RESOLUTION NO. 96-238 A RESOLUTION AUTHORIZING EMERGENCY REPAIRS ENTERING INTO A PERSONAL SERVICE CONTRACT WITH JACOBSON EXCAVATING AND TRUCKING COMPANY FOR THE DREDGING AND CONSTRUCTION OF A RETAINING WALL AT THE STILLWATER YACHT CLUB WHEREAS, it has been demonstrated by the owners of the Stillwater Yacht Club that the harbor in the St. Croix River adjacent to the Stillwater Yacht Club is in the need of emergency dredging and the construction of a retaining wall near the C dock of the Marina should be immediately constructed at this time due to the current low water conditions on the St. Croix River; and, WHEREAS, the City has authority under its Charter to conduct waterfront and wharfage repairs on the St. Croix River in the City; and, WHEREAS, if these repairs are not made immediately, further erosion as necessary that could possibly endanger adjacent City streets and storm water and sanitary sewer facilities located near the area; and, WHEREAS, it is necessary to enter a personal service contract for this work in view of the fact that it needs the personal supervision of the City Engineer, who will give direction to the personal service contractors in order that the work can be done on a timely and efficient basis in view of the crowded nature of the project, its adjacency to the St. Croix River and to existing City utilities in the area. NOW, THEREFORE, BE IT RESOLVED, that a public emergency be declared with regard to the dredging and retaining wall project near the C dock area of the Stillwater Yacht Club on the St. Croix River and that the City is authorized to enter into a contract with L & S Industrial Marine Inc. located at P.O. Box 375, Hugo, Minnesota 55038, and that this work be done on the basis that a Waiver of Assessment Hearing and Consent be signed by the Stillwater Yacht Club for the full amount of the Contract.
