WHEREAS, pursuant to proper notice duly given as required by law the Council has met, heard and passed upon all objections to the proposed assessment for Local Improvement No. 257, otherwise known as the Stillwater, Minnesota Downtown Capital Improvement Project and, WHEREAS, at the original assessment hearing held the 16th of April, 1991, the Council determined that certain objections deserved to be heard more closely and therefore, the Council continued the assessment hearing as to those parcels and on the 8th of October, 1991, and on the 22nd of October, 1991, pursuant to such notice as was required by law, the Council met further and heard additional evidence with regard to the objections, NOW THEREFORE, be it resolved by the City Council of Stillwater, Minnesota: r 1. The proposed assessment roll known as Assessment Roll 257-2, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands therein named and each tract of land therein included is hereby found to be benefitted by the improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments over a period of fifteen years, the first installment to be payable on or before the first Monday in January, 1992 and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1992. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. r 3. The owner of any property so assessed may at any time prior to the certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and they may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31st of the year in which the payment is made. The payment must be made before November 15th or interest will be charged through December 31st of the next succeeding year. , . (' 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment roll to the County Auditor to be extended on the property tax list of the County. Such assessment shall be collected and paid Over in the same manner as other municipal taxes.
