PUBLIC HEARINGS
1. Case No. SUBN/94-58. This is the day and time for the public hearing to consider a major
subdivision of a 6.0 acre parcel of property into 11 lots with a variance to the wetland setback
requirement for road location, 50 ft. required. The property is located on the northeast side of
Boutwell Road and west of County Road 12 in the RA, Single Family Residential District. Bill

1. Workshop - Human Ri2hts Commission
Members of the Stillwater Human Rights Commission Task Group met with Council
regarding the establishment of a Stillwater Human Rights Commission.
e Motion by Councilmember Thole, seconded by Councilmember Zoller to direct the City
Attorney to draft a model ordinance for Council review at the next meeting. All in favor.
2. Authorizin2 advertisement for bids for the United Buildin2 Center project.
Motion by Councilmember Thole, seconded by Councilmember Zoller to adopt the appropriate
resolution authorizing advertisement for bids for the United Building Center project. (Resolution

APPROVAL OF MINUTES
Mayor Kimble noted a correction to the minutes of March 7,1995 Recessed Meeting:
page 6, the motion to approve Case No. PUD/95-8 was made by Councilmember
Cummings and seconded by Councilmember Bealka.
Motion by Councilmember Cummings, seconded by Councilmember Thole to approve the
minutes of March 7, 1995 as amended. All in favor.

1. Metropolitan County-Wide Juvenile Curfew Ordinance -
Richard Arney, Washington County Attorney, and Doug Johnson, Assistant County
Attorney, Juvenile Division addressed Council regarding a County-Wide Juvenile Curfew
Ordinance.
Motion by Councilmember Thole, seconded by Councilmember Bealka to adopt the appropriate
resolution supporting a county-wide, nighttime curfew for juveniles. (Resolution No. 95-66)

2. Dick Anderson - Ice Arena Operations -
Dick Anderson, St. Croix Catering, addressed Council regarding the expenditure of over
$7,000 for R-I2 refrigerant. He requested a credit of $6,000 towards the rental fee.
Motion by Councilmember Zoller, seconded by Councilmember Cummings to allow a $6,000
credit to St. Croix Catering for the rental of the Lily Lake Ice Arena for repairs made to the
arena. All in favor.

Motion by Councilmember Zoller, seconded by Councilmember Thole to adopt the appropriate
resolution approving the Consent Agenda of March 21, 1995 including the following:

Chief Beberg reported that Stu Glaser, Parking Enforcement Officer, has resigned. The
position has been advertised.

replacement of the Downtown Parking Enforcement Officer. All in favor.

resolution employing Richard Schmidt as interim Downtown Parking Enforcement Officer.

Chief Beberg updated Council on the movie currently being filmed locally: his officers
have incurred 200 hours of overtime which will be paid by the production company.
A traffic study is being conducted on Fourth A venue South.
Chief Beberg is looking into additional interim space for the police department.
2. Consulting Engineer -
Consulting Engineer Moore discussed the problems with cracking on Northland Avenue.
Mr. Moore and City Engineer Eckles said they would monitor the streets and also meet
with the contractor to discuss possible remedies.
3. City Engineer -
City Engineer Eckles reported on a request for dredging by the Stillwater Yacht Club. Mr.
Eckles reported that he felt it was not the City's responsibility to maintain the Yacht
Club's harbor access and recommended that the City take no action at the present time.
He suggested that the project could be done in the future in conjunction with the levee
wall project. Council took no action.
4. Community Development Director -
Community Development Director Russell reported to Council that City Planner Ann
Pung- Terwedo has accepted a position in Lake Elmo and has resigned her position with
the City of Stillwater effective April 25, 1995.
Motion by Councilmember Thole, seconded by Councilmember Zoller to advertise for a
replacement for the City Planner position. All in favor.
Motion by Councilmember Zoller, seconded by Councilmember Bealka to receive a
recommendation from the Planning Commission on the Comprehensive Plan on Tuesday, April
4, 1995 and set a date for a workshop with the Planning Commission. All in favor.

1. TIF Assistance. Readex
The applicants have requested that this case be continued.
2. Case No. SUB/95-10 - Approving resubdivision of a 31, 200 square foot lot with 6 residential
units and a 13,500 square foot lot with an auto-service use and a residential structure into two
lots of25,800 square feet with six residential units and 18,900 square feet with an auto-service
use and residential structure. The properties are located at 1624-1634 S. Greeley Street in the
RA, Single Family Residential District. David and Nancy Roettger and Rick Ritzer, applicants.
Mr. Russell reviewed the request. The Planning Commission unanimously recommended
approval of the request.
Council discussed the condition of approval requiring the planting of five additional trees.
Rick Ritzer, applicant, opposed the condition of approval; he stated he would be willing to
move the existing trees from his front yard to the west side of the site.

Motion by Councilmember Thole, seconded by Councilmember Cummings to adopt the
appropriate resolution approving the resubdivision of a 31,200 sq. ft. lot into two lots of 25,800
sq. ft. with six residential units and 18,900 sq. ft. with an auto-service use and residential
structure at 1624-1634 S. Greeley Street in the RA, Single Family Residential District, with
amended conditions of approval requiring two pine trees to the west, and keeping the two pine
trees on the north. (Resolution No. 95-70)

districts (continued from March 7, 1995)
Mr. Russell explained the proposed changes in the ordinance. Mayor Kimble stated that the
Chamber of Commerce has requested additional time to study the proposed ordinance. Betsy
Larey, River Valley Athletic Club and Andy Kass, Sutlers Wine and Spirits, spoke against
the proposed ordinance.
Motion by Councilmember Cummings to have a second reading of an Ordinance 805. Following
further discussion, Councilmember Cummings withdrew his motion.
Motion by Councilmember Thole, seconded by Councilmember Zoller to direct Ordinance 805
back to the Planning Commission. All in favor.

8. Acquisition of Land for Park
Motion by Councilmember Cummings, seconded by Councilmember Bealka to direct staff to
pursue the acquisition of land for park purposes as recommended by the Parks and Recreation
Board, with the acquisition of the McKusick Road improvement project mitigation land as the
priority. All in favor.

Motion by Councilmember Thole, seconded by Councilmember Bealka to adopt the appropriate

WORKSHOP
a. 1995 Police Department Work Pro~ram
Police Chief Don Beberg presented the Council with an overview of the function and
organizational structure of the Stillwater Police Department. The discussion included:
explanation of the duties and responsibilities of the various positions employed by the
department; the equipment used by the department and the area served by the department.

B. 1995 Fire Department Work Pro~ram
Police Captain Tim Bell, who is also an Assistant Chief of the Stillwater Volunteer
Firefighters presented the Council with an overview of the function and organizational
structure of the Stillwater Fire Department. The discussion included: a training
attendance analysis, equipment used by the personnel, a fire experience survey and a list
of the vehicles, their estimated date of replacement and their replacement value.
OTHER BUSINESS
Letter of Credit Reduction for UBC Project
City Attorney Magnuson presented the Council with a request to reduce the letter of
credit required ofUBC for the UBC Industrial Park building project from $1,200,000 to
$852,000. Mr. Magnuson explained that the UBC representatives believed that the value
ofthe UBC property in the downtown was $348,000 and the letter of credit should be
reduced by that amount because the City would have title to the downtown property.
Motion by Councilmember Cummings, seconded by Councilmember Thole to reduce the letter
of credit for the UBC project to $852,000. All in favor.
Stillwater City Chamber of Commerce Committee Appointments
Mayor Kimble said that a request has been made by the new City of Stillwater Chamber
of Commerce to appoint a member of the City Council to serve as liaison to the
Chamber's Economic Development Committee. Mayor Kimble recommended that
Councilmember Bealka be appointed to serve in this capacity.

Motion by Councilmember Thole, seconded by Councilmember Cummings to appoint
Councilmember Bealka to serve as City liaison on the City of Stillwater Chamber of Commerce
Economic Development Committee. All in favor.
Stillwater Manaier's Contract
City Coordinator Kriesel presented the Council with an amended salary schedule for the
1994-95 labor agreement between the City of Stillwater and the Stillwater Public
Manager's Association. The amended schedule included the salary for the Ice Arena
Manager position which was inadvertently left out of the agreement. Mr. Kriesel
recommended Council approval of the amended schedule.
Motion by Councilmember Thole, seconded by Councilmember Zoller to adopt the appropriate
Resolution approving the amended salary schedule for the 1994-95 labor agreement between the
City of Stillwater and the Public Manager's Association. (Resolution No. 95-92)

Assistant Buildini Inspector Position e
City Coordinator Kriesel presented the Council with an amended 1995 salary schedule for
the AFSCME labor agreement. The salary schedule was amended by setting the
Assistant Building Inspector salary at the same level as the Secretary position.
Motion by Councilmember Zoller, seconded by Councilmember Cummings to amend the salary
schedule for AFSCME labor agreement as recommended by the City Coordinator. All in favor.

I TALKED TO PAM BOBEN FROM U.S. WEST AND NOW THEY HAVE DECIDED THAT
THEY DO NOT WANT TO SELL THE PHONE COMPANY BUILDING AT 2ND AND OLIVE
STREETS. THE ORIGINAL 5,400 SQUARE FEET THAT I TALKED TO THEM ABOUT
THE FIRST TIME IS STILL. AVAILABLE FOR LEASE. WE WOULD HAVE TO PUT IN
AN OUTSIDE ENTRANCE TO THE SECOND FLOOR AND REMODEL THE SECOND FLOOR
AS IT IS JUST OPEN SPACE. THEY DO NOT KNOW WHAT THEY WOULD CHARGE
FOR RENT OR HOW LONG THEY WOULD LEASE FOR. I SUGGEST WE FORGET IT.
THE TESTING FOR THE NEW PATROL OFFICER POSITION AND THE NEW
SERGEANT ARE COMPLETED AND I AM ASKING PERMISSION TO HIRE THE NEW
PATROL OFFICER AND TO PROMOTE THE NEW PATROL SERGEANT EFFECTIVE MAY 1,
1995. THESE ARE BOTH ON THE CONSENT AGENDA.
THERE WERE TWO OF OUR OFFICERS THAT APPLIED FOR THE SERGEANTS
POSITION. WE HAD A WRITTEN EXAM AND FOLLOWED THAT WITH AN ORAL EXAM
THAT WAS CONDUCTED BY 3 POLICE OFFICERS THAT ARE NOT WITH OUR
DEPARTMENT. THE FINAL RESULTS WERE CLOSE, IN FACT THE TOP CANDIDATE
BEAT OUT THE SECOND PLACE OFFICER BY 2.87%. I ASK THAT CRAIG T.
PETERSON, BE APPOINTED WITH A ONE YEAR PROBATION PERIOD.

WE TESTED THE CANDIDATES FOR THE PATROL OFFICERS POSITION THRU RATING
THEIR APPLICATIONS, A WRITTEN EXAM AND AN ORAL EXAM. OF THOSE THAT
PASSED, WE DECIDED TO HIRE BRADLEY S. ALLEN AND ASK THAT HE BE
APPOINTED WITH A ONE YEAR PROBATION PERIOD. BRAD HAS BEEN A MEMBER OF
OUR PART-TIME POLICE ORGANIZATION SINCE MARCH 1990. HE WAS THE THIRD
PLACE CANDIDATE, BUT I HAVE THE OPTION OF HIRING ANY OF THE TOP 3 AS
LONG AS THEIR SCORES ARE CLOSE. THE TOP 3 RANKED; 82%, 81% AND BRAD
AT 79%. HIS KNOWLEDGE OF OUR CITY AND THE OPERATION OF THIS
DEPARTMENT PUTS HIM AHEAD OF THE OTHER CANDIDATES.

BRADLEY ALLEN AS PATROL OFFICER
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the full-
time employment of Bradley S. Allen as full-time Patrol Officer, from and after May 1, 1995,
for a probationary period of 12 months, is hereby approved; and that as compensation for
services the said Bradley Allen shall receive the sum of $2,401 per month, together with all
other benefits of City employment.

RE: APPROVING EMPLOYMENT FOR ENGINEERING TECHNICIAN IV
POSITION
Discussion:
Applications were taken for the Engineering Tech IV position. Fifty-two applications were
received. Using an objective rating system, four (4) finalists were chosen from the 52
applications. The fmalists were given a written test and oral interviews. Of the four finalists,
Tim Moore, of SEH, surfaced as the top candidate. Mr. Moore has over 10 years of experience
in municipal engineering including work as a survey crew chief, a project coordinator and a
project designer. This broad base of experience is precisely what we need. None of the other
candidates had as broad a base of experience.
e Tim Moore has gained much of his experience in the field of civil engineering engaging in
various aspects of projects which have been constructed in Stillwater. Therefore, Mr. Moore has
an extensive background in Stillwater which would be a great asset to the city. I have discussed
the position with Mr. Moore and he is very interested in working for the City of Stillwater.
Recommendation:
I recommend council pass a resolution approving the employment of Tim Moore as Engineering
Technician IV as of May 1, 1995.

Discussion:
Staff posted the LaborlMaintenance Worker I position and Mr. Dan Crimmins has indicated he is
interested in this position. Mr. Crimmins has worked part-time for the City of Stillwater Parks
and Public Works Departments for approximately five years and has demonstrated to be a
conscience and productive worker. Mr. Crimmins has indicated his willingness to take this
position which will serve approximately 50 percent of the time in public works and the
remaining portion in parks.
Recommendation:
I recommend Council pass a resolution approving the employment of Dan Crimmins as
LaborlMaintenance Worker I as of May 1, 1995.

APPROVING A MINNESOTA PREMISES PERMIT FOR GAMBLING
FOR ST. CROIX VALLEY HOCKEY ASSOCIATION
AT CAT BALLOU'S, 112 NORTH MAIN STREET
WHEREAS, the St. Croix Valley. Hockey Association has submitted an application to
the City of Stillwater requesting City approval of a pending Minnesota Gambling Premises
application permit; and
WHEREAS, representatives of the organization appeared before the City Council and
demonstrated that the organization is collecting gambling monies for lawful purposes;
NOW THEREFORE, BE IT RESOLVED, that the City of Stillwater approves of the
gambling license requested by the St. Croix Valley Hockey Association at Cat Ballou's, 112
North Main Street, Stillwater, Minnesota. The Mayor and City Clerk are directed to sign the
acknowledgement on the permit application, and are to attach a copy of this Resolution to the
application to be submitted to the Department of Gaming.

RE: REVIEW OF DRAINAGE ISSUE AT THE LLOYD GOBEL RESIDENCE
Discussion:
Mr. Lloyd Gobel at 209 Fifth Street has notified staff that he is suffering from a drainage
problem due to the construction of a fence and grading which took place on the property adjacent
to him. Council will recall that this issue was before the council last year at the request of Jane
Haas.

David Junker and I inspected Mr. Gobel's property during a rainfall last week. It did not appear
to us that the neighboring property had been graded in such a way that it would create additional
drainage problems for Mr. Gobel. Mr. Gobel's property is to the north of the neighboring
property and the water in this neighborhood generally drains from the south to the north and this
has not been altered. No drainage problems were apparent during our inspection. However, it is
our understanding that the problem occurs on and along Mr. Gobel's driveway and garage. The
driveway in question is a new driveway and it is possible that the blacktop driveway has
somewhat altered the course of the flow on Mr. Gobel's property since previously a gravel
driveway existed.
Recommendation:
It does not appear to me that this issue concerns the city. Therefore, I recommend no city action
at this time. It appears to be a private matter by and between the property owners.

Project Description
The proposal is to subdivide a 6.0 acre parcel into 11 lots with a variance to the wetland setback
requirement for road location, 50 feet setback required.
Discussion
The application is for an II-lot subdivision with a wetlands outlot. Of the eleven lots, five lots
gain driveway access from Boutwell Road (lots 1,2,3,4, and 5). Lots 6-11 are accessed off a
new cuI de sac road. The road does not meet City standards for a cuI de sac street. Thirty-two
feet is the standard. Twenty-four is proposed to reduce the impact on the wetland and provide
more flat building land for lots 11-6. The reduced width street also results in the houses being
located closer to the street away from the Wildpines 4th addition houses.
As discussed in the previous review, special development requirements are recommended for lots
1,2,3,4, and 5 because of their location on Boutwell Road. The special conditions are for the
houses to be set back 50 feet from Boutwell and for driveway access to lots 1 & 2 and 3 & 4 be
combined. Lot 5 would have an individual driveway access. A special 50 foot setback is also
required to allow a driveway turn around and to reduce the traffic impact from Boutwell, a
collector road, on the adjacent residences.
The subdivision requires the partial filling of a designated wetland. A wetland mitigation plan
has been prepared providing a 2:1 ratio of replacement wetland. The mitigation plan has gone
through the required notification and approval process as required by Wetlands Conservation Act
rules.
The preliminary plat shows site grading, building envelopes and floor elevation for each
structure. The residences will have to be located in coordination with the sanitary sewer line
installation to make sure satisfactory flow occurs.
The drainage plan has been reviewed by the City engineer and he approved the proposed
drainage plan design.

The project is located in the Single Family Residential District, RA. The plan as proposed meets
the lot site and dimension requirements. _
The City tree protection ordinance limits tree removal to 50% of the tree canopy of each lot. To
control this, City planning design review is required of the site development plans before a
building permit is issued.
A detailed grading/drainage plan showing erosion control measures including silt fencing and re-
establishment of disturbed areas shall be provided and approved before site grading occurs.
The Parks Board has reviewed the proposal and recommended collection of the park dedication
requirement as an in lieu of park fee.
Based on the site conditions, type of development impact on wetland and mitigation plan
approval, a variance to the road setback from the wetland can be justified.

5. A site plan review and approval shall be obtained from the Community Development
Director before site building pennits are issued. The site plans shall show existing trees
proposed to be removed, grading and erosion control measures.
6. A detailed drainage/grading/erosion control plan shall be reviewed and approved by the City
Engineer before any site grading occurs.
7. An in lieu park fee of 7% of the land value shall be paid to the City before final plat approval.
8. Soil boring results shall be reviewed by the City Engineer and building official before final
plat approval.
9. No more than 50% of the tree canopy of any lot shall be removed due to lot construction.
Trees along the easterly lot line buffering this development from the Wildpines 3rd and 4th
addition shall be maintained to the maximum extent.
10. The previous Planning Commission approval, SUB/94-53 is rescinded.
11. The utility and road improvement plan shall be approved by the City engineer.

As requested, we have reviewed the drainage issues for the Wildwood Pines 5th Addition. This
proposed 11 lot plat is located on Boutwell Road, north of Myrtle Street. It is the last plat of the
Wildwood Additions.

The original concept plan for the drainage for the Wildwood Additions was prepared in 1983. The
drainage report for the total development included several ponds with interconnecting pipes and
overflow swales. The largest of the ponds, just north of Wildwood Court, was sized to handle the
majority of the area included in this 5th Addition. This pond has an outlet into a storm sewer
system constructed on Wildwood Court under the Wildwood Pines 3rd Addition. The 1983 study,
however, did not include runoff from the northeast comer of the 5th Addition, the low area in the
proposed Outlot A.
The proposed drainage for the Wildwood Pines 5th Addition is shown on the Preliminary Grading
Plan submitted by Bruce Folz and Associates. The grading plan proposes to have the houses
fronting on Boutwell Road (Lots 1 through 6), lower then Boutwell, and provides for swaies around
the houses to direct the water to the large pond in the back yards. The front yards on the remaining
lots (7 through 11) fronting on the proposed street off Boutwell Road, drain to the street, then along
the street to catch basins. The catch basins are then proposed to outlet into a pond located in Outlot
A of the plat. The back half of Lots 7 through 11 drains easterly to a drainage swale between the
4th Addition and the proposed 5th Addition. The pond in Outlot A is proposed to outlet through
a storm sewer system into the large pond north of Wildwood Court.

The proposed pond in Outlot A is to be constructed as a mitigation to filling part of the existing
wetland. The partial filling of this wetland is required to construct the road and proper roadway
slopes. The proposed pond will need to be sized to restrict runoff from the development to pre-
development rates, as well as to meet the current Nationwide Urban Runoff Program (NURP)
requirements. The NURP regulations require a pond to control construction sediment, provide for
water quality treatment and control post development sediment such as street sanding.

The concept of the proposed drainage improvements is consistent with the original drainage study
prepared in 1983. The construction of the NURP pond is a State requirement and is proposed to
be included in the grading of the project site. We are in the process of sizing this NURP pond at the
time of this letter, and this will be provided as soon as it is completed. We will also need to
determine the required pipe sizes for the pond outlet and catch basin lead. A control structure to
restrict the runoff to pre-development rate will also need to be determined. We would recommend
approval of the proposed drainage plan with the condition that the pipe sizes, rate control structure
and NURP pond be determined and included in the final grading and drainage plan. If you have

Methodology
Wetlands on this site were delineated in the field on
October 18,1994 using the 1989 Federal Manual For
Identifying And belineating Jurisdictional Wetlands.
Wetland basins were also classified in the field in
accordance with Wetlands of the United States (USFWS
Circular 39). wetland 'boundaries were physically flagged in
the field.
Delineation Results

The subject p~operty encompasses two wetland basins, they
are indicated in red on the enclosed photo.
Basin 1 is located along the north boundary of this site.
This wetland is classified as a Type 2/3 wet meadow/shallow
marsh area by the USFWS Circular 39. It is predominantly
open water in the center, with a reed canarygrass and willow
vegetated fringe.

Basin 2 is located in the northwest quadrant of the
intersection created by the existing d~iveway and Boutwell
Road. This wetland is classified as a Type2/; wet
meadow/shrub swamp area. The main body of t ! wetland is
dominated by reed canarygrass, while the ~ tion of the

wetland that extends to the west is dominated by woody
wetland species such as boxelder, willow, and dogwood.
REGULATORY ANALYSIS
Minnesota DNR Protected Waters Jurisdiction
Neither basin is classified as a DNR Protected Waters
wetland, so no permits or DNR review will be required for
this proposal.
Corps of Engineers Section 404 Jurisdiction
Both wetland basins fall within the jurisdiction of the u.s.
Army Corps of Engineers under Section 404 of the Clean Water
Act. Any future impacts to these wetlands would require
Corps of Engineers approval. It appears from the current
subdivision plan, dated Sept. 1, 1994, that no wetland
filling will oc~ur on this plat.

LGU Certification under the Wetland Conservation Act of 1991
The Wetland Conservation Act of 1991 (WCA) regulates the
filling or draining of all wetlands in the state, except to
the extent such activities are covered by one of the
statutory exemptions in WCA. The City of Stillwater is the
designated Local Governmental Unit (LGU) in the area of this
project, responsible for administering WCA..

DECLARING ADEQUACY OF PETITION
AND ORDERING PREPARATION OF REPORT

BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA:
1. A certain petition requesting the improvement of PID 9032-2020 and PID 9032-
3025 by constructing sanitary and storm sewer, water, and street, filed with the council on
April 18, 1995, is hereby declared to be signed by the required percentage of owners of
property affected thereby. This declaration is made in conformity to Minnesota Statutes,

Project Description
The proposal is a 37 lot (36 residential lot and 1 wetland outlot) planned unit development. A 37 lot
subdivision is a part ofthe planned unit development request. The lots are designed to have a zero lot
line on one side and minimum 10 feet on the other side - 20 feet from the adjacent residence. The
residential lots range in size from 5,386 to 20,098 sq. ft. Five Thousand square feet minimum is required
in the Duplex Residential District, R-B. The lot frontage range from 66 feet for corner lots to 46 feet
typical for interior lots.
A commercial center is located to the south of the project. A fence and evergreens screen the
commercial site from the residential site. Vacant land is located to the east and the Forest Ridge
Development across Tuenge Drive to the west. The proposal project is a similar subdivision
configuration as the Forest Ridge Development.

The project plans were referred to Public Works for review and comment. Their comments include the
need for a grading/drainage/erosion control plan particularly around the wetland and street and the
grading impact on lots 3 - 4, 6 - 7 and 17, 18, 19,20. Also, the engineer is recommending that the
combined curb cut for two driveways be limited to 25 feet and the cuI de sac radius be increased to 55
feet minimum.
One tree is required to be planted for each lot.
Park dedication requirements for the land have previously been provided through land dedication.
A 50 foot setback is required for the designated wetland (not provided for in plan).
As a result of these comments, the subdivision may need to be modified and result in the loss of lots.
Additional Information
Since the commission meeting of January 9, 1995, a grading/drainage/erosion control plan has been
prepared for the development (enclosed). The plan shows a 15 foot wall surrounding the wetland. The
structure setback requirement from wetlands is 50 feet. The wall is within 10 feet of the wetland.
Attached is a drawing of the wall.
The developer has been asked to consider other alternative to the prepared wall design such as reducing
the number of lots by one or use cluster concept for a portion of the site

Conditions of Approval
1. The combined driveway for each structure shall be 22 feet maximum.
2. The cui de sac radius shall be 55 feet minimum.
3. A grading/drainage/erosion control plan shall be submitted for staff review before council
consideration ofthe concept pun or preliminary plat (this may result in the loss of lots).
4. An outlet shall be provided for the wetland.
5. A landscape plan for the pond area shall be submitted for Planning Commission review and approval
before final utility improvements.
6. The outlot shall be protected by an open space easement as recorded with the final plant.
7. The drainage easement shall be moved as approved by the city engineer.
8. The retaining wall around the wetland shall be in four (4) steps of approximately 3 feet in height
each.
9. A storm water construction activity permit shall be obtained from MPCA before grading and utility
construction begins.

AN ORDINANCE ESTABLISIDNG THE
STILLWATER HUMAN RIGHTS COMMISSION
The City Council of the City of Stillwater, Washington County, does ordain:
1. Establishment. There is hereby established a Commission to be advisory to the City
Council to be known as the Human Rights Commission, that will be organized and have the duties set
forth in this Ordinance.
2. Purpose. The purpose of the Human Rights Commission is to aid and advise the City
Council in ensuring for all citizens of the City equal opportunity in those areas protected by law and in
other related concerns.
3. Duties and Responsibilities. The Human Rights Commission must:
(a) Study and review programs and policies and aid the City Council in enlisting the
cooperation of agencies, organizations and individuals in the City in an active program directed to create
equal opportunity and eliminate discrimination and inequalities.
(b) Advise and aid the City Council in implementing recommendations that may be
appropriate to the City, including, but not limited to, (1) specific programs of public information
regarding the statutory requirements of the Minnesota State Human Rights Act; (2) comprehensive studies
and surveys of practices in the community; (3) programs of affirmative action to be developed with
employers, the housing industry, the educational institutions, and governmental agencies; (4) programs
of review to give and gain information regarding compliance with state requirements concerning equal
opportunity; (5) programs designed to alleviate community tension; (6) programs designed to create a
genuine climate of community readiness to accept orderly and demonstrable change in eliminating barriers
of equal opportunity.
(c) Attempt to conciliate, within its authority, all grievances involving discrimination
occurring within the City and make all appropriate reports to the City Council and State Department of
Human Rights. .
(d) Advise Independent School District No. 834 on matters relating to human rights.
(e) Establish committees, as the Commission finds it to be necessary, in the following areas:
(1) employment and housing; (2) public information; (3) legislation; and (4) liaison with other
organizations including other city commissions and agencies.
(t) Perform such other functions concerning human rights as the City Council may from time
to time direct:
4. Membership.
(a) The Commission will be composed of 13 members, all of whom must be residents of the
City. Two of the 13 members must be students who attend Independent School District No. 834.

(b) the members of the Commission will be appointed by the City Council after due
consideration has been given their interest and commitment to civil and human rights principles; to their
knowledge in the fields of employment, housing, public accommodations, public services, education and
other areas affected by the State Human Rights Act; to their ability to serve in a genuine leadership role
in the community by virtue of their positions of responsibility in business and civic affairs; to adequate
representation of the classes of persons protected under the State Human Rights Act; and to
recommendations obtained from various sources including any local human rights committee.

(c) Each youth member will be appointed for a one-year term. Except for the first terms,
all other members will be appointed for two-year terms that are staggered in order to provide continuity
of policy and program. In anyone year no more than one-half of the terms may expire. No member
may serve more than six years, not including the time served filling the unexpired term of another.
(d) The City Council must also attempt to appoint members from the various wards on a
more or less equal basis in order to further the policy of the Council that representation on City
Committees be balanced between wards.
5. Bylaws. The Commission must formulate bylaws to govern all other matters relating to
the conduct and operation of the Commission, officers and duties, dates and conduct of meetings,
quorum, and other relevant matters including, but not limited to, amendment of the bylaws. The bylaws
of the Commission and any amendments thereto must be submitted to the City Council for approval.
6. Saving. This Ordinance must be added to the City Code, but in all other ways the City
Code will remain in full force and effect.
7. Effective Date. This only will be in full force and effect from and after its passing and
publication according to law. e

AN ORDINANCE ALLOWING
SPECIAL VElBCLE USE ON A ROADWAY
The City Council of the City of Stillwater does ordain:
ARTICLE I. Enacting.
1. There is hereby designated a roadway within the City of Stillwater that is authorized for
the operation of a motorized golf cart within the meaning of Minnesota Statutes Section 169.045. The
roadway shall be Trunk Highway 95 from its intersection with the southerly limits of the City to Nelson
Street, from Nelson Street to Sam Bloomer Way, and from Sam Bloomer Way to the Stillwater Yacht
Club.
2. Permits. Only persons in possession of a duly authorized permit shall be allowed to
operate these vehicles on this roadway.
3. Times of Operation. The vehicles may be operated on this designated roadway only from

as provided for in Minnesota Statutes Section 169.52.

IMPROVEMENT PROJECT LI 312
Discussion:
SEH will be presenting a set of plans and specs for the 1995 street project. I have reviewed the
plans and have found them to be acceptable and they are under review by the water board as
well.
One significant change from the feasibility study is the proposed method of rehabilitating street
sections. Council will recall on Northland Avenue there were some sections that all we did was a
simple overlay. These particular sections are suffering from some reflective cracking which is a
significant aesthetic issue. The current plan has been altered from the feasibility report and
proposes cold recycling as opposed to simple overlay. Cold recycling is much superior to simple
overlaying. However, it is somewhat more expensive. Cold recycling involves grinding up the
existing blacktop and using it as additional gravel. New blacktop is then overlayed over the top
of this gravel blacktop.
Based on the engineer's estimate, the project could be 10 - 15 percent higher in total cost if we do
not receive good bids. I strongly recommend we go with the cold recycling option as proposed.
If the project does go over the feasibility budget, we will probably have to cover the additional
costs. In the long run, we will get a much better street.
Recommendation:
I recommend Council pass a resolution accepting the plans and specs and authorizing advertising
for bids for the 1995 street project, LI 312.

APPROVING PLANS & SPECIFICATIONS AND ORDERING ADVERTISEMENT
FOR BIDS FOR 1995 STREET IMPROVEMENTS, L.I. 312
WHEREAS, pursuant to a resolution passed by the Council on March 7, 19945, the
City Consulting Engineer has prepared plans and specifications for 1995 Street Improvements
and has presented such plans and specifications to the Council for approval;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
STILLWATER, MINNESOTA:
1. Such plans and specifications are hereby approved.
2.
The City Clerk shall prepare and cause to be inserted in The Gazette and in the
Construction Bulletin an advertisement for bids upon the making of such improvement
under such approved plans and specifications. The advertisement shall be published
for three days, shall specify the work to be done, shall state that bids will be received
by the City Clerk until 11 a.m. on Monday, May 15 ,1995, at which time they will be
publicly opened in the Council Chambers of City Hall by the City Clerk and Engineer,
will then be tabulated and will be considered by the Council at 7 p.m., May 16, 1995,
in the Council Chambers. Any bidder whose responsibility is questioned during
consideration of the bid will be given an opportunity to address the Council on the
issue of responsibility. No bids will be considered unless sealed and filed with the
Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check
payable to the Clerk for ten (10) percent of the amount of such bid.

AND CHAPfER 48 OF THE STILLWATER CITY CODE
(pARKS AND RECREATION BOARD)
THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN:
1. Amending. Chapter 48 of the Stillwater City Code entitled "Parks and Recreation Board"
is hereby amended by adding a new Subdivision 3, Subsection 7, which will hereafter read as follows:
(7) The Board will have authority to control, regulate or prohibit peddlers and
concessionaires within the parks and playgrounds of the City.
2. In all other ways, Chapter 48 will remain in full force and effect.
3. Chapter 41.06, Subdivision Four, Peddlers' Licenses, is amended by changing Subsection
8, which will hereafter read as follows:
(8) Use of Parks. No peddler is permitted to operate at any location the public parks of the
City except by permit given by the Parks and Recreation Board.

A new Subdivision 8(a) is added that will hereafter read as follows:
(a) Use of Streets. No peddler is permitted to operate in any congested street or area where
his operations might impede or inconvenience the public. For the purpose of this Section, the
. judgment of a police officer, exercised in good faith, is conclusive as to whether the area is
congested or the public impeded or inconvenienced.
B. A new Section 8(b) is added that will hereafter read as follows:
(b) Reservation of right. The City Council reserves the right to deny a license to any peddler
if the number of peddlers in any location will cause congestion or impede or inconvenience the
public.

C. A new Subsection 8(c) is added that will hereafter read as follows:
(c) Peddlers Prohibited in CBD. Peddlers are prohibited in the CBO Zoning District of the
City except that the City may issue up to three-day permits to a nonprofit organization in
conjunction with a social activity in the City sponsored by the organization.

The City Council of the City of Stillwater does ordain:
1. Amending Chapter 27.01 Dogs and Other Animals is amended by changing the definition of
Kennel by adding a new Section 4 and adding a new section 4a that will read as follows:

"4 Kennel means any place where 1'\ or more dogs or cats over four months of age are
kept, raised. sold, boarded, shown, treated or groomed.
4a Kennel Licenses. Kennels are not permitted without a Conditional Use Permit. No
Kennel License may be issued or renewed unless the applicant has a valid Conditional
Use Permit for the facility.
1) Existing kennels must be in compliance with this Ordinance within 90 days after
its effective date. "
2. Saving. In all other ways the City Code shall remain in full force and effect.

Dear Mayor Kimble and City Council:
As you now know the final Environmental Impact statement (EIS) for
the new st. Croix River crossing Project was signed on Wednesday,
April 5th, by the Federal Highway Administration (FHWA). This
signature allows the document to be viewed by all interested
parties. Enclosed are two copies of the final EIS for city Council
review. Comments on the adequacy of the final EIS will be received
for 30-days. We will close the comment period on Tuesday,
May 16th.

After the 30-day comment period the FHWA will consider comments
received on the final EIS and make a Record of Decision (ROD).
This ROD will clear the way for Right-of-Way acquisition and final
plans to be developed for the project. Construction of the main
river spans is scheduled to begin in 1997.
The final EIS commits Mn/DOT to the operation and maintenance of
the existing lift bridge through rest of its useful life, which we
have determined is 10-15 years.

On February 27, 1995, the City Council extended a liscense to the
above named property to construct an outside entrance steps on City
property. The construction has begun and the new tenant, Larry's
Floor Covering, is concerned about parking for his customers.
Currently cars park on both sides of Mulberry Street for most of
the day between 8:00 - 5:00 p.m. These cars seem to belong to the
employees of either the optician on Main Street or West Publishing
in the old Conn-Co building. Our request is for two (2) spaces to
be marked If 15 minute customer parking" on the north side of
Mulberry Street directly opposite the stairway leading to the new
retail space. This would allow his customers a chance to get in
and out with carpet sample books during normal business hours and
also have a chance to access his store from a reasonable distance.
