RESOLUTION NO. 96-243 APPROVAL OF JOINT POWERS AGREEMENT BY AND BETWEEN CITIES OF STILLWATER, HUGO, AND TOWN OF GRANT FOR STUDY OF BROWNS CREEK BE IT RESOLVED by the City Council of Stillwater, Minnesota, that the Joint Powers Agreement by and between the Cities of Stillwater, Hugo and Town of Grant for the study of Browns Creek is hereby approved and the Mayor Clerk are authorized to sign said Agreement. I c:J<..t4. . ~ ORIGINAL CITY OF HtTGO WASRIN'GTON COUNTY i MINNESOTA CITY OF STILLWATER WASHINGTON COmITY I MINbmSOTA TO~ OF GRANT WASHINGTON COUNTY I M!NN:BSOTA AGREEMENT THIS AGREEMENT made and entered into this S..:el. day of ~ . 1996, by and between the CITY OF HUGO, a Minnesota mun~Cipality organized under the laws of the State of Minnesota (hereinafter referred to as "Hugo") I the CITY OF STILLWATER, a Minnesota municipality organized under the laws of the State of Minnesota (hereinafter referred to as "Stillwater"), and the TOWN OF GRANT I a Minnesota township organized under the laws of the State of Minnesota (hereinafter referred to as "Grant"). WITNESSETH: WHEREAS, the parties to this Agreement have an interest in the efficient and proper control of .storm water run-off in portions of washington County; and, WHEREAS, the Browns Creek Watershed extends from the City of Hugo down through other communities and outlets in the City of Stillwater; andl WHEREAS, the City of Hugo is considering implementing a plan to draw down several landlocked basins located in the City of Hugo. I I ur nut:!u IU.J.IC..... I (J<.J....J WHEREAS, Grant is currently engaged in planning for the draw down of a landlocked basin located in Grant Township. That plan currently proposes outletting waters through the Browns Creek drainage area through the City of Stillwater; and, WHEREAS, the City of Stillwater is currently looking at several drainage issues which also outlet through the Browns creek systems; and, WHEREAS, the parties hereto believe it would be to the benefit of each of them to jointly engage the services of a qualified engineering firm to perform a computer aided hydrologic downstream model for Browns Creek, as is more fully described as Task 2 on the attached Exhibit "A"i and, WHEREAS, the intent of this Agreement is for the parties hereto to set out in advance a cost sharing formula in order to pay for the modeling study. NOW, THEREFORE, in consideration of the premises and of the mutual promises and conditions contained herein, it is agreed by the parties hereto as follows; 1 . Sharing of Costs. The parties hereto agree to share the costs for the modeling study referenced herein as follows: A. Hugo - 40% B. Grant - 40% c. Stillwater - 20% 2. Billing. The parties hereto agree that the City of Hugo shall send to Stillwater and Grant a copy of any and all invoices received from the Engineers related to the study. The ReV'. Stillwater and Grant shall approve payment of their respective shares of the invoice and immediately remit proper checks to the city for their respective share of the invoice.
