A RESOLUTION APPROVING A TRANSFER
OF LAND TO THE STATE OF MINNESOTA FOR THE
THROUGH mGHWAY 36/COUNTY ROAD 5
RECONSTRUCTION PROJECT
STILL WATER JOB NO. 9725
WHEREAS, the State of Minnesota plans to construct the County Road 5 overpass over
Highway 36 during the Spring of 1997 and the Summer of 1997; and,
WHEREAS, the engineers have laid out the boundaries of the project and it has become apparent
to the State of Minnesota that two (2) parcels owned by the City of Stillwater are effected by the work;
and,
WHEREAS, the State of Minnesota has undertaken an appraisal of the two (2) parcels and
determined that the parcels and the damage is as follows:
Parcel 5, a drainage easement in perpetuity over part of Outlot A, Stillwater Marketplace,
together with an extinguishment of the right of access across the Parcel 5 for the construction
and maintenance of a drainage system and that damages to this parcel in the amount of
$6,700.00; and
Parcel 7, in which the State requires that part of Outlot F, Stillwater Industrial Park as shown as
Parcel 7 on MnDOT right of way plat number 82.84 and that the damage for the taking and the
damage to the remnant parcel, together with the temporary easement that will encumber the
parcel until December 1,2002, is in the amount of$I,450.00; and,
WHEREAS, the City Engineer and the City Attorney have reported to the Council that the
appraised amount offered by the State is fair and reasonable.
NOW, THEREFORE, BE IT RESOLVED, that the City accept the offer of the State of
Minnesota to pay the sum of $6,700.00 for the easement and relinquishment of access to Parcel No.5
and accept the sum of$I,450.00 for the property being conveyed in Quit Claim Deed as Parcel No.7 and
that the Mayor and Clerk are authorized to sign instruments of conveyance to effectuate the transfer of
these parcels to the State of Minnesota and the City Attorney and other staff are authorized to take the
necessary action to complete the transfer.
Enacted by the City Council on this 18th day of March, 1997.
