RESOLUTION NO. 94-122 WHEREAS, the Washington County Board of Commissioners has established a Solid Waste Management Service charge that is proposed to be assessed to residential and nonresidential generators of waste and collected by licensed waste collectors; and WHEREAS, in cities with organized collection where the city bills the generators for service, cities are required to collect the Solid Waste Management Service charge and in the alternative, if the cities do not collect such a charge, the county is authorized to spread the service charge against the generators for collection with their real estate taxes; and WHEREAS, it is more economical for the City to pay the service charge in the amount of $1.40 per month per City residential generator and then to deduct this amount from funds that would otherwise be payable to the Solid Waste Contractor for the provision of the service. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City shall pay to the County of Washington an amount equal to $1.40 per month per City residential generator and the City shall make that payment based upon City records relative to the occupancy of residential dwellings. 2. The City will provide the Solid Waste Contractor with monthly billing reports relative to the occupancy of residential dwellings. 3. The City will remit to the Contractor any refunds of payments made by the Contractor that the City receives pursuant to a Judgment or Order by a Court of competent jurisdiction and that might set aside the service charge or refund the service charge. 4. That the form of agreement for payment of Solid Waste Service Charge as prepared by the City Coordinator and approved by the City Attorney and attached to this Resolution as Exhibit A be and the same hereby is approved.
