(Waiver on file) DISCUSSION CITY OF STILLWATER MEMORANDUM DATE: October 6, 1995 TO: Mayor and Council FROM: Klayton Eckles, City Engineer SUBJECT: Public Hearings for: '95 Street Reconstruction Project L. I. 312 Myrtle Street Concrete Rehabilitation Project L. I. 307 Highlands 6th Addition L. I. 306 Myrtlewood Project L. I. 3 04 '94 Sidewalk Improvements L. I. 274-3 Notices have been sent out to approximately 250 property owners for the assessment hearing on the above referenced projects. To date, the city has not received any written or verbal protests to these assessments. A brief description of each assessment role and project is listed below: The 1995 Street Rehabilitation Project L. I.312 which involved a large portion of the Croixwood neighborhood, was completed this summer. The project came in under budget and therefore the proposed assessment to each lot has been reduced. Note that this project was split based on a per lot rather than frontage basis. This was possible because the lots in this area are roughly the same size. The standard lot assessment is proposed at $1,805 per lot. The feasibility study estimated the cost would be approximately $2,200 per lot. Comer lots which had one street within the project area and the adjoining street outside of the project area, were only assessed for one -half of an assessment. Therefore, there are several lots within this project area that were assessed $902.50. The school district was assessed for a greater portion of this project because the Willard Street extension to County Road 5 was constructed primarily for bus and vehicle access to the school. For the 1995 Street Project the assessments are proposed to be carried over a 10 year period at 7.5 The Myrtle Street Concrete Rehabilitation Project L. I. 307 was completed this year and property owners adjoining the project are being assessed the equivalent of street overlay costs and sidewalk improvement costs. The sidewalk in this area is wider than the standard 5 foot, therefore, residents are only being charged for a 5 foot equivalent for sidewalk repairs. The assessment rates on this project were based on overlay costs, which kept the frontage assessment down to about $14.50. Given the extent of the concrete repair work done, this is a very favorable rate for the property owners. This project is proposed to be assessed over 10 years at 7.5 The Highlands of Stillwater 6th Addition L. I. 306 was scheduled to be assessed in 1994. However, the project was not yet completed and therefore the levying of the assessments was held off until 1995. The attached proposed assessment role shows how the assessments were split. Note that the developer has agreed to pay for all of the assessment costs, so the residents in the neighborhood will not be responsible for any of these assessments. This project is proposed to be assessed over 10 years at 7.5 Last year an assessment hearing was held for the Myrtlewood project L. I. 304. At that time, the developer protested the assessment rates because these rates were based on estimates to complete the final phases of the project. For this reason the council delayed the assessments of this project. The project is now completed and the actual assessment rate can be determined. The difference between 1994 and 1995 is a slight decrease in the assessment rate per lot. This project is proposed to be assessed over 10 years at 7.5 The assessment hearing for '94 Sidewalk Improvement Projects L. I.274 -3 covers a few of the properties that were inadvertently left out of the 1994 sidewalk project improvement. In addition, it also covers the assessment to the Pappus property (see letter included in packet), which was deleted from the assessment role last year due to concerns of the property owner. This project is proposed to be assessed over 10 years at 6.75 For each of the above listed projects a proposed assessment role is attached for council review. There has been very few questions or concerns raised about this proposed assessment role, no written correspondence or protest have been received up to Friday afternoon. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 1996 and shall bear interest at the rate of 7.50 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1996. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15, or interest will be charged through December 31, of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. The City Coordinator shall thereafter provide to the Developer all such further information and documents as are requested in order to verify the costs and computations." "Not less than 45 days after the City has furnished its computations to the Developer, the City may levy special assessments with respect to the Improvements on the Property, in the manner specified in Minnesota Statutes, Section 429.061." On September 5,1995, after receiving the Notice of Hearing on Proposed Assessment dated August 29, 1995, 1 wrote to Ms. Diane Deblon informing the City that: The project is not yet complete —the storm sewer is not functional and water run -off ponds on the east side of the property; I requested the "information and documents in order to verify the costs and computations." The storm sewer is still not functional and I have not been furnished the requested cost information. In my opinion, the City has not complied with the terms of the Development Agreement. Instead, you elected to remove the bad sections and replace them yourself. We inspected the work which you completed and noted that you matched the width of your neighbors sidewalk. Your neighbors existing sidewalk is 4 foot wide, which does not meet the city standard of minimum 5 foot width. If you elect to do additional sidewalk work in the future, please keep in mind the city's minimum width standard. At last years public hearing you made it clear that you were not satisfied with the city's final product. Also, you were not satisfied with the city's administration of the policy regarding replacement. The main objective of the criteria used for repairing sidewalks is to make the sidewalks safe for pedestrians. Using this criteria, it's not possible to satisfy all concerns of the residents. Budget constraints further restrict the actions which we can take in our repair project. The new bridge is a very important and forever decision and deserves at least another brief review without the influence of MnDOT and the Metropolitan Council. It is similar to waiting 30 days before passing judgement or sentence. We feel you owe it to yourself, and to tens of thousands of local citizens who will be adversely impacted if the current bridge plan is implemented. We feel this decision is so important that, in due diligence to your respective cities and to the cities of Oakdale, North St. Paul and to the States of Minnesota and Wisconsin as a whole, you should take a brief second look. As friends, we are asking you to review the pros and cons of just six issues pertaining to this bridge. We feel the consequences of the present bridge plan dramatically out-weight the benefits. We offer a suggested alternative plan which we urge you to adopt and reccomend to MnDOT. Thousands upon Thousands of citizens are completely baffled with the current bridge plan. Most say this is the worst-of-the-worst plan that could have li en devised. Frequently, they cannot find words to express their saproval. Therefore, upon advice.from Senator Rod Grams office, we are providing you with a brief discussion of just six issues in an attempt to outline and quantify an objective and logical thinking process which will lead to a more optimal new bridge proposition. The six issues relating to the bridge proposition are: 1. The proposed approach configuration is very unsafe for motorists. (See "NEW BRIDGE PLAN CREATES TRAFFIC DEATH TRAP" page 3) 2. The current bridge plan will create much greater traffic congestion delays in Oak Park Heights until Highway 36 is up-graded to a limited access freeway. This would destroy much of the Oak Park Heights Business District and tax base. This will adversly impact Stillwater, North St. Paul and Oakdale as well. (See "NEW BRIDGE WILL INCREASE TRAFFIC DELAYS TO STILLWATER" page 3) 3. Relative to other alternatives, the current plan is for a very expensive bridge which won't resolve traffic congestion delays. It will only make them worse immediatly. (See "NEW BRIDGE WILL OFF-LOAD 1-94 and US-8 BRIDGES" page 4) page 2 4. The influx of new bridge traffic to/from Wisconsin will inhibit economic growth in the Highway 36 transportation corridor until Highway 36 is up-graded to a limited access freeway. This will impact the future tax base in Oak Park Heights, Stillwater, North St. Paul, Oakdale, and much of Washington County in Minnesota. The EIS is neither complete or objective and should not be the one and only basis to justify the bridge being proposed by MnDOT. 6. There is a much safer and much less costly alternative in the North Corridor which will reduce congestion delays and would not require the expence to up-grade Highway 36 through the Oak Park Heights Business District. We reccomend a By-Pass around Stillwater to the North Corridor and construction of a two-lane, level, bluff-to-bluff crossing for about a 100 million dollar savings. This would be a much safer and more effective bridge proposition. It would reduce congestion immediately in Stillwater and Oak Park Heights. It would not measurably contribute to urban sprawl which in turn delays the necesity to up-grade Highway 36. It would not measurably curtail further development in the Highway 36 corridor which allows Oak Park Heights, Stillwater, North St. Paul, Oakdale, and much of Washington County to add to their respective tax bases. Thank you in advance for your dedication and early response on this matter. We feel that the current bridge proposition is illogical, ridiculous, and perhaps corrupted. Therefore we will form a coalition and press to correct this unsafe and ineffective waste of 100 million dollars of our tax money. We will be happy to meet with you. These three facts make this bridge access a "death-trap" for motorists during slippery winter days and nights. The stretch of highway 36 between Oak Park Heights and North St. Paul which is level, straight, and windswept experiences about five spinouts into the ditch or median each and every morning after a night-time snow fall. There is no place to spinout on the bridge access, therefore there will be at least five accidents or collisions each time it snows. And since there is no sun to dry out the Northeast facing slope, there will be even more collisions at the foot of the proposed bridge with each new snowfall. "NEW BRIDGE WILL INCREASE TRAFFIC DELAYS TO STILLWATER" 4110 If the proposed bridge/highway project via the Oak Park Heights Business District is implemented, traffic delays will increase for Stillwater visitors, Oak Park Heights shoppers, and interstate motorists. New Traffic projections for the proposed bridge show an increase from 15,000 to 41,000 vehicles per day. Also new firms are locating in the Industrial Parks adjacent to Oak Park Heights. This could amount to a three-fold increase in both thru traffic and cross traffic. These two forms of increased traffic will exceed the capacity of Highway 36. The capacity of the three level intersections in Oak Park Heights are already stressed. Some business owners have already moved because customers have difficulty making access into and out of their parking areas. Therefore, congestion delays for Stillwater-bound traffic will be greater if this bridge is built than they are today. Likewise, interstate traffic will be delayed by this congestion for a longer period of time than it is today. Oak Park Heights shopper traffic will find itself in a virtual deadlock which will impact retail business and inconvenience area shoppers. i MnDOT will soon begin to propose plans to separate thru traffic from cross traffic. Oak Park Heights might as well face the facts. Highway 36 will require an up-grade to limited access about the time the new 411 bridge is completed. This will destroy the Oak Park Heights Business District and tax base. The EIS is in breach of public trust by failing to disclose the severity of this economic impact. page 4 "NEW BRIDGE WILL OFF-LOAD I-94, US-8 AND OSCOLA BRIDGES" Over the years a certain number of motorist who would otherwise choose Highway 36 have migrated to use 1-94 via Hudson, WI or US-8 via Taylors Falls, MN, or the bridge at Oscola, WI. Upon completion of the new bridge, most if not all, of these mortorist will return to the Highway 36 Corridor and immediately add to the Oak Park Heights traffic congestion. "PRESCOTT CROSSING LIMITS DEVELOPMENT IN HIGHWAY 61 CORRIDOR" The Cities of Woodbury and Cottage Grove, MN are finding difficulty in obtaining approvals for new development to increase their tax base. The problem originates from the growth in traffic crossing the Highway 10 bridge at Prescott WI. Other cities on the US-61 corridor are experiencing greater than expected traffic congestion for the same reason. An objective observer would expect MnDOT to give Highway 61 and the 1-494 Bridge in Newport which carries six times as much traffic as the Stillwater bridge a higher priority than the new Oak Park Heights bridge. The Minnesota State Legislature publicly questions MnDOT's judgement on this issue. We question the priority, location, and need for four lanes. If Oak Park Heights and Stillwater were team players in a County and State-wide sence they would reccomend the two-lane North Corrider bridge alternative that we reccomend. This would save approximately 100 million dollars which could then be applied to the Highway 61 Corridor and Washington County would benefit tremendously. "EIS FOR NEW BRIDGE BREACHES PUBLIC TRUST" There are several inconsistencies and omissions in the Environmental Impact Study (EIS) for the new bridge proposed for Oak Park Heights. For example: A trivial 123 acres of farmlands and less than 58 acres of wetlands would have been impacted and thereby ruled out the North Corridor option. Projected growth:in vehicular traffic from 15,000 to 41,000 must imply that more people will take up residency in Wisconsin in the vicinity of the bridge. I am positive that a growth of 26,000 new crossings for the proposed South Corridor will be comprised of new Wisconsin home owners who will impact at least 100 times as much wetlands and farmlands. This was not considered in the EIS. Another example is the presence of the beautiful Soo Line Railway Bridge located six miles North of Stillwater. This bridge is a magnificent example of Eifle Tower architecture. For many years thousands of boaters have taken their guests with pride to view and photograph this magnificent structure. A replica of the Soo Line Bridge constructed in the North Corridor would make a tremendous enhancement to the Stillwater area. Stillwater residents will embrace this "new-old" bridge with pride. Visitors would come year around to view this exquisite structure, and businesses would benefit accordingly. This, too, was not studied in the 411 EIS. 1 In other words the EIS is neither complete or objective enough to be the one and only basis for justifing MnDOT's desire to build the most expensive, most unsafe, and least effective bridge in the South Corridor via Oak Park Heights. CROIX RIVER BRIDGE FOUNDATION TESTING BEGINS LATE NEXT WEEK IN OAK PARK HEIGHTS Phone: 612/ 567 -1000 (Roseville, Minn.) The Minnesota Department of Transportation will collect information needed to finish foundation design for the new Highway 36 St. Croix River bridge in Oak Park Heights during the next few weeks. Foundation testing will begin late next week in Minnesota with the construction of two four -foot diameter shafts drilled into the bedrock on land along the shore of the St. Croix River. The shafts will be filled with concrete and then pressure tested. This will determine the strength of the rock and how much pressure it can withstand Testing in the river later this month will require building a framework around a test steel pile. Researchers will dirve a steel casing down into the river bottom then fill it with concrete and apply downward and sideways force on the piling. Barges will be lifted onto the framework and weighted down to apply pressure to the piling to discover how will it withstands the force. Information collected from the shore and river bottom tests will be used during final design of the new bridge foundation. Construction is slated to start in the spring of 1997. Carlson said that a potential $8 billion shortfall by 2001 will require major changes in the way Minnesota delivers taxpayer funded services. These changes, he said, will not be accomplished by raising taxes or just cutting spending; state government must control costs by using tools, like school vouchers and managed care, which encourage competition and by enlisting communities to handle problems before government is asked to provide expensive solutions The Governor outlined the scope of the budget gap and former Congressman Vin Weber and former legislator John Brandl, charged by the Governor to recommend major reforms, described the principles of their reform efforts. Largely due to powerful demographic changes in Minnesota, the state faces $8.3 billion gap between the demand for spending and the growth of tax revenue. By the year 2001, Minnesota's exploding senior population will contribute to a demand for a 275 percent increase in Medicaid spending from 1987. The K -12 population will grow more slowly but still create a demand for a 120 percent spending increase. According to Governor Carlson, a Minnesota family of four with an income of $48,000 would have to pay an additional $1,000 a year in taxes for the next five years to close this gap without spending reforms. "While Minnesota's baby boomers age into senior citizens and younger families continue to demand more from education, the taxpayer could get caught in the middle," Governor Carlson said. "Now, more than ever, elected officials must be prepared to make tough and even politically unpopular decisions to make sure the taxpayer is protected." The key principles of those tough choices, as explained by Weber and Brandl, are Competition, Community and Concentration. Competition, like offering parents vouchers to use at public or private K -12 schools, encourages innovation, promotes efficiency and keeps costs down. Council activities in September: METRO DIGEST Eight cities sign on as "Livable Communities" in September The Livable Communities Act of 1995 encourages partnerships between the Council and local communities to provide more affordable housing throughout the metropolitan region. Rockford, Hilltop, Lauderdale, Little Canada, West St. Paul, New Hope, Osseo and Maple Grove were the first communities in the region to become partners with the Council in a commitment for more affordable housing for low and moderate income families. The agreement is part of the Council's effort inviting metro -area cities and towns to participate in the Metropolitan Livable Communities Act established by the Minnesota Legislature. As a next step, officials from these communities will work with Council staff to develop goals for more affordable rental and owner occupied housing that fits the community's housing situation. "We applaud the leadership of these cities," said Regional Administrator Jim Solem. "These cities are working to make sure a variety of housing types are available to meet the needs of people of all incomes and at all stages of life. We hope cities and towns throughout the Twin Cities area join with us in this regional commitment to families, healthy communities and a vital Metropolitan Council economy.' Metropolitan Council Communities must decide by Nov. 15 whether to participate in the Livable Communities program. Participating communities will be eligible to compete for funding incentives in the form of loans and grants for: affordable and life -cycle housing cleanup of polluted lands for redevelopment local models of compact, creative and transit- oriented development and redevelopment. Packer appointed to Council Gov. Arne Carlson has appointed Rick Packer to the Metropolitan Council, representing Council District 10. He replaces Patrick Leung, who resigned in May. District 10 covers Columbia Heights, Coon Rapids, Fridley, Hilltop, Mounds View, New Brighton and St. Anthony. Packer lives in Coon Rapids and is a real estate developer with Arcon Development, Inc. in Edina. He was a city planner for Coon Rapids for nine years. He has served on the Metropolitan Council's Growth Management Task Force and its Regional Blueprint Blue Ribbon Task Force. He is also a member of the Builders Association of Minnesota, the Sensible Land Use Coalition and the governor's Wetland Rules Advisory Group. Approved an amendment to the comprehensive plan of St. Louis Park to develop 41 acres of land owned by the Honeywell Company and located southwest of the intersection of I -394 and Highway 100. The industrial site would be converted to the possible uses of: retail, residential, open space and recreation. Approved an application for a loan for the city of Carver to be used for planning waste water treatment. Approved an amendment to Shakopee's comprehensive plan to establish policies for private waste water treatment systems. Accepted the final report of a study on a reverse- commute program for the St. Paul and East Metro area. The purpose is to get job seekers to where jobs are, often a process of assisting with transportation from central city to areas farther out. Approved an amendment to the comprehensive plan of Savage for an addition of 113 acres to the metropolitan urban service area (MUSA) because of failing on -site sewage systems. To make the sewer construction economically feasible, the amendment exchanges 42 additional acres outside the MUSA for 45 acres within the MUSA; the 45 acres will be used as a protective buffer against further development near Eagle Creek, a designated trout stream. Transportation Authorized additional funds for a five -month extension of a contract with National School Bus Co. to provide transit service in the Roseville area—the Roseville Area circulator. Authorized additional funds for a seven -month extension of a contract with Medicine Lake Lines for transit services in the Bloomington and Edina area- -the BE -Line. Authorized extension of a contract with Transportation Displays Co. for advertising on the outsides of buses, including a limited amount of beer and wine advertising. Approved an agreement between the Council and the Minnesota Department of Transportation to apply for federal funds for transportation planning. Approved the 1995 -96 program plan for the right -of -way acquisition loan fund (RALF). The fund makes loans to counties and cities for acquiring properties in future highway corridors. A loan is repaid when the Minnesota Department of Transportation buys the property from the local government. RALF loans for the 1995 -96 period may include Hwy. 610 in Maple Grove, Hwy. 212 in Chanhassen and Chaska, Hwy. 52 in Inver Grove Heights, Hwy. I -94 in Maple Grove and Wakota bridge on Hwy. 61 in Dakota and Washington counties. Authorized Metro Mobility to execute agreements to use property tax revenues for operating paratransit service in Maple Grove and Plymouth; property tax revenues also would be used for paratransit service in Osseo, Shorewood, Tonka Bay and White Bear Township. Environment Approved a water management plan for the Vadnais Lake Area with the recommendation that cities in the area be required to adopt the appropriate floodplain, shore land, erosion and sedimentation ordinances and that the area develop a detailed strategy for improving water quality; further recommendations pertain to protecting lakes in the water management area. Rescheduled a report on the Elm Creek cluster project from Sept. 26 to Oct. 10. Authorized a payment plan for Farmington for the increase in their 1995 sewer charges. Approved the Loretto water supply -and- distribution plan with recommendations to pursue the possibility of interconnection with the Medina water system. Approved the Forest Lake water supply -and- distribution plan with recommendations: to protect the ground water because no alternative water supply source exists in the immediate vicinity to determine how water service will be provided to developing areas of the city. Authorized a contract of $450,000 with CH2M Hill, Inc. to develop procedures for selecting vendors for a solids handling project at the Blue Lake and Seneca treatment plants. Authorized a contract of $120,000 with Allen Bradley Co. to replace variable frequency drives at the Hastings treatment plant. Ratified the declaration of emergency for the collapse of an interceptor sewer near Gray's Bay Boulevard and Hwy. 101 and approved funds up to $900,000 for repair of the resulting damage; funds are appropriated from the Council's reserve contingency fund. Finance METRO DIGEST Authorized the public sale of general obligation bonds of $18 million for transit projects and $3 million for parks projects. Authorized the sale of general obligation bonds to refund previously issued sewer bonds that carried higher interest rates. Eliminated the cash payout portion of the employee voluntary separation program and extended the remainder of the program through November 15. Authorized final settlements in the matters of Ronald J. Accepted the Metropolitan Council's 1994 comprehensive annual financial report and 1994 management letter of the state auditor. Approved the 1996 budget of the Metropolitan Sports Facilities Commission. Declared an emergency because of the imminent likelihood of a strike by Transit Operations employees and authorized certain actions to ensure operation of the Council if a strike occurs. Metropolitan Commission Activities Metropolitan Airports Commission (MAC) The Commission: Awarded a contract to Shafer Contracting Co. for construction of an extension to Runway 4/22. Accepted the resignation of Commissioner Mark Brataas. After eight years on the Commission, Brataas gave notice that he will resign October 31, 1995 for health reasons. Governor Carlson has not named a replacement. Increased the parking rates at Minneapolis -St. Paul International airport to $12 daily and $60 weekly from $10 daily and $50 weekly at the general lot; and, to $7 daily and $35 weekly from $6 daily and $30 weekly for the Econolot. Metropolitan Sports Facilities Commission (MSFC) The Commission: Adopted a report on the Commission's property and liability insurance coverage. Adopted a resolution supporting fan development through the Metropolitan Sports Facilities Commission Foundation. Approved a request for proposals for a lobbyist to represent the Commission at the City of Minneapolis and government bodies other than the Minnesota legislature. Approved specifications for these projects: add restroom, showers, and interview space; and replace concourse scrubber and seating bowl expansion joints. Awarded sound system replacement contract to Commonwealth Electric Co. for $1.9 million. Decided not to opt out of proposed class action settlement in the Piper Jaffray litigation. That process takes a proposal through four steps: review by the staff of the Legislative METRO DIGEST Commission on Minnesota Resources (LCMR) review by the Citizen Advisory Committee review by the LCMR passage by the Minnesota legislature. Supported use of Environment and Natural Resources Trust funds to finance 1996- 97regional parks capital projects not funded by 1996 state bonds.
