The meeting was called to order by Mayor Kimble at 4 40 P m

STAFF REPORTS
City Clerk Ward stated that the first meeting of 2002 IS on New Year's Day and should
be rescheduled It was deCided that the first meeting of the New Year would be held on
Tuesday, January 8, 2002.
Motion made by Councllmember Rhelnberger and seconded by Council member
Milbrandt to schedule the January City Council meetings on Tuesday, January 8 and
Tuesday, January 15, 2002. All In favor
Public Works Director Eckles stated that the contractor for the new public works faCIlity
IS pulling their permits this week and perhaps Council would like to schedule a
ground breaking ceremony In the near future Council scheduled the ceremony on
Friday, November 16 at 4.30 p m
OTHER BUSINESS
Selection of Developer for Sale and Redevelopment of T erntorlal Prison
Community Development Director, Steve Russell reviewed th roposals presented for
the redevelopment of the Terntorlal Prison site The City rec Ived 14 inquiries regarding
the site development With seven actual proposals submltte A committee consisting of
Nile Kriesel, Dave Magnuson, Councllmembers and Zoller and Steve Russell
screened the applicants. After a formal Interview process, the committee IS
recommending Shaw Lundquist as the prospective purchaser and developer of the site
Jack Buxell, spokesman for the developer, came forward to answer any
questions the counCil might have He also presented a list of projects that the
developer was previously Involved In.

Councllmember Rhelnberger stated that he is happy that this project IS finally
moving forward and hopes that the timetable presented will be adhered .
Councllmember Milbrandt had questions about parking density proposed for the
site Mr Buxell stated that part of the developer's strategy IS to avoid putting In a
large parking surface They hope to Integrate parallel street parking and shared
parking spaces to meet the needs of the development
Councllmember Milbrandt also asked what the City'S obligation would be
regarding the wall at the site Community Development Director Russell stated
that further tax Increment financing might need to be done to provide resources
to deal with the wall Issues including ownership, drainage, overall condition, etc
Motion by Councllmember Rhelnberger, seconded by Councllmember Bealka to
approve the selection of Shaw Lundquist for the sale of the terntorial prison site
and to direct the preliminary sales agreement based on the proposal Allin favor.
Presentation of Phase I Lowell Park Implementation Plan
Community Development Director Russell stated that Phase I plans will be
Implemented next year and the money for thiS Implementation has been
budgeted and State grants for the Improvements have been received Work has
been done with City staff and the Parks Commission to prepare the plans and
specs for the work to begin next spring The update IS being brought before
Council to address any concerns they might have

Bill Sanders, Sanders Wacker Bergly, Inc prOVided an updated on the work that
has been done so far and the plans that Will be Implemented He stated that the
cost IS estimated to be $400,000 to $500,000 range for Phase I
Mayor Kimble expressed concerns regarding trees on the east Side of the park
CItizens complained that few trees that are already there interfere with viewing of
fireworks He also stated that trees do not necessarily tolerate flooding well
Councllmember Bealka stated his concern that no restrooms are currently
planned In Phase I He felt that, with that amount of money Involved, public
restrooms should be Included
Councllmember Milbrandt explained that the Parks CommiSSion discussed the
restroom Issue at length. The commission found that putting In restrooms that
would be subject to future flooding was not the best option He further stated that
restrooms Will be Included In the overall park development but not In the area of
Phase I The consensus was that It would be more practical to Install public
restrooms nearer the Main Street entrance to the park allowing for more year-
round use of the faCIlities The restrooms would not be subjected to repeated
flooding If located on the west edge of the park, closer to Main Street.

Councllmember Zoller asked if approving the concept were all the details final
Councllmember Milbrandt explained that this IS not approval of the details, Just
the concept
Motion by Councllmember Rhelnberger, seconded by Councllmember Milbrandt
to approve the concept as presented and to direct the preparation of the plans

Reauest for further TIF assistance - Mainstream Development
Mr Vern Steffan representing Mainstream Development Partnership addressed
the tax Increment financing Issues and the shortfall Involved He wanted to be
assured that Mainstream was optimizing all funds available from the Increment of
the development He asked Council to move that the Winery parcel be Included
In the Increment so the funds can be utilized
Councllmember Zoller asked the City Attorney about the $2900 TIF that the
Winery generates and asked If nght now, that money goes to Mainstream
City Attorney Magnuson stated that the money does not now go to Mainstream
because It was not owned by Mainstream when the agreement was signed
Councllmember Rhelnberger expressed concern that the City would have to "bail
out" this development If It failed In the future He was not Interested In changing
the eXisting contract or extending It He IS reluctant to put any City general funds
Into the project
City Attorney Magnuson stated that In the onglnal TIF Dlstnct, the winery
Northern Vineyards, was part of the TIF plan and that perhaps the Increment
from that parcel could be recovered
Mayor Kimble clanfied the situation by stating that at the time, the Intent clearly
was to Include the Winery parcel In the TIF
Motion by Councllmember Zoller, seconded by Councllmember Bealka to include
the Winery In the TIF Distnct Allin favor

proclaiming November 11, 2001 as Veterans Day In the City of Stillwater All In

Levee Flood Control Proiect Update - Ed Cain. Lecuslatlve Associates
Mr Ed Cain, Legislative Associates, announced that they were successful In
acquiring a $2 million appropnatlon on Stage 3 of the Levee/Flood Control
Project This Includes a floodwall that Will give the City 50 or 100 year flood
protection He reviewed the appropnatlon process for Council and advised what
the next steps are for completing the project.
Mayor Kimble and Council thanked Mr Cain for his hard work and diligence on
the project

Approval of ChanQe Order for McKuslck Ravine Prolect (9626F)
Public Works Director Eckles reviewed the change order for the McKuslck Ravine
project
Motion by Councllmember Bealka, seconded by Councllmember Rhelnberger, adopting
Resolution 2001-229 approval of Change Order #4 for the McKuslck Ravine project (Project
9626F). All In favor

Hawthorne Lane Update
Public Works Director Eckles provided an update on the Hawthorne Lane Project
He stated that at the first meeting It was found that some surrounding areas were
also Involved. Seventy questionnaires were sent out and forty-two responses were
received showing that there were a fair number of problems In the area With the
Silver maple trees and where they were planted He also stated that two bids were
received for the removal of the problem trees St CroiX Tree Service was the low
bidder and he recommended that the City accept this bid and that this work should
get gOing as soon as possible
Councllmember Zoller asked how many trees were gOIng to be removed
Mr Eckles stated that approximately forty-three of about 70 trees would be
removed at this time.
Councllmember Bealka stated that he had heard many favorable reports on the
City Englneenng Department's work With the reSidents Involved
Motion made by Council member Milbrandt, seconded by CounCllmember Rhelnberger,
adopting Resolution 2001-230 accepting plan for boulevard tree removal, accepting quotation
and awarding contract for the boulevard tree removal In the Hawthorne, Bayberry and
Maryknoll neighborhoods. All In favor

DISCUSSion on the use of commUnication tower next to water tower located adiacent to Lllv
Lake School
City Attorney Magnuson reviewed the site agreement that the City has With
Washington County He stated that It IS the position of the Water Board that they
have no Interest In haVing any towers located on the tank nor do they Wish to
control any revenues that might be generated from the City'S land Essentially

they will sign off on the lease Washington County does not desire to control any
more land than IS underneath the tower that provides them access Conceivably, .
there IS enough land on the site so that additional towers could be located there
Mr Magnuson recommended that Council approve the site lease agreement and
present It to Washington County
Motion by Councllmember Rhelnberger, seconded by Councllmember Bealka, adopting
Resolution 2001-231, approving the site lease agreement for lily lake Water Tower and
authorizing ItS presentation to Washington County
Ayes Councllmembers Bealka, Milbrandt, Rhelnberger, Zoller and Mayor Kimble

Industrial Park llohtlno Update
Public Works Director Eckles reviewed the industrial park lighting update to Council
He stated that It was probably too late to actually get the work started this year but
asked that Council authOrize City staff to prepare a feasibility report for the Curve
Crest portion of the lighting and consider options for the Orleans Street portion of
the lighting plan He stated that the approximate cost for the four lights on Curve
Crest would be $23,000
Mr Eckles recommended getting Input from the resIdents In the area because
extra lighting mIght be undesIrable for some
.
Councllmember Bealka expressed hiS concerns for safety In these areas
Motion by Councllmember Rhelnberger, seconded by Councilmember MIlbrandt, adopting
Resolution 2001-232 authOriZIng and updating the feasibIlity report for lighting on Curve Crest
Boulevard and Orleans Street

Reauest for final payment for Aiple property park plan preparation
Mayor Kimble reviewed the request for the final payment on the Alple property
park plan preparation
Councllmember Bealka commented that perhaps a new name should be gIven to
thiS property later
Motion by Councllmember Rhelnberger, seconded by Councllmember Zoller, adopting
Resolution 2001-233 approving the final payment for the Aiple property park plan preparation.

RetalnlnO Wall at 819 Olive Street
City Administrator Knesel explained that the problem with the wall being bUilt by Mr
Bjorkman IS that It IS too close to the nght-of-way If the City would ever have to go
Into the nght-of-way for utility purposes, then the owner of the property would have
to be responsible for the costs for removal of the wall
City Attorney Magnuson commented that In Minnesota, an abutting owner has the
nght to the center of the street, subject to the mUnicipal easement Therefore, an

Community Development Director Russell brought a request to conSider a zOning
amendment for a 4 15 acre area that Includes 3 parcels on the west Side of County Rd 5
just south of Wild Pines Lane EXisting use IS attached Single-family, townhouse,
reSidential zOning that would allow approximately 30 Units on the site He stated that 60
Units are being suggested which IS consistent With the RM - medium nse reSidential
zOning dlstnct - about 3,000 sq ft per Unit ThiS request would require a
Comprehensive Plan amendment as well as a ZOning Plan amendment
Mayor Kimble and Council gave approval to Mr. Nolde to pursue thiS project.

After the rating by the Mayor and Councllmembers present, Mr Bnmeyer
presented Councllmember Rhelnberger's rating of candidates from his interviews
with them on October 26 and October 30, 2001

Mr Bnmeyer reviewed with Council possible benefit options, starting salary and

Re: Sale of bullet proofvest
.
Sgt. Todd Bjorkman has resigned from the Stillwater Police Department effective
November 25, 2001 He has taken a job with the St Paul Police Department as a
patrol officer to enhance his career. He has made a request to purchase his bullet
proof vest from the city. The vest is two years old and costs $540 00.
The police department wrote a federal grant that covered half the cost of the vest.
The State of Minnesota paid the other half: According to the rules of the federal
grant, Todd would not be eligible for any more grant money for 6 years (the
manufactures suggested "life" of the vest). The vest is custom fit to each officer and
usually cannot be reissued. We do not send the vests to auction as with other city
equipment, because we do not want criminals to have bullet proof vests The old
outdated vests (after 6 years) are used for training purposes and shot with handgun
rounds to show the effectiveness of wearing a vest. Once they are shot, they are
thrown away Todd has offered to purchase the vest from the city for $75.00.
Recommend sale of the vest to Todd Bjorkman for $75 00.

For the past several years, the CIty has had a desIgnation for a State Aid Street In the
downtown area The street segment IS described as the TH 212 bypass from TH 36 to
Chestnut Street The bypass was establIshed as a non-existent street, for future use when
bndge options were being dIscussed in the 1970's. The CIty recently receIved a letter
from the Office of State AId, Informing us that smce no actIon has taken place SInce
designatIon, the segment should be revoked. The mIles from thIs segment would be used

The City's Personnel PolIcy, effectIve October 1,2001, states In Section 3-6, Appointment and
Placement of Relatives

"The City of StIllwater does not restrict employment of more than one member of a
famIly or persons related by blood or marriage.
However, to avoid conflict of interest, no City employee may be appointed to the same
Department or take part In deciSIOns to hire, retain, promote or determine the salary of
his/her spouse, family member or relative
In addition, no City employee is to be assigned responsibility for supervising and
directing the work ofhis/ber spouse, family member or relative."
This language restricts family members or relatives of current employees from serving as part-
time, on-call Fire Department employees. The City would like to amend this section of the
Personnel Policy to exclude part-time, on-call Fire Department employees. However, family
members within all departments, including part-time on-call Fire, would still not be allowed to
supervise other famIly members or relatives.
Recommendation
Staff recommends the City CouncIl consider approving the attached Resolution amending
Section 3-6, Appointment and Placement of Relatives, of the City's Personnel Policy.

for the appeal fee It is our understandmg that thIs matter wIll be scheduled for a public hearing
on Tuesday, November 20, 2001.
Pursuant to our dIScussions, as you are aware, the construction is virtually
completed on the subject boat ticket office structure. The heating system needs to be completed,
the water lines must be winterized, the shell on the outside must be attached for WInter
protection, and cert31n electrical work needs to be completed prior to the winter. In additIon,
there is sheetrocking that needs to be done, and box car siding installed. The reason for the
issuance of the stop order was to deal with the issue of the two additional windows on the east
side. We respectfully request that the stop order be specifically limited to that issue, and that my
clients be allowed to complete the construction of the subject building before winter sets in.
Obviously, an occupancy permit will not be issued until all issues have been resolved.

NOTICE IS HEREBY GWEN, pursuant to Section 22-7, Subd. 10, of the Stillwater

Your Appellants respectfully submits that the decision of the Hentage Preservation
CommIssion was in error and/or m bad Judgment for the following reasons:
1. That the subject boat ticket office buildmg IS being constructed by your

Appellant pursuant to the request of the Army Corps of Engineers and the Mmnesota Department
of Natural Resources, WIth the approval of the City of StIllwater to relocate the eXIsting c)'nice
facilIty located near the St. Croix RIver and near your Appellant's excursion boats. That in order to
adequately view the docks and boats, the two requested windows on the east side of the office
buildmg are necessary.
2. That the two requested windows are a functional addItion and will not have
a detrimental affect on the character of the downtown historical district.
3. That the decision of the Heritage Preservation Commission is arbitrary,
capricious, and unreasonable, and has no basis in fact.
4. That the decision of the Heritage PreservatIon Commission is based upon an
erroneous theory of law and fact, and that the procedures followed by the Heritage Preservation
Commission in connection with these proceedmgs are unlawful, improper, illegal, and contrary to
the laws of the State ofMmnesota.

regulatIons, an add1tIOnal fixture had to be placed on the west elevatIon Also, subsequent to the
dISCUSSIon at the October HPC meetIng, a shed roofwas added to the north elevatIon.

Mr Johnson noted that WIndows that were Installed on the east elevation are half the SIze of the
wmdows ongmally proposed. He suggested It looks awkward to have the smaller WIndows and
then add two other WIndows In between Mr. Johnson also smd the buIldIng looks "remudeled",
and It IS not even complete. Mr. LIeberman suggested that the bUlldIng doesn't do Justice to the
AndIamo's value to the commumty
There was a bnef dISCUSSion of a stop work order that had been Issued by the buddmg offiCial. It
was noted that the buildIng permit was Issued on the plans approved by the Hentage PreservatIon
CommissIOn and what IS beIng bUllt is not what was approved by the HPC. Mr Lieberman
cautIoned ag31nst further d1scussion SInce a legal Issue is involved
Mr. Balay smd the Issue at hand IS the request for the two addItional WIndows on the east
elevatIon Mr. Johnson noted the HPC had worked With the appl1cant regarding changes on the
north elevation WIth the expectation that those were the only deSIgn changes that would be made.
Mr LIeberman SaId the east elevation does not reflect what was approved at the last meeting and
moved to deny the request for the additional WIndows Mr. Johnson seconded the motIon, motIon
passed unanImously.

Attached you wIll find copIes of the annual reports of the water qualIty studIes for LIly, Long and
McKuSICk Lakes. These studIes are preformed as a part of a cooperatIve agreement between the
CIty of StIllwater, area watersheds and the MetropolItan CouncIl Each year the CIty of StIllwater
spends approxImately $2,000 to asSIst In the cost of perfonmng these studIes. A bnef summary of
each lake presented as follows

Lily Lake
On the A-F scale for the year 2000, LIly Lake receIved a grade ofC for total phosphorus,
chlorophylla-a and SecchI depth bnngIng the overall score to a C ThIs grade IS IdentIcal to the
ones receIved In 1998 and 1999. In 1995, Lily Lake receIved a B ratmg for overall water quality.
Secchi depth readIngs have been taken SInce 1985 and dUTlng that tIme the average grade has been
a C It should be noted that the water level of LIly Lake was extremely hIgh throughout the year
and thIS water level sIgmficantly decreased the value of the CIty'S recently constructed water
qualIty Improvement project
Long Lake
Long Lake receIved a grade ofF m all categones m the year 2000 ThIs IS farrly consIstent WIth In
the grades receIved m the last three years but somewhat worse than the grades receIved m 1995 and
1996 when It received an overall score of a D Long Lake IS generally a very shallow lake with
depths averaging less than 5 feet ThIs makes It extremely susceptIble to algae blooms and nutrIent
loadIng problems and these depths are generally assocIated WIth a lake near the end of ItS lIfe cycle.
McKusick Lake
The data gathered for Lake McKusick IS extremely unusual Durmg the course of the year, CIty
staff receIved numerous complamts about the qUalIty of Lake McKusick. However, the Lake
receIved an overall grade of a B, whIch is the hIghest ever-recorded water qUalIty score. From a
water qualIty stand pOInt the lake actually had better readings than LIly Lake for much of the year
The complamts about Lake McKuSICk stem from the emergent vegetatIOn and algae mats whIch
covered a good portIon of the lake POSSIble explanatIon is that the emergent vegetatIon used up a
large amount of the phosphorus available making It unavaIlable for free floatIng algae that
generally reduce water VISIbIlIty and water qUalIty Much lIke Long Lake, Lake McKusick is
extremely shallow and hIghly susceptible to water qUalIty problems AddItIonal data In future years
may proVIde more and better understandIng of what's happenIng on thts lake

LIly Lake, located In the CIty of StIllwater m Washmgton County, was mOnItored 14 tunes between nud-Apnl and
nud-October,2000 The lake has been mOnItored through CAMP smce 1995 .
The 52-acre lake has a maxlffium depth of 174m (57 feet), and has publ1c access located on the lake's northern
shore and a fishing pIer on Its southern shore On each samplmg date LIly Lake was momtored for TP, CLA, TKN,
and SecchI transparency, as well as the lake's perceived physIcal condIhon and recreational sUItabIlIty. The 2000
mean summertlffie (May through September) surface TP concentrabon for the lake was 60 0 pg/l (Il11J1lIIlum of 400
pg/I, rnaXlffiurn of 130 0 pg/l) The mean CLA and Secchl transparency readmgs \\-ere 291 pg/l (Il11J1lIIlum of2 5
JIg/l, maxImum of 62 0 pg/l), and 15m (nunlffium of 0 3 m and maxImum of2 9 m), respectively The lake's

The 2000 summertlme means resulted In a TP grade of C, CLA grade of C, and Secchl transparency grade of C.
The overall grade determIned by averagmg all three parameters was a C Therefore, grade WISe, the water qual1ty of
the lake m 2000 was IdentIcal to 1998-1999 and smular to 1996 and 1997 (also an overall grade of C), but worse
than that expenenced m 1995 when the lake received a B grade When lookmg at the lake's 2000 mdlvIdual
summertlffie means, however, 2000 was shghtly worse than that of 1998-1999, WhICh was the lake's worst water
qualIty years The best summertlme mean TP concentrabon was recorded m 1997 (35 0 pg/l), and the best CLA and
Secchl means were recorded In 1995 (12.5 pg/l and 32m, respectIvely)
The physical and recreational conditIons of LIly Lake as perceived by the volunteer(s) were ranked on a l-to-5
scale These rankmgs are also graphed on the lake's mformatlon sheet The mean physical condition rankmg was
3 0 ("definIte algae present") whlle the mean recreabonal SUitabIlIty rankmg was 3 2, (between 3- "swummng
shghtly lffiparred" and 4- "no swunmmg boatmg ok")
The water qualIty graphs show exactly how the lake's TP and CLA concentrabons and Secchl transparency
responded to each other Generally, m most area lakes, an m-Iake mcrease m TP means more phosphorus is
avaIlable for algal growth that usually results m an mcrease m CLA The more algae present, the lower the clarIty .
of the water, and vice versa
A search for water qualIty data through CouncIl, MPCA, and STORET files resulted m a moderate amount of data
WhIle 1995-2000 are the only years for whIch nutrient data are avaIlable, Secclu transparencIes were collected
through the MPCA's CItIzen Lake Momtonng Program m 1985, and 1987-1992 An analysIs ofSecclu data for
each year avaIlable, reveal that the lake's water clarity has improved slIghtly, cllffibmg from a D grade m 1985 to an
Am 1995 and back to a B grade m 1996 and C's m 1997 and 1998 The connnued degradation m the lake's water
qualIty from 1995 to present should cause some concern In order to determme If thIs declme may represent a trend
or Just a normal fluctuabon wIthm the lake's normal water qualIty range more data are needed

As part of the 2000 volunteer momtonng program, Long Lake was mOnItored 14 tImes from mId-Apnl to
mId-October ThIS was the fifth year that Long Lake has been Involved In CAMP. The lake was also
Involved In the program In 1995-1996, and 1998-1999 Graphs as well as the actual data collected by
volunteers show the seasonal vanabIhty In TP and CLA concentratIons, SecchI transparency, and user
perceptIon (physIcal condItIon and recreatIonal sUItabIlIty) The graphs and data tables are presented on
the next page.
The 2000 summertIme mean concentratIons for Long Lake were as follows TP= 160.9 Ilg/I (mInImUm
of 120 0 Ilg/I, maXImum of 21 0 0 IlglI), CLA= 103 9 Ilg/I (mInImUm of 9 9 Ilg/I, maXImum of 179 0
Ilg/l), SecchI transparency= 0 4 m (mInImum of 0 3 m, maxImum of 0 5 m), and TK.N= 2.52 mg/I

collected Therefore, 2000 marks the lake's best mOnItored water qualIty year, whIle 1994 marks the
worst.
The lake's water qualIty graphs on the InfOrmatIOn sheet show that TP and CLA concentratIons and
SecchI transparency are agaIn related to one another, although less so than past years For the most part,
the common scenano found In area lakes IS as In-lake TP Increases, meanIng more phosphorus IS
avaIlable for algal growth, the CLA concentratIon also Increases because more algae are present. When
algae Increases, water clanty--as measured by a SecchI transparency--decreases and VIce versa
Throughout the mOnItonng period, the volunteer(s) ranked theIr opmIons of physIcal and recreatIonal
condItIons of the lake on a I-to-S scale The resultIng user perceptIon rankIngs are shown on the lake.

In the short-term, however, It seems that the lake is very well represented by an overall grade ofD/C. In
order to detect any possIble long-term water qualIty trends, addItIOnal years of data collectIon are
needed.

Subject: DIScussIon of Long Lake HIgh Water CondItIons
DISCUSSION
As CouncIl IS aware, tlns last year was one of the wettest spnngs In our h1story Th1s resulted In
h1gh water levels on both LIly Lake and Long Lake. One of the reSIdents lIVIng on Long Lake who
IS most affected by potentIal floodIng IS Lee MIller. Mr MIller has raIsed the Issue ofh1gh water
SInce 1995 As part of the AUAR for the expansIOn area, the CIty proposed a permanent solutIon to
control Long Lake at elevatIons that would not flood people for events that exceed 100-year
probabIlIty. The DNR denIed the CIty'S request to construct these Improvements m 1997 when the
CIty completed the trunk utIlItIes for the LIberty/Legends area

SInce 1997, continued beaver actIvity at the Jackson WildlIfe area as well as the sIltatIon of the
wetlands and channels that dr31n Long Lake and the collapse of one of the pIpes underneath 72nd
Street have all resulted In the water levels m Long Lake to nse as shown on the attached ~surface
elevatIons of Long Lake. Smce 1996, the Lake has rarely been below an 890 and has never reached
an 889, and In that tIme the average lake elevatIon has nsen by almost half a foot. As the lake level
nses, it reduces the amount of storage available for large storm events Of course, thIS increases the
nsk of floodIng to the lowest homes along the lake. The studIes of Long Lake IndIcated that the
lake should have a normal control elevation of889. Also, the control structure at County Road 12
would need to be enlarged to allow for greater flows Mr. MIller IS request10g the CIty and
Brown's Creek Watershed DIStriCt look at optIons for pursumg interim solutIons.
A possIble solutIon would be to complete the channel excavatIon and pIpe replace underneath 72nd
Street. Both of these Improvements would elIm10ate beaver actIvitIes, remove sIlt from the
channels and Increase the capacIty of the pipes under 72nd Street. These steps would all result 10
the lake level bemg controlled at an elevatIon much closer to 889. The level control structure at
County Road 12 would be left 10 place untIl such tIme the CIty completes the down stream trout
stream dIversIOn projects improvements. Leaving the control in place means we may not have
complete 100-year protectIon for homes along the lake. But, we would dramatIcally reduce the nsk
of floodIng to these homes For this option to proceed, we would need to get DNR approval. It is
lIkely there WIll be some neIghborhood resistance to this solutIon, as it WIll reduce the normal water
level of the lake by about a foot to a foot and a half Since tlns IS a shallow lake tlns could have
sIgmficant Impact on some property owners.

Ifwe proceed WIth tlns project It WIll probably have a constructIon cost of between two hundred
and four hundred thousand dollars. The cost of such a project would be funded by the storm watA
Impact fees charged to developers and perhaps some assIstance from BCWD and Oak Park Heighr
The only downsIde to constructIng the project early is it would delay the construction of some of
the downstream improvements that the DNR is anxIOUS to see happen.
RECOMMENDATION
Staff recommends that Council dISCUSS the ments of an mtenm Long Lake Improvement project
Proceedmg with the project would necessItate staffworlang with Brown's Creek Watershed
DIStrICt, the DNR and hinng Bonestroo to contmue work on this project

The City currently has a Computer Use PolIcy that was adopted and Implemented in August
1998 Smce that tIme, the League of MN CIties has recommended changes to the model policy
which we have included In this update.
Items which we have included or clarified in thIS policy:
. No expectatIon of privacy on CIty hardware, software, LAN, email, and other
technology .
. Addressed other technology such as wireless technology and communications.
. Procedures for unintentional access of inappropriate sItes
. Procedures for regular back-up of data.
Recommendation
Staff recommends the City Council consider approving the attached resolution adopting the
Technology and Internet Use PolIcy to be effective December 1,2001.

BE IT RESOLVED, by the City CouncIl of the City of Stillwater, Mmnesota that the
Technology and Internet Use PolIcy, as on file WIth the City Clerk, is hereby approved. Said

PURPOSE
ThIS gUIdelme establIshes the polIcIes and procedures for employee use of CIty technology and the Internet
Employees are expected to use theIr computers In a profeSSIOnal and busmess lIke manner WhIle the CIty
encourages and supports employee use of computer systems as a means of improving productIvIty, certam
restrIctions are necessary to aVOId ImpropnetIes, ensure that establIshed standards are met, and mamtam
appropnate secunty of computenzed data The Intent of these procedures IS to ensure that use of the CIty
computer systems IS conSIstent WIth the best mterests of the CIty These procedures do not attempt to artIculate
all reqUIred or proscnbed behavIOrs by users, but merely cover the most conspICUOUS examples
2 DEFINITIONS
For the purposes of the procedures m thIS guIdelIne, the followmg definitions shall apply
Data File: CollectIOns of data accumulated for a defimte use Examples mclude word processIng documents,
spreadsheets, databases, etc.
Hardware: The electrIC, electromc, and mechanIcal eqUIpment used to process data. Examples mclude the central
proceSSIng umt, keyboard, momtor, prInter, etc
Information Resources - Any mformatIon In dIgItal electromc format, includIng, but not lImIted to electrOnIC
mall, VOIce mad, local databases, externally accessed databases, clIp art, dIgItal Images, voice and sound
recordmgs.
Internet - A vast collectIOn of Interconnected computer networks that can exchange InformatIon through the use
of common protocols The World WIde Web (www) runs on the Internet
LAN (Local Area Network) - A network consIstmg of electrOnIC devices communIcatmg With one another and
sharmg hardware, software, data, and mformatIon resources
Program: A umque set of InstructIons, purchased by the City, created by CIty staff or by consultants, that tells
the computer how to perform a functIon or senes of functIons
Software: A set of programs that tell the computer how to perform a functIon or series of functions, usually
created by commercIal firms for sale and general use m specific types of applIcations
User: Any person usmg equipment owned and mamtained by the City of StIllwater
Back-up (regular): Copymg important data files to a storage deVIce other than your hardware ThIS should be
done on a weekly baSIS, but may be less dependmg on computer usage

All software, programs, applIcatIons, data, and data files resIdmg on mUnICIpal computer systems or storage .
medIa or developed on mUnIcIpal computer systems are the property of the CIty of StIllwater Only programs th'
are approved by the CIty of StIllwater for bUSIness use can be loaded onto CIty computer systems and are
supported by technology staff The technology and Internet access IS owned, paId for and mamtamed by the CIty
The CIty retams the rIght to access, copy, change, alter, modIfy, destroy, delete or erase thIS property
Computers, computer files, any E-maIl system, and software furnIshed to employees are CIty property intended
for busmess use The use of passwords by employees does not make any files protected by passwords prIvate
Passwords must be dIsclosed to supervIsors upon request and may be bypassed by technology staff If determmed
necessary by the CIty The CIty wIll mOnItor employee e-maIl, computer files, Internet use and other technology
as It determmes necessary and may dIsclose mformatIOn from these sources to third partIes WIthOUt provIdmg
notIce to employees
Back-Up of Data Files
Employees are expected to regularly back-up computer data files m order to aVOId irretrIevable loss through
hardware faIlure Back-up of computer data files, other than those saved on the network servers, IS the
responsIbIlIty of the employee Technology staff IS not responsIble for recoverIng data that is not regularly
backed up
Use of Employee Owned Computers to Work on City Data Flies.
Employees who own personal computers may WIsh to use them for work at home Those who choose to do so
must adhere to this procedure guIdelIne WIth regard to use of CIty-owned software or data files Use of outsIde
computers mtroduces the rIsk that a "computer VIruS" could mfect CIty computer systems. Data files must be
checked by VIruS detectmg software before copymg them back to CIty computers
Inappropnate Uses
The followmg IS a lIst of prohIbIted behaVIOrs or uses of the CIty'S computer systems and resources. Engagmg in
these behaviors or usmg the CIty'S computer systems In an mapproprIate manner wIll result m diSCIplinary action
or termmatIon

Harassment:
The dIsplay, prInting, or transmISSIon of sexually explICIt words and Images, ethnIC slurs, racial epIthets,
relIgIOUS or polItIcal statements or anythmg else that could be construed as harassment or dIscrImination
based on race, relIgIOn, age, natIonal ongm, sex, sexual orientatIon, disability, marItal status or other
claSSIficatIon protected by state and federal law or anythmg that may be construed as harassment or
showmg dIsrespect for others
Employees are prohIbIted from sending unwanted and repeated e-mail to other employees or thIrd partIes
Employees are prohIbIted from using profanity or derogatory remarks even when m Jest
Employees must follow the Rules of Conduct establIshed m ArtIcle XII of the CIty of Stillwater
Personnel PolIcy when using any CIty technology
Personal gain or profit:
Usmg the CIty'S computer systems or knowmgly allowmg another to use the City'S systems for personal
profit, commercIal product advertIsement or partIsan polItIcal purposes The E-maIl system may not be
used to SOlICIt anyone for commerCIal ventures, relIgious or polItIcal causes .

Prohibition on Inappropriate Message Contents
The E-mail system shall NOT be used for:

dIsabIlity, or affectIOnal preference The following types of E-mail messages, though not exhaustIVe, are strIctly
prohIbited:

conSIdered offenSIve are messages WhICh contaIn sexual implicatIons, raCial slurs, gender-specIfic

6 Wireless Communications Technology
All cellular phones, pagers and any other form of wIreless commumcatIons technology are the property of the

mamtamed by the CIty Employees are responsIble for the care and handling of all eqUIpment 10 theIr possessIon

2. Adoption of the Agenda The agenda was adopted WIth two additional Items. They
are reflected m these minutes.
3 CommunIcatIons and PublIc Commentary Lynne shared several suggestions
from the suggestIon box includmg haVIng floor plan maps as a handout for patrons.
4. Consent Calendar The Consent Calendar was adopted Includmg payments of
bIlls totalmg $12,377 44 The motIon to accept was made by Rice and seconded by
Pack. The motIon passed.

5. Personnel PolIcy Several changes had been made to the proposed Personnel
PolIcy based on Board suggestIons at the September meeting. MotIOn by Huelsmann,
second by Fredell to adopt the polIcy as presented. The motion passed.
6. Parking Study Smce this item was not discussed at the Budget Hearmg, Director
Bertalnllo gave Board members an update about neighborhood concerns regarding
parkIng. We were remmded that this IS a servIce and safety issue. Board members are
prepared to dISCUSS this IndIVIdually or collectively WIth City CouncIl members.
7. PrelImmary 2002 Budget Cuts The City is In the process of making cuts
from budgets to match projected revenue Information. We will need to make cuts as
well. The DIrector will make recommendatIons to the Board when she learns the final
dollar amount.
8 Expansion Project Fund Raising FeasibIlity Study The Board was updated on
the progress of the FeasibIlity Study. There were four selection committee meetIngs
that generated a list of approximately 40 individuals/organizations to be interviewed.
IntervIews are bemg set and will be conducted through November.

9 2002 Holiday Closmgs DIrector BertalmIo requested Board approval for the 2002
holiday closmg schedule MotIon by Hickey, second by Fredell to approve the
schedule. MotIon passed.
10. Board Vacancy There IS one applIcant for the current board vacancy
ApplIcatIons will be accepted untIl October 19th. Board members wIll be asked to
serve on the IntervIew COIDImttee.

. Preview of Coming Attractions
NOVEMBER 13
Reception - 8:00 a.m.
A reception will be held prior to the Board meeting to recognize Kris Harvleux, Sr. Social Worker
in Community Services on her being named as Foster Care Social Worker of the Year. Foster
parents and staff members will also help the Board recognize Krist award with a proclamation at
the beginning of the regular Board meetmg.
Workshop - 2002 Budget Review and Discussion
The County Board will hold a workshop to review possible budget adjustments prior to the "Truth
in Taxation" type public meetmg on December 18.

The County Board will receive a status report and discuss access to taxpayer names via the
web site.
NOVEMBER
Public Hearing - liquor license, CiVil Penalty Ordinance
The Minnesota Department of Public Safety is now requiring that local Units of government have a
civil penalty ordinance in place for establishments who have Violated the law by selling alcohol to
underage persons. Failure to have a civil penalty ordinance will preclude the local unit of
government from recelvmg state aide to conduct compliance checks. The Washmgton County
Sheriff's Department IS developing a draft ordinance for conSIderation by the County Board.
Agenda - Award Bid for RadIO Upgrade
.
The County Board will award a bid to upgrade the County's public safety radio system. The
proceeds for the project will come from the County's recent issuance of CIP Bonds.
Workshop - Transportation and Physical Development
Report and discussion on condition of the security system at the law Enforcement Center
Workshop - Impact on MN Property Tax law Changes on Payments in lieu of Taxes
.
County staff will report to the County Board on the impact of the new property tax laws on
the payments made to the county In lieu of taxes for certain tax exempt properties such as
HRA housing projects The Board will also review other elements of the tax law changes
and their effect on the Washington County tax base.

Workshop with Watershed Districts and WMO's
The County Board will host a meeting of watershed districts and WMO's to discuss future
strategies in Implementing the recommendations of the Water Governance Project in light
of the recent Court of Appeals ruling.

The County Boards of Washington and Ramsey Counties will meet to receive an update on
the project to explore the possibility of public solid waste collection that IS being
researched by staff.

The Human Resources Director will coordinate a workshop based on the strategic planning
issue that a group has been working on concerning workforce development Issues of the
present and future including issues such as attraction and retention of qualified staff,
workforce issues of the future and supply and demand for certain types of skilled

Stenerson and Marc Hugunin.
1. AGENDA - M/S/P Johnson/Laabs moved to adopt the agenda as presented.

2. MINUTES - M/S/P Doriott/Laabs moved to approve the 10/25/01 Stillwater
town board meeting minutes as written. (3 ayes, Untiedt abstained)
M/S/P Doriott/Johnson moved to approve the 10/30/01 Stillwater budget
meeting minutes as written. (3 ayes, Laabs abstained)
Ken LaBoda arrived.
3. WATER MANAGEMENT MATTERS - Jane Harper was present to give an overview
of the county's attempt to combine watersheds and water management
organizations into seven watersheds. The town board members are in favor
of disbanding the Marine WAMO to avoid a duplication of efforts and expenses.
Supervisors appointed David Johnson to represent the township in an effort
.0 that end. New Scandia chair Dennis Seefelt expressed that their board
embers also favor a merger of the WAMO with the Carnelian Marine Watershed.
On December 4th the counxy board will discuss the water management issue.
Supervisors will attend.
Current representative Louise Bergeron will be thanked for her past work
with the Marine WAMO and notified that a board member will take over as
Stillwater Township's representative.
4. TOWN HALL - M/S/P LaBoda/Laabs moved $225.00 (labor and material)
for installation of hot and cold water faucets in the town hall basement.
(5 ayes)
M/S/P LaBoda/Laabs moved not more than $350.00 for Joel Peterson to
create a 4 foot by 4 foot bulletin board with a plexiglass door that
hinges to the north and a drop off box added below. (5 ayes)
A punch list of finishing items for the town hall was reviewed. Additional
work on the town hall after contract work is finished will be billed to the
township at $45.00 an hour.

5. MARC HUGUNIN - METROPOLITAN COUNCIL - The people have made it clear
that they value rural land for more than places to build houses. In this
regard, Metro Council is addressing new ways of think1ng about rural lan.
A draft of policies will be available this winter.
6. LUDACK BUILDING LOCATION REQUEST - M/S/P Johnson/LaBoda moved to
approve the placement of a tan metal pole building in front of the dwelling
on the Ludack property at 3530 Stonebridge Trail upon submission of a plan
for additional trees for screening. (5 ayes)
The plan was submitted at the meeting.
7. OPEN SPACE ORDINANCE - Kirsten Spreck brought the changes that the
planning commission came up with to the board. Meg McMonigal elaborated
on the changes.
M/S/P Johnson/LaBoda moved to instruct the attorney draw up an ordinance
that will extend the open space moratorium until February 2002 and refer
some performance standard issues back to the planning commission for
further consideration. (5 ayes)

TREASURER -
1. Checks #15477 to #15514, #15519 and #15520 were approved for
payment.
2. M/S/P LaBoda/Laabs moved to approve a 2002 budget of $609,812.00
and a 2002 levy of $516,970.00. (5 ayes)
3. M/S/P LaBoda/Laabs moved a proposed levy for 2003 of $549,132.00
and a budget of $631,484.00 for 2003. (5 ayes)

9. DATA PRACTICES - M/S/P LaBoda/Laabs moved to approve the data
practices resolution as presented by the attorney with additional language
regarding copy costs. (5 ayes)
10. QUARRY ROAD EASEMENT VACATION - A hearing will be scheduled for January.
The clerk will secure a list of surrounding property owners for notification.
11. ENGINEER -
1. Paul reviewed the 10 year road plan and will update as needed.
2. Paul will contact Ms. Kristman at 10084 Mendel Road about a
hazardous mailbox.
12. SIGN - Ken LaBoda showed the board members a drawing of the est 1858
sign to go on the town hall. The cost will be $55.00.
13. DECEMBER 13. 2001 MEETING - David Johnson will not be at the next
meeting. Sheila-Marie Untiedt may be late.
14. ADJOURNMENT - Meeting adjourned at 10:35 p.m.
