HomeMy WebLinkAbout1999-269 RESOLUTION NO. 99-269 RESOLUTION VACATING AN EXISTING DRAINAGE AND UTILITY EASEMENT WHEREAS, a petition was presented praying for vacation of a drainage and utility easement in the City of Stillwater, Minnesota, hereinafter described; and WHEREAS, the City Council did determine that the petition was sufficient; and the City is a Home Rule Charter City of the Third Class and that is was proper for them to proceed with the vacation pursuant to Minn. Stat. 9440.135; and WHEREAS, at a meeting duly called for that purpose, the City Council did on the 21 st of September, 1999, determine that the proposed vacation would not interfere or defeat the public interest or adversely affect the public and that it would be in the best interest of the City of Stillwater and the abutting owners that the vacating the easement be granted. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the petition be and the same is hereby granted, that the following easement be vacated. That part of Lot 8, Block 2, STILLWATER INDUSTRIAL PARK, according to the recorded plat thereof, Washington County, Minnesota, described as follows: The south 5 feet of the East 194.43 feet of said Lot 3, Except the East 10 feet thereof; and That part of Lot 2, Block 2, STILLWATER INDUSTRIAL PARK 2ND ADDITION, according to the recorded plat thereof, Washington County, described as follows: The North 5 feet of said Lot 2, Except the West 5 feet and the East 10 feet thereof; and Legal description as recorded in Document Number 946330, dated August 15, 1997, recorded September 23, 1997; and Legal description as recorded in Document Number 494045, dated September 30, 1985. Adopted by affirmative vote of all members of the City Council this 21 st day of September, 1999. ATTEST:
