StIllwater' Area Memorial
CIty AdmInIstrator Kriesel informed the CouncIl that the item IS before the CouncIl because
the memonal would be placed on CIty property.

Mr Bnan Larson, Larson Benner ArchItects, presented the desIgn of the memonal to be
placed on CIty property located at the city parking lot on 3rd and PIne Streets
CouncIlmember Rheinberger expressed concern on the security of the structure, why the
County Courthouse was not chosen as a site, the cost of the project and how would it be
funded, how would It be maintained and why the Aiple property wasn't looked at
Mr. Larson stated that the tower had an eIght-foot smooth stone base With a tight knit mesh
that was not climbable
Mr. David Swanson stated that the site commIttee wanted a school site rather than a County
site and With the status of the bndge and floods, the AIple property would not be a good
location,

Mr ~ Olson stated that the total cost for the proJect would be $700,000 The fundIng
would be through private donatIons, businesses, and foundatIons. He also stated that the
COmmIttee would be asking surroundIng communities Within the school district to partIcipate
In the cost. He stated that the commIttee would have an endowment fund to take care of the
maIntenance, they are not looking to have the City provide the maintenance

CouncIlmember Bealka stated that he felt the memonal placed on the CIty parking lot was
Inappropnate, another place should be found and the memonal would obstruct the historic
courthouse He also stated that a County CommISSIoner was upset that the County was not
Informed.

CouncIlmember Zoller asked CommunIty Development Director Russell If the County was
notIfied as part of the plannIng process .
Mr Russell stated that notIces are sent to affected property owners of record In the case of
Washington County the notIce was sent to the Property Management Office of WashIngton
County
He stated he was not aware of actIve plans for other locatIOns, but conceptual use of the
parkIng lot was gIven
Councilmember MIlbrandt asked what thIs memonal would be called
Mr Dave Swanson stated that It would be called Memonal to Veterans of Stillwater Area
Schools He stated that they would mclude schools In Manne on the St Croix, WIthrOW,
Afton, Lakeland, StIllwater, and Bayport mcludIng pnvate schools, home schools, and
parochIal schools WIthIn the school dIstrIct area The memonal would also recognIze all
veterans
CouncIlmember Rheinberger stated that he felt the tIme was wrong, It was too costly, would
be a maintenance Issue for the CIty in the future once the momentum becomes less, and felt
there are other alternatives such as a small memorIal and a utIlIty for the livmg
CouncIlmember Zoller stated that he was In support of the memorIal, he stated that he went
to all the meetIngs and nobody obJected He stated In regards to the cost issue, the CIty is not .
puttIng up money at thIs tIme and there may be a maIntenance Issue so maybe an endowment
clause may need to be addressed and Included He stated that based on comments he has
received he would vote in favor of the memorIal
CouncIlmember MIlbrandt stated that the commIttee has proVIded the CIty with a gIft, the
City can not raise $700,000 for a memonal and It IS a way to show chIldren the realIty of
lIves lost
JulIe Kink stated her support for the memonal based on her experience of losmg a famIly
member during the Vietnam War. She felt that the memorIal serves as a utIlity for the liVIng,
It brings people closer together
Mayor Kimble stated that the commIttee IS not askIng for money at thIs tIme so approval
today does not mclude money
Mr Duane SeaqUIst stated that Mr Wally Abramson, County Commissioner IS against the
memonallocation because it Will block the VIew of the hIstonc courthouse. He questioned
why It wasn't heard for a variance
CouncIlmember Zoller stated that a vanance was approved for the heIght at the Planning
CommIssion meetIng and all property owners were notIfied
Mr Larson stated that the deSIgn of the memonal should not InhibIt the VIew of the .
courthouse, he stated that they could demonstrate it would not block the VIew of the

courthouse He stated that thIS Issue was Important to the Plannmg CommISSIon and
Hentage PreservatIon.
CIty Attorney Magnuson stated that a munICIpal lIcense would be needed to use publIc
property and condItIons can be mcorporated mto that lIcense for SIgnature by all partIes

CIty EngIneer Eckles presented an update and draWings on the PublIc Works faCIlIty He
stated that plans and speCIficatIons will be aVailable to bIdders begInning September 6, 2001
With a bId openIng on September 29,2001 and proVIded to CounCIl for award of the contract
at the October 2,2001 meetIng He stated that the CIty has receIved a permIt from Brown's
Creek for soIl correctIon and Will be receiVIng another pernut for storm water management
CouncIlmember Zoller asked if there were deduct Items m case bids are hIgher than
expected
CIty EngIneer Eckles stated that most of the bId IS a on a per unit basIS so that thIngs may be
deducted If needed

CIty Engineer Eckles reported that the stop SIgn study IS underway and staff Will be
reviewmg placement of stop SIgnS to deternune if they are needed or should be removed in
areas around the CIty He stated that a report would be aVailable for Council at a future
meetIng

regardmg lIghtIng on Curve Crest between Cub Foods and WashIngton Avenue He stated
thIS Issue has not been deCIded yet, but that thIS portIOn of IIghtmg could be done He also .
stated that CouncIl could consIder the issue once the letter IS receIved

Update on local tranSIt system status - Marc HUguIlIn. Met CouncIl RepresentatIve
Mr Marc HUgunIn, Met CouncIl, mformed CouncIl that the Met COunCi1IS currently
evaluatIng the transIt system in the St. Croix Valley. He stated there would be no servIce
reductions m the valley, but they may change tImes and route changes He stated there
would be publIc heanng, flyers, announcement m newspapers, and staff rIdmg the buses to
mform people pnor to any changes bemg made. He stated that he antiCIpates it would be
done by the end of200l
Mr Hugunm also Informed CouncIl that during the flood the infloW/InfiltratIOn at the St
Croix Valley Wastewater Treatment System reached the capaCIty of 4 5 millIon gallons of
the plant He stated that If the inflow exceeds the capaCIty of the plant dunng a flood It may
be necessary to shut down servIce to parts of the St CrOIX Valley. He stated that Met
CounCIl is currently looking at this Issue and wIll need to work With communItIes m the area
to work out a solutIon to this problem.

CIty Engmeer Eckles stated that the CIty would be Interested In knOWIng If there is an
mcrease In need m the express buses due to out state users comIng to StIllwater because
StIllwater would lIke to try to keep our local servIce and not sacrifice It to outsIde users
Mr Eckles asked if there would asSIstance from Met CouncIl for the IInmg of the pIpe to
prevent Inflow along the nver
Mr HugunIn stated he IS not aware of any funds at thIS time He stated untIl costs are known
the Met CouncIl Will not know the Impact on the communItIes, but Will allow for the optIon
of lookIng for fundIng asSIstance even at the legislature level The fundmg Issue IS part of
the study that Met CouncIl wIll be lookIng at
Commumty Development DIrector stated that each summer the Downtown ParkIng
CommISSIon wonders If there IS any tranSIt money avaIlable for shuttle servIce from the
outlYIng parkIng lots Into StIllwater
Mr Hugumn stated that a pnvate shuttle company would probably proVIde a lower cost
servIce He stated that Issue should be dIscussed to find out the City's needs.

except the Central Business DIStrIctS. He also stated that a sectIon should be added
addressmg odd/even parking throughout the entire year for the LIberty and Legends

Hawthorne Improvements update
CIty Engmeer stated that a neIghborhood meetIng has been held With the Hawthorne Lane
reSIdents regardmg the sewer lme problems and pOSSIble solutIons He also stated that not all
reSIdents were present and suggested that informatIon be sent to property owners with a
survey lIstIng the options to correct the problem to find the consensus of the neighborhood

NEW BUSINESS
PossIble approval of Personnel PolIcy
DIrector of AdmImstratIon KadIn revIewed the changes In the Personnel PolIcy She stated
that the polIcy has not been updated SInce 1988 and thIS polIcy Incorporates law changes that
have occurred
She stated that there was an unwntten policy that employees receiving 100% premIum must
enroll in the CIty'S msurance programs and recommended addIng thIS to the polIcy She
stated that thIS Item Will not affect current employees, but will be reqUIred WIth new
employees hIred after October 1,2001
Ms KadIn asked for Council dIrection regardmg the use of SIck and vacatIon tIme dunng an
employee's probationary penod
It was the consensus of CouncIl that employees should be allowed to use SIck and vacation
during the probation penod, but that the probationary penod should be extended by the
amount of time used.
CouncIlmember MIlbrandt suggested that the unwntten polIcy of employees usmg vacatIon,
comp tIme and SIck tIme in quarter (1/4) hours be added to the polIcy
Councilmember Zoller stated that the ConflIct of Interest sectIon should be the same
language as the City's Charter
MotIon by CouncIlmember Bealka, seconded by Councilmember Rheinberger adopting Resolution
2001-178, adoptIng personnel polIcy With the changes to the Conflict of Interest sectIOn to reflect the
language m the CIty'S Charter, to include language allowing probationary employees to use SIck and
vacation dunng the probation period, but that theIr probatIOnary penod wIll be extended by the
amount of tIme used, USIng vacation and SIck tIme m quarter (1/4) hours, and employees receiVIng
100% prenuum must enroll in the CIty'S msurance programs

AdoptIng 2002 proposed budget and tax levv
CIty AdmInIstrator Knesel revIewed the 2002 proposed budget and tax levy He stated that It
is stIll unknown what the revenues Will be from the State, but recommended that CouncIl
adopt the budget and tax levy At thIS time If necessary the budget and tax levy could be
reduced for final adoption m December.
CouncIl set a speCIal meeting date for the adoption of the proposed budget and tax levy for
September 11, 2001 to allow staff time to find out more InformatIon on revenues to be
receIved from the State and InvestIgatIOn of an appeal process regardmg the mcorrect
housing information used by the State in calculatIng the growth adjustment factor

CouncIlmember MIlbrandt asked about the contract for Ted Thompson that expIres August 31, 2001

CIty AdmInIstrator KrIesel stated that Mr Thompson was unable to attend tOnIght's meetmg,
but would be aVailable for the next regular meetIng
CouncIlmember MIlbrandt requested that Mr Thompson be present at the specIal meetmg on
September 11, 2001

PolIce ChIef Dauffenbach reported that the Parade of Homes would be restrIctmg parking to
one SIde of the street In the LIberty and Legends area
City AdnunIstrator Kriesel mformed CouncIl of the sudden death of Scott Montbnand who
was an employee of the City and whose mother was hIS secretary for many years.
CouncIl extended ItS sympathy to the Montbnand famIly.

receIved for the CIty AdmInIstrator posItIon The Brimeyer Group would be mtervIewmg about
20 candIdates and would proVIde the CouncIl With a progress report on October 9,2001 After
reVIew of the progress report, the CouncIl Will select 5 or 6 candIdates to mterview The
mterviews would be conducted on November 16th and 17th

Ted Thompson dIscussed the status of the new nver crossmg The United Institute for
EnVIronmental COnflICt ResolutIon that was comnussIOned on request of WIsconsin's Governor
McCallum was in the process of assessmg issues related to the new bndge Mr Thompson
suggested that he be retained on an as needed baSIS and that at thIs tIme there was not much that
he could be dOIng for the CIty Councilmember Rheinberger Said that the CIty had spent at least a
mIllIon dollars on the bndge issue over the past 40 to 50 years and that he belIeved that the City
should not be spendmg any more funds on thIS matter. Mr Rhemberger also said that he dIdn't
thInk it was necessary to keep Mr Thompson on a retaIner basis Mayor KImble Said that Mr
Thompson would not actually be paid a retaIner but would only be paid If and when hIS services
were reqUIred Councilmember MIlbrandt Said that the CIty should retaIn the servIces of Mr
Thompson on an as needed basIS and should not gIve the appearance of gIving up on thIS matter
CouncIlmember Zoller concurred and also Said that It was a lIfe safety Issue for the reSIdents of
hIs ward because of the extreme traffic condItIons

DISCUSSION OF 2002 PROPOSED BUDGET AND TAX LEVY
CIty AdmInistrator KrIesel Said that the proposed budget and tax levy should be adopted at thIS
tIme and that the final budget and tax levy could be adopted In December Mr Knesel Said that
m regard to the Issue of USIng flawed data for the household growth factor, he had talked to staff
at the League of Minnesota CitIes and the Department of Revenue It appears that there may not
be a way of appealmg the household numbers that were used to determine the growth factor
However, Mr Magnuson would be talkIng to the CommISSIoner of the Department of Revenue
later thIs week to further pursue thIS Issue Mr Knesel Said that the proposed budget and tax levy
had to be certIfied to the County by September 17th and should, therefore, be adopted at thIs
tIme If an appeals process was aVailable It could be done In spite of the certIficatIon
CouncIlmember RheInberger asked if staff had any estImates of what Impact the loss of tax
increment finanCIng revenue would have on the CIty Mr. Knesel and Ms Hamson SaId that It
was very dIfficult to proVIde an estImate on what the Impact would be because they needed
mformatIOn from the State and County before they could analyze or deternune the Impact Mr
Knesel SaId that he dId not thInk that the changes In the law regardIng tax Increment finanCIng
revenues would have an Impact on the 2002 budget and that staff would be analYZing the data
over the next two months and would probably have some reasonable estImates by December, .
when the final budget and tax levy IS adopted

cahl>ration kits The meters will be used by officers to enforce pollution control
standards for sound levels emitted by vehicles and businesses I have received two
bids for the meters, one from Larson Davis Inc at $2340 00 each and the other from
Medical Technologies for $1230 00 each
The money would come out of capitol outlay for year 2001. We had a Varda alarm
approved and budgeted at $3500.00 We purchased a Varda alarm last f8ll with
forfeiture money The alarm was needed then because of thefts of city equipment
from the old prison site The money budgeted for the Varda alarm will be used to
purchase the sound monitoring meters
Recommend pmchase approval of two sound meters from Medical Technologies at
bid price of$2460 00, plus tax

Greenways Grant for Brown's Creek Nature Preserve Closing
Today I met with Bill Penning, DNR Greenways Program Administrator, and Ross Sublett, DNR
Metro Real Estate Coordinator (651-772-7987), and discussed the tasks necessary to close
purchase of the Greenway Property on Wednesday, September 19th (tentative).
They are sending us an option agreement to purchase an open space easement over the property
for $300,000. They would lIke the following items from us:
1. Single parcel legal description. This would include three parcels. Jim Peterson, Creekside
Crossing lot, Outlot "B" Settler's Glen and wetland area (see attached map) It IS important .
to the DNR that one property description include three parcels
2 Any tItle reports that the City has had prepared for three parcels They intend to update our
descriptions and reports.
3. Legal description of utility easements through the site for Settler's Glen water and sewer
lines
Bill Penning will prepare a property report as an exhibIt to the open space easement Dave could
you prepare numbers 1 and 2 and Klayton the utility easement I w1l1 coordinate the closing with
them.
A closing date has tentatively been set for September 19th, 2001, 10 a.m. at Dave's office. At the
closing, the City, Settler's Glen representative and the DNR will be present to sign documents
The sale price for US Homes property is $320,000. DNR is paYIng $300,000 for the open space
easement. The Peterson property has previously been purchased.

WHEREAS, thIs committee requests permISSIon to use the CIty parking lot at 3rd Street
and PIne Streets as the locatIon for thIs Memorial, and
WHEREAS, this committee has presented the desIgn of the MemOrIal to the Plannmg
CommIssIon and Histonc PreservatIon Committee and receIved approval for the vanance

WHEREAS, the concept has been submItted to the City Council for their reVIew

regulations. In additIon to bemg a middle school administrator and classroom teacher, I
direct traffic twice a day during our construction period. An "even/odd" regulatIon Will
help me to better control the traffic flow if drivers are aware of the parkIng regulation. It
will be much easier for SCCS staff members and parents to work with an "even/odd"
regulation than the vague snow emergency regulation currently m place.

Street to Laurel Street odd/even parking in any season It is extremely narrow, and
requires no parkIng on one side of the street It stIli can be very harrowing at times
when meeting another velncle LInden Health Care has numerous employees on each 8-
hour shift, plus viSItors At shift changes, there are double the number ofvelncles in the
area The parking lot at LInden Health Care IS unable to provide adequate parking
What kInd of signage would you use for the two seasons on that section of North
Third Street? One possIbtlity is usmg a different set of signs for each season In any
event, new rules are gOIng to make things more confusmg for those few blocks

comply w1th, and easy to enforce. Because the streets 1n my ne1ghborhood are
narrow, 1t 1S absolutely v1tal that veh1cles are not parked on both sldes of

Liberty has built their streets narrower than normal to slow traffie and to make It pedestnan fnendly,

day or mgbt, no car, let alone an emmgency veluc1e, will be able to get through. From 7pm to
nndmgbt, the roads will be blocked for residents and for emergency velueles, guaranteed. The roads
are currently wide enough to allow cars to park on only ONE Side at a time I know tins because I'm
loolang out my wmdow and I see a car parked m front rL my house and there is no way two cars can
park on either S1de and for a thud car to pass through. L1V1ng on the square, I can state that we get a
LOr d. people parkmg at the playground and on the walkmg path area, people who do not bYe here

streets at all tunes of the day and I as a homeowner will be trapped and won't be able to get out eX
Liberty It would also pose a huge safety hazard for emmgency vehicles I also do not want to take It

that you have a lot d. staff that will then have to be patrollmg our netghborhood to give tickets, even If

out all over Liberty because of our narrow streets

reference. Minn. Stat. ~~ 84.81-84.88 are adopted
as the snowmobile regulation ordinance of the
city.
Subd. 2 Add1.twnal requLrements. In addition
to the restrictions and regulations contained 10
the state statutes, the following provisions apply
within the city:
(1) Place of operatIOn. It shall be unlawful to
operate a snowmobile in any of the foIIow-
109 places and condItions:
a. Upon private property without writ-
ten pennission of the owner or per-
son in lawful possession.
b. Upon any school ground, skating
nnks, park property, playgrounds,
recreation area or golf course unless
pennitted by the owner.
c. Upon any street or alley except in
the righthand traffic lane of that
portion ordinarily used for vehicular
traffic.
d. Upon any public sidewalk or walk-
way
e Upon lakes and rivers in the city
within 25 yards of any fisherman or
pedestrian.
f. In any other area where the use of a
snowmobile may be considered to be
hazardous to others.
(2) Youthful operators. A person 14 years of
age or older, but less than 18 years of age,
may operate a snowmobile upon a public
street or highway withm the city limits If
he has in his immediate possession a
valid snowmobile safety certificate issued
by the department of natural resources
commissioner or a valid motor vehicle
operator's license issued by the commis-
SIoner of public safety or the driver's li-
cense authority of another state.
(3) Hours of operation. Except as is specifi-
cally authorized by Minn. Stat. ~~ 84.81-
84.88, no persons shall operate a snowmo-
bile within the city limits, upon private or
public property, between 11:00 p.m. and
7.00 a m. on Sunday through Thursday
and between midnight and 7:00 a.m. on
Fnday and Saturday except in the foIIow-

a. In the case of emergency when and
where snow on a roadway renders
travel by automobile impractical.
b In the case of emergency when re-
quested by an officer of the city p0-
lice department or fire department.
(4) Manner of operation. No snowmobile may
travel at a speed greater than 20 mph
when traveling on city streets. Snowmo-
bIles must yield the right-of-way to all
other traffic which is approaching uncon-
trolled intersections. SnowmobIles must
be operated in single file, except when

The purpose of this letter is to invite you to the 7 p.m, September 18, 2001 CouncIl Meeting. At
thIs meetIng next Tuesday, the City CouncIl will be considering changes in the winter parking
regulatIons which wIll have an effect on your parking optIons. The CIty CouncIl will be
deCIdIng If the CIty'S snow emergency route deSIgnatIons should be eliminated
CIty staff has recommended that all snow emergency route deSIgnatIons be elIminated. Instead,
It'S recommended these streets be under the calendar parkIng regulation. Calendar parking refers
to the odd/even parking requirements. If snow emergency route designation is eliminated all
those people living on old snow emergency routes would be reqUIred to park on the odd SIde of
the street on odd days and the even SIde of the street on even days Note that between 7 p.m. and
nudnight of each day is a switch over tIme when vehicles can be parked on both sides.

This proposed change has come about for a number of reasons. FIrSt, the CIty does not announce
snow emergencies nor do we announce the end of these snow emergencies This can result in
confusion as to when snow emergency regulatIons apply to the snow emergency routes. This
confusion has caused difficulties for proper plowing operations, dIfficulty removing and hauling
out snow, and made it dIfficult to enforce and regulate a confusmg ordinance.
The vast majority of the CIty is already under an odd/even parking regulation. This proposed
change would make it less confusing and improve the City's efficiency in removmg snow. If
you have questions or comments concerning this issue, you can address them to me and I wIll
present them to the City Council or you're welcome to attend the 7 p.m meeting next Tuesday,
September 18, 2001.

The purpose of thIs letter IS to mform you of a Council meetmg scheduled for 7 p m Tuesday,
September 18, 2001 that mcludes a diSCUSSIon of a change in parking regulatIons for your
neIghborhood. The CIty CouncIl wIll be consIdenng a modIficatIon that would enact an
odd/even parkIng regulation throughout the course of a calendar year. ThIs would result in
parking on the odd number SIde of the street during odd days and the even SIde of the street
dunng even numbered days with parking allowed on both SIdes of the street from 7 p.m. to
nudmght.
The current CIty ordinance puts odd/even parking controls into effect from November 1 through
Apnl 1 Therefore, the only proposed change would be to put thIs mto effect throughout the
entIre year. ThIs change would also result m the removal a number of no parking SIgnS that are
currently m place in the neIghborhood. ThIS proposed change has been brought forth due to
concerns from the Fire Department regardIng access to the neIghborhood. As you are certainly
aware the streets in the LIberty/Legends neIghborhoods have been constructed to a narrower
sectIon than is typICal. ThIs narrow street deSIgn has been put mto place to slow down traffic
and generally make neighborhoods frIendly to pedestrIans When this change was made,_we dId
antIcipate the pOSSIbIlIty of potentIal special parking control regulatIons. Based on the _
expenence of the past three years and the concern raised by the FIre ChIef, staff is proposmg this
change

AND TOWN OF STILLWATER AS TO ORDERLY ANNEXATION
DATED AUGUST 16,1996.
WHEREAS, the City of StIllwater, MInnesota, ("CIty"), has petItIoned that land owned by It, In the
Southeast quarter (SE Y-.) of the Southwest quarter (SW Y-.) of SectIon 19, and the Northeast quarter (NE
Y-.) of the Northwest quarter (NW Y-.) of SectIon 30, TownshIp 30 north, Range 20 west, In the Town of
StIllwater ("Town"), (collectIvely, the "Land") descnbed on ExlubIt "A", as depIcted on the map
attached hereto as ExlubIt "B", be annexed to the City pursuant to the provIsions of the Joint Resolutions
as to Orderly Annexation of the CIty and Town of StIllwater, dated August 16, 1996; and
WHEREAS, the Land is mcluded WIthIn Phase IV of the area designated for orderly annexatIon; and
WHEREAS, the Land, contains 687 acres, more or less, and IS contIguous to the City. The Land IS
UnImproved and IS dedIcated and used for publIc park and open space purposes The Land IS not
proposed for further development for reSIdentIal use MuniCIpal servIces such as water, sanItary sewer
and storm sewer are avaIlable to the Land; and
WHEREAS, SectIon 4 01 of the Orderly Annexation Agreement provIdes that "Phase IV" land and may
be annexed to the CIty pursuant to SectIon 4.09 of the Agreement proVIded that the annexatIon wIll not
create a level of growth that will not exceed a one hundred twenty (120) dwellIng umt per year

City of Stillwater
Request for Proposal for Sale and Development of Old Territorial Prison Site
The City of Stillwater is interested in receiving letters of interest for purchase and development of the .
Old Territonal Prison Site. The site contains 10.33 acres of which approximately 5.5 acres is
developable. The site is located on Main Street, 1H 95, at the north entrance to Downtown.
Site Conditions and Improvements. The 10.33 acre site has 470 feet offrontage on Main Street. A
large limestone wall separates the developable portion of the site, 5.5 acres, from the remaining open
space area. A City interpretive trail is proposed around the perimeter of the historic wall.
Project Review Process. The City Council will make all final decisions on use of the site and sale of
the property. The City's Historic Preservation Commission and Planning Commission will review the
project design and proposed use.
Land Cost. 1996 purchase price $875,000
City Assistance. If a proposal relies on City assistance, other than land sale, a complete description of
the nature and amount of assistance should be submitted with the request.
Review Criteria. The following review criteria will be used to select a prospective developer(s) for sale
of the site:
· Reuse of existing historic building (Department of Interior Standards).
· Proposed use is complementary to and supportive of Downtown business.
· The projects economic benefit to the City, both property tax paid and site sale price.
· Requested City assistance.
· Developer(s) experience with similar sized and type of project.
· Developer(s) financial capacity to fund project.
· AbilIty to complete project in a timely manner.

Downtown Parks Improvements and Open Space Task Force Update
At your meetIng of August 21,2001, CIty staffwas directed to asSISt the CouncIl in establIshIng
a task force to IdentIfy Downtown Park Improvement needs and examine VarIOUS methods of
Improvement Implementation. It IS suggested that the scope of the task force be expanded to
mclude open space proJects particularly those m the expanSIon area.
Based on CouncIl dIrectIon and staff mput, the followmg task force members are suggested for
CouncIl approval. The CommIttee would have broad representatIon With members from
downtown and community business owners, city reSIdents and CIty commIttees and COmmISSIOns

DISCUSSION:
In order for the aboye projects to be certified to the County this year, the assessment
rolls need to be prepared and hearings need to be help. Two of the projects, Wildp~es.
Sewer Extension Project and the County Road 15 Watermain Project haye an agreement
of assessments and waiver of irregulanty and appeal signed by the owners for the, so
no hearing will be needed. The hearing for the 2001 Sidewalk Project is scheduled for
October 16, 2001.
. RECOMMENDATION:
It is recommended that Council authorize the preparation of the assessment rolls and
call for the hearing for the 2001 Sidewalk Project to be held on October 16, 2001 at
7:00 p.m. - -
ACTION REOUlRED:
If Council concurs with the recommendation, Council should pass a motion adopting
the following resolutions:

WHEREAS, a contract has been let and costs have been determined for the construction of
sanitary sewer service on Wild pines Lane and the contract (bid) price for such improyement is
$35,123.28 and the expenses incurred or to be incurred in the making of such improyement
amount to $3,925.86 so that the total cost of the improyement will be $39,049.14
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER,
MINNESOTA:
1. The total cost of the proJect is to be assessed against benefited property owner, Wud Pines
Co. LLC.
2 Assessments shall be payable in equal annual installments extending over a period of five
(5) years, the fIrst of the installments to be payable on or before the fIrst Monday in
January, 2002, and shall bear interest at the rate of seven percent per ;mnum from the date
of the adoption of the assessment resolutions
3. The city engineer shall forthwith calculate the proper amount to be specially assessed for

WHEREAS, a contract has been let and costs have been determined for the installation of the
watermain along Manning Avenue north from County Road 12 to Boutwell Road to the US
Home site, and the contract (bid) price for such improvement is $300,912.22 and the expenses
incurred or to be incurred in the making of such improvement amount to $43,161.96 so that
the total cost of the improvement will be $344,074.18.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER,
MINNESOTA:
1. The portion of the cost of such improyement to be paid by the city is hereby declared to be
$ 109,877.96 and the portion of the cost to be assessed to US Homes is hereby declared to
be $234,196.22
2. Assessments shall be payable in equal annual installments extending over a period of three
(3) years, the first of the installments to be payable on or before the fIrSt Monday in
January, 2002, and shall bear interest at the rate of seven percent per annum from the date
of the adoption of the assessment resolutions
3. The city engineer shall forthwith calculate the proper amount to be specially assessed for
such improvement against US Homes, without regard to cash valuation, as provided by

expenses incurred or to be incurred in the making of such improyement amount to $ 19,198.52
so that the total cost of the improyement will be $94,198.52
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER,
MINNESOTA:
1. The portion of the cost of such improyement to be paid by the city is hereby declared to be
$ 47,099.26 and the portion of the cost to be assessed against benefited property owners is
declared to be $47,099.26.
2 Assessments shall be payable in equal annual installments extending over a period of ten
(10) years, the first of the installments to be payable on or before the first Monday in

WHEREAS, by a resolution passed by the Council on September 18, 2001, the city clerk was directed to
prepare a proposed assessment of the cost for the 2001 SIdewalk Rehabilitation. The following is the area
proposed to be assessed.

published once in the official newspaper at least two weeks prIor to the hearing, and shall state in the
notice the total cost of the improvement. The clerk shall also cause maIled notice to be giyen to the
owner of each parcel described in the assessment roll not less than two weeks prior to the hearings.
3. The owner of any property so assessed may, at any tIme prior to certification of the assessment to the
county audItor, pay the whole of the assessment on such property, With mterest accrued to the date of
payment, to the CIty Treasurer, except that no interest shall be charged if the entire assessment is paid
withIn 30 days from the adoption of the assessment. He/she may at any time thereafter, pay to the City
Treasurer; (m whole or in part) the remainIng pnncIpal balance, with interest accrued to December 31 of
the year m whIch such payment is made. Such payment must be made before November 15 or interest

Request for 15 UnIts of Scattered Site LowIModerate Income HOUSIng Umts
The attached letter was sent to the WashIngton County lIRA to obtain 15 units oflow/moderate
income scattered site housing. The unIts are aVailable from the Department of Housing and
Urban Development HOD through the MInneapolis Housing authority. A portIon, 70 percent, of
the unIts would be OCCUpIed by reSIdents from MInneapolIs and 30 percent from WashIngton
County (attached IS a hst of communItIes partIcipatIng m the program).
The units would help the CIty With its lIvable communitIes affordable housing goals.

The WashIngton County Board has asked for CouncIl approval of the request.
Recommendation: Motion approving the request.

The City of Stillwater, like most metropolitan communities, has experienced an ext.reIne .
shortage of affordable housing, Reccntly~ the Washington County Housing and
Redevelopment Authority acquired a number of scattered site sinale-family units to be
used as low-income rental housing in Washington County. Of the 60 units allocated to
Washington County only 5 were scheduled for acquisition in the City ofStillwatcr. Those
5 UDits have now been withdrawn.
It has come to my attention that there is a possibility of more units bcU1g available for
acquisition within Washington County if the WasllillgtOD County HRA or the
Metropolitan Council would agree to admh'.;9ter aud own the housina. The City of
Stillwater would like to see the 5 UD1lS originally planned replaced and an additional! 0
units acquiml.
J would requcst and urge that the Washington County lIRA or Metropolitan Council
quickly agree to hold and administer these low.income housiDg units as soon as possible.

difficult time

We were told by Mayor Kimble more than five years ago that the lights were approved
by the City CounCil, but we are stili waiting for action I understand that the City prefers
to tackle larger projects and does not want to contract for two lights at a time
However, we have been patient for a very long time and request that thiS lighting

The matter of the latest study on the WashIngton Cy Sheriffs Tower IS tentatively
scheduled for your next CIty CouncIl Meeting Qwest WIreless, LLC (Qwest) would lIke to
propose a collocatIon of a Personal Commumcations System (PCS) antenna on the WashIngton
Cy Shenffs tower located Within the Willard Street Water Tower Compound. We have been
tryIng to locate an antenna to proVIde coverage to that area of StIllwater SInce February of 2000.
After testIng several sites in StIllwater, it has been determmed that the Shenffs tower site Will
provide the best coverage for our system.

WhIle the water tower Itself IS a preferred location under the zomng code, it is the policy
of the water department not to allow antenna placement on the tower. CollocatIon on existmg
towers is also preferred under the ZOnIng code and after 3 separate sets of studIes, It has been
determined that space on the Shenffs tower is aVailable By locatIng on the Shenffs tower,
Qwest would be able to proVIde servIce to the area without havmg to erect a new tower thus
minImIZIng any adverse visual effects caused by placmg a tower m the area. However, we
cannot apply for a permIt to locate on the Shenff s tower since we do not at this tIme have the
permISSIon of the landlord (z e. the CIty of StIllwater) to locate at the SIte. Therefore, we are
formally requestmg permIssion from the CIty to apply for a permit to locate our antenna on the
Shenff s tower and our ground eqUIpment Within the water tower compound
I wJll be at your CIty CouncIl Meeting to answer any questIons you may have regarding
our proposal. In the meantIme, if you have any questions, please feel free to contact me.

The Board met WIth Bruce Bmger to develop a list of persons to be mVIted to be
mvolved m a strategic IntervIewee IdentIficatIon Task Force meetmg. The purpose of
the Task Force is to IdentIfy specIfic indIVIduals/organIZatIons to be mtervIewed for
the feasibilIty study.

problems / Issues m preparatIon for a meetmg With the CIty CounCIl
7. 2002 Personnel Budget Request - Fmal Mer explanatIon and discussion of
changes m the general Insurance category and cost of liVIng mdex expenses, there
was a motion by Huelsmann WIth a second by Myers to approve the 2002 Budget
request. The motIon passed.
8. 2002 Budget Heanng DIrector Bertalmio asked WhICh board members
would be able to attend the Budget Hearing set for August 21, 2001 at 4:30 p.m.

tounst area then we should treat It as such and create an enVIronment that leaves our
guests WIth a pOSItIve ImpreSSIon, one that encourages repeat VISItS
LIke It or not, good or bad, downtown StIllwater does not have the small town feel that It '
once had Gone are the days of tradItional busmess's such as clothmg stores, bakenes,
shoe stores etc It is now time, I belIeve, to face realIty and realIze and treat downtown
Stillwater for what It IS A great tounst to'Yll that prOVIdes much needed JObs and tax
