HomeMy WebLinkAbout0575 Ord (Amend Taxicabs)!76 ORDINANCE NO. 575 AN ORDINANCE AMENDING ORDINANCE NUMBERS 303, 325 AND 360 PROVIDING FOR THE LICENSING AND THE OPERATION OF TAXICABS. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Section 1. Repealing. Ordinance Numbers 325 and 360 are hereby repealed. Section 2. Amending. Ordinance Number 303 is hereby amended as follows: A. Section IV of Ordinance No. 303 is hereby amended to read as follows: "Section IV. The annual license fee to be charged for each taxi cab licensed under the provisions of this ordinance shall be the sum of Fifteen ($15.00) Dollars. All licenses shall expire on December 31st of each year. For licenses issued for less than a year the license fee shall be a prorata part of said annual license fee." B. Section 6 of Ordinance Number 303 is hereby repealed and the following Section 6 is enacted: "Section 6. Insurance. Before the issuance of a license to operate a taxicab, the— ice shall file: A certificate signed by a duly authorized officers of a company authorized to write insurance in the State of Minnesota to the effect that a policy of insurance has been issued and is in full force and effect, issued to the licensee, and that the premium has been paid as required thereon, together with a true copy of the policy contract or certificate of insurance, or in lieu thereof the original policy which shall be in the sum of Twenty-five Thousand ($25,000.00) Dollars for any one person injured or killed and subject to the limit per person; to the amount of at least Fifty Thousand ($50,000.00) Dollars in case of any one accident causing injuries or death to more than one person; and a further amount of Ten Thousand ($10,000.00) Dollars in case of any one accident causing injury or damage to the property of any person or persons." C. Section 11 of Ordinance Number 303 is repealed and the following Section 11 is enacted: "Section 11. Continuous Service. Every person operating taxicabs under the provisions of this ordinance shall give twenty-four (24) hour service to the public, except that between the hours of 1:30 A. M. and 5:30 A. M. only emergency type of service need be provided, and for such emergency type of taxi service the taxicab owner or operator shall not be required to keep open its office." D. Section 12 of Ordinance Number 303 is repealed and the following Section 12 is enacted: "Section 12. Parking . Any licensed taxicab operator herunder, upon his request to the Council, shall be entitled to exclusive parking space for one of his licensed taxicabs. The location thereof shall be determined by the Council." E. Section 13 of Ordinance Number 303 is repealed and the following Section 13 is enacted: "Section 13. Taxis from Other Cities. Any taxicab licensed to operate in another city may carry passengers from said city to any place within the City of Stillwater, and may freely enter and travel upon the streets thoroughfares for that purpose, and may receive passengers for carriage to said city where so licensed, and in such case it shall not be deemed necessary for the driver of such vehicles to pay the license fee herein provided for, but such driver shall not be permitted to solicit or pick up business on the streets of the city except in a case where a return trip has been previously arranged, or to otherwise operate with- in the city without being licensed under the provisions of this ordinance. While within the corporate limits of the city, the driver of such vehicle from another city shall be required to observe all of the regulations and conditions of this ordinance and shall have with him the license certi- ficate of said vehicle and display the same to any person upon demand." F. Section 14 of Ordinance Number 303 is hereby enacted: (continued on page 477) • • 47i e • ORDINANCE NO. 575 (continued) "Section 14. Revocation. Taxicab licenses may be revoked by the City Council att an me for 'cause' after hearing. 'Cause' shall include intentional violations of provisions of this ordinance, con- viction of a crime or moral turpitude, conviction of the licensee or any driver employed by the licensee of three or more moving violations within a licensing year, or failure to maintain equipment in proper working order, after warning, where such failure threatens the life, health or safety of passengers." G. Section 15 of Ordinance Number 303 is hereby enacted: "Section 15. Penalty. A person who knowlingly violates any of the provisions of the ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be sentenced to payment of a fine not to exceed $500,000 or imprisonment not to exceed 90 days, or both." H. Except as expressly repealed or amended by this ordinance, Ordinance Number 303 shall remain in force and effect. Section 3. Effective Date. This ordinance shall be in full force and effect r� om and after its passage and publication according to law, and all current license holders and all others affected by this ordinance shall be in full compliance with this ordinance within thrity (30) days after its enactment and publication. THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN: Section 1. Repealing. Sections 3, 4 and 5 of Ordinance Number 505 are hereby repealed. Section 2. Amending. A new Section 3 of Ordinance Number 505 is hereby enacted as follows: "Section 3. Regulations: The City Council of the City of Stillwater shall from time to time as they see fit to protect the public health and welfare enact by resolution such regulations as they deem proper regarding use of the rubbish disposal station including the type of rubbish that may be deposited therein, residency requirements of users and such reasonable fees for the use of the rubbish disposal station as are needed to defray the cost of its operation." Section 3. In all other ways Ordinance Number 505 shall remain in force and effect. Section 4. This Ordinance shall be in force and effect from and after is passage and publication.
