RESOLUTION NO. 96-140
A RESOLUTION REVOKING A KENNEL LICENSE
WHEREAS, the City Council conducted a hearing on the 4th day of June, 1996, in the Council
Chambers upon due notice to the public and to the holder of the kennel license; and,
WHEREAS, the City Council listened to the testimony of adjoining neighbors and reviewed
reports of the City Staff and, although personally served with notice of the hearing, there was no
appearance by the holder of the kennel license; and,
WHEREAS, at the close of the hearing, the City Council adopted the Findings of Fact,
Conclusions of Law and Order revoking the kennel license for the property at 7 17 South Second Street
attached as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the Findings of Fact, Conclusions of Law and Order attached to this Resolution as
Exhibit" A II be and the same hereby are adopted as the Findings of Fact, Conclusions of Law and Order
revoking the kennel license for the property located at 717 South Second Street, Stillwater, Minnesota.
Enacted by the City Council of the City of Stillwater this 4th day of June, 1996.

In Re:
Kennel License Revocation
for the property at
717 South Second Street,
Stillwater, Minnesota
FINDINGS OF FACT.
CONCLUSIONS OF LAW. AND
ORDER FOR REVOCATION
The above-entitled matter came on for hearing before the City Council of the City of Stillwater
on the 4th day of June, 1996. The holder of the license, Nancy Canning owner of the property at 717
South Second Street was duly served with Notice of the Public Hearing and chose not to attend. At the
public hearing, the City Council considered the testimony of adjoining neighbors, the written complaints
by adjoining neighbors and they records of the Stillwater Police Department with reference to complaints
at the premises.
Based upon the evidence introduced at the hearing, the City Council makes the following:
FINDINGS OF FACT
1. That the back yard of the property has been worn bare and the bare dirt is covered with
animal feces.
2. That the oppressive odor from the dog manure sometimes becomes so oppressive that the
adjacent neighbors cannot open their windows or use their back yard.
3. That urine and other animal wastes run onto adjacent property.
4. That layers and clumps of feces on the bare dirt smell so badly that on even a cool day
the smell is offensive to adjoining properties.

5. That sometimes as many as nine (9) to twelve (12) dogs have been kenneled on the
property at one time and after numerous warnings the conditions have not been corrected.
6. That the conditions on the property devalue adjacent property.
NOW, THEREFORE, BASED UPON THE FINDINGS OF FACT, the Council makes the
following:
CONCLUSIONS OF LAW
1. That the conditions at the premises constitute a nuisance and have not been rectified by
the license holder after warnings by the Stillwater Police Department.
ORDER OF REVOCA nON
That the kennel license held by Nancy Canning for the premises at 717 South Second Street be
and the same hereby is revoked.
