A RESOLUTION DETERMINING NO POTENTIALLY
SIGNIFICANT ADVERSE ENVIRONMENTAL IMPACTS
WIlli REGARD TO THE STILLWATER WATER FLOOD AND
RETAINING WALL PROJECT AND APPROVING A NEGATIVE
DECLARATION FOR THE PROJECT
WHEREAS, an Environmental Worksheet was prepared by the United States Army Corps of
Engineers, St. Paul District, through their agents, Short, Elliott & Hendrickson and the Worksheet was
prepared in accordance with the Minnesota Environmental Quality Board Guidelines and Minnesota Rules
part 4410-1300; and
WHEREAS, the Environmental Assessment Worksheet incorporated the Design Memorandum
and Environmental Assessment prepared by the United States Corps of Engineers for the levy project and
advertised for public review for the required thirty (30) day period; and,
WHEREAS, comments were received and reviewed and responded to by Minnesota Department
of Transportation, the Metropolitan Council, the Minnesota Department of Natural Resources and the
Freight House Restaurant; and
WHEREAS, the City Council has reviewed all documents submitted as part of the environmental
review and public comment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF STILL WATER ADOPTS THE
FOLLOWING FINDINGS OF FACT:
1. That the noise levels of the project will be elevated for approximately one-half (1/2) year
in each of two (2) sequential years. Any impacts to the quality of life from this additional noise can be
mitigated using restrictions on the hours of equipment operation and by maintaining vehicle noise
mufflers. Because construction noise will be a short term adverse impact and the added use of the
improved lakefront will add significantly to the overall noise in the Lowell Park area, impacts to noise
are considered adverse but minor.
2. Traffic flow and parking activities could have a negative impact if not properly controlled,
however, the plan for mitigation and control of both public and private transportation set forth in the
Design Memorandum will adequately address these impacts and keep them to a minimum.
3. That some minor short term adverse impact can be expected during the construction
period to the business activities in the downtown, however, if accommodating all of the businesses'
desires would increase the cost and would be a major impediment to the project. These destructions can
be mitigated by adequate forewarning of each new construction phase and should effectively minimize
their potential losses. Considering all aspects and all information in the context of total business activity
in the downtown district, project impacts can be considered minor and adverse during the construction
period and minor and positive in the long run.

6. The condition of existing buildings in the area of construction will be inventoried and
monitored for impact. Some soil conditions in the area are poor, some of buildings old and there is the
potential for some building impact, however, it will be closely monitored throughout the project
construction and the adverse impact should be negative but short term.
BASED UPON THE ABOVE FINDINGS, IT IS DETERMINED:
1. That no potentially signifIcant adverse impacts will occur by reason of the project and that
a negative declaration is hereby approved.
