RESOLUTION NO. 94- 16 A RESOLUTION ESTABLISHING A DESIGNATED HAZARDOUS SUBSTANCE SITE WHEREAS, the City council of the city of Stillwater on Tuesday, the 18th of Kay, 1993, established a modification of the development program for Development District No.1 (the "Development Program"), and the modification of the Tax Increment Financing Plan relating to Tax Increment Financing Districts Nos. 1-5 located therein, by establishing Tax Increment Financing District No. 6 within Development District No.1, and the adoption of the Tax Increment Financing Plan relating thereto, all pursuant to and in accordance with Minnesota Statutes S 469.124 through 469.179, inclusive, as amended; and, WHEREAS, the City has entered into a Redevelopment Agreement with SuperValu, Inc., (the "Redeveloper"), dated June 30, 1993, wherein the City obligated itself to "demolish buildings and other abandoned improvements on the site, the clearing of the site, the removal and abatement of hazardous material from the site"; and, WHEREAS, in order to accomplish the removal of the hazardous material, it was necessary for the City to propose and submit to the Pollution Control Agency a "Development Action Response Plan" that was approved in writing by the commissioner of the agency as reasonable and necessary to protect the public health and welfare and the environment; and, WHEREAS, after the approval of the Development Action Response Plan, it was necessary for the City to enter into a contract with H.E.W., an Iowa corporation, 503 7th Street, Bode, Iowa 50519, wherein H.E.W. contracted to perform asbestos removal pursuant to the approved Development Action Response Plan for the sum of $148,732, all of which has been accomplished by H.E.W. and the amount of the contract has been paid over to H.E.W. and the work accepted as complete; and, WHEREAS, it was necessary to sell its general obligation tax increment bonds of 1993 in order to finance, among other things, the removal of the hazardous substance pursuant to the approved plan. WHEREAS, prior to the expenditure of sums for the hazardous substance removal, the net tax capacity of the District was $8,747; and, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: That the City of Stillwater hereby certifies to the County Auditor of the County of Washington that the City has provided funds at least in the amount of $148,732 to finance the Development Response Action Plan and pursuant to Minnesota statutes S 469.174, Subd. 7, the City requests that the original net tax capacity of Tax Increment Financing District No. 6 be certified as zero (0) until certification by the City that the cost of the removal and remedial actions specified in the Development Response Action Plan has been reimbursed and fully paid.
