HomeMy WebLinkAbout0582 Ord (Amend Fences)482 • ORDINANCE NO. 582 AN ORDINANCE AMENDING STILLWATER CITY CODE CHAPTER 31, SECTION 31.02, REGULATION OF THE CONSTRUCTION, PLACEMENT, HEIGHT, NATURE AND EXTENT OF FENCES. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Section 1. Section 31.02, Chapter 31, adopted February 12, 1980, of the Stillwater City Code is hereby repealed. Section 2. A new Section 31.02 of the Stillwater City Code is hereby enacted as follows: Subdivision 1. Purpose. The purpose of this ordinance is to provide for the regulation of fences in the City of Stillwater, to prevent fences being erected that would be a hazard to the public, or an unreasonable inter- ference with the use and enjoyment of neighboring property, and are compatible with existing uses and other zoning restrictions. Subd. 2. Definitions. For the purpose of this ordinance the following definitions shall apply: (1) Fences shall be any lineal structure used to prevent access by persons eranimals or prevent visual or sound transference. Subd. 3. Fences may be permitted in all yards, subject to the following: (1) Fences in excess of six (6) feet above ground grade shall be prohibited unless the abutting neighbor consents to a higher fence and permission is granted by the City Council. (2) The side of the fence considered to be the face (finished side as opposed to structural supports), shall face abutting property. (3) No fence shall be permitted on public right of ways. (4) No fence shall he erected on corner lots that will obstruct or impede the clearview of an intersection by approaching traffic. (5) In residential districts, fences located in the front yard beyond the building line and in the side yard on the street side beyond the building line shall not exceed 42 inches in height. Subd. 4. Fences may be permitted along property lines subject to the following: (1) Fences that require continuing maintenance such as wooden privacy fences shall not be erected within one foot of a property line. (2) Fences in commercial or industrial districts may be erected on the lot line to the height of six feet; to a height of eight feet with a security arm for barbed wire. Subd. 5. No existing fence in violation of the ordinance will be allowed to be replaced or rebuilt. Should an existing fence be replaced or rebuilt, it must come under the regulations of this ordinance. Subd. 6. Violations of this ordinance may be enforced by Injunction and the City shall be entitled to the remedy of abatement in order that a fence erected in violation of this ordinance may be removed. Section 3. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication according to law.
