Chairperson Johnson called the meeting to order at 7:07 p.m.
Approval of Minutes: Mr. Zoller, seconded by Mr. Laabs, moved to approve the minutes of Jan.
17, 2001; motion passed unanimously.
Case No. CPA/01-01 Comprehensive Plan Amendment changing land use designation of 15
acres of land located south of Boutwell Road and west of Boutwell Cemetery from Single
Family to Public Facility. City of Stillwater, applicant.
Mr. Russell explained that this action concludes work done last summer when a site study was
conducted preparatory to purchase of the land for a public works facility. Two public hearings
have been held. Mr. Russell noted that 50-75 townhouse units could have been constructed on
the site if the land use designation were not changed.
Lorree Neitz, 7865 Manning Avenue, said the wetlands on the property are tributary to Brown's
Creek and asked if setback requirements will be met. Mr. Russell noted that a condition of
approval is review by the Brown's Creek Watershed District. Ms. Neitz asked if the site is
located in the Phase 2 or Phase 4 annexatftQ[]r/az?QOMr. Russell stated the site is in Phase 2 and
not changed from the original Comprehensive Plan.
Mr. Zoller, seconded by Mr. Laabs, moved approval as conditioned. Motion passed
unanimously.
Case No. ZAT/01-01 Zoning Text Amendment establishing a new Public Facility Zoning
District. City of Stillwater, applicant.
Mr. Russell explained this is a new zoning district specifically for the site. All other zoning
requirements such as wetland setbacks apply. Requirements for Design Review and Planned
Unit Development result in real detailed information being provided, he said.
Mr. Zoller, seconded by Mr. Laabs, moved approval as submitted. Ms. McMonigal asked where
the noise levels came from; Mr. Russell said they are state Public Health recommended levels.
Ms. McMonigal asked if there would be generators on site. Mr. Eckles said there would be
nothing exterior other than an emergency generator to open garage doors; the generator is strictly
for emergency only. Ms. McMonigal noted that in section 5 item g, there is 10 percent missing -
30 percent landscape, 60 percent land coverage. Mr. Russell suggested changing the wording of
Sg to indicate the minimum landscaped/open space area for the district will be 30 percent. Mr.
Laabs moved to change the wording in Sg as suggested; Mr. Zoller seconded the motion, and the
motion passed unanimously. The original motion to approve the Zoning Ordinance Text was
then passed unanimously.

ZAM.01-02 Zoning Map Amendment designating 15 acres of land south of Boutwell Road and
west of Boutwell Cemetery Public Facility. City of Stillwater, applicant.
Mr. Russell noted the Zoning Map Amendment applies the zoning ordinance text to the site. Mr.
Zoller, seconded by Mr. Laabs, moved approval; motion passed unanimously.
Case PUD/01-27 A Planned Unit Development for development of portions of a 15 acre site into
a 40,000-square-foot facility with outdoor storage. City of Stillwater, applicant.
Mr. Russell noted the site includes shared parking/parks area, the facility includes a community
meeting room, and much of the site is wetlands. There are 7 conditions of approval.
City Engineer Klayton Eckles reviewed the needs for the facility and stated the city wants to e a
good neighbor. There is a large green space nearby and wetland that provide a large buffer
between neighbors. Three members of the architectural team, SALA Architects, reviewed the
project. Shane Coen of Coen & Stumpf landscape architects reviewed the site plan; he noted
details of the park use have not been fully developed.
Sheila Marie Untiedt, Stillwater Township, questioned whether nursery stock trees would be
sufficient for screening. Ms. Neitz questioned whether the proposed bioinfiltration swale would
change the existing level of the wetlandsONQU?Offioodman, city of Stillwater, questioned the
location of the swale noting there are some portions of the area the city doesn't own.
Ms. Neitz said she was concerned about noise levels, specifically from backup alarms. Mr.
Eckles noted the main garage has two entrances so there won't be any need to back up. There
will be a need to back up from the salt shed. Mr. Zoller noted that are radar sensitive backup
alarms which make less noise. It also was noted that extending the perimeter of the tree line
around the impound lot was a possibility.
Wayne Branum reviewed the exterior building elevations. He said the intent is to provide a rural
feel to the design. Colors and landscape details have not been decided on yet.
Ms. Neitz questioned which neighboring property owners were notified of the meeting. Mr.
Russell said all owners within 350 feet were notified. Ms. Neitz said at the last meeting it was
requested that the notification area be extended; Mr. Eckles agreed that issue was brought up at a
neighborhood meeting. Mr. Russell said the notification area could be extended for the July 17
City Council hearing.
Mr. Laabs moved approval of the Planned Unit Development as conditioned. Mr. Zoller
seconded the motion; motion passed unanimously.
Mr. Johnson noted that the park being incorporated into the site is Township land and asked how
the Town Board will stay in the loop. Mr. Magnuson said at a minimum there should be a use

agreement between the Town and City. Ms. Untiedt said the Town Park Board is in favor of the
use and would have no problem with such an agreement.
Case No. ZAM/01-03 Zoning Map Amendment rezoning 5.3 acres of land from Townhouse
Residential and Agricultural Preservation to Single Family Residential, located on the southwest
corner of CRS and Wildpines Lane. City of Stillwater, applicant.
Mr. Russell said Young Life has an agreement with Bethany Covenant Church to purchase a
single family residence currently used by the church. Townhouse Residential does not allow
churches or church-related use; such use is allowed in Single Family Residential with a special
use permit. The recommendation is to rezone both the church property and the single residential
lot. Mr. Laabs, seconded by Mr. Zoller, moved approval as requested; motion passed
unanimously.
Other items:
• Mr. Johnson raised the issue of the yearly 120 building permit limit in the annexation area.
He noted the intent of the yearly limit was clearly to place some constraints on development
and control the pace of change. However, he suggested that at some point, it might become a
City decision on how to allocate those permits. Mr. Russell agreed there is a concern that in
the future, a developer could spend $3 million for infrastructure development, with no
building permits available. Mr. MagntWiQ142996sted that if the situation gets to that point,
the City and Town will have be revisit the issue. Mr. Zoller suggested that the 120 limit
could be kept for phases 1, 2 and 3 and changed for the phase 4 annexation area.
Paul Bruggeman told the Board that the Bruggemans have 18 acres of land in the phase 4
annexation area, between Boutwell and County Road 12, that they would like to development
now. Mr. Johnson noted the township residents in the phase 4 area clearly wanted a choice
regarding annexation and suggested that the City/Board needs to look at the broader picture
of the phase 4 properties. Mr. Bruggeman asked how they should proceed. Mr. Russell
stated the City doesn't have the resources to plan for the area at this point; he suggested the
developer may want to assist with the necessary engineering studies. Mr. Zoller suggested
the Town Board may want to discuss the issues of the building permit limits and phase 4
development/annexation.
• Nancy Goodman and Phil Eastwood were present to discuss the Washington County
Historical Society's decision to sell the property the Society owns around Boutwell
Cemetery, the offer to sell the property to the City, and the asking price.
Mr. Laabs, seconded by Mr. Zoller, moved to adjourn at 9:55 p.m.; motion passed.
