MEMORANDUM TO Mayor and CouncIl FR City AdmmIstrator RE Ted Thompson - update on status of new nver crossmg DA September 7, 2001 Ted Thompson WIll be at the meetmg Tuesday to update the CouncIl on the status of the new nver crossmg InCIdentally the CouncIl should also dISCUSS the status ofMr Thompson's consultmg contract Mr. Thompson's ongmal contract had an expIratIon date of May 30, 2001 The contract was extended for a 90-day penod whIch ended August 31, 2001 Therefore, Mr. Thompson's contract wIll need to be extended If the CouncIl wants him to contInue the consultmg work (of course a new agreement WIth a new set of condItions could also be consIdered RecommendatIon CouncIl consIder status oflegislattve consultIng work ofMr Ted Thompson - /)(~ tcgrlf RESOLUTION 2001-110 APPROVING EXTENDING AGREEMENT WITH DEMAY & ASSOCIATES, INC. MEMORANDUM TO Mayor and CouncIl FR CIty AdminIstrator RE 2002 proposed budget and tax levy DA September 7,2001 DISCUSSIOn I am resubmIttmg the resoluttons adoptmg the 2002 proposed budget ($11,544,885) and "reVIsed" tax levy The proposed budget has not changed smce the last meetmg. However, the tax levy has mcreased to $6,334,881 The mcrease IS necessary to help pay the debt servIce on the RecreatIon Center Bonds The mcreased amount IS related to the TIF revenues that the CIty was gomg to use to help pay for the debt servIce on the RecreatIon Center However, due to the changes made by the LegIslature during the 2001 seSSIon, It appears that there WIll not be adequate TIF revenues to pay the debt servIce As I reported at the preVIOUS meetmg, the budget numbers are hIgher than that whtch WIll be finally adopted m December and, as you know, the budget (and tax levy) can be decreased but not mcreased Therefore, the budget, Includmg CapItal Outlay, can be adJusted accordingly to come up WIth an appropnate budget The tax levy could also be decreased as well, If the revenue/expendIture pIcture changes by December In regards to the factors used In calculatIng the CIty'S overall 2002 levy lImItatIon, the League of MInnesota CItIes staff have stated that there IS not an appeals process or remedy available for CItIes ill our positIon (i e , haVIng household numbers adjusted downward) On the other hand, the omnibus tax bIll (see attached Sec 7 27571 Levy LImIts) that was passed thts past session states, m part, "one plus a percentage equal to the annual percentage increase In the estImated households. If anv. for the most recent 12-month penod that was avaIlable on Julv 1. 2000" However, the bIll does not speCIfically state whose estimates are to be used (i.e , what is the authonzed source of the estimates - the Met CouncIl, the State Demographer, the local government, etc. ?) So there IS a question on what household numbers should or could be used. At thIS wnting, CIty Attorney Magnuson was stIll In the process of determining how these estImates can be determIned (as opposed to how they were determmed by the Department of Revenue, whIch we understand to be based on Met CouncIl estimates) In other words, does the CIty have some input or dIscretIon m the determming what numbers should be used or can the CIty petItIon the Department of Revenue to have the numbers changed based on actual or more accurate data? Note that lme 13 mcludes the numbers that are m dIspute For your further mformatIOn, I am attachmg two "Truth In TaxatIOn" notIces that the County prepared. Also, Planner Meg McMonigal, Attorney Tom Scott, Treasurer Warren Erickson, Peace Officer Steve Nelson, Rolf Dittmann and Maury Stenerson. 1. AGENDA - M/S/P Johnson/Doriott moved to adopt the agenda as amended. (5 ayes) 2. MINUTES - M/S/P Untiedt/Laabs moved to approve the 8/9/01 Stillwater town board meeting minutes as written. (5 ayes) 3. TOWN HALL - Rolf Dittmann and Maury Stenerson were present to talk about handicap parking ramps, sidewalks and stairs. At the next meetlng Rolf and Maury will suggest fixtures for the building. Also a tlme to discuss storage issues wlll be set. 4 . TREASURER - 1. July report discussed. 2. Checks #15365 thru #15390 were approved for payment. 3. A meeting was set up for August 27, 2001 at 7:00 p.m. to discuss budget issues and a possible levy adJustment. 4. The Raleigh road contract will be discussed at the 9/13/01 meeting. Mike Raleigh is to be present. . 5. PEACE OFFICER - 1. M/S/p Laabs/Johnson moved to purchase a Motorola HTIOOO Portable Radio for $841.38 plus a 2 year warranty ($38.00), Rapid Rate Charger ($55.00) and a Remote Speaker Microphone ($87.25) for the peace officer's use.
