The meeting was called to order by Mayor Kimble at 7 00 p.m Present Councilmembers Bealka, Thole, Cummings, Zoller and Mayor Kimble Absent. All in favor Fire Chief Kallestad requested that Council authorize the sale of the Fue Department `s 1973 Seagrave Ladder Truck. • Motion by Councilmember Bealka, seconded by Councihnember Cummings authonzing staff to advertise the sale of the Fue Department's 1973 Seagrave Ladder Truck. All in favor. Motion by Councilmember Thole, seconded by Councihnember Zoller adopting Resolution No. 2000- 345, adopting the final tax levy for the yeaz 2001 All in favor Ayes Councihnembers Bealka, Cummings, Thole, Zoller and Mayor Kimble Nays None .7 Motion by Councilmember Thole, seconded by Councihnember Zoller adopting Resolution No. 2000- 346, adopting the final budget for the yeaz 2001 All in favor Ayes Councihnembers Bealka, Cummings, Thole, Zoller and Mayor Kimble Nays None NEW BUSINESS Approval of Andiamo Dock Permit for 2001 Commumty Development Director Russell stated that the terms of the dock permit have not changed, but the fee has been raised $100 00 per boat for a total fee of $8,400 00 Motion by Councilmember Thole, seconded by Councilmember Cummings adopting Resolution 2000- 347, approval of dock permit for St Croix Boat and Packet All in favor Ayes Councilmembers Bealka, Cummings, Thole, Zoller and Mayor Kimble Nays None Leasing of Desch Building parking lot r~ LJ 2 City Council Meeting No 00-27 December 19, 2000 Commumty Development Director Russell reviewed the Downtown Parking Commission's recommendation to no longer lease the Desch Building pazkmg lot Mr. Mark Desch stated that he is not opposed to the termination of the lease, but requested that Council not termunate the lease until July 1, 2001 to allow hun time to pursue avenues to allow him to provide pay pazkmg at this lot Motion by Councilmember Thole, seconded by Councilmember Cummings to terminate the lease of the Desch Parking Lot as of July 1, 2001. All in favor Final plat approval for Liberty 5~' Addition Commumty Development Director Russell reviewed the final plat and conditions for the Liberty 5~' Addition. Councihnember Cummings stated that the Parks Boazd should determine the name of the park within the subdivision. This does not include school distract land or golf courses However, if the schools and golf courses were added, we ~i ould have over 10% which is good for a city this size 1 Areas of responsibility for the Parks and Public Works Supenntendent and Assistant Supenntendent to oversee on a yearly basis, but not limited to are • 79 16 miles of streets plus new streets m a few years 70 miles of sanitary sewers, with 20 more miles in a few years. 45 4~ miles of stone sewers 13 sewer lift stations 466 acres of pazk and open space 30 miles of trails and sidewalks 700 acres of city nght of ways 2 azenas when not leased out Maintain all City pazking lots 2 We have a total of 17 employees, 6 in Parks, 2 in Sewer, 1 %z in Maintenance, and 71/z in Streets Activities for the year 2000 included: Sent 5 employees to Equipment Training School Cleaned 17 miles of sanitary sewer. Rebuilt 25 catch basins Laid 482 tons of asphalt on the streets and filling 12 mules of cracks. All employees took a tree tramming and pruning course since we aze doing a citywide tree tramming and brushing on all City right of ways and boulevards Installed new signs on ahl crosswalks along with reflectors on all cross walk signposts and stop signs through out the City Installed new playground equipment in Staples Park and a picnic shelter at Washington Park Began building a new park in the Legends Subdivision which will take 2-3 years to complete 3 Ongoing activities include Trash pickup and restroom cleaning done seven days a week from Apnl 15th to October 15th in all parks Trash pickup is done 2 to 3 days a week yeaz round in the downtown azea and on other busy streets in town. Sometimes more when we have special events Street sweeping in the spring, fall and summer months when needed and every 2 weeks in azeas that have storm sewers going into lakes Approximately from Memonal Day to Labor Day, we have the Lily Lake Beach opened with 4 to 6 hfeguazds employed 7 days a week. We set up and take down for all special events such as Lumberjack Days, Spring Fall Art Fairs, Taste of Stillwater, Music on the ]uverfront, Mazch of Dunes, Stillwater Bicycle Classic, Diabetes Walls and Leukemia Walk. This spring and fall we aught have two new events coming to Stillwater, the World Walleye Fishing Contest and the World Fishing Championship. We work v~nth the school distract on ball field use for adult league, girls fast pitch, boys fast pitch, lads soccer and 4 to 8 softball tournaments a year. We take 150 to 300 park reservations every year for birthday parties, reunions, weddings, school picnics, church picnics, Elks, VFW, and other get-togethers. • We work with about 75+ volunteers on City clean up in parks, open space, ravines, flower gardens, painting, and plantings. For the year 2001, we will be tracking hours spent on street patching and repairs as well as sewer cleaning, city wide sign inventory, pazk mowing, equipment maintenance, sweeping, all safety framing that we currently have done, equipment framing for employees, tree trimming, playground safety checks, and much more. We want to have this all on a database so we can run reports every quarter for Council. Some of the issues should be introduced this year to get them before the Committees even though final action will likely no# occur until 2002 Some of the Federal issues and protects Usted may be resolved before the end of the year, but a mayor push must be made early with the new Administration Federal Issues• 1 Reauthorization of Stage 3 of the Levee/Flood Control Protect 2. Appropriation for Stage 3 of the Levee/Flood Control Protect • 3 Work on additional funding for the Stillwater Bridge There is suppose to be $5 million in the Health and Human Services Appropriations Biil, but we will need another $12 million minimum from the Highway Works Administration ff not there, we will need to get another special appropriation in the infrastructure and Transportation Committee. 4. Obtain a $5 million appropriation for the new Stillwater Armory We are now back as the State's top priority. State issues• Local Sales Tax -The State Legislature must approve the initiation of a local sales tax. SECTION VI. STATUS OF CONSULTANT This Contract calls for the performance of the services of the Consultant as an independent contractor and the Consultant will not be considered an employee of the City for any purpose SECTION VII. Recitals a The Internal Revenue Service has issued Section 1. 103 -18 of the Income Tax Regulations (the Regulations) dealing with the issuance of bonds, all or a portion of the proceeds of which aze to be used to reimburse the City for project expenditures made by the City prior to the time for the issuance of the bonds. b. The Regulations generally require that the City make a prior declazation of its official intent to reimburse itself for such prior expenditures out of the proceeds of subsequently issued borrowing, that the borrowing occur and the reimbursement allocation be made from the proceeds of such borrowing within one yeaz of the payment of the expenditure or, if longer, within one yeaz of the date the project is placed in service, and that the expenditure be a capital expenditure. • c The City desires to comply with requirements of the Regulations with respect to certain projects hereinafter identified. 2. Official Intent Declaration a. The City proposes to undertake the following projects described on Exhibit A attached hereto b Other than (i) expenditures to be paid or reimbursed from sources other than a borrowing or (ii) expenditures permitted to be reimbursed pursuant to the transition provision of Section 1.103-18(1)(2) of the Regulations or (iii) expenditures constituting of preliminary expenditures as defined in Section 1.103-18 (i)(2) of the Regulations, no expenditures for the foregoing projects as identified on Exhibit A have heretofore been made by the City and no expenditures will be made by the City until after the date of this Resolution c The City reasonably expects to reimburse the expenditures made for the costs of the designated projects out of the proceeds of the debt (the Bonds) to be incurred by the City after the date of payment of all or a portion of the costs All reimbursed expenditures shall be capital expenditures as defined in section 1 150-1 (h) of the Regulations d. This declazation is a declazation of official intent adopted pursuant to Section 1 103-18 of the Regulations C. 3. Budget Matters. As of the date hereof, there are no City funds reserved, allocated on a long term basis or otherwise set aside (or reasonably expected to be reserved, allocated on a long term basis or otherwise set aside) to provide permanent financing for the expenditures related to the projects other than pursuant to the issuance of the Bond This resolution, therefore, is determined to be consistent with the City's budgetary financial circumstances as they exist or are reasonably foreseeable on the date hereof, all within the me and content of the Regulations. 4 Filing. This resolution shall be filed within 30 days of its adoption in the publicly available official books and records of the City This resolution shall be available for inspection at the office of the city clerk at the City Hall (which is the main administrative office of the City) during the normal business hours of the City on every business day until the date of issuance of the bonds. 5 Reimbursement Allocations. The City's financial officer shall be responsible for making the reunbursement allocations" described in the Regulations, being generally the transfer of the appropriate amount for proceeds of the Bonds to reunburse the source of temporary financing used by the City to make payment of the prior costs of the projects. Each allocation shall be evidenced by an entry on the official books and records of the City maintained for the bonds, shall specifically identify the actual prior expenditure being reimbursed or, in the case of reimbursement of a fund or account in accordance with Section 1. 103-18, the fund or account from which the expenditure was paid, and shall be effective to relieve the proceeds of the bonds from any restriction under the bond resolution or other relevant legal documents for the Bonds, and under any applicable state statue, which would apply to the unspent proceeds of the Bonds. Vogel's historic cornext documern was compiled in accordance with the Secretary of the Irnerior's Standards for preservation planning which call for the establishment of historic contexts and the use of these contexts to develop goals and ultimately register those that quantify on national or local historic register. The context study was divided into 16 Stillwater neighborhoods, each to be surveyed at a sepazate time. The City has received seven grants from the Minnesota State Historical Society (Certified • Local Government Grants -CLG) $4,000 to $5,000, with matching and, in-kind funding from the City. The neighborhoods that have had the architectural surveys completed to date aze: 1. North Hill Original Town (7/31/95) 2. South Hill Original Town (7/31/96) 3. Sabin/Greeley Addition (7/31/97) 4. Dutchtown District (7/31/98) 5. Holcombe District (7/31/99) 6. Hersey Staples & Co. 7. PRESENT: Chairperson David Johnson, Supervisors Jerry Hicks, Louise Bergeron, Sheila-Marie Untiedt and Ken LaBoda. Also, Planner Meg McMonigal and Attorney Tom Scott. 1. AGENDA - M/S/P Bergeron/Untiedt moved to adopt the agenda as amended. (4 ayes 2. MINUTES - M/S/P Untiedt/Bergeron moved to approve the Stillwater Town Board Meeting minutes and the Canvas of Election minutes both dated 11/9/00 as written. (4 ayes) David Johnson arrived. 3. TOWN HALL RENOVATION - Maury Steverson was present to discuss continuing town hall issues. Plans and specs are at a point where we can advertise for a project manager. The clerk will get advertisements out in early January. A holding tank versus a septic system will be investigated. Set-backs for the building will be checked. 4. CHECKS/CLAIMS - Checks X1504 thru X1550 were approved for payment. 5. SCVAP PRESENTATION - Ed Simonet and John Melville were present to upd~ the board about progress made this past year in developing soccer fields. 6. ATTORNEY - M/S/P Untiedt/La6oda moved that subject to review of a letter clarifying the county's arrangement for reduction of the size or removal of the Smith's non-complying building, return of escrow money will be considered. (5 ayes) 7. APPOINTMENTS - M/S/P Untiedt/Bergeron moved that Michael Ranalla and Matthew Beane be appointed to three year terms on the park committee and Kirsten Spreck and James Fagrelius be appointed to three year terms on the planning commission. (5 ayes) 8. PLANNING COMMISSION VACANCY - Robert Ranalla will be invited to meet with the board in January about filling a planning commission position previously held by Tim Hassett. 9. PROSPECTIVE RIGHT TO FARM ORDINANCE - After moratorium issues are dealt with, the planning commission is to investigate further the need for a right to farm ordinance or if state ordinances already in place will meet the needs of residents who carry on farming activities. Also included would be hobby farming. 10. PARK - M/S/P La6oda/Bergeron moved that 325,000.00 be allocated for playground equipment in Otto Berg Park including materials and installation.
