Dear City Clerk or County Auditor:
Minnesota Statutes Sec. 134.34 and 134.341 affect city and county
funding for participation in regional public library systems.
The law requires that the Department of Education certify annual-
ly to you the minimum amount of local support necessary during
the next calendar year for your city or county for continued
eligibility to participate in your regional public library
system. Maintenance of effort by participating cities and
counties is required by state law for the regional pUblic library
system to continue to receive federal and state aid funds. Once
required minimum levels are met, a city or county may increase
support to whatever level it chooses. In most regional library
systems, contracts, agreements or budgetary needs call for
amounts larger than the minimums certified to you by this Office
in the enclosed certification.

The minimum level of local support is determined in one of two
ways. The minimum level is the larger amount of:
(1) The dollar amount provided for public library service
during the second preceding year (not less than the amount in
1993 must be provided in 1995, for example) as specified in Minn.
Stat. 134.34, Subd. 4a.; or
(2) The dollar amount equivalent to the lesser of either:
(a) .82 per cent of the adjusted net tax capacity of all
participating areas for the second preceding year (1993 adjusted
net tax capacity, payable 1994, is used for 1995, for example) as
specified in Minn. Stat. 134.34, Subd. 1; or
(b) $7.64 per capita in 1995 for the population of areas
taxed for pUblic library service as specified in Minn. Stat.
134.34, Subd. 1.

When the adjusted net tax capacity decreases, there is a provi-
sion to allow the minimum to decrease by the same percentage the
tax capacity decreased. However, with increasing use of librar-
ies and increased costs in providing library services, any reduc-
tions in library budgets will jeopardize the quality and quantity
of services to the public.
Minn. stat. 134.34, Subd. 1 states that: "In no event shall the
Department of Education require any city or county to provide a
higher level of support than the level of support specified in
this section in order for a system to qualify for a regional
library basic system support grant. This section shall not be
construed to prohibit a city or county from providing a higher
level of support for public libraries than the level of support
specified in this section."
The enclosed certification Form states the minimum amount of
local support for operating purposes in 1995 for eligibility for
participation in a regional public library system. If there are

PROGRAM
Background:
Early 1995 will see the completion of the comprehensive plan and the preparation of more specific plans and
studies called for in the comprehensive plan. Listed below with a cost attached are the special projects that have
been previously discussed by the councilor are anticipated as part of plan implementation. A request for
$10,000 is being made to cover final comprehensive plan work and special projects.
North Hill Historic study
McKusick Lake Study and Pathway Plan

. part of developing the comprehensive plan, a GIS parcel final was developed to update the file for future
ects and apply the data current planning applications, $4,000 is requested. The update could be
accommodated with student intern or consultant assistance.
Besides the normal supplies and services with an adjustment for special projects listed above, the following
items are requested for 1995:
. Citizen participation course. $800
. Computer application arch view courses - $500
. A second phone line in the planning office is also requested and a permanent map file - $400 total
. For 1995 a car allowance of $300/month is requested to pay for the community development director's
car use while attending after hours and special meetings (over 100 last,year).
. The budget request for 1995 represents an increase in projects and activity reflected in the increased
interest in parks planning, community participation and computer application for planning activities.
. No new staff is requested to support this increase in activity so consultant assistance is necessary.
The figures in this memo are shown in the attached line item community development budget request.

ELECTIONS - REFERENDUM LANGUAGE
Reminder to Council:
Language for the 1 % sales tax question must be submitted to the county auditor no later than
September 23, 1994, for inclusion on the ballot for the November 8 General Election.
Chapter 205.16 NOTICE
Subd. 4. Notice to Auditor. At least 45 days prior to every municipal election, the
municipal clerk shall provide a written notice to the county auditor, including the date
of the election and the offices and questions to be voted on at the election.
Action required:
It would be helpful if the language to be used for the referendum
question could be finalized by September 14, 1994, to enable prompt
submission of the required notice to the county auditor.

STATUS ON GREASE TRAPS
CAT BALLOU'S - 439-4567, Dick Anderson - 430-1236
Talked to Dick Anderson, the owner, on August 23, 1994. Grease trap was installed at Cat Ballou's in
February, the Health Department inspected. They also installed one at St. Croix Boat.
DOCK CAFE - 430-3770, Mike McGuire - 439-3710
Talked to Mike McGuire, the owner, on August 24, 1994. Grease trap has not been installed. After they
received fIrst notice, they contacted Ra-Mar Plumbing right away to do the work. They intend to get it
in, but Ra-Mar hasn't gotten back in touch with them.
ELK'S LODGE - 439-5276
Have not been able to reach.
GOOD SAMARITAN HEALTH CARE - 439-7180
Talked to Charlie Huiink on August 23, 1994. Grease trap has not been installed. They are working
with their plumber and the consultant for their St. Paul regional office. He wasn't very specifIc, thought
it might take up to a couple of months yet to get it in.
GREELEY HEALTH CARE - 439-5775
Talked to Jim Spafford, the maintenance supervisor, on August 23, 1994. Grease trap has not been
installed. After they received fIrst notice, they contacted Ra-Mar Plumbing right away. He hasn't heard
from Ra-Mar, but will contact them again.
HARBOR BAR - 430-3224
Talked to Ed Schmidt on August 24, 1994. Grease trap has not been installed yet. He just talked to
Choc yesterday and called Wiley Simonet to do the work. He will be ordering it tomorrow, he expects
it to take a week to get it and a week to put it in. He's going to call Choc when it's in.
LINDEN HEALTH CARE CENTER - 439-5004
Talked to Bill in maintenance on August 23, 1994. Grease trap has not been installed. Linden Health
Care Center and Greeley Health care are working together. Greeley Health care is supposed to contact
him. He said is was going to call Greeley and check.

Talked to Dick Chilson, the owner, on August 24, 1994. Grease trap has not been installed. They don't
really intend to put one in because they send their grease out.
MAIN CAFE - 430-2319
Talked to Kevin on August 23, 1994. Grease trap has not been installed. The water for the whole
building goes through his business. If it'll cost $800-$1,000, he'll be unable to put it in unless he's given
some sort of tax break. $800 is a lot of money for a small business to have to pay.
PAPPY'S ON THE RIVER - 430-1147
Talked to Debbie, the general manager, on August 23, 1994. The grease trap has not been installed.
They need specifications on what they need. Someone from the City was supposed to let them know,
but no one has gotten back to them.
SAVORIES - 430-0702
Talked to Kristin Klemegsrud, the owner, on August 24, 1994. Grease trap has not been installed. She
doesn't think they need a grease trap. Their business creates very little grease, and they don't dump their
grease down the drain. She feels they should be looked at differently. Also, if they do need a grease
trap, why are they responsible? She said she was told two months ago that the City would pursue this
as the building owner's responsibility (AI Ranum). She also said that when she was first told about this,
she was told the estimated cost would be $200-$300. Yesterday Choc and Zepper were there and told
her the estimated cost would be $800-$1,000, and they can't afford to pay that. She wants to talk to
someone regarding all of this.

doing the work. He wants specifications from the City about requirements. He will do work promptly.

Talked to Dave on August 25, 1994. Grease trap has not been installed. The club manager, Jim Smith,
has been out of town. He is supposed to be back today or tomorrow and they will be addressing it as

Federal STP funds were granted for Trunk Highway 5 and Trunk Highway 36
interchange reconstruction project.
Oak Park Heights has invited the Minnesota Department of Transportation to an
informational workshop on this project Wednesday, September 14,1994 at 7:00 p.m.
at Oak Park Heights City Hall.
We're extending an invitation to Target Stores to attend this workshop. Please respond
to LaVonne Wilson, 439-4439, if a representative will be attending.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
ENCOURAGING THE HONORABLE ARNE CARLSON
GOVERNOR OF THE STATE OF MINNESOTA TO CALL A SPECIAL
SESSION AS SOON AS POSSIBLE TO DEAL WITH THE ISSUES
RAISED BY THE MINNESOTA SUPREME COURT IN MATTERS
AFFECTING THE RELEASE OF SEXUAL OFFENDERS WITHIN THE COMMUNITY
WHEREAS, the City of Oak Park Heights is located in a
community which has contained within it or adjacent to it, two
major correctional facilities; and,
WHEREAS, recent decisions by the Minnesota Supreme Court
indicate inadequacies in the laws of the state affecting the
ability of the Department of Corrections to protect the children
of the state of Minnesota from repeat sexual offenders; and,
WHEREAS, it appears that additional legislation is required
so that predatory and repeat sexual offenders not be enabled to be
released within the community to once again perpetrate crimes
against the children and the people of the State of Minnesota; and,
WHEREAS, the point of release for most of these individuals
as has been currently displayed within the past week is in the Oak
Park Heights, Bayport and stillwater communities.
.
NOW, THEREFORE, BE IT RESOLVED by the City council for the
City of Oak Park Heights, that this City, on behalf of all of its
children and the members of the public throughout this community,
request that the Governor of the State of Minnesota call as soon
as reasonably possible a special legislative session to deal with
the inadequacies of the existing state laws affecting the release
of repeat and predatory sexual offenders within the State of
Minnesota.

RE: Krafthefer - Robinson Fence Dispute
Robinson is claiming that Krafthefer is maintaining a public nuisance in
violation of M.S.S609.74, by placing a small fence at the end of what is known
as North 3rd street.
The construction of a fence is a public nuisance where it is constructed and
maintained within the right of way limits and it "impairs the usefulness" of the
highway to the public or makes such use "dangerous". (Op. Atty. Gen., 377-B-10-
j, April 10, 191). This standard was further refined in Fish v. Hanna Coal and
Ore Corp. (D. Minn. 1958) 164 F. Supp. 870. "The interference must be a material
and substantial one for a nuisance to exist that entitles the party to relief".
Nuisance is based upon the sensibilities of the reasonable person.
In this situation, the fence is located at the edge of a dead end road. Just
beyond the fence is an area of land fill. This area is the site of environmental
cleanup efforts. (See attached drawings for reference). Applying the standards
set out by the Courts and the Attorney General, the location of the fence does
not appear to "impair the usefulness" of the roadway. Al though the Robinson
property does extend beyond the fence, their access to the roadway is not
obstructed. The Robinson driveway is not blocked by the fence, nor is the fence
on the Robinson's property. Therefore, the location of the fence is not a
"material and substantial interference" for purposes of travel to and from the
Robinson property.
The only use that maybe impaired is parking. Apparently the previous owners of
the Robinson property parked a vehicle at the edge of the road for a number of
years. This was prior to the 1993 survey which revealed that the Krafthefers are
in fact the owners of the roadway.
There are several reasons why denying access for parking purposes does not amount
to a "material and substantial interference". Just beyond the fence is an area
of land that is approximately 50 ft in length. This area of fill drops off
sharply into a ravine. The American Testing and Engineering Corporation (ATEC)
has determined that the "Crest" of the slope is unstable and shows signs of slope
failure or "slumping". In addition, the fill area is an environmental cleanup
site. Given the condition of the fill area the location of the fence actually
confers a benefit upon the public. strangers to North Third Street now are
warned not to pass beyond the fence.
In addition, if the Robinsons were to park where the fence now sits, the City's
access to the fill area for cleanup efforts would be obstructed. Although the
fence may obstruct parking, such interference is neither substantial nor
material. The Robinsons have the option of parking in their driveway. It is in
the best interests of the public to maintain the fence.
Based upon a careful review of the facts and thorough research, we have concluded
that the Robinsons do not have a cause of action for public nuisance.
