The county was approached by Quest wireless for permission to co-locate on the tower (letter attached). As payment to use the county tower, Quest would possibly construct a tower at the county public works site or some other county site. City zoning regulations allow new towers of 75 to 100 feet (co-location). The existing tower is legal, nonconforming and may remain but not be extended or enlarged In discussing the future use of the tower, City public works, fire and pOlice staff felt city public safety needs should be considered before a decision on possible private use of the tower be decided. The fire chief contacted communications consultant Jeff Nelson to review the tower Situation and existing and future public safety communication needs. His review indicated that it was pOSSible for a private prOVider to co-locate on the tower. Regarding city enhanced communications, there are several alternatives available and under consideration by the county and state that mayor may not use the lily Lake tower site as part of a new system. City staff consensus, after discussing the future of the tower, was to do nothing at this point until the new public safety communications system has been developed. Staff felt it would be premature at this pOint to allow a private provider to be located on the tower. At some point in the future, the City may want to use the tower or have a tower at an alternative site constructed. If it was determined that a private provider could co-locate on the county tower, it was recommended the co-locate pOSition be bid to all private proViders rather than negotiated with one provider. The city and county attorneys suggested that the tower arrangement between the cityand county be formalized In a written use agreement to describe rights and responsibilities of each party. Recommendation: Direct city staff to work with county attorney to develop a use agreement for lily Lake water tower site. Back~ound PSC Alliance IDc was retained by the City of Stillwater to examineunacceptab1e perfonnance of the Fire Ground Radio system (hereinafter referred to as the FGR system). Stillwater's Fire Department staff reported that performance of the FGR system did not meet expectations or needs of the department inasmuch as there were locations within the Stillwater Fire Department (SFD) service area where reliable communications could not be effected with the existing system. . An on-site inspection of the equipment was performed. The existing FGR system consistS ofa multi-channel mobile radio, associated AC power supply, and roofmounted, 3 dB gain antenna. The tranSmitter output of the radio was measured at 90 watts. The radio is installed in the fire department's communications room. Even though a mobile radio is being used for FGR operations, the radio's permanent fixed location installation plus its connection to an outSide, fixed, building mounted antenna1 classifies the headquarters installation as a "base" radio under the applicable FCC Rules. The system is installed at the SFD headquarters building at 216 North 4111 Street in downtown Stillwater. While on-site, selected fire department portable radios were also electronically tested to verify proper operational perfonnance. The FGR. radio system operates on the wide band frequency oflS3 .830 MHzwhich is the designated channe1in the State ofMinnesota for fire ground operations. Under the roles of the Minnsota Statewide Fire Radio Frequency Plan, departments using frequency 1 S3 .830 MHz are not eligible to install base radio facilities on the frequency and, in fact, transmitter power output levels for mobile/portable operation on this frequency is limited to 10 wattS by the MN Plan. The City of Stillwater holds no FCC license authority to operate on this radio channel in a fixed mode although FCC callsign K.A93599 does authorize 6 mobUe units with a maximum power of 6 watts on the frequency. 1 Ground elevation and antenna mounting height yield an effective antenna height of . approximately 740 feet Above Mean Sea Level (AMSL) for this site. Kim .Ka11estad Page 2 - August 30~ 2001 The Stillwater Fire Department Administration was informed of this non-conforming use and alternative options were discussed to enhance radio fire ground coverage for the department. The desired FGR system performance goal articulated by the Fire Department administration was to provide reliable, two-way radio coverage from the fire station to a fire vehicle parked at the curb virtually anywhere in the service response area of the department For purposes of this report. this coverage is characterized as 95% mobile coverage reliability. Coverage Improvement Strategies There are effectively four methods for improving substandard performance for land-mobile two- way radio communications. These methods are: . 1. Increase Transmitter Power: Increasing the transmitter power offers limited improvements to range. Further. since the FGR system must operate in a two-way mode, simply raisingthe transmitter power of the base station, if permitted, does not guarantee reliable talk-back performance from a mobile unit In general terms the transmit power of the base and the effective transmit power ofmobileslportab1es must be reciprocally '~a1a.ncedtt to ensure that the fixed site cannot talk further than the mobile/portable units can answer back. In the case of the fire ground channel now in use by the SFDt transmitter power is limited by the FCC Rules and the MN Fire Frequency Plan. 2. Raise Antenna Height: It is a generally accepted radio engineering practice that raising antenna height offers more benefits in terms of range than attempting to increase transmitter power Doubling the antenna height is said to have the same effect as a four-fold increase in transmitter power. Raising antenna height. howevert is impractical for a mobile and not pennitted because of the "mobile only" regulatory status of the existing channel for the fixed FGR operations of the fire department, 3. Reduce Distance Between Transmitter & Receiver: Often times the most practical way to improve radio communications in a system such as that operated by the SFD is to reduce the distance between transmitter and receiver. In practical terms this translates into adding more fixed radio sites so that regardless of where the mobile happens to be within the service area, they are never "too far" away from any individual fixed site. Fixed sites are then networked together so that the base station user always has the benefits of access to all of the fixed sites spread across the jurisdiction. In the case of Stillwater's FGR system, adding fixed sites is not an option on the current radio cbannel because oEregulatory constraints. 4. Improve Receiver Equipment Performance: It is theoretically possible to improve system pexfoonance by enhancing receiver performance. On a practical level, improving FGR system performance for the City of Stillwater would entail adding not less than three (3) fixed radio sites. Three sites would be needed because of the variations in terrain (which ranges from 675 feet AMSL near the St. Croix river to almost 1,000 feet AMSL near the western edge of the service boundary). No single site is expected to provide 95% mobile coverage throughout the service area (assuming that the channel now used for FGR could be installed at fixed sites anyway) and operated at power levels required to achieve the perfonnance objective, Candidate sites for placement of fixed equipment are: · City Hall · Lilly Lake Tower · County Highway Shops Tower · Commercial Wireless Monopole - Grant Township Hall · Commercial Wlfe1ess Structures in Stillwater or Scandia Twp. We conducted a preliminAry search and did not identify a candidate wide band channel which would be suitable for the intended purpose. We anticipate that the City would have better success licensing a first-phase narrowband radio channel for FGR operations However, some existing mobile/portable equipment could not be used on a narrow band channel and would need to be upgraded at an estimated additional cost of 524,000 to retire and replace the radios which are not narrow band capable. . ~ 7JSC) ALLIANCE. August 30~ 2001 Alternative Ungrade Dntions Several options exist in addition to the one described above to achieve 95% mobile coverage reliability for fire ground radio operations. They are described below. Option 1: Washington County is undertaking a large scale upgrade of its public safety radio communications systems. Efforts are underway to secure licensing for a "repeated" .fire radio channel which, when established~ would create a second, non-repeated channel forfire department operations and :fire ground use countywide. Since much of the infrastructure is already in place to effect this system and many of the costs are being borne by the County, establishing a suitable FGR system replacement for use by the Stillwa.ter Fire Department would be the least costly approach. Stillwater Fire could connect to the upgraded County system for the recurring cost ofa dedicated telephone line connection which is expected to be less than $1 ,200/year/per fire department campus location Local equipment which would need to be purchased by the SFD to connect to the County's system is estimated to cost approximately $300 per desktop location where it is needed. 95% mobile coverage could be anticipated under this scenario. OPtion 2: Stillwater Public Works Radio Channel. The City of Stillwater operates a public works chaone12 which offers slightly better coverage (compared to the existing FGR radio system). This system's better performance is a function of the installation of the antenna on higher ground (antenna. is approximately 940 feet AMSL). Even with its single location on higher ground. use of this system to achieve 95% mobile coverage in the fire department's response area is unlikely; additional sites would need to be added to the system to deliver the higher level ofpertormance expressed by the SID. Estimated cost to expand this public works system are similar to the itemized costs shown above for the FGR upgrade. The benefit of utilizing Option 2 is that 8FD mobile/portable equipment would not need to be replaced although some alternative arrangements would need to be made to handle the traffic for public works users.3 A limitation of using the public works channel for fire ground communications is the strong possibility of interference from neighboring licensed users. Within a 75 mile radius of Stillwater, there are 11 other licensed users and six of these 11 users are located within 30 miles of Stillwater, The closest large system users licensed on the frequency are in Chisago County and Ramsey County. Nexte1 radios are provided free by that carrier to governmental agencies. Subdivision 7 Entitled TraffiC Public Works Director Eckles reviewed the proposed ordinance amendment regarding the elimination of snow emergency routes and Implementing calendar parking on these routes from November 1 through Apnl1 He also reviewed the proposed amendment regarding year round calendar parking In the legends and liberty neighborhoods Mr Eckles stated that out of the 600 notices sent to affected property owners he received 4 letters, one for the change and three against the change - two of which were In the legends and liberty area regarding the narrow area around Hentage Park . We request the dedication of an additional 60 feet of right of way adjacent to Manning Avenue (CSAH 15) The labeling of the space between Manning Avenue right of way and Lots 10 and 11 IS Illegible on the draWing that I received In prevIous Liberty on the lake additions a 60 foot wide outlot has been platted Platting of a 60 foot wide outlot, owned by the City IS acceptable to the County . The County Board and the HRA Board entered Into a Cooperation Agreement on June 3. 1997 to permit the HRA to place 60 units of scattered site public housing throughout the County via the Metropolitan Housing OpportUnity Program Since that time. the HRA has acquired and now manages 46 units (12 single family homes and 34 townhomes) and 9 more units are under private ownership (four Units are located In the Lakeside Development In Woodbury. and five more are proposed in the Tamarck VIllage Homes development. also by the same developer in Woodbury) The MHOP program is a result of the Hollman Consent Decree. which authOrized several million dollars from the federal government to house persons displaced by a redevelopment project by the City of Minneapolis. The intent of the Consent Decree was to provide permanent rental housing for the indIviduals housed in the demolished development and to deconcentrate public housin~ units for lower income persons In the metropolitan area As a result. several cities and counties in the metro area have agreed to permit the location of scattered site public housing (to address the deconcentration objective) to make up for the lost 700 units. OTHER JURISDICTIONS A majority of the units are located In Hennepin County. however. Scott and Carver Counties have 50 units each. Ramsey County has10 and An~ka County has committed to 23. Carver and Scott Counties are evaluating taking on more units. Similar to the current effort by the Washington County HRA. , " . 1 Jo " The Washington County HRA does not have any MHOP Units in the northern part of Washington County at thIS time. The Units are located in Woodbury, Oakdale, . Cottage Grove, and St Paul Park CURRENT REQUEST TO WASHINGTON COUNTY HRA In an effort to complete the requirements of the Consent Decree prior to the Consent Decree deadline of April 2002, the Minneapolis Public Housing Authority (MPHA) hired Minnesota Housing Resources Inc (MHR) to contact Jurisdictions across the metropolitan area. MHR contacted me last spring I advised MHR that the HRA was not in a pOSItion to take on more MHOP Units until several operational Issues were resolved dUring the ensuing months (further explained below). However, I did not want to prevent the cities In the County from evaluating thiS option. It is my understanding that MHR contacted the citIes of Woodbury and Stillwater. Woodbury responded favorably to the inquiry by MPHAlMHR to locate additional MHOP units in Its community, and subsequently requested that the HRA In May 2001 to own and manage ten additional units. The HRA Board approved the Woodbury request on May 17, 2001 subject to several condItions and events occurnng prior to HRA ownership (the letter from the Stillwater Mayor had not been receIved at that time). The oeneral understandino was that MPHA would comolete the acauisitions this fall and early winter as a temoorarv means to allow the HRA to comolete the followlno ooerational oroiects. and then convev the units to the HRA at the end of March . 2002. 1. Complete a public hOUSing "Administrative Plan" for day-to-day operation of the Units 2 Complete the 2002 Budget process 3. AuthOrize a ReSIdent Advocate posItIon to assist the HRA In handling a variety of issues associated With the units. 4 Initiate a management company RFP process and select a management company. If there is to be change to a new company, an adequate transition timetable must be accomplished first prior to taking on additional units. 5 Complete a financIal analysIS of the impact of the additional units on the Authority budget. 6 Resolve various compliance Issues With HUD. 7 Approval of necessary agreements with the County, HUD, and MPHA. Items 1 through 5 have been completed, and item 6 WIll be completed within the next 60 days. Item #7 is discussed next . 2 .. COUNTY REQUEST . Subsequent to the Woodbury request, I received the letter from Mayor Kimble regarding 15 Units In Stillwater. The HRA requested the County Board to amend the Cooperation Agreement (thiS constitutes part of Item #7) on September 11, 2001 to authorize an Increase In the number of Units to be located in Stillwater and Woodbury, and to permit the MPHA to acqUire the Units until the HRA takes ownership In March 2002 The County Board tabled conSideration at thiS meeting and directed both cities to take formal action requesting the units. The Woodbury City Council on September 12, 2001 approved a motion requesting the Washington County HOUSing and Redevelopment AuthOrity and the Washington County Board to take the necessary actions to allow for the provision of ten (10) additional MHOP Units in Woodbury It is my understanding that the Stillwater City Council postponed action until October 2, 2001. As a result, the County Board conSidered an amendment to the cooperation agreement onlv for the City of Woodbury on September 25, 2001. The County Board approved the request HRA BOARD ACTION . The HRA Board on September 18, 2001 approved a resolution authOriZing an amended Cooperation Agreement With the County for the Woodbury units only The HRA Board did not take action on the Stillwater Units until the City Council completes their consideration If the City of Stillwater does not approve of the request to have MHOP units within the City, the HRA Board and the County Will not pursue the matter further. HOW THE MHOP PROGRAM WORKS . The Units Will be acquired based on several location factors. It IS Important that Units have good access to public transportation services, employment opportunities, and park areas for children TYPically, one unit Will be purchased In a townhome development that IS located close to these types of amenities Units will range In size from two to four bedrooms, depending on market availability. In some cases, the Units have been made part of new townhome construction as In the case of the LakeSide development In Woodbury The MHOP program IS an income based housing program. Tenants pay rent to the HRA based on their Income The HRA receives "operating funds" from HUD on an annual basis to make up the difference between the tenant's rent payment and the operating costs The Consent Decree requires the HRA to select 70% of the tenants from the MPHA waiting list and 30% from the HRA list However, a substantial majority of the existing HRA units were filled with families from the HRA's list since the list from MPHA was not available in 1999 when the program was initiated A 1998 amendment to the Consent Decree will permit the HRA to place tenants from the HRA's waiting list (list maintained by Metro HRA) after ten 3 , years from the date that the first scattered site units were placed in service, at opposed to abIding by the priOrity protocol maIntained by MPHA. This will mean . that 10 years from now, persons from Washington County Will receive priority Tenants' credit history and criminal histories are thoroughly reviewed prior to placement All tenants must meet the HRA and HUD selectIon criteria SUMMARY The program has been very successful to date. New signs would be located on TH 36 directing east bound traffic to CR 15, Th 96 and TH 95 (North Main) as an alternative route to Downtown. The cost of the additional signs is $2,861.00+. In addition to the signs as proposed, an additional sign directing drivers north at CR 15/12 was suggested by the Downtown Parking Commission. The Parking Commission felt that the benefit of the alternative route signage was a general City Downtown benefit not specific to parking and should be paid by the City. The city engineer in reviewing the request, indicated the City has some credl~ from Mn DOT coming for snow plowing Main Street and this may be a resource for the signage. DISCUSSION: Smce 1997 the City of Stillwater has been workmg With the Mmnesota PollutIon Control Agency, MPCA, to obtain a closme letter on the Myrtle Street Dump ReceiVIng tins status removes the dumpsite from the superfund cleanup list and elimmates potential liabIlity on the part of the CIty. In order to obtain this status from the MPCA, the CIty has completed a number of studies lookmg at potentIal contammants and health nsks associated With the dumpSlte. All of the necessary testing has been done and no sigmficant threat of contaminatIon or hazardous matenals are present on the SIte. The MPCA has md1cated they Will give the CIty the closure letter If the City files a deed restriction on the property The CIty Attorney Will proVIde CIty CounClI with a final copy of thIs deed restnc1:lon. A working draft has been attached. To summanze, thIs deed restrIctIon would allow the CIty to continue use of the dumpsIte as we currently are for snow storage and storage of street sweepmgs. In the event that we Wish to change the use of tins property It Will be necessary for the CIty to obtaIn a written approval from the MPCA mcludmg possible cond1tIons which maybe necessary to protect pubhc health, welfare or the envrronment This is a reasonable request SInce it would only be prudent to take precau1:lonary steps m the event we wish to mtensify the use of this site or develop tins Slte. Periodically during general City clean up days, dumpsters were placed on the Propet1y for the collection and removal of mixed municipal wute by the City garbage contractor. The City continues to use the Property as a deposit and staging area for street sweepings and tree triouning to this date~ and WHEREAS. the site of the Property was placed on the U.S. Envtromnental Protettion Agency's (the liEPA'') Comprehensive EnVU'OnmentaI Response. Tlu'ee surface water samples and three sediment samples were collected from the adj8CeIlt wetland area. Six soil samples were collected from the dump area All samples were analyzed for the presence of volatile orgamc and semi-volidle organic compOlDlds, PCB's, pesticides, metals and cyanide, and WHEREAS, the laboratory analysis of the solI samples revealed that semi-volatile organic compounds, particularly polynuclear aromatics (WPNAs"), make up the majority of the ou-site sOli contamination. The pesticuic, AldrIn, was detected in one soil sample at a relatively high eonccDtration. The compounds acetone and toluene were also detected in several soU samples at lower ooncentrations. A number of semi-volitiJe compounds and the compoWld toluene were detected in sediment samples collected from the edge of the wetland. No oontam1n!olnU Welro dotected in the sample taken from the municipal well, and WHEREAS, the results of the SSI indicate that contaminants found within the dump have been released to surface water and the wetland area adjacent to the Property. The Pbue II Work Plan was approved by the MPCA on December 2S, 1995; and WHEREAS, the Properly is IDeated approximately 2,000 feet south-southwest of Lake McKusick. Residential property and athletic fields are located to the west and east of the Property, respectively Wetland areas'are located immediately west, north and northeast of the Property. Mark Holsten, MNDOT, Congressman Bill Luther, and all others concerned: I hesi1 te to even write this letter; it feels risky to broach the topic at all and its so much easier to just avoid the debate, when it comes to the topic of a proposed new Stillwater bridge. Not long ago I gave p trying to follow the news on it - too confusing and exhausting, I thought. After uch consideration, I still find that I don't really know what is right - whether or not a new bridgl is needed or a wise decision, though it appears that there is a clear majority of folks in the area here "I ho feel this is very important that a new bridge is built here as soon as possible. (My opinion whicJ I again can't back up with any vote or poll). The dilemma is 1.U1derstandable to me and I wow. 't pretend to know the "right" answer - only history can say what that is - and I truly do respe t all points of view on this. I am not for or against a bridge, but rather neutral. And J now realize what a huge impact a new bridge will have on our town and our lives here, and I cert' y can speak only for myself, as there are a myriad of opinions on it, and very powerful emot ons expressed by almost everyone discussing a new bridge. Sturgeon Bay has some of the same characteristics as Stillwater - a pret tourist town on the water, a historic steel bridge and a perception of too much traffic and need for I other bridge. WISDOT is looking at a "Two Two-Lane" concept as an option. Aceo ding to the report by the University of Minnesota's Civil Engineering Department, the old bridg is structurally sound - they did stress tests and found that even trucks don't pose a hazard to it. I h d as the main objection to keeping the old bridge as a bridge is that the parts are no longer made for the lift mechanism. But, after seeing the magic our machinists can do in our shop at the facto where I work, I feel confident that, on a different scale, we could come up with the neces ary parts should the unlikely event occur (told to me to be unlikely be a civil engineer) that the Ii should fail. The 1 wo Two-Lane Bridge is not a novel idea: it is a commonly used solution when a single bridge is det rmined to lack sufficient lanes. In fact in a July 16, 2001 Letter to the Editor by a Stillwater TOWJ 'p citizen with some background in civil engineering, this very concept was outlined as a logic solution. And the geographical area proposed for the Two Two-Lane Bridge has already been iVered by a prior Environmental Impact Statement and little more would need to be done to upda' e it (according to the fonner project manager from MND01). Its re onable to ask why the smaller Two Two-Lane Bridge idea can't get at least serious review and, . ration by the decision-makers here. I think there is much interest in this idea on the part ofth. citizens, as well as several politicians involved who were not aware of the idea at the time ofBI un C and now have the intellectual honesty and courage to change their position based upon new onnation. There seems to be great fear though that ifwe don't get Braun C then we don't get a . dge. I have to at least ask one last question, is that really the case? Or can this mediation be a] t chance for all involved to be flexible in their thinking, to reconsider positions and, putting all el ooons aside, taking a critical look at all of these concems.
