003 on lot 40, but with fewer footings. Imoact on trees over 6 inches in diameter on 25% or Qreater slooes All trees on the site over 6 inches in diameter are Locust trees. It is our desire to retain as many trees as possible on the site. Because great care was taken to design the home using existing topographic elements and with consideration of existing vegetation, we were able to craft a solution that: 1. Preserves all trees over 6 inches in diameter at the rear of the home except for two Locust trees. One tree (near the screen porch) is located where a retaining wall will be constructed at the southeast comer. Another tree (behind the garage) is estimated to be two feet from the foundation for the garage, and at a higher elevation than the final grade. 2. The triple trunk Locust tree located near the eastern edge of the deck will be preserved by adjusting the deck at the time of construction, even if it means notching the rear edge of the deck for the tree. 3. The front setback at 25-feet has no impact on trees over 6 inches in diameter because the two Locust trees to be removed (see # 1 above) would need to be removed even at a 20-foot setback. (Note: A 20-foot setback would result in a driveway slope of 15%.) V. Variance Request and Justification The following listing is presented as a summary of issues supporting the consideration of variances for our future home. The size of the lot and the slopes present on the lot create a hardship peculiar to this parcel, and were not created by the owner of the property. a. 56% of the lot has slopes of over 25%. 5 I I. The parcel is a legally platted lot of record (since the early 1900's), in a residential zone which allows single-family homes to be constructed on said lots. c. Due to the slope and setback requirements, a single-family home cannot reasonably be constructed on this lot without some relief from the setback requirements. 2. The value of the lot for tax purposes ($127,000 for 2005), the purchase price of the lot in 2003 ($115,000), and the appraised value obtained by the previous owner ($170,000 in 2003) are all consistent with a buildable parcel. a. We believe our proposal presents a responsible approach to the resolution ofthe site limitations. If we are not given reasonable use of the property, we will have to sell lot 39 and then a future owner will present a variance application to the City to obtain full use of the property. b. It is very likely that another variance application would occur in the very near future, especially due to the installation of sewer and water this year. c. Even though the desires of a future owner are unknown, given current trends in home construction it is very likely that a future proposal would involve a larger home with greater impact on the site. The variance is necessary in order to exercise substantial property rights. a. The lot was platted as and was represented by at least the last two owners as a developable parcel for single-family residential purposes. b. The parcel is not a renmant parcel or an outlot parcel. It is a legally platted lot. 2. The variance would not constitute a special privilege. a. Our proposed home minimizes disruption to the slope. b. Our proposed home is consistent with the zoning of the property (single-family residential). c. Homes in the surrounding area enjoy similar if not more substantial use of slope areas. d. In some instances, homes in the area are built entirely on steeply sloped areas. 3. The estimated market value of the property is not consistent with a non-developable lot ($127,000 for 2005 taxes). 4. No reasonable/responsible use ofthe property could occur in conjunction with the existing home on lot 40 because any expansion of the home would result in construction even further onto the slope than our proposal for lot 39, because of the location of the home. 6 I I. The granting of the variance would not provide a detriment to adjacent property and will not impair public interest. a. Substantial tree coverage already exists on the east slope of the lot and will not be altered as part of this request. b. The size and height of the proposed home is modest and will have a minimum impact on views from adjacent properties. c. Adjacent property to the south (lot 38) is not developed, and at this time only contains the driveway for a home that is located several lots to the south. d. Adjacent property to the north (lot 40) has no view through lot 39 due to the tree coverage on the east slope of the property, which will remain unaltered. e. The home will not be detrimental to the neighborhood or public welfare, because of the modest size of the home, minimal impact on the site and the overall design of the structure. f. The character of the neighborhood was considered and the design of the home is compatible with older homes in the neighborhood. 2. The proposal provides for use of the site under the present zoning. 3. The proposal minimizes cut, fill, earth moving and grading: a. Minimal modifications to the natural terrain occur only to the extent necessary for the home. b. Construction/excavation activities are limited to the foundation area and the north side of the lot (for the garage). c. Construction activity in the slope to the rear of the home will be limited to deck/porch post footings or for the construction of two modest retaining walls (typical size for a standard walkout). 4. Existing natural features of the site will be preserved to the greatest extent possible. a. The natural vegetation and trees along the southern boundary will be preserved. b. As much natural vegetation on the north side as possible will be preserved between the two parcels for privacy of both property owners. c. The garage will act as a retaining wall on the north side of the lot. The lower elevation of the garage also minimizes the need for fill on the site. 5. Natural non-vegetative features of the site are preserved. a. The old stone retaining wall on the north side of the property will be preserved. b. Existing rock structures/outcroppings are preserved. 6. Modifications to the terrain will not impact water runoff and soil erosion, and gutters and downspouts will be used to collect and direct rainfall from the home and toward the City's storm system. 7. The builder will work closely with the building department to comply with all city codes and requirements for the resolution of site disturbance problems if any occur. 8. The construction of a home on lot 39 will not adversely impact the comprehensive plan as this neighborhood is designated for single-family residential in the plan. Further, the design of the home and consideration for the natural habitat are compatible with conservation objectives of the comprehensive plan. 7 I I. I I I I I I I I. I I I I I I I. I I VI. Summary Weare thrilled to make Stillwater our permanent home and enjoy being a part of the North Hill Neighborhood. We agree with the principles of the City's conservation regulations and it is also our desire to protect the slope and the trees. For that reason, and even though the water and sewer system is not quite ready for us to hook up at our current home at 1307 N Broadway, we have already hired a trenching contractor to bring the sewer and water to the house, and a plumber to make the necessary interior plumbing changes. We're concerned about the long-term environmental effects of on-site septic systems, and are looking forward to connecting to the municipal sanitary sewer and water system. Our proposed home design is an extension of that respect for the City's history and conservation through the construction of a home with a small footprint. We want our new home to blend into the neighborhood and environment, not to stand out as an obvious recent addition. Given that there will be a new owner for one of these two parcels in the next year, we believe that it is in the best interest of the City and ourselves to select the optimal solution for the site. It is in our best interest, because it allows us reasonable use of the property. It is in the best interest of the City, because we also are interested in protection of the site, at the same time that we are asking for reasonable use ofthe property. We have been responsible and respectful in our efforts to improve the home at 1307 N Broadway. Our proposal for lot 39 is in keeping with the spirit and intent of the ordinance and with the surrounding neighborhood, as well as construction that has occurred on other property in Stillwater. We would be happy to meet with the Planning Commission members on the site in the days leading up to the Planning Commission meeting, provided it is appropriate. Stillwater is a wonderful place to live. We look forward to building our retirement home as soon as possible. Despite the differing styles, from historic Victorians to modem rambler designs, most of the homes on the North Hill have existed for a considerable length of time. Because of the age of most of the homes, we selected a bungalow exterior for our future home on lot 39 because it is our desire to construct a home that will appear to have been part of the neighborhood for a very long time. Our goal is for the new home to look as if it has been recently rehabilitated, rather than newly constructed. Vlemorandum To: Mayor and City Council From: Diane Ward, City Clerk Date: 12/17/2004 Re: Designation of Legal Publications for 2005 The City has received the attached proposals from The Stillwater Evening Gazette, The Courier, and Press Publications to provide legal publication services to the City. Press Publications' proposal is considerably higher than the Gazette and Courier. The Gazette has not raised their rates from last year ($4.05 per column inch for the first insertion and $3.20 per inch for subsequent insertions of the same legal notice) and The Courier has reduced their rate from $3.80 per inch to $3.65 per inch. For over 10 years, the legal publications have been shared between the Gazette and the Courier. The Gazette has published the legal notices and the Courier has published the proceedings of the meetings as required by the City Charter. . Both newspapers have provided timely and required services in the past. However, because the Gazette is a daily paper the requirements for legal publications are easily met. The Courier on the other hand is a weekly paper and the requirement for legal publications such as a Special Meeting Notice would be more difficult to achieve. Example: Council at its regular meeting calls for a special meeting for the following Tuesday (which needs to be published three days prior to the special meeting) would not be published until the following Wednesday after the Special Meeting. RECOMMENDATION: I recommend that we continue to use the Gazette and Courier for legal publications. The Courier for the City's meeting proceedings and the Stillwater Gazette for other legal publications/notices. Even though the Gazette's quotation is higher than The Courier's, the Stillwater Gazette as a daily paper would better serve the City for other legal notices. Its function will be to keep open lines of communications to the entities that each member represents and to act as a conduit for ideas, concerns and complaints about Lumberjack Days. This will provide the public with an identifiable way to have input in Lumberjack Days. It would serve to help guide and shape Lumberjack Days in a general sense. As set forth in the LJD by laws the Lumberjack Days Board of Directors would retain authority in all Lumberjack Days operating decisions. The Lumberjack Days Festival Association Board of Directors is establishing a committee to approve making offers to music talent for appearances at the festival. Magnuson ~ December 29, 2004 FROM: DATE: RE: Request for Highway Department Reconveyance When the final site surveys were being completed for the Lofts project, a flaw was detected in the boundary that will require a conveyance from the Minnesota Highway Department. By way of background, the Minnesota Highway Department once obtained land to allow future widening of North Main Street. This additional right-of-way was acquired from the north line of Mulberry Street to Laurel Street and would have allowed for an eventual 100 foot right- of-way width through that reach of Main Street. Current plans now call for a 66 foot right-of- way now and in the future. Several times adjacent owners have petitioned the City to request the Highway Department to authorize the sale or release of this additional and now excess right-of-way. In April of 2003, the City Council adopted a Resolution to request the Highway Department convey an 18 foot parcel line between the Lofts of Stillwater site and Main Street. This request was honored by MNDot and they eventually sold the 18 foot parcel to the Lofts of Stillwater for $40,000.00. . . . The problem is, however, with the legal description of the 18 foot parcel. I enclose a survey that points out the discrepancy. It was caused by a land trade. Initially the City owned that part of Tract 2, north of the Spur Track and Bill Stouvenal, former owner of the Lofts site, owned the property south of the Spur Track. The Spur track is shown on the survey as a curved line. After the City obtained title to its parking lot, north of the Lofts parcel, a trade was arranged to allow the squaring off of the boundary. When the certificates of title for the new squared off parcels were completed they did not affect the legal description of the 18 foot strip. As a result, the conveyance obtained from the Highway Department by the Lofts in April of 2003 did not convey the 18 foot strip adjacent to the MNDot parcel that abuts the northerly 45 feet of the Lofts site. The purpose of this memo is to request that the City authorize contacting MNDot to request the conveyance of this parcel. At the same time, it is recommended that the City explore acquiring, in its own right, that portion of the 18 foot strip that is north of the Lofts site and that runs to a point 48 feet north of the north line of Laurel Street. The enabling resolution will recite that the City Council would have the right to decide whether the asking price of the portion abutting the City property is acceptable before final arrangements are made for the purchase. We regularly monitor the traffic volumes, delay, and crashes that occur at this intersection. Analysis shows that the number and severity of vehicular crashes remains low, while delay and back-ups during peak times has become excessive. We also recognize the concerns expressed by your City Council with this intersection and related development and project issues. Because of this we programmed in our 2005 Capital Improvement Program (CIP) installing a traffic signal at this intersection. The current proposal is to install a wood pole system that will be replaced with a permanent system as part of the future Manning Avenue project. No change to the road intersection pavement is needed with the wood pole traffic signal system. The design and construction of the wood pole traffic signal system would be 100% county funded. The cities of Stillwater and Grant, as well as Stillwater Township, will be asked to assume the electrical power costs to operate the signal system. I also want to let you know that project delivery in 2005 is dependent on County Program Aid we receive from the State of Minnesota. As you know, the State Legislature is facing a budget shortfall.
