A RESOLUTION DETERMINING THE NECESSITY FOR
AND AUTHORIZING THE ACQUISITION OF REAL PROPERTY
BY PROCEEDINGS IN EMINENT DOMAIN
WHEREAS, the City Council has reviewed reports submitted by the Building Inspector
and City Coordinator setting forth that the Real Estate described in Exhibit "A' is hazardous and
dilapidated within the meaning of M.S. §463.15.
WHEREAS, the building has been vacant and underutilized for approximately 10 years,
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF STILLWATER, MINNESOTA AS FOLLOWS:
1. Acquisition by the City of the following described property is necessary in order to
maintain a sufficient supply of adequate, safe and sanitary buildings in the Historic Downtown
District of the City for commercial purposes.
2. The City Attorney is authorized and directed on behalf of the City to acquire the real
estate above described by the exercise of the power of Eminent Domain pursuant to Minnesota
Statutes Chapter 117. The City Attorney is further authorized to take all actions necessary and
desirable to carry out the purposes of this Resolution.
See Attached Exhibit "A".
3. That this Resolution is not operative until March 17, 1999, and until that time will not
be in force and effect.

EXHIBIT "A"
All that part of block eighteen (18) of the original Town (new City) of Stillwater
according to the Plat thereof on file and of record in the office of the Register of Deeds,
Washington County, Minnesota described as follows:
Beginning at a point on the west line of Main Street that is 164 feet north of the
north line of Myrtle Street; thence north on the west line of Main Street distance
of nineteen feet; thence west on a line parallel with the north line of Myrtle Street
to the east line of Union Alley; thence south on the east line of Union Alley a
distance of nineteen feet; thence east on a line parallel with the north line of
Myrtle Street to the point of beginning.
