CITY OF STILLWATER
On the morning of June 27th I returned to Stillwater and upon entering
my house at 200 Deerpath I smelled a foul odor. I found the lower level
living room and bedroom carpeting soaked with sewage/water and the
bathroom linoleum covered with 1/8" dark brown substance.
I contacted Mr. Richard Goulet, general manager of Rainbow International
Carpet Cleaning Co., on June 28th. Mr. Goulet inspected the damage and
cautioned urgent carpet removal and proper disposal along with the cleaning
and sealing of the cement floor.
After meeting with Richard Goulet I called Washington County Health Services
and talked to Pete Ganzel asking for advice and potential health risks. He advised
me to have the carpet discarded and cement cleaned properly.
On June 29th I asked Dave Junker to look at the damages and he requested
I fill out a claim form and proceed with cleaning up.
At the time of the damage I was uninsured by my home owner's policy.
The sewage/flood coverage was not added to the policy because I was
unaware of this backup problem when I purchased the house in '91. This
system needs a check valve or if one is already in place it needs to be
inspected on a regular basis. I do not believe the home owner should be
liable for a system that has failed in the past and now again on June 26, 1995.
Subsequently, I have added the sewage/flood coverages to my home
owner's policy.
Listed below are the bills that have accrued :
1. Rainbow International Carpet and Cleaning
2. New carpeting and instillation (this is a direct
replacement of the carpeting that was removed).
3. Moving and cleaning - two people at $15.00
for six hours.
4. Sheet rock damage and repair.

1995 Capital Budget
At its meeting on July 11, 1995t the Board of Trustees voted to send the
capital items on the attached page to the City Council for the release of
funds. All of the items were requested by the library and approved by the
Council in our 1995 budget request. We anticipate requesting the release
of funds for the remaining items in our 1995 capital budget in September.

CD ROM Workstation $41 91
This workstation is designated for the Reference Department. We
have a list of very useful CD ROM reference sources compiled and
waiting for the workstation.
3 Public Access Catalog Terminals 930
At the end of August, we will institute limited access to reference
services on the Internet through our automated system. Two of
these public access terminals will be dedicated to this use and one
will be for access to the full text of 650 periodicals on line.
2 Public Access Catalog Printers 700
We will institute full text access to periodicals early this fall.
Patrons will find this a great help in research, but only if they can
print the results. (We plan to charge for copies.)
2 Receipt Printers 908
Receipt printers at the check out desks will allow us to give patrons
a list of the items that they have checked out and the date due as
they are checking out. We hope that this will result in an earlier
return of materials.
2 Ergonomic chairs 330
Two staff chairs in the workroom will be replaced with chairs with
better ergonomic design.
Reupholster lounge chairs 5200
All of the 13 lounge chairs in the library are badly worn. we will
purchase replacement fabric and reupholster the chairs.
Plant

Portions of the reference and circulation desks will be lowered to
make check out, check in, and negotiation of reference questions
easier for children and people with disabilities.
Stained Glass Repair 5800
Almost all of the stained glass windows are buckling and need repair
and cleaning. Starting with those in the worst condition, the
windows will be removed, cleaned, and resealed.
Dehumidifier 202
The lower level of the library is humid in the summer. The
dehumidifier will help pro.tect materials and make staff and patrons
more comfortable

Request to Purchase Notebook Computer

When Tennison Company did their survey, they recommended that City Hall become automated to
improve proficiency and efficiency. Research with other inspection departments and other
governmental agencies have indicated to us that one of the most effective ways to accomplish this
is through the use of a notebook computer, which can be carried with us in the vehicle. This will
allow us immediate access to determine if there is a permit issued for a specific address. The present
system requires us to record an address when we notice a job in progress without a permit card
posted, when we return to the office we must manually look in the address file, which is in another
room, the 3 X 5 card file, which is upstairs, or the unfiled permits (they are filed monthly). Ifwe
do not find a permit of record, we must look up the current homeowner's name in the Public Works
office and send a certified letter to them requesting that they come into secure the proper permits or
go back out to the job site to ask the homeowner or contractor to secure the permit. Often we must
send out second and third notices to the homeowner when the choose to ignore the first letter. This
becomes time consuming and difficult, because on roofs, decks, and other small projects, the project
is often completed before we are able to contact the homeowner.
Another benefit would be to not replace Shirley Montbriand, the part-time secretarial help we had,
because we can log each inspection as we make them, then at the end of the day we would be able
to transfer all of the information from the notebook computer to the desktop computer in the office
for permanent record. This eliminates the necessity for manual paper work such as the 3 X 5
inspection card index, tallying the daily inspection logs at the end of the month and other data for
our monthly reports. With all of the information logged daily on a computer, we would be able to
run reports on a daily, weekly, monthly, or yearly basis or at any time with the push of a few buttons
rather than manually going through many files in different locations and compiling the information.
The savings generated from eliminating the necessity of hiring a replacement part-time secretary for
approximately 16 hours per week at $15.00 per hour would be about $11,500 per year, plus the hours
we spend logging in and/or searching the files, which could easily equal that figure.
If other departments need to do computer work at home (e.g., financial reports, etc.), this computer
would be readily available for their use. This computer would also compatible with all of the current
printers we now have so the work could either be printed the next morning or the printer taken home
with the notebook, eliminating the need of transferring the entire desktop computer home or working
extra hours at the office.
The building permit software necessary is already in next year's budget. This software would be
compatible with the proposed notebook computer; however, it would probably have to be purchased
with the computer. As of June 30, 1995, the department has spent a total of$71,000 including the
$15,700 for the pick-up truck. Also as of June 30th, the department revenues were already in excess
of $130,000 and by the end of July should be well in excess of $140,000, which is more than the
expected expenditures for the year.
Attached are quotes for the notebook computer. I would recommend purchasing from Wager's, who
came in with the lowest quote of $4,795.00 plus tax and a carrying case. A carrying case is
necessary because the computer would usually be in the truck and it gets quite dusty around
construction sites. The cost of this case is approximately. $75.00. We are looking at various permit
programs and it appears they cost about $3,000 to $4,000. I am requesting permission to purchase
a notebook computer and necessary software. As I mentioned above, this computer should pay for
itselfwithin six months by eliminating the part-time secretarial help and the Inspection Department
personnel's time.

The City has received a peddlers licence pennit request from Charles Annis to sell sweet com from
a City Street (Greeley Street near the Pine Street intersection). The Council recently added a provision
to the City code which states:
"No peddler is permitted to operate in any congested street or area where the operations
might impede or inconvenience the public. For the purpose of this section, the judgement of
a police officer, exercised in good faith, is conclusive as to whether the area is congested or
the public impeded or inconvenienced."
Therefore, Mr. Annis will be allowed to sell his farm products at the aforementioned location.
However, the police can ask him to move or relocate if the operation creates a traffic related problem.
Staff recommends approve of the license as part of the consent agenda.

RE: SELECTION OF CONSULTING ENGINEER FOR THE MYRTLE
STREET DUMP SITE ENVIRONMENTAL STUDY
The old Stillwater dump site located near the Jaycees ball field is a possible site of contamination
therefore City of Stillwater has enrolled this site in the Voluntary Investigation and Clean-up
program (VIC). The VIC program has a standard procedure for investigating and cleaning up
sites. The program is set up to avoid liability associated with super fund clean-up activities. The
first two steps in this process involve a Phase I Investigation and a Phase 2 Work Plan. The
Phase I Investigation is a process of documenting or compiling historical records investigating
existing information. The Phase II Work Plan uses the information gained from Phase I to
formulate a plan of action for doing additional underground and above ground testing. In order
to perform these first two steps an outside consultant is required.
I invited requests for proposals (RFPs) from seven different firms. I received six proposals and I
have listed the firm, a very brief description of my assessment of each firm and its proposal also
the price of the initial phase has been included.

1. A TEC. This firm has 'done quality work for Stillwater in the past at reasonable rates and has
developed a nitch in this type of environmental engineering, price $2410.
2. SEll. SEH has done quality engineering work for the City of Stillwater for many years. SEH
does provide environmental engineering and one advantage is that it a multi-disciplined firm
and provide engineering services beyond environmental consulting, if necessary. Estimated
cost. 15:;t>'O
3. BARR ENGINEERING. This firm is very reputable and provides regional services in
engineering and environmental consulting. This proposal is a solid one based on a common
sense approach. Cost estimate $7300.

4. RUST ENVIRONMENT AND INFRA STRUCTURE. This is a large nationwide firm with a .
local office in Minneapolis, which has many years experience working with the Minnesota
requirements. Cost is $4900.
5. PEER ENVIRONMENTAL. This firm is a smaller specialty firm known for doing quality
work and knowledgeable of the VIC program. Estimated cost of $6500.
6. STS CONSULTANTS. This firm is a national firm specializing in environmental issues.
The Minneapolis branch office has a staff of engineers knowledgeable of the VIC program
and PCA requirements. The estimated cost is $5992.
7. LBQ. This is a nationwide firm specializing in environmental issues. The estimated price
is $8500.
There is a significant difference in the prices, however, council should understand that this is the
frrst phase of the study process and the additional phases may run much more. If it becomes
necessary to take significant clean up actions the city's responsibility could go as high as
$400,000. -
RECOMMENDATION:
I am confident that any of these firms would provide excellent service to the city. Since A TEC
has demonstrated itself to be competent and reasonably priced and also now has some familiarity
with the City of Stillwater, I recommend City Council direct staff to designate ATEC as the
consultant for the Phase I Environmental Site Assessment for the Myrtle Street Dump Site and
not to exceed the amount of $2410.

DISCUSSION
Attached is a report from SEH which discusses the options available for addressing the easement
problem on Oak Glen Drive. Recall that the problem here is that the city owns a 30 foot
easement across two parcels, however, the homes were built on the existing easement. Rather
than a 30 foot clear space the city is now left with less than 17 feet. The easement is needed
because there are city sewer and water lines thru the properties. The report, prepared by Dick
Moore, lists four options for addressing the issue. The Water Board is in favor of Option 1
because it is a permanent solution that minimizes potential problems in the future. Option 2 is a
cheaper solution, but it will make maintenance and emergency access difficult in the future. The
Water Board is concerned that this option would put more future burden on the Water Board or
the City if there is a problem.
RECOMMENDATION
I recommend the CitY CoUncil discuss the situation, potential solutions and possible city liability
and direct staff on the next course of action.

Dear Mr. Eckles:
As you requested, we have investigated the matter of the location of House Number 1850 Oak
Glenn Drive in relation to the sanitary sewer and water main on the easement on the east side of
the lot.
The final dedication of this utility easement was 30' in width. We understand the house was
constructed from a plat that did not reflect the final 30' easement, rather a preliminary 12' easement.
Therefore, according to the as-built survey dated July 7, 1995 you furnished to us, the House
Number 1850 was constructed 10' too far to the east. This resulted in the house foundation being
approximately over the existing water main and 10' west of the sanitary sewer.
After reviewing the area and location of the structures and utilities, we have concluded there are
at least five alternates for a solution to the problem of the homeowner.
The alternates are as follows:
1. RELOCATE.SEWER AND WATER MAINS ON GOLF COURSE, RECONNECT ON
SERVICE DRIVE TO MAINTENANCE AREA (DRAWING 1 AND 2).
Advantages
A. Utilities under and/ or near house can be abandoned.
B. Future maintenance will be more accessible.
C. Permanent solution.
D.
Utility and drainage easement will more closely conform to standard in
development.

water main.

We have conducted this preliminary investigation as you requested, but we have not prepared a
feasibility study.
However, we feel after investigating Alternate I, this alternative would be feasible. We estimate a
construction cost range of $56,500 to $64,000. This includes 35% for engineering, contingencies,
legal and City administration and fiscal costs. This estimate does not include easement costs.
We feel the cost of Alternate II will be less than Alternate 1. This alternate is also feasible. We
estimate Alternative II may cost about $10,000.
Alternates III and IV are feasible, but we have not investigated any cost involved with moving the
two homes that encroach on the City's easement.
We also met with the Board of Water Commissioners personnel and they indicated that Alternate
I was their preference.

This letter is to confIrm our understanding of the terms and objectives of our engagement
in the nature and limitation of the seIVices will provide.
The City of Stillwater has prepared a draft of a Comprehensive Plan dated March 30,
1995. Included in the draft of the Comprehensive Plan are various SChedules related to
the fIscal impact of land use alternatives. SpecifIcally, Section 11 focuses on "Fiscal
impacts associated with the proposed land use alternatives, A.2, F.3 and E.2 described in
the land use section of this report." The various statistical and fInancial schedules relate
primarily to proposed growth in population and develOpment. The tables include
projections of property tax revenues and other City revenues.
In addition to the summary tables presented in the draft of this Comprehensive Plan, the
City has accumulated other data and statistics relative to proposed development and
expansion. You have asked us to perform the following procedures:
1. Read and analyze the various reports.
2. Identify issues which should be considered prior to proceeding with certain
aspects of the expansion including, but not limited to:
· Terms and conditions of developer agreements
· Phasing development to manageable segments.
· Funding sources for improvement bond payments
. Impact on funding sources if development occurs at a slower pace than
anticipated
· Assessable project costs versus non-assessable costs of core system
improvements
· The relationship between historical cost, market value and tax capacity values.
3. Identify any apparent or potential inconsistencies between the various reports.
4. Reference current state statutes regarding funding sources.
5. Discuss the fiscal impact of expansion with respect to annual operating cycles
versus construction and bonding commitments.
6. List recommendations for the City to consider in conjunction with the proposed
expanSIOn.

request. Our fees for this engagement will be based on our standard hourly rates. We
anticipate the total cost of the engagement to be $15,000. Should the City request

The project is set to allow the City and Developers to award the contract to the low bidder for the
Wildwood Pines project, to the low bidder for the Calibre Ridge or to the low bidder for the
combined projects. We would recommend that the City contact the developers with the bid results,

SUBJECT: Meeting with Stillwater Chamber regarding Downtown Improvement Projects.

Staff was directed to meet with representatives of the Stillwater Chamber of Commerce to review
their ideas for Downtown improvements. Attached to this memo is a list of Downtown talking
points.
Klayton Eckles, City Engineer and myself met with the Chamber.
Downtown Improvements
Listed below are the improvements discussed:
1. Replacement banners - Stillwater Chamber is taking care of this item.
2. Decorative street light ~ Decorative lighting was a part of the original streetscape design for
Downtown. The estimated cost of lighting is as much as $1 million. Street lighting could be
phase based on area or completed as one project. Lighting is a TIF eligible expense.
3. Street planters - Barrel planters have previously been provided by the Downtown merchants.
A more permanent program is being requested.
4. Litter Baskets - There is a need for additional trash receptacles of similar design to those in
Downtown. Trash receptacles cost $500 per.
5. Park Benches - Additional park benches could be placed in key pedestrian locations in the
Downtown. The cost is $800 per bench.
6. Christmas decorations - New Christmas decorations are needed. A committee of the
Chamber is looking at alternative decoration schemes. The committee will appear before the
Council at an August meeting to request City support and financial assistance to ensure that
decorations are available for Christmas.
A second area of discussion was how would the improvements be paid for. Alternatives
mentioned were a Downtown business property tax. Surcharge, general property tax, and fund
raisers were other methods.
Other areas discussed included Lowell Park improvement plans particularly extending the park
from Myrtle Street to Mulberry Point and maintenance of existing landscaped and improved
Downtown areas.
Discussion regarding Lowell Park will be made depending on federal funding availability and
local TIF funds and maintenance of Downtown areas is an operations matter and shared
responsibility of City and business community.
Recommendation
Council review of improvement projects and finance methods, and direct staff to work with
Stillwater Chamber regarding improvements and financing (including Lowell Park and
maintenance issues).

Background:
The City Council has previously directed staff to work with the Parks and Recreation Board on
developing a master plan for Pioneer Park.

Recreation Board has reviewed the scope and recommended Council approval and authorization
to advertise for consultant services to prepare the plan.
The estimated cost of the plan effort is $15,000.
A reason for the priority in plan preparation is the availability of a substantial gift for park

Scope of Work
The City of Stillwater is developing a master plan for the city's park system as part of the
update of the Comprehensive Plan. Pioneer Park, one of the most used parks in the
city and in need of major improvements will be the first on the agenda to be
implemented with a master plan.
Description of Pioneer Park:
History: Pioneer Park is named for the Pioneer Lumberman, Isaac Staples, who built a
grand stone mansion on the site in 1875. The site is located above his mill which is
located on North Main Street. The home was demolished by 1910 and it is unknown
when the City took title of the property and developed it into a park. It is unlikely that a
formal park plan was developed for this property since it not included in the Morell and
Nichol's 1918 Master plan for Stillwater. Further historical research will need to be
conducted on the Isaac Staples family as well as the Park and Recreation Board
minutes prior to 1950 in order to determine when exactly Pioneer Park was named and
designated as a park.
Setting: Pioneer park is nestled above the Downtown Stillwater. The spectacular view
from this site of the St. Croix river bluffs, the river, and Main Street is known throughout
the Upper Midwest.. North of the site is the Murdock home and West of the site is the
North Hill residential neighborhood. The Ivory McKusick house, a National register site,
faces the parks entrance along North second Street.
Park Facilities: Since no formal park plan has ever been implemented for the park, there
is no formal landscape plan, defined play area which is incorporated into the setting of
the park, and an appropriate seating area for the band shell. Picnic shelters, park
benches, and trash receptacles have been added to the park which serve a function but
do not have an architectural detailing to enhance the park and its setting. The park does
have restroom facilities and a small parking area. A circular drive was incorporated
around the foundation of the Isacc Staples home which has served as a road.

Development of a Pioneer Park Plan:
Participants:
In order to properly develop a Pioneer Park Plan, the City will need to hire a landscape
architect, who has experience in working with historic sites and landscapes. This person
will work with the project director who will administrate the planning process through a
special Pioneer Park redevelopment committee. All community organizations will have
an oppurtunity to be involved in the plan development process. including the Chamber
of Commerce, Fraternal organizations, the Stillwater Parks and Recreation Board, and
the Heritage Preservation Commission. In particular, the neighborhood residents around
the park will provide input to the planning process since they use and are impacted by
the park. A park user survey may be a good way of-gathering information on the

existing use, needs and expectations of park users.
Timeline: It is estimated that it will take 4-5 months to prepare a plan for Pioneer Park.
This timeline includes historical site research, existing conditions defining 4-5 meetings
to gather public input and prepare and formalize adoption of the plan through the Parks
Board, Planning Comission and Stillwater City Council.
Costs: In order to prepare the plan the City will need to hire a landscape architect who
has experience in historic sites and landscapes. It is estimated the costs of this study
will be from 10 to 15 thousand dollars. This does not include the Project Directors time
(City Planner), organizing the meetings, and mailings.

County Road 5 Landscape Plan
In April 1994 Council authorized $50,000 for landscaping along
the County Road 5 corridor from Highway 36 access to Croixwood
Blvd. The allocation was part of the_County Road 5 improvement
project. A master plan for landscaping County Road 5 has been
developed. The design is coordinated with the existing private
landscape concepts and with existing plant materials in the area.
The plan provides a framework for future landscaping on this
significant entryway to stillwater.
Recommendation: approval of the landscape plan and direction to
begin the bidding process for installation of the plant
materials.

SUBJECT: Acceptance of Certificated Local Government Grant for South Hill Historic
Structure Survey.
The City Council previously authorized the submission of a CLG Grant request for a South Hill
Historic Structure Survey. The total cost of the survey is $11,200. The City's portion of the cost
is $3,500 in cash and $3,200 in in-kind matching expenses as reflected in the attached budget.
The City's share of the costs will be included in next year's, 1996, planning budget request.
The South Hill Survey is the second residential survey area. (The North Hill area is being
surveyed this year).
The grant is supported by the Heritage Preservation Commission and is consistent with the City's
Historic Preservation Implementation Program.
Recommendation:
Approve grant and authorize Mayor to sign the agreement (Resolution).

Work Summary: The project will consist of survey and evaluation of the City's
South Hill Original Town. The area, plated in 1848/ is one of the early developed
residential areas in the City. It contains 55 acres, is 23 square blocks, and contains
approximately 172 properties. The project will be accomplished under the supervision
of personnel meeting the Secretary of the Interior's Professional Qualifications Stan-
dards.
Photoqraph Guidelines: The SOCIETY'S State Historic Preservation Office (SHPO) will
furnish the CITY or its contractor with black and white 35mm film to record all
inventoried properties. The first frame on each roll of black and white film will
contain a photo of a label identifying the roll as part of the City of Stillwater's
CLG Survey. As each roll is exposed, the film should be submitted to the $OCIETY/S
SHPO Office for developing. In approximately two weeks, two contact sheets for each
roll will be returned to the CITY or its contractor. The contractor should then
complete a photograph identification sheet for each roll and forward them to the SHPO
Office. The negatives will become the property of the SOCIETY--individual prints or
contact sheets may be ordered by the CITY or its contractor.

Consultations and Proqress Reports:
1. The CITY will inform the SOCIETY'S Grants Office of the name and
qualifications of the historian, architectural historian, or historical architect
with whom it has contracted within fifteen (15) days of the contract's execution.
The CITY will at the same time provide a copy of the contract and a complete
report on the procurement process demonstrating compliance with Federal
competitive procurement requirements. (See II. ASSURANCES, item B, CLG
Agreement, and Part VI of 1994 CLG Grants Manual.)
2. By November 15;-"1995;, the CITY will submit Proqress Report No.1 to the SOCIETY'S
Grants Office outlining the work that has been accomplished to date plus a
Research Design for the project. The Research Design should follow the Secretary
of the Interior's Standards and Guidelines for Identification (Federal Reqister,
September 29, 1983, pages 44720-44723), including the Ob;ectives of the survey,
and the Expected Results of the surveYi and the MN SHPO's Guidelines for SHPO
Architecture/History Pro;ects of January, 1993. Note: the Research Design
should refer not only to the material products of the survey but the kinds of
historical materials that will be used and synthesized.
3. By December 15, 1995, the CITY will schedule a meeting through the SOCIETY'S
Grants Office to confer with SHPO staff regarding the CITY' S Research Design and
inventory form intended for use in the project. If the CITY develops its own
form, it must include all the information listed on the current SHPO inventory
form.

4. By March 1, 1996, the CITY will submit Proqress Report No.2 including sample
inventory forms to the SOCIETY'S Grants Office to be reviewed by SHPO staff.

Office to discuss a draft survey report and evaluation criteria with SHPO staff.
6. By May 15, 1996, the CITY will submit Proqress Report No.3 to the SOCIETY'S
Grants Office detailing work accomplished to date.
7. The SOCIETY may request other written progress reports and on-site reviews of
project progress, as necessary.
Final Products: The Final Products to be submitted with the Project Director's Report
and Request for Reimbursement (see Part III of the Grant Agreement), will be printed
on a letter-quality printer or a typewriter (they should not be printed on a dot-matrix
printer). Products should conform to the standards and guidelines specified in the
most current edition of the MN's SHPO'S Guidelines for SHPO Architecture/History
Pro;ects. Products will consist of:

Inventory forms for all surveyed properties. All forms will be typed and
numbered according to the established SHPO numbering system (for Washington
County the number system is WA-SWC-xxxx (See Appendix E of SHPO Guidelines).
Each form will contain an original photograph of the property using one of the
two contact sheets with the sheet identification number written on the back of
each frame (see Appendix G of SHPO Guidelines). Data from current SHPO inventory
forms for Stillwater should be incorporated into the inventory forms prepared by
the CITY (SHPO staff will provide copies of the current inventory forms at the
commencement of the project). UTM coordinates are also required (see Appendix
E SHPO Guidelines) .

2. A narrative report of the survey. This report must conform to the Secretary
of the Interior's Standards and Guidelines for reporting identification results
(see Federal Reqister, September 29, 1983, pages 44721 and 44723), and MN SHPO's
Guidelines for SHPO Architecture/History Pro;ects of January, 1993 (see Appendix
D). A statement providing the total number of properties inventoried and the
total acreage surveyed must be included in the abstract or management summary.
One unbound and two bound copies (see No. 4 below) of this report are to be
submitted to the SOCIETY.
3. A map indicating each surveyed property or other appropriate map. If available,
the individual-properties should be plotted on a plat map which indicates the
precise location of individual properties. Color coding schemes should not be
used because they do not photocopy. (See Appendix F SHPO Guidelines.)
4. The two bound copies of the final product, with the exception of the inventory
forms, should be bound with a GBC binding.
Pro;ect Director's Report: The report will include a brief description of the
administration of the project. Two copies of this report will be submitted to the
SOCIETY'S Grants Office with the Final Products and the Request for Reimbursement Form
(see Part III of the Grant Agreement) .

Reimbursement Schedule: The CITY will be reimbursed, in total amount not to exceed
$4,500, for the actual amounts expended under the federal (HPF) portion of the budget.

I enclose a earnest contract money that has been prepared by the lawyers for the Port of
Sunnyside, offering to purchase a 75 foot strip of the Aiple property for the sum of $20,000. Also
enclosed is the earnest money check provided by the buyers in the amount of $2,000 and a letter from
their lawyer explaining their reasons for requesting the purchase and that they would gladly accept Title
to the property subject to the Aiple Lease.
If the City is willing to consider such an offer, they must now proceed under Section 16.01 of
the City Charter that was amended in May of 1994 to provide a procedure for informing the public about
the proposed sale. It would be helpful if City Council would make a review of the proposal and decide
whether there is enough interest on the Council to proceed with the process for a sale since if a five-fifths
vote is not readily apparent it does not make any sense to go through the publication procedure and incur
the costs associated therewith.

Preapplication request for Tax Increment Financing Assistance for development
in West Stillwater Business Park, TIF-95-2.
The request before the Council is a preapplication for TIF Assistance. The project is for
Schoonover Body works. They plan to construct a 13,739 s.f. (600,000 A V) facility on Curve
Crest Boulevard between Stillwater Clinic and Stillwater Veterinary Clinic. (See enclosed plans).
The facility is a high-tech body repair operation with the most current environmentally safe
repair and painting operations.
As can be seen from the site and building design plans, the structure is attractive in appearance
and well landscaped.
Assistance Requested
Tax increment financing assistance is being requested so the project can proceed. The site is in
the TIF district and will generate revenues. The TIF policy for retail areas is five years of 50%
assistance. This body repair use is a heavy service use and will result in 14 new jobs paying
good salaries. They project employment growth to increase to 25 within two years of opening.
Staff recommends because of the nature of the area that five years of 100% "pay as you go"
assistance be provided to write down the cost of the land. This is consistent with other industrial
type projects constructed.in the business park area.
If this level of City assistance is acceptable, staff can be directed to prepare the necessary
development agreement for consideration at your August 15th meeting. The developer is
prepared to begin construction late summer/early fall.

Consideration of request and direction regarding TIF assistance.

Dear Council Members:
My husband and I own 3 ~ lots on the ravine located west of Everett Street. On Thursday, July
13, 1995, I contacted Mr. Steve Russell and informed him of the dangerous condition that existed
on our property from a tree that was becoming uprooted due to erosion along Linden Street.
On July 15, 1995 that tree and several more trees were uprooted. Due to the moratorium, we are
prohibited from removing the trees and request the city to remove the downed trees.
By this letter I am putting the city on notice of the dangerous condition existing along the ravine,
that the city, by its own ordinance, prevents the homeowner from correcting.
Please consider taking immediate action to direct staff to view the site and develop a plan that
will permanently address the problem. The current condition gives rise to serious public safety
issues.

On behalf of the American Cancer Society, we would like to invite you to attend Stillwater's first
annual River of Hope Classic - Relay for Life. The event will be held at Miller Stadium at the
Stillwater Junior High School on August 4th and 5th from 6:00 p.m. Friday to 6:00 p.m.
Saturday.
The River of Hope Classic - Relay for Life is a team event where teams of 8-12 family members,
friends, colleagues or any combination participate in a 24-hour overnight event. Team members
raise $100 each in sponsorship funds that they bring to the event. Camping, fun, food,
entertainment, and camaraderie are all part of the festivities. We will have 30 teams participating
this year. With family and friends, this will amount to between 300 and 500 people for the
overnight.
The Relay for Life began in 1985 in Tacoma, Washington when Dr. Gordon Klatt, a Stillwater
native, ran around a track for 24 hours, raising $27,000 for the American Cancer Society. From
his initiate grew a te~ event, and interest developed into creating a national signature event.
Today Relay for Life has'raised more than 54 million dollars for the American Cancer Society.
Please take the opportunity to be a part of this great fun-filled family event. The enclosed
brochures describe the event.

We are writing regarding the Section 106 Memorandum of Agreement (MOA) on the St.
Croix River Crossing Project. This MOA was executed by the Advisory Council, the
Federal Highway Administration, the Minnesota and Wisconsin State Historic Preservation
Offices, and the Minnesota and Wisconsin Departments of Transportation.
The MOA addresses the impacts of the project on three National Register eligible properties
- the Bergstein House and Shoddy Mill, the Log Cabin, and the Stillwater Overlook. The
mitigation measures for these effects have been initiated by MnDOT.
Recent events have raised a concern about the effects of the project on a fourth historic
property, the Stillwater Bridge. This property is listed on the National Register of Historic
Places. The MOA indicates that the bridge will remain on each state's respective trunk
highway systems and will not be affected by the project. However, in response to project
related issues raised by the National Park Service relative to the Lower St. Croix National
Scenic Riverway (LSCNSR), the Minnesota Department of Transportation wrote the Federal
Highway Administration on 25 April 1995, stating the following:
"In recognition of the purposes for which the LSCNSR was designated, and in
recognition .of the. impact of the proposal on those purposes, we agree:
1. That only normal maintenance will be performed on the existing Stillwater
bridge and that the estimated useful life is 10-15 years.
2. That the existing Stillwater bridge will be removed within 10 years of
completion of the new bridge. Any necessary compliance procedures will be
completed as part of this decision making process to insure that we can make
such a commitment. "
This agreement concerns us, because it appears that the current project now does have an
effect on the historic bridge. If this is true, then ~itigation measures addressing the effects
should have been included in the MOA.

There are several ways that the position taken by MnDOT could affect the historic bridge.
For example, as part of the ongoing survey of historic bridges being undertaken jointly by
MnDOT and our office, a management plan for historic bridges is to be developed. A
component of that management plan is expected to be a program of more proactive
maintenance of certain historic bridges, and we would expect that the Stillwater bridge would
be a prime candidate, in order to extend its life and value as a cultural resource. The recent
MnDOT letter could chill this discussion. Further, at the point that the bridge is no longer
useful for vehicular traffic as part of the trunk highway system, it may be a good candidate
for another transportation purpose, such as a local road or a trail. Similarly, the recent
MnDOT letter could chill the discussion of alternate uses that could leave the structure in
place rather than remove it.

Also of concern are several recent media articles which have clearly interpreted the MnDOT
letter as a straightforward statement that the bridge will be removed in 10 to 15 years.
MnDOT has pointed out that their letter also indicates that necessary compliance procedures
will be completed. However, in the eyes of the public, it.appears to many that the case has
been settled. In such an environment, any active interest to plan for the future of the historic
bridge may easily be stifled.
Finally, we take exception to the MnDOT statement "In recognition of the purposes for
which the LSCNSR was designated..." as a prelude to an agreement to demolish a cultural
resource on the riverway. The LSCNSR's purpose, as we understand it, is to preserve
historic and cultural values as well as scenic and other values. The statement by MnDOT is
unnecessarily pejorative with regard to cultural resources.

We believe that discussions of the project relative to the Section 106 review need to be re-
opened, and amendments to the MOA need to be considered. If you have any questions

Dear Community Leaders:
With a borrowed $50, a little bit of luck and a great deal of determination,
Charles "Red" Schoonover started his body repair business in 1937. Fifty-eight
years later, Schoonover Bodyworks continues to grow, employing more than 30
associates and producing annual sales over $3 million.
Growth Potential. In 1995, Schoonover Bodyworks is implementing a three-
pronged growth strategy which consists of: 1) increasing expansion in our target
markets 2) building upon our dealer network and 3) developing direct repair
programs in partnership with insurance companies to better serve existing and
new customers.
The emergence of chain service centers and superstores has dramatically
changed today's business climate. To compete effectively, an independently
owned and operated facility must provide exceptional service. While many small
repair centers have struggled, Schoonover Bodyworks has enjoyed steady
growth. The company's repair quality, service and timeliness consistently
receive high ratings from customers, according to independently conducted
customer surveys.
Our new facility located in Stillwater would provide convenient service to our
growing customer base in the area. In addition to better serving our customers'
needs, we would create many livable-wage jobs. We anticipate hiring 14 new
employees, 9 production and 5 professional, to open the facility. The salary
range for these positions will be $27,000 - $34,000 per year. While we would
rely on some resources from our existing facility in Shoreview to support the new
location initially, we will recruit associates from the local Stillwater area work
force. After one year in our new location, we project 18 employees and after two
years, 25.
Community Involvement. One of the secrets to Schoonover's success has
been our active involvement in the local community. During the '50s, Dick
helped his father by sweeping floors, tending the finicky furnace and filling in as
a gopher. He learned all aspects of the business, including the importance of
being a good neighbor.
When Red passed away in August of 1966, Dick took over. Under Dick's
leadership, the company purchased property, which even his banker questioned,
in the northern suburbs. Once occupied by a hobby farm, Schoonover
Bodyworks built a 14,500 square foot facility. While Dick and his wife Beryl,
invested heavily into the business, they also became integral parts of the
community. Familiar faces on local boards and committees, they worked closely
with city, schools, professional associations, churches and industry
organizations.
Staff members are encouraged to be active in the community. In recent months,
Schoonover staff have painted playground equipment for a local elementary
school, served as a guest speaker in a college class discussion about business
ethics, and participated in the Performance Plus program at Mounds View High
School to recognize and reward perfect attendance and improved behavior.
Return on Investment. The $50 Red borrowed from businessman Harold
Slawik in 1937 was enough to purchase a small air compressor and some basic
supplies. Today, the Shoreview facility bristles with state of the art electronic
diagnostic and repair gear - more than $1 million worth of the stuff, much of it
purchased in the last five years. There's a unique overhead vacuum system
which removes dust and sand particles from the air. Then there are two
innovative painting booths which use a downdraft, waterwash system. Cars are
painted and baked to a factory-showroom, flawless finish, a Schoonover
signature.
Not to mention the Uni-Body computerized frame measuring systems which
ensure damaged vehicles are restored to within 3 millimeters (the thickness of
two dimes) of their original condition, as well as sophisticated computer
estimating, management and accounting systems that transfer data
electronically to various insurance companies.
The extraordinary commitment to capital equipment will be supported by
extensive staff training, pollution prevention, energy conservation and recycling.
Due to extensive capital outlays for equipment and development costs for the
site, the tax increment financing assistance is essential to proceed with this
project. The unusual aspects of the business will include meticulously-tended
lawns and carefully screened holding areas which shatter the sterotype often
associated with repair facilities.

Public involvement is important in planning for the future. The Metropolitan
Council is hosting a series of community meetings on a range of regional
issues. You are invited to a brief presentation on the Metropolitan Livable
Communities Act, the Elm Creek Cluster Planning Project, Regional Growth
and Development Options, and Transit Redesign. There will be an

Gentlemen:

Kellison Company will be assisting Mr. Dick Schoonover in the design and construction, as well as
other functions, required for the above-referenced project in Stillwater, MN. As such, we have
prepared the following information in accordance with the City of Stillwater pre-application for tax
increment financing assistance.
1. The boundaries of the property as well as a vicinity map are shown on sheet Al.l of the
drawings.
2. The project as currently designed comprises a total of 13,739 sq. ft. of which approximately
3,500 sq. ft. is office and parts facility with tf?e balance being the production area. The
building will be utilized as an automobile body repair facility open to the general public and as
a proprietary provider for certain local automobile manufacturers. The traffic ingress and
egress will be off of Curve Crest Blvd. utilizing shared driveway facilities with the properties
directly adjacent to the east (undeveloped at this time) and to the west (Stillwater Veterinary
Clinic). The access to the site is in alignment with the current left turn lanes in Curve Crest
Blvd. It is currently anticipated to commence construction on this project as early as pOSSIble
in September 1995 with completion by mid-January 1996.
3. The property is currently zoned BP-I and we anticipate no requirement to alter that zoning.
Due to the nature of the facility, there will be overnight outside parking required for vehicles
to be repaired which may require a special use permit. In all other ways the property, as
proposed, meets all existing land use designations, zoning requirements, and setbacks.

4. Due to the relatively high price of the land, including the outstanding assessments, as well as
the in ordinate cost required to provide the screening necessary to provide for an attractive
facility with the project's parking requirements, the developer would not be able to complete
this project without assistance from the city. As I am sure you are aware, the new equipment

required for a shop of this size is extremely high and will require a large use of capital during
the first seven to ten years of its existence. Therefore, the tax increment financing assistance
from the city is necessary to mitigate those unusual development expenses as well as the
capital outlay for equipment.
5. It is currently anticipated that the land will be assessed at a value of approximately
$120,000.00 and that the building improvements will be assessed at a value in excess of
$600,000.00. We will be asking Washington Co. for a preliminary assessed valuation in the
near future. The balance of the information for this item will be provided by the developer.

by the timeframe outlined above, we are most anxious to proceed with the approval process from the
city and will accommodate your requests as rapidly as we can.
