RESOLUTION NO. 96-247 APPROVING THE DISSOLUTION OF THE BROWN'S CREEK WATERSHED MANAGEMENT ORGANIZATION WHEREAS, the City of Stillwater is a member community of a joint powers organization known as the Brown's Creek Watershed Management Organization; and WHEREAS, the City of Stillwater is aware that efforts by the Brown's Creek WMO to update its Joint Powers Agreement have failed; and WHEREAS, the City of Stillwater is aware that the Minnesota Board of Soil and Water Resources has declared that the Brown's Creek WMO has failed to implement its plan through failure to update its Joint Powers Agreement to provide the powers to do so; and WHEREAS, the Brown's Creek WMO Board of Commissioners voted on August 21, 1996, to recommend that the member communities unanimously agree to dissolve the current Brown's Creek WMO Joint Powers Agreement pursuant to section 8.2 of the Agreement. NOW THEREFORE, BE IT RESOLVED by the City Council of Stillwater, Minnesota, that the following resolution was duly made, seconded and approved: l. The City Council of the City of Stillwater supports the recommendation of the Brown's Creek WMO Commissioners that the Joint Powers Agreement be dissolved; 2. The City Council of the City of Stillwater agrees with the findings of the Board of Water and Soil Resources that the Brown's Creek WMO has failed to implement its plan; 3. The City Council of the City of Stillwater hereby approves the dissolution of the Joint Powers Agreement forming the Brown's Creek Watershed Management Organization. WHEREUPON, a vote being taken upon the motion, the following members voted in favor: Councilmembers Bealka, Cummings, Thole, Zoller and Mayor Kimble Those voting against: None WHEREUPON, said motion was declared duly passed and adopted.
