THE CITY OF STILLWATER, MINNESOTA
January 25, 1994
A Resolution Approving a Memorandum of Understanding
with the
U. S. Army Corps of Engineers
WHEREAS, the City Council passed Resolution No. 92-255 requesting the
United States Congress to appropriate $2.4 million for the purpose of undertaking the
design, repair, reconstruction, expansion, and extension of the Levee Wall System on
the St. Croix River at Stillwater, Minnesota, as authorized in Section 363 of Public Law
102-580, the Water Resources Development Act of 1992; and
WHEREAS. the 103rd Congress of the United States passed, and the President
signed into Law, H.R. 2445, which appropriates $2.4 million for the flood wall system
project in FY 1994; and
WHEREAS, the U.S. Army Corps of Engineers Headquarters in Washington,
D.C. has authorized the U.S. Army Corps of Engineers District OffIce in St. Paul,
Minnesota to initiate the process, il1lluding a "Cooperative Agreement" between the
r City and Corps, and the "Design Memorandum; leading to the construction of the
project; and
WHEREAS, the development of Lowell Park is closely associated with, and
related to, the work on the levee wall system; and
WHEREAS, the U.S. Army Corps of Engineers District Office has requested a
clarification, and delineation of the levee wall project as distinguished from the Lowell
Park development, and a single "point person" for communication and coordination
purposes for the project for the City;
NON, THEREFORE, BE rr RESOLVED:
That the attached "Memorandum of Understanding" broadly defines the scope
of the work to be included in the Levee Wan Project, and responds to the needs
identified, and requests made by the U.S. Army Corps of Engineers District Office in St.
Paul, Minnesota.

MEMORANDUM OF UNDERSTANDING
January 25, 1994
It is the understanding of the Council for the City of Stillwater, MN that the levee
repair, reconstruction, extension, and expansion project authorized and funded by the
103rd Congress includes the following:
1. The levee wall system will be either repaired or reconstructed in a manner and style
consistent with the design of the original structure;
2. That the Levee Wall System will be extended approximately 1,600 feet to the North,
around all of Mulberry Point, and extended approximate 300 feet to the South, at the
point where the elevation of riverbank eliminates potential flooding;
3. That the Levee Wall System win be "expanded" by including an "I walr, in
accordance with the Conference Report of the Congress. The"' walr will extend
approximately 21/2 feet above the ground, and 15 feet below the the surface. This
structure will increase the Levee Wall System to a 50 year flood protection plan. The "I
waJr will permit "sandbagging," yet prevent the seepage the occurs when flood waters
reache$ the sand bags. The "I Walr will extend approximately the length of the
primary Levee Wall System, however the topography of the area win not require the "I
Walr to extend past the extension of the primary system to the South of the existing
r levee, but will likely require the "I walr to extend beyond the extension to the North.
While the "I walr is very important to both the City, and the Minnesota Department of
Natural Resources, it is of secondary importance to the repair and extension of the
existing levee wall system;
4. That the levee wall project will facilitate the planned park development when
possible, but the levee wall project will not include these park features as construction
elements of the levee project;
5. That the reconstructed levee wall will include "tie-ups" and bumpers for the purpose
of clocking boats;
6. That the walkway include 3 inch concrete wheel stops at the water's edge, with
appropriate drainage, for the purpose of minimizing the danger for the handicapped in
wheel chairs, baby carriages, and those using crutches or walking aides;

7. That the Lowell Park plan will be completed by December 31, 1994, to provide
specific locations for such park improvement structures that may be included in the
design of the levee wall, i.e., additional stairways, locations of interpretive plaques,
and the inclusion of markers, such as exaggerated joints, to define the location of the'
original levee, to enable these features to be added more easily in the park .

8. That the process should be carried out as expeditiously as possible; that the City of
Stillwater will cooperate with the U.S. Army Corps of Engineers to facilitate the
development and construction of this project in a manner acceptable to both the City
and the Federal government.
