RESOLUTION 96-195 .
RESOLUTION V AC1TING PART OF EAST SCHOOL STREET
WHEREAS, a Petition was presented for vacation of a part of East School Street; and
WHEREAS, the City Council did determine that the Petition was sufficient; and the City
is a Home Rule Charter City of the Third Class and that it was proper for them to proceed with
the vacation pursuant to Minnesota Statutes ~440.135; and
WHEREAS, a meeting was duly called for that purpose, the City Council did on the 6th
day of August, 1996, determine that the proposed vacation would not interfere or defeat the
public interest or adversely affect the public and that it would be in the best interests ofthe City
of Stillwater and the abutting owners that the portion of street be returned to the tax rolls.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the following description to vacate all part of platted East School Street as
the same is dedicated on the plat of SABIN HEIGHTS, according to the recorded plat thereof on
file and of record in the office of the County Recorder of Washing County, Minnesota, is
described as follows: Commencing at the northeasterly comer of said Lot 1, thence northerly
along a northerly proj ection of the easterly line of said Lot 1 a distance of 9.20 feet to the point
of beginning of the parcel being described; thence southerly along said projected line 9.20 feet,
more or less, to said northeasterly comer of Lot 1; thence westerly along the northerly line of
said Lot 1 to the northwesterly comer thereof; thence northerly along a northerly projection of
the westerly line of said Lot 1 a distance of 8.65 feet; thence easterly in a direct line to the point
of beginning. Parcel contains 1240 square feet, more or less., be and hereby is vacated
2. Further that a copy of this Resolution duly certified by the City Clerk shall be
recorded in the Office ofthe County Recorder, Washington County, Minnesota.
Adopted by affirmative vote of all the members of the City Council of the City of
Stillwater this 6th day of August, 1996.

All part of platted East School Street as the same is dedicated on the plat of SABIN HEIGHTS,
according to the recorded plat thereof on file and of record in the office of the County
Recorder of Washington County, Minnesota, described as follows; Commencing at the northeasterly
corner of said lot I, thence northerly along a northerly projection of the easterly line of
said lot 1 a distance of 9.20 feet to the point of beginning of the parcel being described;
southerly along said projected line 9.20 feet, more or less, to said northeasterly
corner of lot 1; thence westerly along the northerly line of said lot 1 to the northwesterly
corner thereof; thence northerly along a northerly projection of the westerly line of said
lot 1 a dist3nce of e.~5 feet; thence easterly ina direct line to the point of beginning.
Parcel contains 1240 square feet, more or less.

not located in conjunction with this survey, unless shown otherwise.
Note encroachments as shown and noted. The concrete retaining wal~ located generally
northerly of the southerly line of Lot I, SABIN HEIGHTS, has alignment that is tipped
s'ly and leans over said s'iy line a maximum of 0.2't. This wall has also been
pUShed s'ly by frost action as to create a slightly curved alignment.
Pool improvements on the site were not located.
The northerly line of Parcell is located generally just \
