RESOLUTION APPROVING A DEMOLITION OF A PRE-1946 STRUCTURE
FOR 403 OWENS STREET SOUTH (CASE NO. CD 2024-050)
WHEREAS, the City of Stillwater received a demolition approval request from Kelly
Miller, ("Applicant"), for property located 403 Owens Street South, legally described as in
Exhibit A (the "Property"), regarding the demolition of an accessory strucutre built prior to
1946; and
WHEREAS, the demolition is to facilitate the removal of an accessory structure;
RITS
WHEREAS, the primary reason constituting the demolition is due to existing
deteriorated conditions of foundation, framing, and roofing making preservation of original
historic structure through repair infeasible; and
WHEREAS, the on November 13, 2024, the Heritage Preservation Commission
for the City of Stillwater considered the request.
NOW, THEREFORE, BE IT RESOLVED, that the Heritage Preservation
Commission of the City of Stillwater hereby approves the demolition. The approval of the
demolition is based on the following findings:
FINDINGS
1. Demolition of the resource has been evaluated against and, on balance, has been
found supportive of the goals and policies of the comprehensive plan, especially
those dealing with the health, safety and welfare of the community, and relevant
area plans, taking into account factors such as: the merits of proposed new
development on the site, the merits of preserving the resource, and the area's
desired character; and
2. Denial of a demolition permit would effectively deprive the owner of all reasonable
use of the site.
a. For investment or income -producing properties, the owner's inability to
obtain a reasonable rate of return in the present condition or if rehabilitated
under design permit criteria.
b. For non -income producing properties consistent of an owner -occupied
single- or two-family dwelling and/or institutional use not solely operating for
profit, the owner's inability to convert the property to a compatible and
conforming use in its present condition or, if rehabilitated.
c. Noneconomic reason: There is situation substantially inadequate to meet
the applicant's needs because of specific health and/or safety issues.
CONDITIONS OF APPROVAL
Prior to issuance of building permit for any new accessory structure, the
proposed structure shall receive review and approval by the Heritage
Preservation Commission.
