RESOLUTION NO. 96- 131 A RESOLUTION APPROVING THE RESUBDIVlSION OF LOT 4, BLOCK ONE, PRIME SITE SUBDIVISION AND THE VACATION OF UTILITY EASEMENTS AND THE ACCEPTANCE OF NEW UTILITY EASEMENTS WHEREAS, at a meeting duly called for this purpose, the City Council listened to testimony and reviewed exhibits with regard to the resubdivision of Lot 4, Block One, PRIME SITE SUBDIVISION that was necessitated for the acquisition by the City of a parcel of land to be made available for the relocation of Colonial Craft pursuant to a Development Agreement made between Colonial Craft and the City; and, WHEREAS, it is necessary in order to effectuate the conveyance to resubdivide Lot 4 and to relocate the drainage and utility easements ordinarily along the lot lines of the parcel; and, WHEREAS, a survey has been prepared and is attached to this Resolution as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the subdivision of Lot 4, Block One, PRIME SITE SUBDIVISION is hereby approved and the division of Lot 4 into two (2) parcels is hereby approved and will hereafter be described as follows: Parcel A: That part of Lot 4 lying Westerly of the East 157.30 feet, Block One, PRIME SITE SUBDIVISION, according to the plat thereof; Parcel B: The East 157.30 feet of Lot 4, Block One, PRIME SITE SUBDIVISION, according to the plat thereof; and The vacation of the following easements within Lots 1, 2, 3, and 4, Block One, PRIME SITE SUBDIVISION, according to the plat thereof be and the same hereby are vacated. The vacated easements are described as follows: All that part of the platted drainage and utility easements located on Lots 1, 2, 3, and 4, Block One, PRIME SITE SUBDIVISION, according to the plat thereof on file and of record in the offIce of the County Recorder of Washington County, Minnesota, described as follows: All that part of the platted drainage and utility easements located along the westerly line of said Lot 1 and along the easterly lines of said Lots 2, 3, and 4, lying southerly of a line drawn parallel with and 10.00 feet southerly of the northerly line of said Block One, and northerly of a line drawn parallel with and 15.00 feet northerly of the southerly lines of said Lots 1 and 4; and All that part of the platted drainage and utility easements located along the southerly line of said Lot 2 and along the northerly line of said Lot 3 lying easterly of a line drawn parallel with 10.00 feet easterly of the westerly line of said Block One; and ; . . . All that part of the platted drainage and utility easements located along the southerly line of said Lot 3 and along the northerly line of said Lot 4 lying easterly of a line drawn parallel with and 142.30 feet easterly of the westerly line of said Lot 1, all located in Block One, PRIME SITE SUBDIVISION, Washington County, Minnesota. A new drainage easement for the newly confIgured parcel is hereby accepted and dedicated to be reserved in the City as an easement for drainage and utilities upon the reconveyance of this parcel. The new drainage and utility easement is described as follows: An easement for drainage and utility purposes only, over, under and across all that part of Lots 1 and 4, Block One, PRIME SITE SUBDIVISION, according to the plat thereof on file and of record in the offIce of the County Recorder of Washington County, Minnesota described as follows: The South 15.00 feet of said Lots 1 and 4; and the West 30.00 feet of the East 172.30 feet of said Lot 4, all located in Block One, PRIME SITE SUBDIVISION, Washington County, Minnesota.
