RESOLUTION NO. 96i8 A
RESOLUTION VACATING UTILITY EASEMENTS
STILLWATER MARKET PLACE 2ND ADDITION
WHEREAS, a Petition was presented praying for vacation of utility easements of Stillwater
Market Place 2nd Addition in the City of Stillwater, Minnesota hereinafter described; and,
WHEREAS, the City Council did determine that the Petition was sufficient; and the City is a
Home Rule Charter City of the Third Class and that it was proper for them to proceed with the vacation
pursuant to Minnesota Statutes ~440.135; and
WHEREAS, at a meeting duly called for that purpose, the City Council did on the 6th day of
February, 1996, determine that the proposed vacation would not interfere or defeat the public interest or
adversely affect the public and that it would be in the best interests of the City of Stillwater.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the Petition be in the same is hereby granted, that the following City easements, be and
the same are hereby vacated:
That part of Market Place Second Addition, platted as Lots 2, 3, 4, 5 and 6, Block 1,
Stillwater Market Place Second Addition.
BE IT FURTHER RESOLVED, that a copy of this Resolution duly certified by the City Clerk
shall be recorded in the office of the County Recorder of Washington County, Minnesota.
Adopted by affirmation vote of all members of the City Council this 16th day of Janua ry, 1996.
