A RESOLUTION APPROVING AGREEMENT BETWEEN
THE CITY OF STILLWATER AND PARK CONSTRUCTION
FOR THE MULBERRY POINT STORM SEWER MODIFICATIONS
TO THE STILLWATER BEACH EROSION CONTROL PROJECT
ST. CROIX RIVER STAGE II
WHEREAS, on the 29th day of September, 1998, the City and the Department of the
Army reached an agreement calling for construction of the Levee Wall system, St. Croix River at
Stillwater, Minnesota (hereinafter the "Project"), as authorized by Section 363 of the Water
Resources Development Act of 1992, Public Law 102-580; and,
WHEREAS, pursuant to the Project Cooperation Agreement the Department ofthe Army
duly advertised for bids for the Project and pursuant to that advertisement and solicitation
awarded a contract to Park Construction executed by the Department of Army and Park
Construction on June 30, 1999, and,
WHEREAS, during the course of the Project, it was recognized by Boonestra, Roseen,
Anderlick and Associates, engineers for the City, that a storm sewer appurtenance draining
through Mulberry Point would be disturbed and rebuild since the sewer would be effected by the
Levee Wall and other appurtenances in the Project. The engineers also recognized that it would
be important to establish the Mulberry Point storm sewer in a size that would be sufficient to
handle increased flows from the diversion structure construction on Browns Creek as part of the
AUAR mitigation measures established by the City for the Annexation Expansion area; and,
WHEREAS, the engineers designed a structure that would handle the increased outflow
and subsequently reached agreement with the Department of the Army and Park Construction
that an Addendum would be made to the contract between Park Construction and the Department
of the Army allowing for a modification of the Contract to provide for the additional work as
necessary to accomplish the needed capacity in the storm sewer; and,
WHEREAS, the Department of the Army and Park Construction agreed to allow this
modification on the condition that the Department of the Army be allowed to supervise and
administer the construction of the storm sewer system provided that the costs associated with the
work would be paid directly by the City; and,
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the agreement between Park Construction and the City of Stillwater for
payment of costs associated with the Mulberry Point storm sewer modifications be, and the same
hereby is, approved according to the unit prices and estimates attached to this Resolution as
Exhibit A.
2. That it is necessary for this work to be done immediately since the opportunity
presents itself for a significant savings since if the Levee Wall were constructed without the

proposed modifications, it would require the completed Levee Wall to be tom up and
reconstructed if the over-sizing of the storm sewer were to be done at a later time.
3. It is not practical or possible to advertise for bids since there is not sufficient time
to allow formal plans and specifications to be prepared and advertised and further it would
require the consent of Park Construction to allow an additional contractor to work in their
Project.
4. The circumstances require that this agreement approved as negotiated.
5.That the Mayor and Clerk are authorized to sign the agreement on behalf of the City for
direct payment of costs associated with the over-sizing of a Mulberry Point storm sewer as part
of the contract between the Department of the Army and Park Construction all reached pursuant
to Addendum Number 1 of the Project Cooperation Agreement between the Department of the
Army and the City of Stillwater as Amended on the 29th of September, 1998.
Enacted by the City Council of the City of Stillwater this 7th day of December, 1999.
