A CITY HALL: 216 NORTH FOURTH STILLWATER, MINNESOTA 55082 PHONE: 612-439-6121 e PARK AND RECREATION BOARD May 22, 1995 Present: David Junker, chairman Judy Gulden, AI Liehr, John Melville, Ken Meister, Delwin Peterson, and Steve Wolff Others Tim Thomsen, parks; Steve Russell, planning Absent: Richard Cummings, Rob McGarry, Mike Polehna and Marguerite Rheinberger Members met at Pioneer Park at 6 p.m. for the Board's annual park tour. Prior to the tour, there was a renewed discussion about the need to repair the steps/planters in the pit area at Pioneer Park. e Mr. Thomsen reiterated his position that the repair has nothing to do with the preparation of a plan for Pioneer Park -- it's a matter of public safety. He said he had brought the Mayor to the site, and the Mayor agreed the work should be done. Ms. Gulden and Mr. Peterson both pointed out the Board had voted to redo the steps only. Mr. Meister noted that when the steps are removed and replaced, most of the planter walls will be lost and have to be replaced as well. Mr. Melville said, while not to minimize the safety concern, the issue is that the project seemed out of sequence, considering the park plan has yet to be developed. Mr. Junker noted that it could be two or three years before a comprehensive plan is completed for Pioneer Park; Mr. Russell said it is anticipated a plan will be prepared by the end of this year. Ms. Gulden also expressed her concern about the type of material to be used in the new steps/planters. She said she preferred the Minnesota quarry stone, and went on record as being unequivocally opposed to the project as proposed. She also asked if the rock for the existing steps/planters could be reused elsewhere if it is removed. Members then visited Kolliner Park, Lowell Park, the Aiple property and e the neighborhood park near Shelton and Tuenge Drive. e e e There were some comments made regarding the potential for future use of Kolliner Park. Use now is deterred by traffic, and somewhat hinges on the future of the lift bridge. According to the conditions of the gift of the land to the city, it must remain in some kind of open space use. Mr. Thomsen showed members the damage done to Lowell Park grounds during the recent art fair. He estimated it would cost about $4,500 to resod the area. Mr. Russell suggested that members might want to consider whether it is preferable to maintain the current heavy schedule of events in the park or keep the park for more passive use. While there is an economic incentive for the existing schedule of events, he suggested there should be balance of uses. Mr. Wolff asked if there was a concept plan for the Aiple property. Mr. Russell'said there is thought of moving the Andiamo to the area. Mr. Thomsen said he thought a good use for the property would be an RV park. Ms. Gulden asked whether the area could be used when Lowell Park is closed for the levee wall project. Mr. Russell said the park dedication land at Shelton and Tuenge Drive would be a good park area to develop plans for next year. The group returned to Pioneer Park at about 7:30 p.m.; the recording secretary left at that time. Actions taken when the Board reconvened included: approval of a peddler's license for David Rochlin to sell glow necklaces in city parks; and continuation of a request by Shawn Vougeot to sing in Lowell Park. Respectfully submitted, Sharon Baker Recordirtg secretary e e e TO: Stillwater Park Commission RE: Rock Garden Volunteers FA: Friends of Stillwater Parks DA: May 22, 1995 Friends of Stillwater Parks would be pleased to work with the City to establish rock gardens that would showcase the unique character and natural stone in the sunken gardens located in Pioneer Park. We could create a display of annuals and hardy perennials that would give color while reflecting the tradition of the site. We would be happy to show you a design and examples of plants and flowering shrugs and give you locations of similar rock gardens to view. In the event that a park plan would require the relocation on the gardens, the plants could easily be moved. The random positioning of the existing rock provides an ideal condition for a rock garden similar to those established at Lake Harriet, Como Park in the Twin Cities, or Stillwater's own "Perennial Garden" located across from Lowell Inn. Also, the Pioneer Park rock garden would reflect the historic authenticity and aesthetics associated with Pioneer Park, Stillwater and the passage of time. Volunteers are eager to begin planting. Just say the word. ORDINANCE NO. 812 AN ORDINANCE AMENDING CHAPTER 41.06 OF THE STILLWATER CITY CODE (pEDDLERS' LICENSING) AND CHAPTER 48 OF THE STILLWATER CITY CODE (pARKS AND RECREATION BOARD) THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: 1. Amending. Chapter 48 of the Stillwater City Code entitled "Parks and Recreation Board" is hereby amended by adding a new Subd. 3(7) which will hereafter read as follows: (7) The Board will have authority to control, regulate or prohibit peddlers and concessionaires within the parks and playgrounds of the City. 2. In all otller ways, Chapter 48 will remain in full force and effect. 3. Chapter 41.06, Peddlers' Licenses, is amended by changing Subd. 2(2) which will hereafter read as follows: (2) The word "peddler" means any person, whether or not a resident of the City of Stillwater, traveling by foot, wagon, automotive vehicle, or any other type of conveyance, offering or making sales and delivering articles to purchasers, or who, without traveling from place to place, shall sell or offer the same for sale from a wagon, automotive vehicle, railroad car, or other vehicle or conveyance, including a person selling products of the farm, garden or orchard. Exempted from this defmition are persons involved in fund drives for registered nonprofit entities such as the Scouts of America, authorized activities of students raising funds for school sponsored events, and newspaper delivery services, whether delivered by foot or vehicle. and A. A new Subd. 8 is added that will hereafter read as follows: within (8) Use of Parks. No peddler is permitted to operate at any locatio~the public parks of the City except by permit given by the Parks and Recreation Board. and B. A new Subd. 8(a) is added that will hereafter read as follows: (a) Use of Streets. No peddler is permitted to operate in any congested street or area where his operations might impede or inconvenience the public. For the purpose of this Section, the judgment of a police officer, exercis,ed in good faith, is conclusive as to whether the area is congested or the public impeded or inconvenienced. C. A new Subd. 8(b) is added that will hereafter read as follows: (b) Reservation of right. The City Council reserves the right to deriya license to any peddler if the number of peddlers in any location will cause congestion or impede or inconvenience the public. and D. A new Subd. 8(c) is added that will hereafter read as follows: (c) Peddlers ProhibittXl in CBD. Peddlers are prohibited in the CBD Zoning District of the City except that the City may issue up to three-day permits to a nonprofit organization in conjunction with a social activity in the City sponsored by the organization. . E. A new Subd. 5(1)(d) is added that will hereafter read as follows: (d) No fee may be charged to any peddler involved in interstate commerce, and protected by the commerce clause of the United States Constitution. 7. In all other ways, Section 41.06 will remain in full force and effect. 8. to law.
