HomeMy WebLinkAbout1998-163RESOLUTION NO. 98~~b3 A RESOLUTION DETERMINING THE NECESSITY FOR AND AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTY BY PROCEEDINGS IN EMINENT DOMAIN WHEREAS, the City Council has determined that the City of Stillwater should establish anew park in the North Hill area of the City upon property formerly owned by Henry Amundson and now owned by Nena Amundson and for several years negotiations have taken place between Nena Amundson and the City of Stillwater for the voluntary purchase of this property, however, the negotiations have proven fruitless and the goals of the City Park Plan are being frustrated. NOW, THEREFORE, BE IF RESOLVED BY THE CITY COUNCIL OF THE CITY OF STILLWATER AS FOLLOWS: 1. Acquisition by the City of the following described property (the Property) is necessary for the acquisition, construction and maintenance of a City park: Beginning at the southeast corner of the southeast quarter of the southeast quarter of Section 20, Township 30N, Range 20W; thence north along the east line of Section 20 a distance of 650.00 feet to the north line of the tract as described and decreed by order of the District Court of Washington County on May 24, 1911, recorded with the County Recorder of the County of Washington in Book 70 of Deeds, page 628; thence north 89°41'29" west a distance of 511.67 feet to the southeast corner of Lot 5, Block 5, Oak Glen; thence south along the easterly line of Oak Glen on bearing south 1°11'03" east a distance of b50 feet to the south line of the southeast quarter of the southeast quarter of Section 20 to a point where the north line of the northeast corner of the northeast quarter of Section 29 intersects the easterly line of Amundson Drive as contained within Oak Glen; thence south along the easterly right-of--way line of Amundson Drive, a distance of 345.83 feet to the northwest corner of Lot 1, Block 1, Fisher Heights; thence east along the north line of Lot 1, Block 1, Fisher Heights and the westerly prolongation of the south line of the north half of the northwest quarter of the northwest quarter of the northwest quarter of Section 28, a distance of 508.50 feet, the line bearing north 88°54'24" east to the east line of the northeast quarter of the northeast quarter of Section 29; thence north along the east line of Section 29 to the point of beginning. Containing 11.18 acres, more or less. Subject to an exception as described in Book 317 of Deeds, page 861, and subject to an easement described in Document No. 458990 and subject to a permanent drainage easement as described in Document No. 400713. The Property is depicted on the survey map attached as Exhibit "A". 2. The City Attorney is authorized and directed on behalf of the City to acquire the real estate above described by the exercise of the power of Eminent Domain pursuant to Minnesota Statutes Chapter 117 and is specifically authorized to notify the owners of intent to take possession pursuant to Minnesota Statutes Section 117.042. The City Attorney is further authorized to take all actions necessary and desirable to carry out the purposes of this Resolution.
