Mr Johnson stated the responsIbihty before the Board was to go through a pubhc reVIew
process for the zomng text and map amendments This has taken place on two occasIOns
first, ajomt pubhc hearing With the Joint Board and Planmng CommiSSIon on February
26 1998, and second, a pubhc hearmg at the Jomt Board meetIng of February 28. That
meeting was recessed untIl the pubhc hearing and actIon of the Stillwater City CouncIl
meetIng of February 3, 1998 (Immediately precedmg thIs meetmg).

was strongly supported.

partlcIpate in the DNR Natural and Scemc Areas Grants Program and any other fundmg
sources that may be aVaIlable for the purchase of any or all of the lands of the oak

Accompanying thIS memo is the lease extension agreement that the CIty Attorney has prepared.
CouncIl previously approved extendmg the lease thru December 31, 1998 to allow the AIples to
construct two boats The CIty, In turn, would have the right to occupy the remmnmg lease
property prior to the expIration of the lease The attached map shows the approXImate location of
the area
Also accompanymg thIs memo is a memo from the CIty Attorney regardmg a survey of the
Alple lease area I think It would be beneficial to obtam a lease of the property for future
reference and use. I would recommend that Barry Stack be commIssioned to conduct the survey
at an estimated cost of $2000

I've talked to Barry Stack and, at the present tIme, he IS domg some survey work on the north
end of the AIple property for Andersen He tells me that if he were able to survey the Alple
property at the present time, m conjunction with the work that he's now domg, he could save
substantial funds He estlmates the cost of thIs survey, at the present tIme, would be about
$2,00000 In my VIew, It IS Important that this be done smce once all of the land the CIty owns
In the downtown is surveyed, we wIll be able to register the tltle to It and for hIstoncal purposes
know exactly what we have and where it IS Call If you have any thoughts about thIs.

I enclose the ExtenSIon Agreement that now has a hmIted extension for the south 1200 feet of the
property and allows the City entry mto the remmmng property ImmedIately except that the CIty

ADDENDUM AND LIMITED EXTENSION AGREEMENT
TillS AGREEMENT IS made this _ day of January, 1998, between the City of .
St1l1water, Washmgton County, Mmnesota, a MumCIpal CorporatIon, ("City") and Stillwater St
CrOIX Barge Termmal Co , a Mmnesota Corporation, AIple Towing Company and Elaine J
Aiple, (" Alple")
1 The CIty and Alple are parties to a Lease (the "Lease") made on the 2200 day of
September, 1958, With regard to property adjacent to the St CrOIX River commonly known as the
Barge Termmal property descnbed With more partIculanty In ExhibIt "A" ("Leased Property")
2 The Lease Will be termmated according to its terms at the expIratIon of forty (40)
years, which Will occur on the 2200 of September, 1998, and at that tlme Alple Will have no nght,
tItle or mterest m the Leased Property.
3 Alple has requested that the CIty grant a limIted extensIon to the Lease for only a part
of the Leased Property, more partIcularly descnbed m Exhibit "B" ("the ExtenSIon Property").
4 The purpose of this hmited extensIon would be to allow Alple to finIsh work that is In
process in order that Alple be allowed to vacate the ExtenSIon Property without damage or waste
and With mImmum disruption of the present busmess cycle This limited extension With regard
to the ExtenSIon Property Will not operate to extend the Lease on the remaInder of the Leased
Property whIch will be terminated m all ways on September 22, 1998.
5 In return for the hmIted extensIon With regard to the ExtensIon Property, Alple agrees
to allow the City immediate posseSSIon of the remainder of the Leased Property subject to the
hmItatIon that the CIty'S use and possession of the property may not mterfere With or Impede the
llWIndmg up" actiVIties of Aiple remainmg to be done on the Lease Property

6. That the CIty hereby grants to Alple an extenSIon of the Lease untIl the 31st day of
December, 1998, With regard to the ExtenSIon Property described m Exhibit "B", and the terms
of the ExtenSIon Will be the terms of the ongmal Lease
7 That this LimIted ExtenSIon Will not serve to bmd the CIty to any further extenSIOns or
to create any nghts of any kind, vested or otherwIse, in the ExtenSIon Property or the remainder
of the Leased Property
8 Any lease nghts in the remaInder of the Leased Property will terminate accordmg to

The CIty and LakevIew have completed negotiations for the sale of the CIty'S mdustnal park
property to the hOSpItal and the Purchase Agreement has been sent to the hospital for their review
and signature One of the terms of the Purchase Agreement, however, IS that the CIty finalize the
ponding drainage and maintenance agreement that is constructed partially on the CIty'S property,
partially on the hOSpItal'S property and partially on the Spme Chmc's property The engineers
for the Spme Climc made some calculatIons of the square footage of each lot Within the dramage
area but, a survey has never been done to locate, not only the drainage easements on each of the
contrIbuting parcels but also, the descriptions for the cross easements for the pond Itself The
hOSpItal'S attorneys have asked that this be finalized before closmg and I think it IS a reasonable
request
I would ask that the CouncIl authorize a survey to be prepared by Barry Stack who completed the
CIty'S boundary survey m 1996 ThIS would be the cheapest and most expedItIOUS way to get the
agreement finalIzed

Dear Stillwater City Council,
On Tuesday July 15, 1997, my brother John and I came before you to
request that you appoint us, as well as four others (Charlie Hooley,
Sharon Mailman, Bob Utecht, and Gene "Taco. Bealka), to head up the
150th (sesquicentennial) celebration of the Minnesota Territorial
Convention. The date of the celebration is Wednesday, August 26, 1998.
At that point we requested $5,000 from the city toward that celebration.
Since that time, John and I were able to do some things toward the
celebration, e.g., get a special pictorial postmark, book Pioneer and
Lowell Parks for two days of events if desired (Wednesday and
Saturday), and send out 100 letters to area businesses. According to
Diane Deblon, Finance Director, we have gotten back $2700 in donations
as of January 26, 1998.
In late Fall I received a large unexpected federal grant, which requires
traveling every month, In addition to my full-time work. Realizing that I
could no longer give the necessary energy needed for this tribute to
Stillwater, and noticing the limited Input of ideas and follow-through on
these ideas I had had from the other appointed members, I realized that
the leadership of the event needed to be turned over to a group that not
only had the time, but had the desire and talent within the group to give
Stillwater the celebration it deserves.
In early January, I met with Taco Bealka who suggested the City of
Stillwater Chamber of Commerce take over the leadership of the event.
Charlie Hooley was in Florida at that time, and Sharon Mailman .could
not be reached. However, John, Bob, and I agreed with this choice
because we felt the organization had put on successful events of this
magnitude In the past. We also felt that they not only knew how to
generate Ideas, they had the expertise to implement them. Because of
our limited manpower and time, we never were able to get the input of
other groups such as the Washington County Historical Society, a group
we certainly had planned to contact had we continued. The City of
Stillwater Chamber of Commerce will work with this group as well as
other groups and individuals.
Bob, John, and I attended the City of Stillwater Chamber of Commerce on
Wednesday, January 28, 1998, to see if they might be interested in
taking over the leadership of this event. They were very honored to be
asked and a motion to accept the leadership passed unanimously. Bob
Utecht, Taco Bealka and I have openly expressed our willingness to this
organization to continue to be involved to some degree. For example,

Bob and I will continue our original plans to produce a series of videos
featuring footage of historic Stillwater and Interviews with historians and
former and current Stillwater residents who took part in the 1948
centennial celebration. I will also be promoting Stillwater's special .
postmark as the day draws closer.
Since you originally appointed us in charge, I am requesting that you
transfer the leadership of this celebration to the City of Stillwater
Chamber of Commerce. I am also asking that the City of Stillwater
Chamber of Commerce be able to use all funds donated to the City of
Stillwater toward this event. I also request that the City of Stillwater fund
this celebration with $5,000, as we had requested last summer. Please

than usual, much controversy, and It IS hIghly doubtful IS the SessIon WIll be shorter
The deadlines, however, are set up for a short seSSIon, whIch makes meetIng all the
deadlines very diffIcult
Stillwater LeveelFlood Control Pro,iect:
We're In good shape, so far, on the flood control project I worked from last Summer
with the DNR, and we were able to get Into the Governor's Budget Request for
$750,000
Today, we had our hearIng before the Senate Energy and Agnculture Budget
CommIttee, and the appropnatlon for the Stillwater Project was accepted by the
CommIttee It now must go before the full policy Commrttee, but there IS much less
scrutIny there I antIcIpate no problems In the full CommIttee or floor actIon
In the House, the bIll was passed by the FInance CommIttee The problem WIll be
getting Into the House Bonding BIll The House has a CapItal Budget Committee whIch
pulls together all the House FInance CommIttee BIlls They frequently omIt Items that
are In the Governor's Budget or In the Senate for the purpose of haVIng negotIating

The Repair of the Territorial Prison Wall:.
We have bIlls Introduced In both the House and the Senate that requests $2 million for
the repair of the Terrltonal Pnson Wall It IS not Included In the Governor's Budget, but
could have been If we had started last August rather than December This WIll make It a
tough sell thIS year Heanngs have been requested In both the House and the Senate,
and the bIll must be through at least one commIttee by Fnday the Thirteenth It IS still to
early to make any predictions on the results

Full State funding for the Armory Project was a long shot at best This IS a program In .
which the Federal Government has always picked up 75% of the costs For the State to
set a precedent In this area of funding would commit them to the funding a number of
other armory projects that have been requested
The Governor turned down the request from the Department of MIlitary Affairs to Include
the armory In hiS budget While the Department would not oppose the armory now, as
an agency of the Governor, they can not actively support It It would have been a
difficult task to get It through the Legislature, even In the Governofs budget Without
that support, It would be a waste of time when we have other pnontles In this Legislative
Session
Our best opportUnity IS now With Congress as a demonstration program I'll be following
up on that approach after we get through the craziness at the State Legislature.
The Perro Creek Proiect:
I am working With the Middle St CroIx River Watershed Management Organization
(MSCWMO) of which the City of Stillwater IS a member, regarding the problems
associated With the pnson pond, the storm sewer, and the flooding which has occurred
In that area It's a $2 4 Job to replace the eXisting sewer system that was constructed In
1907 Since the Cities of Bayport, Oak Park Heights, and Stillwater all contnbute to the
watershed area, the costs of repair will fall on the consortium If we are unable to get
State dollars thiS year
I am also working With MNDOT and the Department of Corrections to get their support
We have had one hearing in the House, and will likely have the Senate hearing on

Background:
In 1907 the MInnesota State Prison (MCF) constructed a reservoir and dam along the present day
alignment of County Road 21. That system also includes a outlet pipe that supplies the prison with
water. In the last 20 to 30 years this source of water has been used to cool boilers. In recent history
the MCF has eliminated the need for this source of water. The City of Bayport has been
compensating the MCF to continue pumping water entering the Prison Pond during the winter
months to eliminate a build up of ice in the downstream channel. Ice build up in the channel has
during certain years impacted traffic on TH 95.
In 1972 the City of Bayport experienced significant flooding along PelTO Creek downstream of the
Prison Pond. An injunction was ordered against the City which restricts diversion of runoff into
Perro Creek.
In 1987 the MCF contacted the City of Bayport with concern that they may no longer be able to
maintain and repair the old outlet system. Since then the MCF system bas failed which put the .
City of Bayport in a real predicament.
In 1993 the Middle St. Croix River Watershed Management Organization (MSCWMO) contracted
with SEH to develop a smdy of the 1700 acres tributary to the Prison Pond and Perro Creek. In
that study SEH confinned that atleast 9 areas along PelTO Creek will experience flooding during a
100 year event in the watershed under existing conditions. SEH made recommendations for
improvements at the outlet which were constructed in 1995. The new outlet structure does provide
some flexibility for discharge into Perro Creek. With this structure MDNR can simulate a drought
on the pond to get emergent vegetation growth. The MDNR participated in this study through a
Flood Hazard Mitigation Grant in the amount of . ,.
In November of 1994 the City shutdown the old outlet (new outlet constructed in 1995) to
eliminate the downstream Icing condition. However, the water in the Prison Pond continued to
rise. Under emergency conditions the City and Washington County constructed a 3 to 4 foot high
earthen embankment about 500 feet long to contain seepage and runoff that had been used by the
MCF since 1907. Since then the City has been setting up temporary pumps WIthin the MCF and
discharging mto the MCF's downstream stonn sewer. Tins effort has been taxing on the City staff
and finances
In 1996 the MSCWMO selected SEH to mvestigate construction of a North Prison Pond Outlet.

water from the Prison Pond to the St. Croix River without the icing conditions along the way. This
outlet may also provide additional discharge capactiy from the Prison Pond during extreme runoff
events. One of the keys to getting the water to the river without icing conditions is to keep it
underground. Since the MCF operates a storm sewer from the north side the prison to the river the
SEH included this in their investigations. This alternative looked good from the stand point that
the MCF typically would need the capactty during runoff events during the non-winter months.
The MSCWMO just wanted the pipe capacity dumg the winter months. SEH is also under
contract with Washington County to design modifictions to County Road 28 along the proposed
outlet route in conjunction with the Stillwarer Bridge Crossing.
SEH's initial focus centered on the MCF storm sewer. Invert elevations along with data from the
County's highway project were used to develop profiles of the existing sewer alignment. A video
inspection of the existing 24 inch clay stonn sewer provided a significant statement about its
condition. Portions of segments 2, 3, 4A and 4B are cracked and leaking water and sediments into
the pipe. Once we shared our infonnation about the pipes condition with MnDOT they
programmed replacement of the pipe across the highway as soon as either m 95 or the Prison
Pond outlet is COnstlUcted. Local representatives from the MCF indicated they could probably not
assist in reconstruction of the stonn sewer even though they are interested in its condition and
operation. SEH made an approximate evaluation of the capacity of the storm sewer for
comparisoin with the discharge capacity that might be required for the prison grounds. The pipe
capacity is inadequate by our approximate calculations. At this point the MSCWMO directed SEH
to look at other alternatives.
After various discussions with the MSCWMO three additional outlet alternatives were reviewed
from a macro perspective. The perfered outlet alignment is provided on the attached Drawing A.
The City of Bayport with assistance from SEll has developed a project budget for a detailed study,
development of plans and specifications and consuuction of the outlet based on the perfered
alignment. The estimated budget for the North Prison Pond Outlet project is $2,400,000. A
brakedown of budget is provided on the following page.

Request for State Matching Funds: The City of Stillwater requests $750,000 In State
Bonding funds In 1998 to provide half of the non-Federal matching funds required for
the completion of Stage II, and the third and final stage of the Stillwater levee and flood
control project The total cost of Stage II completion, and Stage III IS $6 million.
The City will provide the other half of the non-Federal matching funds ($750,000) funds
to generate the 25%, or $1 5 million, reqUired by Federal statute The expenditure of
the State funds for the project Will be contingent on Congressional approval of Phase III
Federal funding The U S Congress has authonzed a total of $11 6 million In the Water
Resources Development Act of 1996 for the project
Stage III Provides Up to 100 Year Protection: Stage III consists of the construction of
a flood wall to be located approximately 125 feet Inland from the newly reconstructed
levee wall which protects the fragile river bank from deterioration The nse In the
elevation from the nver to the flood wall and the flood wall construction which extends 2
1/2 above the ground level Will provide a fifty year flood protection for the City The
flood wall provides a 100 year protection with additional sandbagging.
Dunng recent floods In 1997 and 1993, and earlier floods, sandbagging was Ineffective
due to seepage through the porous SOIl. The flood wall Will extend 15-20 feet below the
surface to prevent such seepage dUring future flood events The flood wall Will prevent
the seepage through the porous SOil, the remnants of the logging industry and lumber
mills that dotted the nverfront more than a century ago The ai-wall- Will also permit the
effective use of sandbagging to provide 100-year flood protection for the State's first
City, which Includes 63 structures that are listed on the National Register of Hlstonc
Sites

Stage II Designed to Eliminate Annual Flooding: Stage II of the project extends the
eXisting levee wall system on the St CroIx River approximately 1,000 feet north of the
eXisting levee wall It Includes raising the height of the riverfront and the emergency
service road that runs parallel to the levee wall system by about SIX feet, and the
construction of a two-tier levee wall system Similar to the eXisting levee walls that were
constructed by the WPA In 1937
ThiS IS thiS area where flooding first occurs In a flood event Work was begun on Stage
II In 1997, and was originally scheduled for completion In the Fall of 1997 The flooding
and the construction slow down due to extended high water In the Summer of 1997, has
delayed the completion of Stage II
Without the levee extension, flood waters flow both west Into the City'S bUSiness distriCt,
and south to the area protected by the eXisting flood wall In both the 1993 and 1997
floods, the high water levels extended some 400 feet over railroad tracks, roadways,
covered parking areas, and flooded the basements of the hlstonc buildings closest to
the nver

Congress In the Water Resources Development Act of 1992, and reauthorized In the
Water Resources Development Act of 1996 at a total cost of $11 6 million. In
accordance with the Legislation, the Federal Government prOVides 75% of the costs
The Minnesota State Legislature has prOVided one half of the non-Federal matching

Definition of Hate Crime:
Crimes committed against a person or group because of the race, color, religion,
gender, sexual orientation, age, disability or national origin of the victim.
Such hate motivation allows for a penalty enhancement of the following crimes:
assault, criminal trespassing, criminal damage to property, harassment or stalking.
Such hate motivation may be considered by the court as a reason to impose a more
severe sentence Sentences include incarceration, fines and community service.

Review Board (MESERB) and as the Public Works Director for the CIty of Manka to because
you discharge either directly or indIrectly mto the Mmnesota or MississIppi Rivers The City of
Mankato recently underwent NPDES permit reissuance from the MInnesota PollutIon Control
Agency (MPCA), and you need to be aware of the lIllplications of this reissuance m the event
sImilar issues develop in your own SItuation. As some of you may know, MESERB is a 15-city
Joint powers board interested in improVIng enVIronmental protections with scientific and .
economic informatIon.

Before discussing the speCIfic outcomes of the Mankato permit case, It should be noted at the
outset that the city of Mankato has always conSIdered phosphorus reduction on the Mmnesota
River to be a prionty As a result, the CIty voluntarily took sigmficant steps With ItS existing
facihty to make phosphorus reductions a realIty These efforts will contmue with the new facihty
upgrade deSIgned by the CIty; whIch deSIgn did not change as a result of the dIspute discussed
below
The Issue IS the proper allocation of pollutant loadings for the protection of water qUalIty and the
apphcatIOn of those loadmgs to all dIschargers whether from pomt or non-point sources The
approach needed IS a basin-Wide one WhICh includes proper monitoring, waste load allocation
studIes, and detaIled SCIentIfic analYSIS Based on scientIfic eVIdence, the tWIn CInes
metropohtan area, industrial dIschargers and the agncultural communIty must all share m the
effort to reduce phosphorus in the Minnesota River Only by conductmg such analysis and
estabhshing a partnershIp approach Will appropnate discharge hmIts be determmed and apphed
Yet as the example dIscussed below shows, thIS does not seem to be the approach wlnch some
environmental groups are taking

Based on the Mankato expenence, MESERB believes CItIes should take the following positions
With respect to the reissuance of their own NPDES penmts
.
Summary:
.
Cities should oppose attempts to use the Mankato permit as a basis for
establishing a phosphorus limit in other NPDES permits. Some
environmental groups may inappropriately attempt to use the Mankato pemnt to
try to establish a precedent and thereby CIrcumvent the MPCA's rulemaking
process. CitIes should recognize such tactics and understand that the Mankato
permit phosphorus limit was established arbitrarily through pohtIcal
negotIations, and is not based on any waste load allocation or scientific analYSIS
.
Cities should not accept any phosphorous limit unless the proposed limit is
scientifically justified and required by MPCA rules. Proposed pemnt Ilmlts
not required by Minnesota law or mles nor supported by a basin-Wide wasteload
allocation study and developed through the MPCA' s rulemalang process should
be rejected. Cities should always try to bwld treatment plants that exceed the
pemnt limits m law as Mankato did, but they should not agree to arbItrary pemnt
limIts. The focus should be on protecting the quality of our water resources
.
Cities should voluntarily request an Environmental Assessment Worksheet
(EA W) on their projects at the beginning of the permitting process.
Requesting the EA W m a tImely manner WIll help to avoid having an EA W used
against your project as a means to delay or stop your project at the end of the
permitting process
· Cities should critically review all permit documentation and associated non-
degradation and environmental reviews. CItIes should review all permIt
documentatIon to ensure accuracy of the assumptions and calculations used in the
permit process

permit and facIhty plans for a $22 mllhon plant upgrade and expanSIon At the very end of the
pubhc comment penod for the new draft permlt, an enVIronmental group known as the
Minnesota Center for EnVIronmental Advocacy (MCEA) challenged the permIt, claimmg it was
