RESOLUTION NO. 91-41
WHEREAS, it has been recommended to the City Council by the
Stillwater Port Authority that proper enforcement of the no wake
provisions contained in the Minnesota Rules be achieved within
the City limits of the City of Stillwater, and
WHEREAS, Minnesota Rule 6105.0320 defines slow "no wake" to
mean the operation of a motor boat at the slowest possible speed
necessary to maintain steerage, and
WHEREAS, Minnesota Rule 6105.0330 subpart 2e provides that
no motor boat shall be operated in excess of a slow "no wake"
speed within 100 feet of shore, including the shores of islands
and of swimmers and from sand bars located approximately at mile
31.0 to the confluence of the st. Croix River with the
Mississippi River, and
WHEREAS, the City of Stillwater is located within this zone.
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the City Coordinator, with the assistance of the
Public Safety Director, is directed to place buoys in order that
the public be clearly informed of the no wake zone between the
extension of Elm Street on the North and the extension of Locust
Street on the South.
2. That the City Coordinator is authorized to purchase
these buoys at the approximate amount of $125 - $150 each.
3. That the City Coordinator is directed to seek the
cooperation of the Public Safety Director and the Washington
County Sheriff to develop a program for the enforcement of this
restricted zone as marked.
4. That since the Minnesota Rules provide that violating
the above rules constitutes a misdemeanor, all law enforcement
officers now employed by the City or deputized by the City are
hereby directed to vigorously enforce the standards set forth in
these rules.
Enacted by the City Council of the City of Stillwater this
5th day of March, 1990.
