RESOLUTION NO. 97-160
A RESOLUTION VACATING A PART OF THE
UTILITY EASEMENTS WITHIN
LOT 3, BLOCK 3, STILLWATER MARKET PLACE 2ND ADDITION
WHEREAS, a petition was presented paying for vacation of a part of the utility
easements within Lot 3, Block 3, Stillwater. Market Place 2nd Addition in the City of Stillwater,
Minnesota hereinafter described; and
WHEREAS, the City Council did determine that the petition was sufficient; and the City
is a Home Rule Charter City of the Third Class and that is was proper for them to proceed with
the vacation pursuant to Minnesota Statutes g440.135; and
WHEREAS, at a meeting duly called for that purpose, the City Council did on the 15th
day of July, 1997, determine that the proposed vacation would not interfere or defeat the public
interest or adversely affect the public and that it would be in the best interest of the City of
Stillwater and the abutting owners that land burdened by the easement be returned to the tax
rolls.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the petition is hereby granted, that the following utility easement, be and the
same is hereby vacated:
The Northeasterly 10 feet of Lot 1, except the Northwesterly and Southeasterly 10 feet
thereof; and the Southwesterly 10 feet of Lot 2, except the Northwesterly 10 feet thereof
and the Southwesterly 10 feet of Lot 3, except the Southeasterly 10 feet thereof; and the
Southeasterly 10 feet of the Southwesterly 40 feet of Lot 2 and the Northwesterly 10 feet
of the Southwesterly 40 feet of Lot 3, all in Block 3, Stillwater Marketplace 2nd Addition,
Washington County, Minnesota.
BE IT FURTHER RESOLVED, that a copy of this Resolution duly certified by the City
Clerk shall be recorded in the office of the County Recorder of Washington County, Minnesota.
Adopted by affirmative vote of all members of the City Council this 15th day of July,
1997.
