RESOLUTION NO. 97-6
RESOLUTION VACATING A PORTION OF SYCAMORE STREET
AND A PORTION OF CARNELIAN STREET
WHEREAS, a petition was presented paying for vacation of a portion of Sycamore
Street and a portion of Carnelian Street in City of Stillwater, Minnesota hereinafter described;
and,
WHEREAS, the City Council did determine that the petition was sufficient; and the City
is a Home Rule Chart City of the Third Class and that it was proper for them to proceed with the
vacation pursuant to Minnesota Statutes ~440.135; and,
WHEREAS, at a meeting duly called for that purpose, the City Council did on the 7th
day of January, 1997, determine that the proposed vacation would not interfere or defeat the
public interest or adversely affect the public and that it would be in the best interest of the City of
Stillwater and the abutting owners that the portion of street be to returned to the tax rolls.
NOW, THEREFORE, BE IT RESOLVED, BY THE City Council of the City of
Stillwater, Minnesota, that the petition be and the same is hereby granted, that the following
street as platted, be and the same is hereby vacated:
That part of Sycamore Street lying between Blocks 11 and 12, Cooper's Addition
(Part "A") and between Blocks 15 and 16, Cooper's Addition (Part "B") and
reserving in the City a permanent drainage and utility easement described as the
North 20 feet of the South 40 feet of both Part "A" and Part "B".
BE IF FURTHER RESOLVED, that a copy of this Resolution duly certified by the
City Clerk shall be recorded in the office of the County Recorder of Washington County,
Minnesota.
Adopted by affirmative vote of all members of the City Council this 7th day of January,
1997.
