The meeting was called to order by Mayor Kimble at 4 40 P m Present' Councllmembers Bealka, Milbrandt, Rhelnberger, Zoller and Mayor Kimble Absent None Also Present City Administrator Kriesel City Engineer Eckles City Attorney Magnuson Fire Department Chief Kallestad Police Chief Dauffenbach Director of Administration Kadln Community Development Director Russell City Clerk Ward Press Julie Kink and Mark Brouwer STAFF REPORTS City Clerk Ward stated that the first meeting of 2002 IS on New Year's Day and should be rescheduled It was deCided that the first meeting of the New Year would be held on Tuesday, January 8, 2002. Motion made by Councllmember Rhelnberger and seconded by Council member Milbrandt to schedule the January City Council meetings on Tuesday, January 8 and Tuesday, January 15, 2002. All In favor Public Works Director Eckles stated that the contractor for the new public works faCIlity IS pulling their permits this week and perhaps Council would like to schedule a ground breaking ceremony In the near future Council scheduled the ceremony on Friday, November 16 at 4.30 p m OTHER BUSINESS Selection of Developer for Sale and Redevelopment of T erntorlal Prison Community Development Director, Steve Russell reviewed th roposals presented for the redevelopment of the Terntorlal Prison site The City rec Ived 14 inquiries regarding the site development With seven actual proposals submltte A committee consisting of Nile Kriesel, Dave Magnuson, Councllmembers and Zoller and Steve Russell screened the applicants. After a formal Interview process, the committee IS recommending Shaw Lundquist as the prospective purchaser and developer of the site Jack Buxell, spokesman for the developer, came forward to answer any questions the counCil might have He also presented a list of projects that the developer was previously Involved In. Page 1 of 11 ~ City Council Meeting No 01-24 November 6, 2001 ~ Councllmember Rhelnberger stated that he is happy that this project IS finally moving forward and hopes that the timetable presented will be adhered . Councllmember Milbrandt had questions about parking density proposed for the site Mr Buxell stated that part of the developer's strategy IS to avoid putting In a large parking surface They hope to Integrate parallel street parking and shared parking spaces to meet the needs of the development Councllmember Milbrandt also asked what the City'S obligation would be regarding the wall at the site Community Development Director Russell stated that further tax Increment financing might need to be done to provide resources to deal with the wall Issues including ownership, drainage, overall condition, etc Motion by Councllmember Rhelnberger, seconded by Councllmember Bealka to approve the selection of Shaw Lundquist for the sale of the terntorial prison site and to direct the preliminary sales agreement based on the proposal Allin favor. Presentation of Phase I Lowell Park Implementation Plan Community Development Director Russell stated that Phase I plans will be Implemented next year and the money for thiS Implementation has been budgeted and State grants for the Improvements have been received Work has been done with City staff and the Parks Commission to prepare the plans and specs for the work to begin next spring The update IS being brought before Council to address any concerns they might have . Bill Sanders, Sanders Wacker Bergly, Inc prOVided an updated on the work that has been done so far and the plans that Will be Implemented He stated that the cost IS estimated to be $400,000 to $500,000 range for Phase I Mayor Kimble expressed concerns regarding trees on the east Side of the park CItizens complained that few trees that are already there interfere with viewing of fireworks He also stated that trees do not necessarily tolerate flooding well Councllmember Bealka stated his concern that no restrooms are currently planned In Phase I He felt that, with that amount of money Involved, public restrooms should be Included Councllmember Milbrandt explained that the Parks CommiSSion discussed the restroom Issue at length. The commission found that putting In restrooms that would be subject to future flooding was not the best option He further stated that restrooms Will be Included In the overall park development but not In the area of Phase I The consensus was that It would be more practical to Install public restrooms nearer the Main Street entrance to the park allowing for more year- round use of the faCIlities The restrooms would not be subjected to repeated flooding If located on the west edge of the park, closer to Main Street. . City Council Meeting No 01-24 November 6, 2001 Councllmember Zoller asked if approving the concept were all the details final Councllmember Milbrandt explained that this IS not approval of the details, Just the concept Motion by Councllmember Rhelnberger, seconded by Councllmember Milbrandt to approve the concept as presented and to direct the preparation of the plans Allin favor Reauest for further TIF assistance - Mainstream Development Mr Vern Steffan representing Mainstream Development Partnership addressed the tax Increment financing Issues and the shortfall Involved He wanted to be assured that Mainstream was optimizing all funds available from the Increment of the development He asked Council to move that the Winery parcel be Included In the Increment so the funds can be utilized Councllmember Zoller asked the City Attorney about the $2900 TIF that the Winery generates and asked If nght now, that money goes to Mainstream City Attorney Magnuson stated that the money does not now go to Mainstream because It was not owned by Mainstream when the agreement was signed Councllmember Rhelnberger expressed concern that the City would have to "bail out" this development If It failed In the future He was not Interested In changing the eXisting contract or extending It He IS reluctant to put any City general funds Into the project City Attorney Magnuson stated that In the onglnal TIF Dlstnct, the winery Northern Vineyards, was part of the TIF plan and that perhaps the Increment from that parcel could be recovered Mayor Kimble clanfied the situation by stating that at the time, the Intent clearly was to Include the Winery parcel In the TIF Motion by Councllmember Zoller, seconded by Councllmember Bealka to include the Winery In the TIF Distnct Allin favor Mayor Kimble recessed the meeting at 5 40 p m Into Executive Session. Proclamation for Veterans Dav Motion by Councllmember Rheinberger, seconded by Councllmember Bealka proclaiming November 11, 2001 as Veterans Day In the City of Stillwater All In favor Levee Flood Control Proiect Update - Ed Cain. Lecuslatlve Associates Mr Ed Cain, Legislative Associates, announced that they were successful In acquiring a $2 million appropnatlon on Stage 3 of the Levee/Flood Control Project This Includes a floodwall that Will give the City 50 or 100 year flood protection He reviewed the appropnatlon process for Council and advised what the next steps are for completing the project. City Council Meeting No 01-24 November 6, 2001 UNFINISHED BUSINESS Approval of ChanQe Order for McKuslck Ravine Prolect (9626F) Public Works Director Eckles reviewed the change order for the McKuslck Ravine project Motion by Councllmember Bealka, seconded by Councllmember Rhelnberger, adopting Resolution 2001-229 approval of Change Order #4 for the McKuslck Ravine project (Project 9626F). All In favor Ayes Councllmembers Bealka, Milbrandt, Rhelnberger, Zoller and Mayor Kimble Nays None Hawthorne Lane Update Public Works Director Eckles provided an update on the Hawthorne Lane Project He stated that at the first meeting It was found that some surrounding areas were also Involved. Seventy questionnaires were sent out and forty-two responses were received showing that there were a fair number of problems In the area With the Silver maple trees and where they were planted He also stated that two bids were received for the removal of the problem trees St CroiX Tree Service was the low bidder and he recommended that the City accept this bid and that this work should get gOing as soon as possible Councllmember Zoller asked how many trees were gOIng to be removed Mr Eckles stated that approximately forty-three of about 70 trees would be removed at this time. Councllmember Bealka stated that he had heard many favorable reports on the City Englneenng Department's work With the reSidents Involved Motion made by Council member Milbrandt, seconded by CounCllmember Rhelnberger, adopting Resolution 2001-230 accepting plan for boulevard tree removal, accepting quotation and awarding contract for the boulevard tree removal In the Hawthorne, Bayberry and Maryknoll neighborhoods. All In favor Ayes Council members Bealka, Milbrandt, Rhelnberger, Zoller and Mayor Kimble Nays None DISCUSSion on the use of commUnication tower next to water tower located adiacent to Lllv Lake School City Attorney Magnuson reviewed the site agreement that the City has With Washington County He stated that It IS the position of the Water Board that they have no Interest In haVing any towers located on the tank nor do they Wish to control any revenues that might be generated from the City'S land Essentially Page 7 of 11 City Council Meeting No 01-24 November 6, 2001 they will sign off on the lease Washington County does not desire to control any more land than IS underneath the tower that provides them access Conceivably, . there IS enough land on the site so that additional towers could be located there Mr Magnuson recommended that Council approve the site lease agreement and present It to Washington County Motion by Councllmember Rhelnberger, seconded by Councllmember Bealka, adopting Resolution 2001-231, approving the site lease agreement for lily lake Water Tower and authorizing ItS presentation to Washington County Ayes Councllmembers Bealka, Milbrandt, Rhelnberger, Zoller and Mayor Kimble Nays. None Industrial Park llohtlno Update Public Works Director Eckles reviewed the industrial park lighting update to Council He stated that It was probably too late to actually get the work started this year but asked that Council authOrize City staff to prepare a feasibility report for the Curve Crest portion of the lighting and consider options for the Orleans Street portion of the lighting plan He stated that the approximate cost for the four lights on Curve Crest would be $23,000 Mr Eckles recommended getting Input from the resIdents In the area because extra lighting mIght be undesIrable for some . Councllmember Bealka expressed hiS concerns for safety In these areas Motion by Councllmember Rhelnberger, seconded by Councilmember MIlbrandt, adopting Resolution 2001-232 authOriZIng and updating the feasibIlity report for lighting on Curve Crest Boulevard and Orleans Street Ayes Councllmembers Bealka, Milbrandt, Rhelnberger, Zoller and Mayor Kimble Nays None Reauest for final payment for Aiple property park plan preparation Mayor Kimble reviewed the request for the final payment on the Alple property park plan preparation Councllmember Bealka commented that perhaps a new name should be gIven to thiS property later Motion by Councllmember Rhelnberger, seconded by Councllmember Zoller, adopting Resolution 2001-233 approving the final payment for the Aiple property park plan preparation. RetalnlnO Wall at 819 Olive Street City Administrator Knesel explained that the problem with the wall being bUilt by Mr Bjorkman IS that It IS too close to the nght-of-way If the City would ever have to go Into the nght-of-way for utility purposes, then the owner of the property would have to be responsible for the costs for removal of the wall City Attorney Magnuson commented that In Minnesota, an abutting owner has the nght to the center of the street, subject to the mUnicipal easement Therefore, an abutting owner can use the nght-of-way If It IS compatible With the character of the street, I e Sidewalks, dnveways, stairs. If It IS not considered compatible, then it IS an obstruction This entities the abutting owner to a JudiCial determination that It IS an obstruction Mr Magnuson pOInted out at least one case where a City has gone In and torn out a Similar wall and the courts ruled that they should not have done that because there was no JudiCial determination that the wall was an obstruction Mayor Kimble asked Mr Bjorkman If he would be Willing to sign a release stating that If for any reason the City had to remove the wall, then he (the owner) would be responsible for those costs Mr Bjorkman said that this would be agreeable to him. . Todd Bjorkman has resigned from the Stillwater Police Department effective November 25, 2001 He has taken a job with the St Paul Police Department as a patrol officer to enhance his career. He has made a request to purchase his bullet proof vest from the city. The vest is two years old and costs $540 00. The police department wrote a federal grant that covered half the cost of the vest. The State of Minnesota paid the other half: According to the rules of the federal grant, Todd would not be eligible for any more grant money for 6 years (the manufactures suggested "life" of the vest). The vest is custom fit to each officer and usually cannot be reissued. We do not send the vests to auction as with other city equipment, because we do not want criminals to have bullet proof vests The old outdated vests (after 6 years) are used for training purposes and shot with handgun rounds to show the effectiveness of wearing a vest. These studIes are preformed as a part of a cooperatIve agreement between the CIty of StIllwater, area watersheds and the MetropolItan CouncIl Each year the CIty of StIllwater spends approxImately $2,000 to asSIst In the cost of perfonmng these studIes. A bnef summary of each lake presented as follows . Lily Lake On the A-F scale for the year 2000, LIly Lake receIved a grade ofC for total phosphorus, chlorophylla-a and SecchI depth bnngIng the overall score to a C ThIs grade IS IdentIcal to the ones receIved In 1998 and 1999. In 1995, Lily Lake receIved a B ratmg for overall water quality. Secchi depth readIngs have been taken SInce 1985 and dUTlng that tIme the average grade has been a C It should be noted that the water level of LIly Lake was extremely hIgh throughout the year and thIS water level sIgmficantly decreased the value of the CIty'S recently constructed water qualIty Improvement project Long Lake Long Lake receIved a grade ofF m all categones m the year 2000 ThIs IS farrly consIstent WIth In the grades receIved m the last three years but somewhat worse than the grades receIved m 1995 and 1996 when It received an overall score of a D Long Lake IS generally a very shallow lake with depths averaging less than 5 feet ThIs makes It extremely susceptIble to algae blooms and nutrIent loadIng problems and these depths are generally assocIated WIth a lake near the end of ItS lIfe cycle. McKusick Lake The data gathered for Lake McKusick IS extremely unusual Durmg the course of the year, CIty staff receIved numerous complamts about the qUalIty of Lake McKusick. However, the Lake receIved an overall grade of a B, whIch is the hIghest ever-recorded water qUalIty score. From a water qualIty stand pOInt the lake actually had better readings than LIly Lake for much of the year The complamts about Lake McKuSICk stem from the emergent vegetatIOn and algae mats whIch covered a good portIon of the lake POSSIble explanatIon is that the emergent vegetatIon used up a large amount of the phosphorus available making It unavaIlable for free floatIng algae that generally reduce water VISIbIlIty and water qUalIty Much lIke Long Lake, Lake McKusick is extremely shallow and hIghly susceptible to water qUalIty problems AddItIonal data In future years may proVIde more and better understandIng of what's happenIng on thts lake . The 52-acre lake has a maxlffium depth of 174m (57 feet), and has publ1c access located on the lake's northern shore and a fishing pIer on Its southern shore On each samplmg date LIly Lake was momtored for TP, CLA, TKN, and SecchI transparency, as well as the lake's perceived physIcal condIhon and recreational sUItabIlIty. As was the case WIth the lake's 2000 overall grade, the 2000 user perceptIOn means were the best recorded to date. One of the reSIdents lIVIng on Long Lake who IS most affected by potentIal floodIng IS Lee MIller. Mr MIller has raIsed the Issue ofh1gh water SInce 1995 As part of the AUAR for the expansIOn area, the CIty proposed a permanent solutIon to control Long Lake at elevatIons that would not flood people for events that exceed 100-year probabIlIty. The DNR denIed the CIty'S request to construct these Improvements m 1997 when the CIty completed the trunk utIlItIes for the LIberty/Legends area . . SInce 1997, continued beaver actIvity at the Jackson WildlIfe area as well as the sIltatIon of the wetlands and channels that dr31n Long Lake and the collapse of one of the pIpes underneath 72nd Street have all resulted In the water levels m Long Lake to nse as shown on the attached ~surface elevatIons of Long Lake. Smce 1996, the Lake has rarely been below an 890 and has never reached an 889, and In that tIme the average lake elevatIon has nsen by almost half a foot. As the lake level nses, it reduces the amount of storage available for large storm events Of course, thIS increases the nsk of floodIng to the lowest homes along the lake. The studIes of Long Lake IndIcated that the lake should have a normal control elevation of889. Also, the control structure at County Road 12 would need to be enlarged to allow for greater flows Mr. MIller IS request10g the CIty and Brown's Creek Watershed DIStriCt look at optIons for pursumg interim solutIons. A possIble solutIon would be to complete the channel excavatIon and pIpe replace underneath 72nd Street. Both of these Improvements would elIm10ate beaver actIvitIes, remove sIlt from the channels and Increase the capacIty of the pipes under 72nd Street. These steps would all result 10 the lake level bemg controlled at an elevatIon much closer to 889. The level control structure at County Road 12 would be left 10 place untIl such tIme the CIty completes the down stream trout stream dIversIOn projects improvements. Leaving the control in place means we may not have complete 100-year protectIon for homes along the lake. But, we would dramatIcally reduce the nsk of floodIng to these homes For this option to proceed, we would need to get DNR approval. It is lIkely there WIll be some neIghborhood resistance to this solutIon, as it WIll reduce the normal water level of the lake by about a foot to a foot and a half Since tlns IS a shallow lake tlns could have sIgmficant Impact on some property owners. . November 16, 2001 Ifwe proceed WIth tlns project It WIll probably have a constructIon cost of between two hundred and four hundred thousand dollars. The cost of such a project would be funded by the storm watA Impact fees charged to developers and perhaps some assIstance from BCWD and Oak Park Heighr The only downsIde to constructIng the project early is it would delay the construction of some of the downstream improvements that the DNR is anxIOUS to see happen. NOVEMBER Public Hearing - liquor license, CiVil Penalty Ordinance The Minnesota Department of Public Safety is now requiring that local Units of government have a civil penalty ordinance in place for establishments who have Violated the law by selling alcohol to underage persons. Failure to have a civil penalty ordinance will preclude the local unit of government from recelvmg state aide to conduct compliance checks. The Washmgton County Sheriff's Department IS developing a draft ordinance for conSIderation by the County Board. Agenda - Award Bid for RadIO Upgrade . The County Board will award a bid to upgrade the County's public safety radio system. The proceeds for the project will come from the County's recent issuance of CIP Bonds. Workshop - Transportation and Physical Development Report and discussion on condition of the security system at the law Enforcement Center Workshop - Impact on MN Property Tax law Changes on Payments in lieu of Taxes . County staff will report to the County Board on the impact of the new property tax laws on the payments made to the county In lieu of taxes for certain tax exempt properties such as HRA housing projects The Board will also review other elements of the tax law changes and their effect on the Washington County tax base. DECEMBER 4 Workshop with Watershed Districts and WMO's The County Board will host a meeting of watershed districts and WMO's to discuss future strategies in Implementing the recommendations of the Water Governance Project in light of the recent Court of Appeals ruling. WATER MANAGEMENT MATTERS - Jane Harper was present to give an overview of the county's attempt to combine watersheds and water management organizations into seven watersheds. The town board members are in favor of disbanding the Marine WAMO to avoid a duplication of efforts and expenses. Supervisors appointed David Johnson to represent the township in an effort .0 that end. New Scandia chair Dennis Seefelt expressed that their board embers also favor a merger of the WAMO with the Carnelian Marine Watershed. On December 4th the counxy board will discuss the water management issue. Supervisors will attend. Current representative Louise Bergeron will be thanked for her past work with the Marine WAMO and notified that a board member will take over as Stillwater Township's representative. 4. TOWN HALL - M/S/P LaBoda/Laabs moved $225.00 (labor and material) for installation of hot and cold water faucets in the town hall basement. (5 ayes) M/S/P LaBoda/Laabs moved not more than $350.00 for Joel Peterson to create a 4 foot by 4 foot bulletin board with a plexiglass door that hinges to the north and a drop off box added below. (5 ayes) A punch list of finishing items for the town hall was reviewed. Additional work on the town hall after contract work is finished will be billed to the township at $45.00 an hour. LUDACK BUILDING LOCATION REQUEST - M/S/P Johnson/LaBoda moved to approve the placement of a tan metal pole building in front of the dwelling on the Ludack property at 3530 Stonebridge Trail upon submission of a plan for additional trees for screening. (5 ayes) The plan was submitted at the meeting. 7. OPEN SPACE ORDINANCE - Kirsten Spreck brought the changes that the planning commission came up with to the board. Meg McMonigal elaborated on the changes. M/S/P Johnson/LaBoda moved to instruct the attorney draw up an ordinance that will extend the open space moratorium until February 2002 and refer some performance standard issues back to the planning commission for further consideration.
